CITY HALL, CITY OF STEPHENVILLE, TEXAS
The City Council of the City of Stephenville, Texas met in Special Session Wednesday, May 24,
1978 at 3:00 p.m, with Mayor Donald R. Jones present and presiding. Councilmembers Raymond Anderson,
Mike Leese, W.M. Irwin, Calvin McGee, Charles Riggins, E.W. Ferguson and Linda Chew were present.
Councilman Larry Hammett was absent.
Others attending the meeting were City Administrator Marshall Shelton, Director of Public
Works R.Y. Gann, Administrative Assistant Kurt Ackerman, Tax Assessor - Collector Robert Groves,
Acting City Secretary Trecia Perales and others (Press).
Mayor Donald Jones called the meeting to order.
ITEM I: DISCUSSION OF LANDMARK DESIGNATION46
Mayor Jones delayed this item for another meeting as Mrs. Herrington could not attend because
of such short notice.
ITEM II: CONSIDER SALE OF PORTION OF CAREY ST.410
Mayor Jones advised the Council that Harold Fox wished to purchase a 50t X 104, strip of
Carey Street. Mr. Fox presently owns the southwest corner of property adjacent to this street.
The north half of this property sold last year for $975.00.
After some discussion, Councilman Irwin moved to sell a 50' X 1041 portion of Carey St. to
Mr. Harold Fox for the sum of $975.00. Councilman Ferguson made the second. Motion carried
unanimously.
ITEM III: OLD BUSINESS
Telephone Company put a new pole in the center of the sidewalk at Mayor Jones' office. Jack
Hancock says this will be corrected. Should not have been put there in the first place.
R.Y. Gann is to work up a new cost figure and projection plan for a water improvement fund
on new lines that need to be made. This is to be for next regular council meeting.
In the previous council meeting, it had been suggested to offer Mrs. Shirley Whitely $1,500.00
for the purchase of right -of -way on Long St, near the railroad. Mrs. Whitely did accept the offhr.
The City will furnish a title policy for this property to Mrs. Whitely.
Councilman Irwin moved to appropriate funds for the purchase of said right -of -way and provide
a title policy to Mrs. Whitely. Councilman Riggins made the second, Motion carried:unanimously.
R.Y. Gann is to also bring a full Street Department report to next regular council meeting.
Councilman Irwin suggested that a street program be set up for the summer because so many of the
city's streets are in bad condition due to the winter weather, etc.
Mayor Jones adjourned the meeting at 3:25 p.m.

ORDINANCE DECLARING A PORTION OF NORTH CAREY AVENUE RUNNING NORTHERLY
FROM ITS INTERSECTION WITH WEST OAK STREET A DISTANCE OF 104 FEET ON ITS
EAST AND WEST SIDES IN THE CITY OF STEPHENVILLE IN ERATH COUNTY, TEXAS,
TO HAVE BEEN ABANDONED AS A STREET, ORDERING SAME VACATED AND CLOSED,
FINDING THE VALUE OF SAID LAND, AND AUTHORIZING THE CONVEYANCE OF SAME
TO HAROLD FOX UPON THE PAYMENT OF THE AMOUNT FOUND TO BE THE VALUE OF
THIS LAND.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Section One
That portion of North Carey Avenue described as follows:
All that certain portion of North Carey Avenue, Stephenville,
Texas, being situated between Blocks 6 and'7, Crow-Styles
Addition to Stephenville, Texas, as shown by King's 1956
Revised Map of said city, attached to adoption recorded in
Volume 381, Page 105, Deed Records of Erath County, Texas,
and such portion of street described as follows:
BEGINNING at an iron rod set at the SWC of Block 6, Crow -
Styles Addition to Stephenville, Texas, for the SEC of this
tract;
THENCE N 300 E, with west line of Block 6 and east line of
North Carey Avenue, 104.0 feet to an iron rod set for the NEC
of this tract;
THENCE S 600 W, crossing North Carey Avenue, 50.0 feet to an
iron rod set in east line of Block 7, Crow- Styles Addition,
at the SEC of Lot 1 in Block 7, for the NWC of this tract;
THENCE S 300 W, 104.0 feet to an iron rod set at the SEC of
Block 7 for the SWC of this tract;
THENCE N 600 E, with north line of West Oak Street, 50.0 feet
to the place of beginning;
is hereby declared to have been abandoned for street purposes and said
portion of North Carey Avenue above described is hereby ordered vacated
and closed as a street.
Section Two
That portion of North Carey Avenue hereinabove described is hereby
found by the City Council of Stephenville, Texas, to be of a value of
$975.00. Said amount having been offered by Harold Fox for that portion
of North Carey Avenue above described, it is hereby ordered and directed
that Donald R. Jones, Mayor of the City of Stephenville, Execute a
special warranty deed to the said Harold Fox conveying to him the above
described land and such deed shall be delivered to the said Harold Fox
upon the payment by him to the City of Stephenville of said sum of
$975.09, the said Harold Fox being an abutting land owner.
