The City Council of the City of Stephenville, Texas, convened on August 1, 2017, at 5:30 p.m., in the Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: Mayor Mayor Pro-Tem Council members Jerry K. Weldon II Doug Svien Carla Trussell Mark McClinton Rhett Harrison Alan Nix Sherry Zachery Jerry Warren Absent Brady Pendleton Others Attending Allen L. Barnes, City Administrator Randy Thomas, City Attorney Staci L. King, City Secretary I. Call to Order The meeting of the Stephenville City Council was called to order at 5:30 p.m. on Tuesday, August 1, 2017, by Mayor Weldon. II. Pledge of Allegiance to the United States Flag Pledge of Allegiance to the Texas Flag —"Honor the Texas flag; I pledge allegiance to thee, Texas, one state under God, one and indivisible." Mayor Weldon led the audience in the pledge to the United States Flag and to the Texas Flag. III. Invocation was given by Pastor Don Middleton, Cross Timbers Church of Christ, Stephenville. IV. Recognition of Officer Jeremy Lanier and Sergeant Orlando Gaitan, Stephenville Police Department. Chief Jason King recognized Officer Jeremy Lanier and Sergeant Orlando Gaitan with the following citation: Officer Jeremy Lanier and Sergeant Orlando Gaitan, of the Stephenville Police Department, distinguished themselves by heroic actions in the saving of a human life in Stephenville, Texas, on March 23rd, 2017. At approximately 1:40am on March 23rd, 2017 Officer Lanier and Sgt. Gaitan responded to the report of a man on the side of the South Loop Bridge in Stephenville, Texas. Upon arrival they discovered a man with one leg over the rail of the bridge who was intent on taking his own life. Regular Business Meeting —August 1, 2017 Stephenville City Council By working together Officer Lanier was able to approach the subject from behind while Sergeant Gaitan spoke to him. Just prior to jumping, Officer Lanier was able to grab the man and pull him back over the railing to safety. By their prompt action and humanitarian regard for his fellowman, Officer Lanier and Sergeant Gaitan has reflected great credit upon themselves and the Stephenville Police Department. V. Citizens' General Discussion No one came forward to address the council. VI. Consider Approval of an Encroachment Agreement for the Construction of a Balcony at 104 East Col lee Street. MOTION by Alan Nix, second by Sherry Zachary, to approve the encroachment agreement for 104 East College. MOTION CARRIED by unanimous vote. VII. Nominations Committee Report A. July 18, 2017 1. Consider Appointing Brandon Huckabee to Place 1 and Malcolm Cross to Alternate 1 on the Board of Adjustment MOTION by Carla Trussell, second by Mark McClinton. MOTION CARRIED by unanimous vote. 2. Reducing the Size of the Planning and Zoning Commission MOTION by Carla Trussell, second by Jerry Warren that the Planning and Zoning Commission remain at ten members. MOTION CARRIED by unanimous vote. II B. July 25, 2017 1. Charter Amendments The Nominations Committee recommended that a Charter Review Committee be established that consists of the Nomination Committee and two citizens appointed by the committee chair. No action taken. Vill. Planning & Development Committee Report A. Request for Variance on Septic System Inside City Limits. Committee gave positive recommendation to council. B. Mobile Food Vendor Ordinance. Staff and Council Member Zachery met with vendors and will bring an ordinance for consideration in September. C. Section 12: "Sign Regulations" of the City of Stephenville Zoning Ordinance. The committee recommends that this item be tabled until a public meeting can be held for citizen input. D. Amendment to the Thoroughfare Plan. This item was removed from the committee agenda. E. Residential Home Improvement Incentive Program. Staff was asked to bring additional information to the council. No action. IX. Public Health and Safety Committee - Credit Access Business Staff was directed by the committee to meet with local businesses and committee members would reach out to various officials to schedule a meeting to discuss the issue. No action. X. Planning and Zoning Commission A. PUBLIC HEARING Case No. RZ2017-002 Regular Business Meeting —August 1, 2017 Stephenville City Council Consider approval of a rezone of the property located at 1092 W. Tarleton Street, being Lot(s) 3A, 1B, 14B, and part of 14A, Block 16, of the SS400 Park Place Addition, to the City of Stephenville, Erath County, Texas, from R-3 (Multiple Family Residential District), to B-1 (Neighborhood Business District). Mayor Weldon opened the public hearing. Jeremy Allen, acting Director of Planning and Building Services, presented the staff report on this matter. The rezone request was unanimously denied by the Planning and Zoning Commission, and therefore would require a super -majority vote by the city council to overturn the commission's denial. Mayor Weldon asked for anyone in favor of the rezone to come forward. Those speaking in favor of rezoning: Carrie and Austin Pack, 1225 N. Cleveland, Stephenville, Texas, petitioners and owners of University Flowers and College, Etc. Wendell Hollingsworth, 206 Logan Lane, Stephenville, Texas Linda Brown, 586 N. Clinton, Stephenville, Texas Kari Haile, 6520 County Road 258, Stephenville, Texas Rosemary Nagle, 401 Bluebonnet, Stephenville, Texas Evan Arendell, 1081 N. Harbin, Stephenville, Texas Those speaking in opposition to rezoning: Amy Crew, 1080 W. Tarleton, Stephenville, Texas Karen Finney, 1060 W. Tarleton, Stephenville, Texas Mayor Weldon closed the public hearing at 6:24 p.m. Consider Adopting Ordinance No. 2017-0-08 rezoning from R-3 Multiple Family Residential District to B-1 Neighborhood Business District, Lots 1A, 1B, 148, and part of 14A, Block 16 of the 55400 Park Place Addition to the City of Stephenville, Erath County, Texas. MOTION by Carla Trussell, second by Sherry Zachery to table the item until the full council is present to vote. MOTION CARRIED, Alan Nix casting an opposing vote. B. PUBLIC HEARING - Case No. PZV2017-001— Consider approval of a variance from the City of Stephenville Subdivision Ordinance, Section 5.13, Subsection (6), in orderto install an onsite sewage facility (septic tank system) on a lot being less than 1 acre in size, located at 2612 W. Lingleville Rd., being a .809 Acre tract of land out of the Jarrett Menefee Survey, Abstract 0520, City of Stephenville, Erath County, Texas. Vincent LaTour, developer, spoke in favor of the variance. No one spoke in opposition. MOTION by Mark McClinton, second by Sherry Zachery to approve a variance to 2612 W. Lingleville Road to allow the installation of an on -site sewage facility. MOTION CARRIED, Alan Nix casting an opposing vote C. PUBLIC HEARING - Case No. RRP2017-001— Consider approval of a replat of Lots 1, 14, and a portion of 13, Block 14, of the Park Place Addition to the City of Stephenville, Erath County, Texas, to Lots 1-R, and 14-R, Block 14, of the Park Place Addition to the City of Stephenville, Erath County, Texas. No one came forward to speak in favor of, or opposition to, the replat. Regular Business Meeting —August 1, 2017 Stephenville City Council MOTION by Mark McClinton, second by Carla Trussell to approve the replat of Lots 1, 14, and a portion of 13, Block 14, Park Place Addition. MOTION CARRIED by unanimous vote. D. PUBLIC HEARING -Case No. FP2017-02 —Consider Approval of Application for Final Plat of Christy Plaza II development located on Christi Plaza (at 377), Stephenville, Erath County, Texas This item was removed from the agenda. No action. E. PUBLIC HEARING -Case No. FP2017-003 —Consider Approval of Application for Final Plat of the Blue Sky Subdivision located on FM 205 and Private Road 1098, Stephenville, Erath County, Texas No one came forward to speak in favor of, or opposition to, the final plat. MOTION by Mark McClinton, second by Doug Svien to approve the final plat of the Blue Sky Subdivision. MOTION CARRIED by unanimous vote. F. PUBLIC HEARING —Case No. Ord2017-001 —Consider approval of Ordinance No. 2017-0-_ to repeal and replace Section 12: "Sign Regulations" of the City of Stephenville Zoning Ordinance Allen Barnes, City Administrator, recommended to council that this item be tabled to allow at least one council workshop and a public meeting to be held before a final version is presented for approval. MOTION by Doug Svien, second by Mark McClinton to table the item on the recommendation of the city administrator. MOTION CARRIED by unanimous vote. XI. Set Time, Date, and Location of Public Hearing on the Proposed Tax Rate Staff recommended the first public hearing on the tax rate be held on August 29, 2017 at 5:30 p.m. in the City Council Chambers and the second public hearing be held on September 5, 2017 at 5:30 p.m. in the City Council Chambers. MOTION by Mark McClinton, second by Alan Nix to set the public hearings on the tax rate as recommended by staff. XII. Consider Approval of Resolution No. 2017-R-21 to Extend the Deadline to Turn the Annual Budget into the City Secretary's Office MOTION by Doug Svien, second by Mark McClinton to approve Resolution No. 2017-R-21. MOTION CARRIED by unanimous vote. XIII. Consider Approval of Ordinance No. 2017-0-08 Amending the Water and Sewer Rates MOTION by Alan Nix, second by Mark McClinton to approve Ordinance No. 2017-0-08. MOTION CARRIED, Carla Trussell casting an opposing vote. XIV. Consent Agenda MOTION by Alan Nix, second by Mark McClinton to approve the consent agenda. MOTION CARRIED by unanimous vote. A. Consider Approval of Minutes of the Regular Council Meeting on July 11, 2017 Regular Business Meeting —August 1, 2017 Stephenville City Council B. Consider Addendum to Extend the Interlocal Agreement with the North Central Texas Council of Governments for 9-1-1 Services C. Consider Approval of Resolution No. 2017-R-20 Accepting the 2017 Pavement Management Project — Chip Seal Project D. Consider Abatement of Easement in the J.B. Dupey Survey, A-196, Lot 35 and Lot 36 of the Elk Ridge Phase III Subdivision E. Consider Changing the Date of the October Regular Council Meeting to October 9, 2017 XV. Comments by City Administrator • Thursday, August 3 — Texstar Ford Summer Nights Concerts — Songwriters Show featuring Larry Joe Taylor, Davin James, Richard Leigh, and Keith Sykes • Wednesday, August 16 — First Day of School for Stephenville ISO • Council Budget Workshops begin on Monday, August 14 • Monday, September 4— City offices closed for Labor Day • Tuesday, September 5 — Regular Council Meeting Waste Connections will be refunding the city $22,000 in overpaid fuel surcharges. XVI. Comments by Council members Mark McClinton wished everyone a safe and successful school year. Carla Trussell thanked the Planning and Zoning Commission for all of the work they put in on the sign ordinance. Doug Svien reminded everyone the tax free weekend was coming up. Mayor Weldon requested Allen Barnes coordinate with the district office of TxDOT to update the city council on their ongoing projects in Erath County. XVII. EXECUTIVE SESSION. In compliance with the provisions of the Texas Open Meetings Law, Subchapter D, Government Code, Vernon's Texas Codes, Annotated, in accordance with: A. Section 551.087 — Deliberations Regarding Economic Development Negotiations — Project Summer B. Section 551.074 Personnel Matters (a)(1) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee —City Administrator Evaluation XVIII.
