HomeMy WebLinkAbout1990-04-18 - Special City Council MINUTES OF SPECIAL MEETING City of Stephenville - City Council WEDNESDAY, APRIL 18, 1990 - 5:30 P.M. The City Council of the City of Stephenville, Texas, convened in special session on March 18, 1990 at 5:30 p.m. in the Council Chambers of City Hall , 354 N. Belknap, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Article 6252-17, Section 3A, V.T.C.S. , with the following members present, to wit: Mayor: George Swearingen Mayor Pro Tem: Bob Self Helen Martin Vicki L. Truss Scott Evans Ray Reynolds James L. McSwain Joel M. Hillin Absent: Jim Bostic Others Attending: Don Davis City Administrator Joyce Pemberton City Secretary Joseph Chandler City Attorney Randy Thomas Assistant City Attorney Charlene Young Director of Finance I: Mayor George Swearingen called the meeting to order and declared a quorum present. II : MATTERS BY COUNCILMEMBERS. 90-04-087: A. Discussion of Existing Leash Law and Its Enforcement by Councilmember Joel Hillin. Councilmember Joel Hillin said that he has noticed persons in the parks with their dogs running loose. He felt that the public should be made aware of the City' s existing Leash Law Ordinance and said ordinance be enforced. City Attorney Chandler advised that the ordinance provides that any dog or cat, not on the owner' s property is to be on a leash and that leash is to be in the owner/guardian' s hand. The present ordinance is suf- ficient; it just needs to be enforced. 90-04-088: B. Councilmember Ray Reynolds made the motion, seconded by Councilmember Joel Hillin, that, due to the need to canvass the May 5, 1990 election returns, the regular meeting date of May 1, 1990 be changed to May 8, 1990. The motion carried UNANIMOUSLY. III : COMMITTEE REPORTS. 90-04-089: A. Damage Claims Committee: Wendell Riggs, 380 N. Dale Ave - Sewer backup Councilmember Scott Evans reported that Mr. Riggs had had problems at his home before. Mr. Riggs' insurance has paid $2,002.13 for repairs. It is the Committee' s recommendation that the City pay Mr. Riggs' insurance deductible in the amount of $250.00. Councilmember Bob Self made the motion, seconded by Councilmember Scott Evans, that the City Council authorize the payment of $250.00 to Mr. - 25 - Wendell Riggs as compensation for damages incurred when sewer backed up into his house, subject to a signed release from Mr. Riggs. The motion carried UNANIMOUSLY. 90-04-090: B. Personnel Committee: Discuss File on Police Chief Doug Conner. Councilmember Bob Self, reporting for the Personnel Committee, said the Committee had studied the files made available by the District Attorney, with regard to administrative procedures. They studied the aspect of what things might need a closer and adjustments made; changes they would recommend to be made to the administrative procedures. Don Davis, City Administrator, advised that some problems/weaknesses had been discovered during a review of said files. Mr. Davis presented the following changes to the purchasing procedures: 1. The City will not make purchases for individuals or grous on a re- imbursement basis without the written prior approval of the City Administrator or Finance Director; an exception being long-distance telephone calls. 2. Fixed assets purchased at Texas Surplus which have a fair market value of over $250 at the time of donation will be added to the fixed asset inventory list. 3. The purchaser of goods shall provide detail to the purchasing agent on items which, from the description on the invoice, are not clear to the purchasing agent. The purchasing agent shall check the invoice of open purchase orders against the actual items. Councilmember Bob Self made the motion, seconded by Councilmember Helen Martin, to approve purchasing policies as outlined above by Mr. Davis; said policies to go into effect immediately and be included in the purchasing manual . The motion carried UNANIMOUSLY. 1 Councilmember Scott Evans commented that he would like reiterate his position about trading out of town. He felt all of the things that Sam' s has could be bought at home from a local vendor at a competitive price. IV: CONSENT AGENDA: Items A & B were removed from the Consent Agenda for discussion. 90-04-091: A. Landfill Budget Amendment: After discussion, Councilmember Joel Hillin made the motion, seconded by Councilmember Helen Martin, to approve the amendment to the Landfill Operating Budget by transferring $97,664.65 from the Cash Reserve Account to the Landfill Operating Account, including $43,443.56 to the Street Department. The motion carried UNANIMOUSLY. 90-04-092: B. BID CONSIDERATIONS: After discussion, Councilmember Bob Self made the motion, seconded by Councilmember Helen Martin, to award the bid for excavation of the North Cell at the landfill to low bidder, Word Construction Company of Iredell , Texas, in the amount of $17,260.00. The motion carried UNANIMOUSLY. C. ORDINANCES & RESOLUTIONS: 90-04-093: After some discussion, Councilmember Vicki Truss made the motion, seconded by Councilmember Helen Martin, to pass and adopt a Resolution supporting the Tri-County Drug Task Force and approve the $2,500 for matching funds as recommended. The motion carried UNANIMOUSLY. Resolution 1990-03. - 26 - Councilmember Ray Reynolds made the motion, seconded by Councilmember Joel Hillin, to approve the amendment of the Police Department Budget by transferring $19,560.00 from the Sales Tax Account to the Police Department' s Operating Budget, which will include $17,460 for Prisoner Fees and $2,500 for the Drug Task Force matching funds. The motion carried UNANIMOUSLY. V: DEPARTMENTAL REPORTS. 90-04-094: A. After some discussion, Councilmember Ray Reynolds made the motion, seconded by Councilmember Scott Evans, to pass and adopt a Resolution authorizing the Mayor to sign an agreement with Santa Fe Railway Company dedicating the public railroad crossing on Caporal Lane to the City of Stephenville. The motion carried UNANIMOUSLY. VI : EXECUTIVE SESSION: Mayor George Swearingen recessed the open portion of this meeting and called the City Council into executive session as provided in Vernon' s Texas Civil Statutes, Article 6252-17, Section 2(g) , for the purpose of discussing the resignation of Doug Conner, Chief of Police. Mayor George Swearingen reconvened the City Council into open session. 90-04-095: No action was taken on matters discussed in the executive session. VII : ADJOURNMENT.
