MINUTES OF THE CITY COUNCIL SPECIAL MEETING
OF THE
CITY OF STEPHENVILLE, TEXAS, HELD ON
TUESDAY, APRIL 3, 1984 - 1:30 P.M.
The special meeting of the City Council of the City of
Stephenville, Texas was called to order by the Mayor with the
following members present:
Mayor Joe F. Cummings G. A. Swindle
Councilmen: Charles Riggins James L. McSwain
John Pollan Ray Reynolds
William G. Brede David Clayton
and with the following members absent: Councilman Floyd Gordon.
City Administrator Kurt Ackermann, City Secretary Joyce
Pemberton, City Attorney Joseph Chandler, Director of Public
Works Danny Johnson, Administrative Clerk -P /I Dept.Betty Chew,
James Young, Pat Wilson, Kenneth Currier, Mike Craft, Seth Moore,
and members of the press were also present.
ITEM I: CONSIDER FINAL PLAT OF QUAIL RUN SUBDIVISION.
Director of Public Works Danny Johnson advised the Council
that all the requirements for the final plat of the Quail Run
Subdivision have been presented and approved. He said this
entire Subdivision will be serviced by a booster pump. Also that
Bosque Lane,at this point, has not been accepted by the City.
All that is needed is for the paving to be leveled and that is
noted in the requirements.
Mr. Johnson advised that some of the piping is not in the
City's Plumbing Code,(polybutylene water pipes), instead of
copper piping but according to the State, since it is a HUD pro-
ject and HUD has their stamp of approval on it, we as a City have
no jurisdiction over it as far as approving or disapproving it.
The exterior plumbing would have to meet the city's specifica-
tions. They also allow autovents where our code does not.
After discussion, Councilman Riggins moved that the final
plat of the Quail Run Subdivision be approved and accepted as
presented. Councilman Reynolds seconded the motion. The motion
carried by the following vote:
AYES: All members present voted aye
NOES: None

HOUSING.
Mr. Kenneth Currier addressed the Council stating that he
had hoped he would get to speak to the Council before they voted
on the final plat of the Quail Run Subdivision. Mr. Currier read
a summation of the comments from those persons he had talked with
regarding the R -1 zoning for manufacted homes.
In short, they believed that a precedent would be set if
Quail Run Subdivision was accepted with R -1 zoning. It was their
opinion that the Planning & Zoning Commission and the City
Council should give serious consideration to having an R -la
zoning classification for manufactured housing as Quail Run is
not much more than a mobile home park.
Mr. Currier said they are asking the Council to send
the Quail Run Subdivision plat back to Planning & Zoning for
further study of zoning. They feel that the City cannot control
R -1 zoning in other subdivisions if this subdivision is brought
in under R -1 zoning. Mr. Currier also asked that it be made

public how each member of the Council voted on this issue as the
City Election was coming up this Saturday.
After discussion, Councilman Riggins moved the City Council
direct the Planning & Zoning Commission to consider a specific
zoning area (R -W for manufactured housing. Councilman Reynolds
seconded the motion. The motion carried by the following vote:
AYES: All members present voted aye.
NOES: None
ITEM III: HEAR PROPOSAL FOR CITY'S PARTICIPATION IN
MULTI - FAMILY SURETY BOND PROGRAM.
Mr. Boyd London of First Southwest Company of Dallas, pre-
sented a proposal for the City's participation in the North
Central Housing Finance Corporation. NCHF Corp. is composed of
Hood, Hun, Johnson, Kaufman, Navarro, Palo Pinto, and Parker
Counties serving as a board to issue tax - exempt bonds for the
purpose. -of constructing multi - family housing for low to moderate
income families.
This method of financing appears to be similar to industrial
revenue bonds or health facilities development bonds in that the
bonds hold tax - exempt status and are sold at lower interest
rates. The bonds are no issued by the City. They do not
encumber the City in any way.
Mr. Gene Brown from Oklahoma City, Oklahoma said he would
like to construct 128 units (a 1.4 million dollar project) here
in Stephenville with this type of financing.
Mr. Jack Arthur of Stephenville addressed the Council
opposing this type financing for out of town developers. He said
he was opposed to out of town inverters coming in and taking the
money out of Stephenville.
After a lengthy discussion, Mayor Cummings appointed the
following councilmembers as a committee to discuss this program
with the lending institutions of the city to see how they feel
about this type of program and report back to the Council at the
May meeting.

There being no other business to come before the Council at
this time Mayor Cummings adjourned the open meeting and called
the Council into EXECUTIVE SESSION as provided in the Open
Meetings Law, V.T.C.S., Article 6252 -17 for the purpose of
discussing with the city's legal advisor contemplated litigation
regarding excessive water diversion (onto Don Coan's property).
Mayor Cummings closed the executive session and called the
Council back into open session.
No action was taken at this time.
There being no other business, the Mayor adjourned the
meeting.
