Pledges of Allegiance Council member Ricky Thurman led the pledges of allegiance. III. Invocation by Curt Plaxco, Stephenville Church of the Nazarene IV. Regular Agenda 1. Recognition of Girl Scout Gold Award Recipients Victoria Saucedo and Taryn Gibbs were recognized for earning their Girl Scout Gold Awards. 2. Citizens' General Discussion No one came forward to address the city council. 3. Set the Maximum Tax Rate for 2019 The city's current tax rate is $0.475 per $100 valuation, the effective tax rate is $0.4437, and the rollback rate is $0.4707. Allen Barnes, City Manager, recommended setting the maximum tax rate at the rollback rate and advised that the council may set the tax rate at any amount up to the maximum. MOTION by Mark McClinton, second by Carla Trussell, to set the maximum tax rate for 2019 at $0.475 per $100 valuation. MOTION CARRIED by unanimous vote. 4. Set the Time, Date, and Location of the Public Hearing on the Proposed Tax Rate MOTION by Mark McClinton, second by Brandon Huckabee, to set the time, date, and location of the public hearings on the proposed tax rate as follows: Tuesday, September 3, 2019 at 5:30 p.m. in the City Hall Council Chambers, 298 W. Washington Tuesday, September 10, 2019 at 5:30 p.m. in the City Hall Council Chambers, 298 W. Washington MOTION CARRIED by unanimous vote. 5. Consider Approval of Resolution No. 2019-11-24 Initiating the Abandonment of a 12-foot Alley Located in Block 15 of the City Addition of the City of Stephenville, Erath, Texas Staff recommended the abandonment of a 12-foot alleyway located behind the Long Street Hotel as there are no utilities in the alleyway, nor does the city intend to develop the alleyway into a public street. MOTION by Carla Trussell, second by Nick Robinson, to approve Resolution No. 2019-R-24 Initiating the Abandonment of a 12-foot Alley Located in Block 15 of the City Addition of the City of Stephenville. MOTION CARRIED by unanimous vote. V. Tourism and Visitors Bureau Committee Carla Trussell, Chair 1. Committee Report Council member Carla Trussell gave the committee report. 2. Consider Approval of Hotel Occupancy Tax Fund Application from X-Treme Team Roping Finals MOTION by Carla Trussell, second by Mark McClinton, to approve a Hotel Occupancy Tax Fund Application from X-Treme Team Roping Finals in the amount of $8400. MOTION CARRIED by unanimous vote. 3. Consider Approval of Hotel Occupancy Tax Fund Application for Stephenville SOX Tournament to approve a Hotel Occupancy Tax Fund Application from the Stephenville SOX in the amount of $700. MOTION CARRIED by unanimous vote. VI. Planning and Zoning Commission Karen Wilkerson, Interim Director of Development Services 1. PUBLIC HEARING - CASE NO. SV2019-002 Applicant is requesting a Waiver from City of Stephenville Subdivision Ordinance Section 155.6.11A Sidewalk Requirements at 1051 W. Elm, being Lot 15, Block 4 of the Frey Second Addition of the City of Stephenville, Erath, Texas Mayor Pro Tern Pendleton opened the public hearing at 5:51 p.m. Karen Wilkerson, Interim Director of Development Services, stated that the waiver City Of Stephenville Regular City Council Meeting - 06 Aug 2019 received a unanimous positive recommendation from the Planning and Zoning Commission. Council member Mark McClinton wished to reiterate his concern with continually granting waivers to the sidewalk requirement and asked whether the ordinance should be revisited. Council member Carla Trussell stated that she had spoken with the property owner and was advised that the sidewalk would have occupied a majority of her front yard. No one came forward to speak in favor of or opposition to the waiver. Mayor Pro Tern Pendleton closed the public hearing at 5:53 p.m. Consider Approval of a Waiver from the City of Stephenville Code of Ordinance Section 155.6.11(A) Sidewalk Requirements at 1051 W. Elm, being Lot 15, Block 4 of the Frey Second Addition of the City of Stephenville, Erath, Texas MOTION by Carla Trussell, second by Nick Robinson, to approve a waiver from the City of Stephenville Code of Ordinance Section 155.6.11(A) Sidewalk Requirements for the property at 1051 W. Elm, being Lot 15, Block 4 of the Frey Second Addition of the City of Stephenville, Erath, Texas MOTION CARRIED by unanimous vote. PUBLIC HEARING - CASE NO. SV2019-003 Applicant has requested a waiver from the City of Stephenville Subdivision Ordinance Section 155.6.04(M)1 Curb and Gutter Requirements at 1051 W. Elm, being Lot 15, Block 4 of the Frey Second Addition of the City of Stephenville, Erath County, Texas Mayor Pro Tern Pendleton opened the public hearing at 5:54 p.m. Karen Wilkerson, Interim Director of Development Services, stated that the Planning and Zoning Commission recommended that the waiver be denied. No one came forward to speak in favor of or opposition to the waiver. Mayor Pro Tern Pendleton closed the public hearing at 5:55 p.m. 4. Consider a Request for Waiver from the City of Stephenville Subdivision Ordinance Section 155.6.04(M)1 Curb and Gutter Requirements at 1051 W. Elm, being Lot 15, Block 4 of the Frey Second Addition of the City of Stephenville, Erath County, Texas MOTION by Ricky Thurman, second by Carla Trussell, to deny a waiver from the City of Stephenville Subdivision Ordinance Section 155.6.04(M)1 Curb and Gutter Requirements for the property located at 1051 W. Elm, being Lot 15, Block 4 of the Frey Second Addition of the City of Stephenville, Erath County, Texas. MOTION CARRIED by unanimous vote. PUBLIC HEARING - CASE NO. RZ2019-005 Applicant is requesting a rezone of .998 Acres out of A0515 of the William Motley Survey in the City of Stephenville, Erath County, Texas from Industrial (I) to Single Family Residential District (R-1). City Of Stephenville Regular City Council Meeting - 06 Aug 2019 Mayor Pro Tern Pendleton opened the public hearing at 5:55 p.m. Karen Wilkerson, Interim Director of Development Services, stated that the rezone received a unanimous positive recommendation from the Planning and Zoning Commission. No one came forward to speak in favor of or opposition to the rezone. Mayor Pro Tern Pendleton closed the public hearing at 5:57 p.m. 6. Consider Approval of Ordinance No. 2019-0-24 Rezoning .998 Acres out of A0515 of the William Motley Survey in the City of Stephenville, Erath County, Texas from Industrial (1) to Single Family Residential District (R-1). MOTION by Brandon Huckabee, second by Nick Robinson, to approve Ordinance No. 2019-0-24 rezoning .998 acres out of A0515 of the William Motley Survey. MOTION CARRIED by unanimous vote. 7. PUBLIC HEARING - CASE NO. RZ2019-006 Applicant is requesting a rezone of property located at 824 W. Tarleton, being Lot 1B, Block 0, of the Kight First Addition to the City of Stephenville, Erath County, Texas from City, Tarleton, School (CTS) to Retail and Commercial Business (B-2). Mayor Pro Tern Pendleton opened the public hearing at 5:58 p.m. Karen Wilkerson, Interim Director of Development Services, stated that the rezone received a unanimous positive recommendation from the Planning and Zoning Commission. No one came forward to speak in favor of or opposition to the rezone. Mayor Pro Tern Pendleton closed the public hearing at 6:01 p.m 8. Consider Approval of Ordinance No. 2019-0-25 Rezoning a Property Located at 824 W. Tarleton, being Lot 1B, Block 0, of the Kight First Addition to the City of Stephenville, Erath County, Texas from City, Tarleton, School (CTS) to Retail and Commercial Business (B-2)• Council member Brandon Huckabee filed a conflict of interest form with City Secretary Staci King. MOTION by Nick Robinson, second by Ricky Thurman, to approve Ordinance No. 2019-0- 25 rezoning a property located at 824 W. Tarleton, being Lot 1B of the Kight First Addition. Consider Approval of Contract with Jacob & Martin, LLC for Engineering Services for the City Of Stephenville Regular City Council Meeting - 06 Aug 2019 Downtown Revitalization Grant n MOTION by Nick Robinson, second by Mark McClinton, to approve a contract with Jacob jJ &Martin, LLC for engineering services for the Downtown Revitalization Grant. MOTION CARRIED by unanimous vote. 3. Consider Approval of Resolution No. 2019-R-25 Authorizing an Application for the Safe Routes to School Grant, Stephenville Walkability Plan - Central Elementary Long St Connection MOTION by Brandon Huckabee, second by Nick Robinson, to approve Resolution No. 2019-R-25 authorizing an application for the Safe Routes to School Grant, Stephenville Walkability Plan - Central Elementary to Long Street Connection. MOTION CARRIED by unanimous vote. 4. MOTION CARRIED by unanimous vote. Vill. Public Works Committee Alan Nix, Chair 1. Committee Report In Council member Nix's absence, Allen Barnes, City Manager, gave the committee report. 2. Consider Approval of a Memorandum of Understanding with Tarleton State University MOTION by Mark McClinton, second by Nick Robinson, to approve a Memorandum of Understanding with Tarleton State University regarding stormwater mitigation. MOTION CARRIED by unanimous vote. 3. Consider Approval of an Amendment to the Wastewater Treatment Plant Operations Contract MOTION by Mark McClinton, second by Carla Trussell, to approve an amendment to the Wastewater Treatment Plant Operations contract. MOTION CARRIED by unanimous vote. IX. Finance Monica Harris, Director of Finance 1. Consider Approval of Ordinance No. 2019-0-26 4th Quarter Budget Adjustments MOTION by Mark McClinton, second by Nick Robinson, to approve Ordinance No. 2019-0- City Of Stephenville Regular City Council Meeting - 06 Aug 2019 26 authorizing 4th quarter budget adjustments. MOTION CARRIED by unanimous vote. 2. Consider Approval of Ordinance No. 2019-0-27 Amending Plan Review Fees The city currently has a contract with Bureau Veritas for plan review. The fees are being amended in order to reflect current fees from Bureau Veritas so that the fees are a pass - through for the city. MOTION by Mark McClinton, second by Nick Robinson, to approve Ordinance No. 2019-0- 27 amending plan review fees. MOTION CARRIED by unanimous vote. X. MONTHLY BUDGET REPORT Monica Harris, Director of Finance, gave the following report: In reviewing the financial statements ending June 30, 2019, the financial indicators are as or better than expected. Property Tax - We received $25K in property taxes in the month of June, resulting in a $253K or 4.38% increase over funds collected through June last year. Erath County usually collects approximately 99% of the property taxes through June. The $6.02 million collected is 99.70% of the $6.04 million budgeted. Sales Tax - We received $499K in sales tax in June, resulting in $33K over the target budget through June. We received $215K or 4.73% more than the funds received through June last year. HOT Funds - We received $346K in Hotel Occupancy Tax revenue through June, a 36% increase over the $254K in Hotel Occupancy Tax revenue received last year. Of the $92K increase, $511K is j[ revenue from Moolafest and $3,000 is investment income. We spent $361K in Hotel Occupancy Tax funds through June as compared to $244K last year. This increase is expenditures for Moolafest and Tourism wages. Revenue (Budgetary comparison) - The target budget for operating revenue is $19.1 million. We received $21 million in revenue through June, resulting in $1.9 million over budget. This is a result of property taxes, sales tax and interest income. Expenditures (Budgetary comparison) - The target budget for operating expenditures is $15.1 million. We expended $13.8 million through June, resulting in $1.3 million under budget. Revenue (Prior year comparison) - Operating revenue received last year was $19.8 million as compared to the current year's $21 million, resulting in a $1.2 million increase due to property taxes, sales and other taxes, service charges, and investment income. Expenditures (Prior year comparison) - Operating expenditures last year were $13.4 million as compared to the current year's $13.9 million, resulting in a $454K increase. Additional expenditures included wages, the special election, outside professional fees, maintenance, Child Safety grants, wages and advertising in the HOT Fund, and wages and economic development programs in the SEDA Fund. New Programs - Street improvements are in progress, and the master plans are still progressing. XI. Stephenville Type B Economic Development Authority Update Jeff Sandford, Executive Director, gave an update on local and national economic development trends and improvements. Comments by Council Members Mark McClinton recognized Council member Carla Trussell and Tourism and Visitors Bureau Manager Julie Smith for the time and hard work on developing policies and procedures for the expenditure of Hotel Occupancy Tax funds. Carla Trussell encouraged local employers to send employees to the free hospitality training hosted by the Stephenville Tourism and Visitors Bureau. The Stephenville Historical Museum has recently completed renovations on the John Tarleton house and Ms. Trussell encouraged everyone to go visit. Ricky Thurman wanted to inform everyone of a fundraiser for Habitat for Humanity in October. Brandon Huckabee reminded everyone that Handsome Hunks would be taking place on August 16 and all proceeds benefit the Stephenville Fire Department and the Stephenville Police Department SWAT Team.
