MINUTES OF THE CITY COUNCIL
OF THE
CITY OF STEPHENVILLE, TEXAS, HELD ON
TUESDAY, JUNE 1, 1982 - 7:00 P.M.
The regular meeting of the City Council of the City of Stephenville,
Texas, was called to order by the Mayor with the following members present:
Mayor Joe F. Cummings
Councilman G. A. Swindle
Councilman John Pollan
Councilman William G. Brede
Councilman Charles Riggins
Councilman Raymond Anderson
Councilman E. W. Ferguson
and with the following members absent: Ray Reynolds and David Clayton.
City Administrator Kurt Ackermann, City Secretary Joyce Pemberton,
and City Attorney Joseph Chandler were also present.
ITEM I: APPROVE MINUTES.
Councilman Swindle moved that the minutes of the regular meeting of
the City Council of the City of Stephenville, Texas, held on the 4th day
of May, 1982, be approved as written. The motion carried by the following
vote:
AYES: All members present
NOES: None
ITEM II: PUBLIC HEARING AMENDING THE ZONING ORDINANCE TO INCLUDE
A B -4 ZONING DISTRICT.
Mayor Cummings opened the floor for a public hearing to consider an
ordinance amending the present Zoning Ordinance to include a B -4 zoning
district.
No one addressed the Council either for or against said ordinance.
Mayor Cummings closed the public hearing.
Councilman Swindle moved passage of the following ordinance:
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
STEPHENVILLE BY ADDING A NEW CLASSIFICATION TO BE KNOWN AS
B -4 AND BEING SECTION 10A OF THE ZONING ORDINANCE OF THE
CITY F STEPHENVILLE, WHICH CLASSIFICATION SHALL PERTAIN
TO ANY AND ALL PRIVATE CLUBS, DANCE AREAS AND ANY OTHER
BUILDING WHEREIN ON- THE - PREMISES CONSUMPTION OF ALCOHOLIC
BEVERAGES OCCURS.
Councilman Riggins made the second

After some discussion, Councilman Anderson moved approval of a
RESOLUTION CONTRACTING WITH ERATH COUNTY CENTRAL APPRAISAL DISTRICT
FOR ASSESSING SERVICES FOR THE YEAR BEGINNING OCTOBER 1, 1982.
Councilman Brede made the second. The motion carried by the following
vote:

AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
STEPHENVILLE BY ADDING A NEW CLASSIFICATION TO BE KNOWN
AS B -4 AND BEING SECTION 10A OF THE ZONING ORDINANCE OF THE
CITY OF STEPHENVILLE, WHICH CLASSIFICATION SHALL PERTAIN TO
ANY AND ALL PRIVATE CLUBS, DANCE AREAS AND ANY OTHER BUILDING
WHEREIN ON- THE - PREMISES CONSUMPTION OF ALCOHOLIC BEVERAGES
OCCURS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE
The Zoning Ordinance of the City of Stephenville is hereby amended
to add to such ordinance a new classification to be known as B -4, pri-
vate clubs, dance areas and any other building wherein on- the - premises
consumption of alcoholic beverages occurs. The following regulations
shall apply to this classification:
A. USE REGULATIONS:
A building or premises shall be used only for the following purposes:
1. Any use permitted in "B -3 " District.
2. A new classification be and the same is hereby established and
shall be added to the Zoning Ordinances of the City of Stephen-
ville as B -4, which classification shall pertain solely to any
and all private clubs and any other buildings wherein on -the-
premises consumption of alcoholic beverages occurs.
B. HEIGHT REGULATIONS:
No building hereafter erected or structurally altered shall exceed
seventy -five (75) feet in height.
C. YARD REGULATIONS:
1. Front Yard:
For uses permitted in the "R-2" District, the front yard re-
quirements for the "R-2" District shall apply: For other uses,
no front yard is required.
2. Side Yards:
For uses permitted in the "R -2 " District the side yard re-
quirements for the "R -2 " District shall apply. For other uses,
there are no side yard requirements.
3. Rear Yard:
For uses permitted in the "R -2 " District, the rear yard re-
quirements for the "R -2 " District shall apply. For other uses,
there are no rear yard requirements.
D. INTENSITY OF USE:
For uses permitted in the "R -2 " District, the minimum lot width shall
be the same as in the "R --2 " District, There are no minimum lot area or lot
width requirements for other uses.
E., PA.RKI:NG REGULATIONS,
Each such business shall provide a parking space for each fifty (50)
square feet in the building used for such business which shall be on the
property occupied by the building or within three hundred (300) feet of
the principal use properties, open or closed with ingress and egress
totaling one hundred sixty (160) square feet for each.-motor vehicle.
F. ADDITIONAL USE, HEIGHT, AND AREA REGULATIONS:
Additional Use, Height and Area Regulations and exceptions are
found in Section 11 herein.
G. OTHER CONDITIONS:
1. If for any reason a building located outside a B -4 District
which is occupied for the purpose of conducting the business
of a private club or any other building wherein on- the - premises
consumption of alcoholic beverages occurs is closed and thereby
n t conducting its regular business for a period of forty -eight

8) continuous hours, excepting legal holidays, that building
s all remain closed as long as it shall remain outside a B -4
z�ning.
I Any person desiring a permit for conducting the business of a private
club, hall make application therefor which shall describe the area
to be o used and such application shall be referred to the Planning
and Zoning Commission which shall find whether such area shall be de-
signat6d as a B -4 area and then make its recommendation thereon to
the City Council which shall proceed to take action thereon to esta-
blish or refuse to establish such area as a B -4 District.
I. The penalty for failure to comply with the zoning classification herein
created shall be the same penalty as heretofore set out for other
zoning classifications as passed by the City Council of the City of
Stephenville. Each day's violation of this ordinance shall constitute
a separate offense.
J. Any ordinance heretofore passed by this body which is set out in the
Code of Ordinances of the City of Stephenville in conflict with this
section is herein superseded by the contents hereof; and all other
parts of an ordinance not affected shall remain in full force and
effect.
This ordinance was introduced at the meeting of the City Council of
the City of Stephenville held on April 13, 1982 and there being a
quorum present at this meeting, motion was made and duly seconded
that this ordinance be referred to the Planning and Zoning Commission
for its action thereon in accordance with Section 20 of the Zoning
Ordinance of the City of Stephenville. Further action on this ord-
inance shall be deferred until recommendation and report is made to
this Council by the City Planning and Zoning Commission.
Thereafter the Planning and Zoning Commission approved the ordinance
changing the square feet within the building for parking and the space
for parking outside,
After due notice of Public Hearing for this date, came on to be con-
sidered the passing of the above ordinance.
After announcement by the Mayor that the matter was before the Council
for action, and there being no objection, Councilman Swindle moved
and Councilman Riggins seconded that the above ordinance be passed.
Such motion being put to a vote, same carried unanimously.

RESOLUTION
WHEREAS, the Erath County Central Appraisal District
is performing property tax assessment services for the City
of Stephenville for the current tax year, and
WHEREAS, it has been demonstrated that a benefit is
provided to the citizens through lower city tax administration
costs, and
WHEREAS, the Board of Tax Assessor Examiners for the State
of Texas is requiring a written record between the City of
Stephenville and Erath County Central Appraisal District to
continue these services -,
BE IT THEREFORE RESOLVED, that the Mayor and City Council
of the City of Stephenville, Texas, does, by this Resolution,
desire to continue an agreement with the Erath County Central
Appraisal District and that said agency provide to the City
property tax assessment services for the coming tax year begin-
ning October 1, 1982.
PASSED AND ADOPTED this the lst day of June, 1982.

ITEM IV: EXECUTIVE SESSION TO CONSIDER MATTERS OF PERSONNEL
Mayor Cummings recessed the open meeting and advised that, as provided
in V.T.C.S., Article 6252 -17, Section 2(g), the Council would convene in
executive session to discuss matters of personnel.
The Council reconvened in open session.
Councilman Ferguson moved that Douglas Conner be appointed permanent
Chief of Police. Councilman Riggins made the second. The motion carried
by the following vote:
AYES: All members present
NOES: None
Councilman Swindle moved that Douglas Conner's salary be set at pay
scale 25D. Councilman Pollan made the second. The motion carried by the
following vote:
AYES: All members present
NOES: None
There being no other business to come before the Council, the meeting
adjourned at 7:20 p.m.
