Monday, August 12, 2019 at 5:30 PM The City Council of the City of Stephenville, Texas, convened on Monday, August 12, 2019, at 5:30 PM, in the City Hall Training Room, 298 West Washington Street, for the purpose of a Special City Council Meeting, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: COUNCIL PRESENT: Mayor Doug Svien (via videoconference) Council Member Mark McClinton Council Member Carla Trussell Council Member Nick Robinson Council Member Ricky Thurman Council Member Alan Nix Council Member Brandon Huckabee COUNCIL ABSENT: Mayor Pro Tem Brady Pendleton Council Member Gerald Cook OTHERS ATTENDING: Allen L. Barnes, City Manager Staci L. King, City Secretary Randy Thomas, City Attorney Jason King, Interim Assistant City Manager Call to Order In the absence of Mayor Pro Tern Brady Pendleton, and due to the fact that Mayor Svien was in attendance via video conference, pursuant to the city council's adopted Rules of Procedure the meeting was called to order by City Secretary Staci King at 5:30 p.m. MOTION by Doug Svien, second by Carla Trussell, to appoint Mark McClinton to chair the meeting. MOTION CARRIED by unanimous vote. 11. Consider Adoption of a Bicycle / Sidewalk Plan for the City of Stephenville The current bicycle/pedestrian plan did not include the proposed sidewalks for the Safe Routes to School Grant applications that were approved on August 6, 2019. The amended plan includes these routes and brings the city into compliance for application for the grants. MOTION by Ricky Thurman, second by Carla Trussell, to accept the bicycle/pedestrian plan as presented. MOTION CARRIED by unanimous vote. III. EXECUTIVE SESSION In compliance with the provisions of the Texas Open Meetings Law, Subchapter D, Government Code, Vernon's Texas Codes, Annotated, in accordance with 1. Section 551.074 Personnel Matters - To deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee • City Manager • Assistant City Manager • City Secretary • Director of Finance • Director of Public Works • Director of Parks and Leisure Services • Director of Development Services • Police Chief • Fire Chief • Tourism and Visitors Bureau Manager • Stephenville Type B Economic Development Authority Executive Director • Stephenville Type B Economic Development Authority Assistant Director • City Engineer • Building Official • Fire Marshal IV. Action taken on items discussed in executive session (if necessary) The meeting was called back in to regular session at 6:33 p.m. Allen Barnes, City Manager, announced that he would be hiring Police Chief Jason King as the new Assistant City Manager. King will continue serving as police chief, in addition to assistant city �{ manager, until a new police chief is appointed. ii MOTION by Carla Trussell, second by Brandon Huckabee, to amend Ordinance No. 2019-0-23 regarding development incentives by amending Exhibit A as presented. MOTION CARRIED by the following votes: Ayes: Mark McClinton, Carla Trussell, Nick Robinson, Brandon Huckabee Noes: Alan Nix V. Positions Eligible for Economic Development Performance Incentives A. Tier • City Manager • Assistant City Manager • Economic Development Director • Assistant Economic Development Director B. Tier II • Director of Public Works • Director of Finance • Director of Planning and Development • City Engineer • Building Official • Fire Marshal 2. Calculation of Inventive payments All incentive payments below shall be calculated on ad valorem tax values, less any incentive given to the project developer. 3. Calculation of Ad Valorem Tax Increase The ad valorem tax increase shall include only dollar amounts for real property values and shall not include business personal property values 4. Eligible Projects A. Commercial Projects with a value exceeding 2.5 million dollars ($2,500,000) B. Mixed -Use Projects a. Mixed -use projects are those that contain both residential and commercial usage in the same buildings, specifically commercial/retail and multi -family. b. To be eligible for development incentives, a mixed -use project must consist of commercial and/or retail establishments that are open to the general public on the ground level of the building with multi -family residential beginning on the second level or higher. C. Single -Family Residential Projects are not eligible for incentives. D. Multi -Family Residential Projects are not eligible incentives. 5. Definitions: A. Projects and valuations shall be defined by single -parcel boundaries. Cumulative valuations of projects across contiguous parcels owned by a single person or entity shall not be used to determine eligibility for development incentives. B. Incentives will be paid only on the first building permit and certificate of occupancy on a parcel unless: a. If a contiguous parcel is acquired after the completion of a project, and the parcels are replatted to a single parcel, a project will be considered to have entered into an Ordinance No. 2019-0-23 Development Incentives Page 1 of 3 Amended Exhibit A" 2019.08.12 additional project phase and shall be eligible for additional incentives if Phase I of the project exceeded 2.5 million dollars ($2,500,000) in valuation. C. "Parcel" is defined as a tract of land defined by legally surveyed boundaries. 6. Schedule of amount of performance incentives by position A. Tier (1) When building permit on commercial project over 2.5 million dollars ($2,500,000) is issued: City Manager, Assistant City Manager, SEDA Executive Director, and SEDA Assistant Executive Director shall each be paid within thirty (30) days a five hundred dollar ($500) incentive. (2) When certificate of occupancy is issued on a commercial project over 2.5 million dollars ($2,500,000) is issued: City Manager, Assistant City Manager, SEDA Executive Director and SEDA Assistant Executive Director shall be paid within thirty (30) days a fifteen hundred dollar ($1,500) incentive. (3) When any commercial project over 2.5 million dollars ($2,500,000)is completed and the final ad valorem/property values are provided to the city, the formulas below shall be used to calculate incentives for the following positions: (a) City Manager and Executive Director of SEDA Six (6) percent of City of Stephenville portion of calculated ad valorem/property tax revenue of project, as assessed by E.C.A.D. the first year after completion, less any incentives given to the project developer. Payment is to be made to the employee no later than thirty (30) days after receipt of the final ad valorem values each yeaR (b) Assistant City Manager and SEDA Assistant Director For each year that the City Manager and SEDA Executive Director receives disbursement as described above, the Assistant City Manager and SEDA Assistant Director shall receive a payment of fifteen (15) percent of the scheduled amount to be paid to the City Manager and SEDA Executive Director in that year. Payment is to be made to the employees no later than thirty (30) days after receipt of the final ad valorem values each Year (c) Assistant Executive Director SEDA In addition to the above described payment, when City Manager and SEDA Executive Director are paid their year 1 (one) incentive described above, the Assistant SEDA Directorwill be paid four tenths (A) of one (1) percent of any grant funds that were gained in furtherance of completing any commercial project over 2.5 million dollars ($2,500,000). I Payment is to be made to the employee no later than thirty (30) days after receipt of the final ad valorem values each yeaF. Ordinance No. 2019-0-23 Development Incentives Page 2 of 3 Amended Exhibit A"2019.08.12 1-mr47ll When building permit on commercial project over 2.5 million dollars ($2,500,000) is issued: Director of Public Works, Director of Finance, Director of Planning and Development, City Engineer, Building Official, and Fire Marshal shall each be paid within thirty (30) days a one hundred dollar ($100) incentive. ii) When certificate of occupancy is issued on a commercial project over 2.5 million dollars ($2,500,000) is issued: Director of Public Works, Director of Finance, Director of Planning and Development, City Engineer, Building Official, and Fire Marshal shall each be paid within thirty (30) days a two hundred fifty dollar ($250) incentive.
