September 6, 1955.
The City Council met in regular session on this date with
Mayor Clark presiding and the following aldermen present:
John Hancock, J. P. Hedrick, Jim Farr, Chas. Riggins, Doyle
White, Herman Ferguson and J. W. Clements.
Others present were City Attorney Chandler, Water Supt.
Anderson, Chief Pilice Moore and St. Supt. McMahan.
Minutes of last meeting were read and approved.
Mr. 0. Byrd, Mrs. Whisenant and Mrs. Graves appeared be-
fore the Council making several requests with reference to the
opening of Erath Street from Washington Street north to Green
Street. After some discussion this matter was referred to the
Street Committee.
Mr. W. L. Howell appeared before the Council complaining
about his having to pay a parking meter fine, also how the
police department personel had mistreated him in giving the
parking meter ticket, and requesting the Council to do some-
thing about it. This matter was referred to the Law & Order
Committee to be worked out by them.
Mr. Burleson Graham, consulting engineer out of Dallas,
Texas, reported he wanted any work the City might have in his
line of business.
It was moved by Alderman Clements, seconded by Alderman
Farr, that an Ordinance dedicating for street purposes .0522
acre of land, part of the D. W. Roberts 582 acre subdivision
of John Blair Survey which is owned by the City of Stephen-
ville and making same a continuation of Garfield Avenue, be
passed (said ordffnance being attached to and becoming a part
of these minutes). Motion carried.
Alderman White requested the City Secretary to read a
letter to the Council received from Mr. Ennis Favors which
read in part of Mr. Favors complaining of the overflow of
water on his property in the 1300 block of West Frey Street,
and allowing that the City should do something about it. This
matter was discussed and referred to the Street Committee to
be worked out by them.
Alderman Clements reported that Ed Crowder was wanting
to purchase the two old ceiling fans in the old City Hall and
Fire Station building. This was discussed and referred to
Alderman Clements to be worked out by him.
Alderman Hedrick reported that the State Highway Dept,
was wanting to purchase a small part of the Golf Course which
lies west of the State Highway Maintenance Dept. This was
discussed and referred to the Park Committee to be worked out
by them and report back at a later date.
Alderman Farr suggested that the old 30 Watt Radio & Re-
ceiver,which had been replaced with a larger unit, be offered
for sale by sealed bids. This was discussed and referred the
Law & Order- Committee to be worked out by them.
Mr. Anderson reported that Dr. Bruce Terrill was willing
to pay for material and labor to extend City Water Main across
Stadium cut-off road from the City Limits west to his property
line. This was referred to the Water Committee to be worked
out.
A petition for authority to record plat of the Chamber-
lin Addition was presented and signed by ThomasB. King, attor-
ney for petitioners. It was moved by Alderman White, seconded
by Alderman Ferguson, that the City Council, having duly in-
spected said plat, having examined the same avid considered the
petition, do hereby approve said plat of said Chamberlin Addi-
tion and authorize the County Clerk of Eritth County to record

same in the Map & Plat Records in his office. Motion carried.
It was moved by Alderman Ferguson, seconded by Alderman
Hedrick, that the following monies be transferred from the Gen-
eral Fund: $50.00 to Band Fund; $500eOO to.Street Lighting Fund;
and $500#00 to Park Fund. Motion carried.
The City Secretary discussed in detail the 1955-56 annual
City Budget -and it was suggested that the proper notice be run
in the local newspaper. That the new Budget would be acted up-
on at the next regular meeting of the Council. Notice as follows:
The Annual Budget of the City of Stephenville, Texas, has
been prepared and filed with the City Secretary for approval by
the City Council:
This is to notify that the City Council will meet on the
4th day of October, 1955, at the City Hall in the City of Step-
henville, Texas, at 7:30 P. M. to hear any and all protests why
such budget shall not be accepted and approved. -

City Attorney Chandler was requested to discuss the City's:
not paying interest on all meter deposits. Mr. Chandler recommen-
ded that new contract forms be printed leaving out that paragraph
y which stated the City would pay .06% interest on customer's de-
posits. After further discussion, it was moved by Alderman Farr,
seconded by Alderman Riggins, that City Secretary Cates be author-
ized to have new contract forms printed and leaving out that par-
agraph which stated the City would pay .06% interest on customer's
deposits: Upon receiving said new forms no interest will be paid
on any customer's meter deposit. Motion carried.
Mr. Chandler also reported he had received a ruling from the
attorneys of the League of Texas Municipalities stating that rent-
ing out of parking meter space was illegal and was passing this
information on to the Council for their befefit.
Mr. Chandler explained a proposed ordinance which provides
for notice of claims for damages for the death or personal in-
juries of any person or for damages to or destruction of property,
making such notice condition precedent to the right to sue the
City of Stephenville, and prescribing the authority to waive
notice. After discussion, it was moved by Alderman White, secon-
ded by Alderman Hancock, that this ordinance be adopted and ap-
proved (said ordinance be attached to and becoming a part of these
minutes). Motion carried.
Alderman Hedrick reported that the Club House at the City
Golf Course was complete and was inquiring what would be a -reas-
onable charge for the club house per night. After discussion, it
was suggested and agreed that $5.00 per night would be a reason-
able charge.
Alderman Riggins ask the other Council members to be think-
ing about the hiring of two new firemen in the very near future.
This was discussed but no action taken at this time.
It was moved by Alderman Clements, seconded by Alderman Fer-
guson, that bills and accounts be allowed and ordered paid. Mot-
ion carried.
There being no other business at this time, the Couhc i-1
