The City Council of.the City of Stephenville, Texas, met in Special
Session Tuesday, March 24, 1981 at 3:00 p.m. with Mayor Joe F. Cummings
present and presiding.

Mayor Cummings called the meeting to order and declared a quorum
present.
ITEM I; DISCUSS RESIDENTIAL GARBAGE SERVICE
Mr. Jim McSwain came before the Council and presented a petition
to the Mayor with 127 signatures of persons residing in the area from
Tarleton to the North Loop - From Cleveland and Woodland Cleveland
and Wildwood - Lydia to Charlotte. He said the petition states that
We the undersigned citizens of Stephenville, Texas, wish to request
that the action taken by the City Council March 3, 1981,iregarding
change in policies requiring that the garbage be picked up at curb-
side instead of designated alleys be rescinded until there is adequate
time to hold public hearings on this matter."
Mayor Cummings explained that, as he was sure the Council was
aware, the people were concerned about not being able to put their
garbage in the alleys for pick-up.
Councilman Brede, chairman of the Garbage Franchise Committee,
said that, in view of the concern expressed by the citizens, and,
after a very lengthy meeting of the committee with city staff and
Mr. Bledsoe, the committee is proposing the following recommendation
regading residential garbage pick-up:
"Garbage personnel will no longer be required to pick-up
garbage at the house. All garbage must be placed in the
alley or at the curb for pick-up.
The city will permit garbage pick-up in utility easements,
however, the city cannot bear the responsibility for main-
tenance."
Councilman Riggins explained that, if the property owner has a
dedicated alley, Mr. Bledsoe's men will continue to pick-up the garbage
in the alley as they are presently doing. If the property owner has
a utility easement, they have a choice either to maintain the easement
or to put their garbage at the curb for pick-up. Those that do not
have an alley or an easement, Will put their garbage at the curb. The
garbage personnel will not come up to the house anymore.

Mr. Bledsoe explained that exceptions will be made for the
physically handicapped that cannot put their garbage out.
Mr. Bledsoe also stated that the garbage trucks will have a better
schedule than in the past. They will start their residential runs no
earlier than 6:00 A.M.
Mayor Cummings expressed his concern with setting the garbage
cans on the curb and dogs turning them over or the wind blowing
them over and scattering the garbage all over the streets.
Councilman Leese commented that should this recommendation be
approved, it needs to be clarified. As it reads now, it could be
interpreted to mean thegarbagecould be put either in the alley or
easement or at curbside as the person so chooses.
After a lengthy discussion, Councilman Irwin moved, seconded by
Councilman Brede, that the City Council rescind their action of March
3rd pertaining to the change in garbage pick-up policies and to adopt
an ordinance that all garbage be picked up in an alley, if an alley is
available, or an easement. If not,at curbside.. The easement will be
maintained at the property owner's expense. Effective April 15, 1981.
The motion carried by the following vote:
AYES: Councilmen Leese, Irwin, Brede and Riggins.
NOES: Councilmen Ferguson, Hammett and Clayton
ABSENT: Councilman Anderson
ABSTAINED: None
Councilman Brede commented that the purpose of this change in policy
was to hold down expenses and he hoped the public would understand and
appreciate what the Council is trying to do. Also, that the public will
be tolerant during this trial period and do all they can to cooperate
with Mr. Bledsoe and his personnel.
The Mayor asked Mr. Chandler to prepare an ordinance to that
effect for adoption at the April 7th meeting.
There being no other business to come before the Council, the
meeting adjourned at 4:30 p.m,
