Councilmembers Jim Chambers, Calvin l Ermer Ferguson, Larry Hammett and Betty Heath Anderson was absent. REGULAR SESSION - TUESDAY MARCH 1, 1977 - 7:OO P.M. lle, Texas, met in Regular Session, or Donald R. Jones present and pre - cGee, W. M. Irwin, Charles_ Riggins, were present. Councilman Raymond Others attending the meeting were City Administrator Marshall Shelton, Dir- ector of Public Works R.Y. Gann,.City Attorney Joseph Chandler, Assistant City Attorney Randolph Chandler, Chief of Police Mike Watkins, Director of Utilities Danny Johnson, Director of Parks & Recreation Ronnie Isham, Administrative Assistant Kurt Ackermann, Accountant Betty Chew, Mr. J.W.Beck, Mr. Floyd Gordon, Mr. Lyle Lacy, Mr. & Mrs. Edward Diaz, Mrs Virginia Dorris, and City Secretary Joyce Pemberton, Mayor Jones called the meeting to order and the Reverend Ken Hall of the River- . side Baptist Church gave the invocation. Mayor Jones stated that the minutes of the February 1st meeting reflect that Mr. Frank Cunningham was awarded the bid to remodel the garage at the police station for the amount of $2,228.00 and he have the overhead garage door. Mayor Jones asked that these minutes (March 1st) reflect that the City paid Mr. Cunningham $2,428.00 and he reimbursed the City $200.00 for the garage door. Councilman McGee made the motion th2t the minutes of the February 1, 1977, meeting be approved as written with the above correction noted. Councilman Irwin made the second. Motion carried unanims:ouly. Mr. J.W.Beck, local manager of Lone Star Gas Company, came before the Council to discuss the proposed franchise for LonelStar Gas. The Council and Mr. Beck discussed the differences between the franchise pre - sented by Mr. Beck and the one written for the City by Mr. Don Bird, Austin, Texas. Some of the differences discussed included the term of the franchise the gross receipts tax and the commencement date. The Mayor advised the Council to study both drafts and he would call a meeting later for action by the Council. _ The developer of the River North Subdivision was not present and had not submitted the final plat for action by the Council, therefore, this agenda was passed at this time. i ME director of Parks & Recreation Ronnie Isham came before the Council with the nendation that for the ten (10) camper sites at the City Park a charge of per night, with a maximum of seven (7) nights, per camper be imposed. This to include a concrete slab and hookups for water and electricity. fter some discussion, Councilman Chambers made the motion that the Council appro e the recommendations of Mr. Isham for a $3.00 per night, per camper, charge be m de, with a maximum of seven (7) nights, for the ten (10) camper sites located in t.e City Park. Councilman Riggins made the second. Motion carried unanimously. erector of Public Works R. Y. Gann presented a report on the water situation, the condition of the streets and the landfill. In his report Mr. Gann informed the Council that the new ground storage tank, distribution lines and transmission lines now being installed would increase Stephenville's water production to five milli n gallons of water per day. r. Gann also reported some problems with the bulldozer at the landfill and advised the Council that a new one would be needed in the near future and would probably cost $75,000.00. qr. Gann, in closing, recommended extending the water lines north on Belknap St. and across the Lingleville Highway and sewer availability for residents along Highway 377 ia the far northeast part of the city. ayor Jones read the ordinance in which the City sold apart of North Carey Street to Melba Guest and Ruth Lawson for the sum of $975.00. fter reading of said ordinance, Councilman Chambers made the motion that the ordinance be passed and approved as read. Councilman Irwin made the second. Motion carried unanimously. ORDINANCE QRDINANCE DECLARING A PORTION OF NORTH CAREY STREET RUNNING SOUTHERLY BETWEEN BLOCK3 6 AND 7 OF THE CROW- STYLES ADDITON IN THE CITY OF STEPHENVILLE A DISTANCE OF 104 F ET, TO HAVE BEEN ABANDONED AS A STREET, ORDERING SAME VACATED AND CLOSED, FINDING THE VALUE OF SAID LAND AND AUTHORIZING THE CONVEYANCE OF SAME TO MELBA L. GUEST AND RUTH LAWSON UPON THE PAYMENT OF THE AMOUNT FOUND TO BE THE VALUE OF THIS LAND. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Councilwoman Heath requested that in the future the Juvenile Officer's monthly report denote the ethnic origin of the offenders, such as, White - American, Mexican - Ameriian, White - American, etc rather than color. , ouncilwoman Heath also requested a report from Assistant City Attorney Randolph Chand�er regarding who is liable for the safety and wellbeing of a city prisoner being held _n the Erath County jail. Also what the obligations are concerning the Open Records Act regarding all departments of the city, specifically the daily log kept by the olice department. Mayor Jones advised the Council he had received a letter from County Judge L. L. (Blac ie) Martin requesting the city to give some thought to paying a part of the jailers' salaries. fter some discussion, Mayor Jones appointed Councilwoman Heath, chairperson, Counc Imen Chambers, Riggins and himself as a committee to meet with Judge Martin and s�udy this request more thoroughly and make their recommendations to the Council at a later date. Jones announced the Council would go into Executive Session for the purpose of di layor cussing personnel and he would reopen the meeting at the close of the Executive Sessi n. Pie Council reconvened in Open Session at 9:30 p.m. Mayor Jones announced that no ac on would be taken at this time regarding the Executive Session discussion. ouncilman Riggins made the motion that the meeting adjourn at 9:35 p.m. Council- man Clambers made the second. Motion carried unanimously. Q or ecretary I II ORDINANCE DECLARING A PORTION OF NORTH CAREY AVENUE RUNNING SOUTHERLY BETWEEN BLOCKS 6 AND 7 OF THE CROW - STYLES ADDITION IN THE CITY OF STEPHENVILLE A DISTANCE OF 104 feet, TO HAVE BEEN ABANDONED AS A STREET, ORDERING SAME VACATED AND CLOSED, FINDING THE VALUE OF SAID LAND AND AUTHORIZING THE CONVEYANCE OF SAME TO MELBA L. GUEST AND RUTH LAWSON UPON THE PAYMENT OF THE AMOUNT FOUND TO BE THE VALUE OF THIS LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One That portion of North Carey Avenue described as follows: A part of North Carey Avenue,.Stephenville, Texas, being situated between Blocks 6 and 7, Crow - Styles Addition to Stephenville, Texas, as shown by King's 1956 Revised Map of said city, attached to adoption recorded in Volume 381, Page 105, Deed Records of Erath County, Texas, and such portion of street described as follows: BEGINNING at an iron rod set at the NWC of Block 6, Crow - Styles Addition to Stephenville, Texas, for the NEC of this tract; THENCE S 30 E with west line of Block 6 and east line of North Carey Avenue, 104.0 feet to an iron rod set for the SEC of this tract; THENCE S 60 W crossing North Carey Avenue, 50.0 feet to an iron rod set in east line of Block 7, Crow - Styles Addition at the SEC of Lot l in Block 7, for the SWC of this tract; THENCE N 30 W 104.0 feet to an iron rod set at the NEC of Block 7.for the NWC of this tract; THENCE N 60 E with south line of West Park Street, 50.0 feet to the place of beginning; is hereby declared to have been abandoned for street purposes and said portion of North Carey Avenue above described is hereby ordered vacated and closed as a street. Section Two That portion of North Carey Avenue hereinabove described is hereby found by the City Council of Stephenville, Texas, to be of a value of $975.00. Opportunity being given for open competition and bidding for the purchase of such property having been given to the adjoining pro- perty owners on the east and west of said above described land, and Melba L. Guest and Ruth Lawson having offered the sum of $975.00 for said land, it is hereby ordered and directed that Don Jones, Mayor of the City of Stephenville, execute a special warranty deed to Melba L. Guest and Ruth Lawson conveying to them the above described land and such deed shall be delivered to said purchasers upon the payment by them to the City of Stephenville of the sum of $975.00.
