CITY COUNCIL CHAMBERS
CITY HALL, CITY OF STEPHENVILLE, TEXAS
The City Council met in Special Session Thursday, November 13, 1975 at 2:00 p.m.
with Mayor Donald R. Jones presiding and Councilmen Jim Chambers, W. M. Irwin, Cal
McGee, Charles Riggins, Raymond Anderson, Jesse Sexton, Larry Hammett and Neal Guthrie
were present.
Others attending the meeting were City Administrator Marshall Shelton, Assistant
City Attorney Randolph Chandler, Director of Public Works R. Y. Gann, City Secretary
Joyce Pemberton, Chief of Police Mike Watkins, Administrative Aide Kurt Ackermann,
and Tax Assessor - Collector Robert Groves. Also attending were Don Metsgar, Garland
Sargent, Scott Allen, Billy Oxford, Jr., Gary Lewallen, Gerald Cook, Kay Walton,
Lavania Lohrmann and J. W. Beck.
Mayor Jones called the meeting to order as an open meeting then called an
Executive Session at 2:00 p.m. under Section 2B of the Open Meetings Law.
Mayor Jones closed the Executive Session and the Council went into open session
at 3:00 p.m.
Mayor Jones asked for a motion to take care of the contract provisions for the
construction of the fire sub station to be constructed by Thomas Construction Co. of
Dallas, Texas.
Councilman Chambers moved, seconded by Councilman Guthrie, that Mayor Jones be
authorized to sign the fire station construction contract and the date of the con-
struction be within ten (10) days from the date of signing of contract; that the bills
be presented and paid on or about the 10th day of each month at 90% of the value, based
on the contract prices of labor and material, as determined by the archetect, be sub-
mitted. The acceptance and final payment of the construction shall be due at least
30 days after completion of the work. Motion carried unanimously.

Mr. Clyde Hamilton of Southwestern Appraisal Co. of Austin, Texas, appeared
before the Council and gave a lengthy discussion on a proposed tax reappraisal
for the city. He quoted a cost of approximately $12.00 to $15.00 per parcel, with
an estimated 49950 to 5,450 parcels to be appraised.
After some discussion, it was the consensus of the Mayor and Council to do
more study on this before making a decision.
Mr. Craig Shaffer, Dallas, Texas, appeared before the Council in regard to a
fee for consultation services in preparing the hospitalization and retirement plans
for the city employees.
Mr. Shaffer stated, in part, that in July, 19759 he had been asked by the auditing
firm of Cheatham & Lansford to contact the City Administrator concerning the hospital-
ization, the pension plan and the property casualty insurance and to do an overall
assessment of the insurance program of the city.
After four, almost five, months of work and preparation, he is asking the city to
accept the hospitalization plan he submitted for the Hartford Co. which would amount
to $3,500.00 to $4,000.00 in commissions for him or pay him $2,500.00 for consultation
fees.
City Administrator Shelton stated that he had not hired Mr. Shaffer as a con-
sultant; that he had not signed a :contract for a :consultant nor did he have a letter
as the agent of record for the hospitalization insurance. Also that "all .things
being the same, he thought, it would be better to have a local representative for
the hospitalization insurance ". .
In the previous meeting of November 4th, the City had accepted the hospital-
ization plan of the Hartford Co. submitted by Garland Sargent and the retirement
plan submitted by Texas Municipal Retirement System.
After considerable discussion, Councilman Irwin moved, seconded by Councilman
Riggins, to deny Mr. Shaffer's request for a consultant's fee. Motion carried
by the following vote: Councilmen Chambers, Irwin, McGee, Riggins, Anderson, Sexton
and Hammett voted for and Councilman Guthrie voted against.
Mayor Jones brought the Council uptodate on the paving of Frey Street.
Scott Allen and Gary Lewallen appeared before the Council speaking against the
paving of Frey Street because of the historical value of the brick which is now in use.
After considerable discussion, Councilman Irwin moved, seconded by Councilman
Sexton, that the paving of streets is an administrative matter and should be turned
over to the City Administrator Marshall Shelton to make the decision as to the
feasibility of paving Frey Street or any other streets needing paving. Motion carried
unanimously.
There being no other business, the meeting adjourned at 4 :15 p.�,
