Stephenville, Texas February 11, 1954. The City Council met in a called session on Feb. 11, 1954, with Mayor Clark presiding and the following aldermen present. Herman Ferguson, Joe B. Frey, Leonard Wood, J. P. Hedrick, J. W. Clements and J. T. Mays. Fill Alderman Scott D. Reed's regisnation was discussed by the Council and the following motion was made: It was moved by Alderman Ferguson, seconded by Alderman Clements, that the City accept Alderman Reed's regisnation to become effective as of April 1, 1954. Motion carried unanimously. Mayor Clark requested that Aldermen Clements and Frey draft a letter of appreciation to Alderman Reed for his faithful ser- vice to the City. It was moved by Alderman Ferguson, seconded by Alderman Mays, that a special city election for official be called on Appril 6, 1954, in accordance with the Election Ordinance on page! $6C of Minute Book F, and the State Statute procedure for use of the secret ballot. The special election to be for one alder- man in Ward # 4 to fill an unexpired term of one year. Motion carried. The Council discussed the moving of the Fire Siren, now located on roof of old City Hall, to a more centrally located place. This matter was refereed to the Fire Committee, to be worked out and report back at a later date. Alderman Clements discussed with the Council an article which appeared in the December, 1953, issue of The Texas League of Municipalities which read in part: "City Official as Officer of City Depository;" In a recent opinion denying the right of a City Council member to serve simultaneously as a director stockholder, or officer of the bank which is the City Depository, the League's legal advisors refute three previous opinions, It is their opinion that the bank in which the City Alderman (or other members of the City Council) is a director, stockholder, and officer, may not be legally designated as the City Depos- itory.
