HomeMy WebLinkAbout1954-11-09 Ordinance Ordering ElectionAN ORDINANCE ORDERING AN ELECTION TO DETERMINE WHETHER A COM- MISSION SHALL BE CHOSEN TO FRAME A NEW CHARTER AND PROVIDING FOR CHARTER COMMISSION AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One That an election beheld on the 9th day of November , 1954, within the city of Stephenville, submitting to the qualified voters of the City of Stephenville, the question, "Shall a commis- sion be chosen to frame a new charter?" and that should the majority of the qualified voters voting on said question have voted in the affirmative, that a charter commission of 15 members be elected from the city at large. Said election shall be held at Old Fire Hall in Old City Hall in the City of Stephenville, Texas, and J. E. Burnett is hereby appointed presiding officer of said election and he shall select the necessary judges and clerks to assist him in holding the same. Section Two That said election shall be held under the provisions of the Constitution and laws of the State of Texas, governing elections for cities and towns and all persons qualified to vote in the city of Stephenville under the laws of this State regulating general elections shall be allowed to vote. The manner of holding said election shall be governed by the Laws of the State of Texas relating to general elections. Section Three That the form of ballot to be used in said election shall be substantially as follows: Answer SHALL A COMMISSION BE CHOSEN TO FRAME A NEW CHARTER: "Yes" "NO" For the following named persons to constitite the Charter Commission, not more than fifteen in number: C. W. Bryant C. 0. McMillan C. H. Maguire H. M. Everett, Sr. R. F.Higgs Roger Gideon John Tom Heaton Clinton C. Cox R. L. Meek Pete Huffman Dick Smith T. G. Funk Jack Arthur Vern Pendleton Fred McCleskey Those desiring to vote for the proposition: "Shall a commission be chosen to frame a new charter?" shall strike the word "no", and those desiring to vote against the proposition: "Shall a commission be chosen to frame a new charter?" shall strike out the word "yes". In either event, the voter will then vote for a charter commission of the fifteen members to serve in case a majority of the voters voting in this election have voted in the affirmative. The above list has been selected by the City Council as a charter commission and should the voter desire to vote against any or all of the above named persons, he may do so by scratching the name of such person and writing opposite such name the name of the person for whom he desires to vote, provided that a failure to so name a charter commission shall not invalidate the vote as to the question "Shall a commission be chosen to frame a new charter?" That should a majority of the qualified voters voting in said election vote in the affirmative as to the question "Shall a commission be chosen to frame a new charter?", then, after the charter commission has completed its work and submitted the new charter that a second election will be held, at the date designated by the charter commission, in conformity with law, to determine whether the new charter shall be adopted. Section Four A copy of this ordinance signed by the Mayor of the City of Stephenville and attested by the City Secretary of the City of Stephenville shall serve as a proper notice of the election to be held as ordered herein on the 9th day of November , 1954. The Mayor is authorized and directed to cause notice of said election be be posted as provided for regular elections held for the election of aldermen and the mayor of the City of Stephenville which notices shall be so posted in the manner and for the length of time required for regular city elections of the City of Stephenville. Section Five The fact that the City of Stephenville is operating under the general laws of the State of Texas applicable to cities with 5,000 or less and that the City of Stephenville has considerably more than 7,000 population and did so have at the taking of the last Federal Census and such general laws are considered by many citizens to be in adequate to prescribe the best form of government for the City of Stephenville, Texas and that the citizens of Stephenville, Texas entitled to vote should be given such oppor- tunity on this matter, creates an emergency and an imperative public necessity that this ordinance go into effect immediately and provisions of law or any rules to the contrary are hereby suspended and this ordinance shall take effect immediately upon its passage and approval.
