The City Council of the City of Stephenville,Texas, convened on Tuesday, October 1, 2019, at 5:30 PM, in the
Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business Meeting,
with the meeting being open to the public and notice of said meeting, giving the date, time, place and
subject thereof, having been posted as prescribed by Chapter 551, Government Code,Vernon's Texas Codes
Annotated,with the following members present,to wit:

Mayor Svien called the meeting to order at 5:30 p.m.

IV. Regular Agenda
1. Bosque Adventure and Recognition of Stephenville ISD Students Caleb Jones and Libby
Post
The Bosque River Trail Corridor Committee, Stephenville ISD, Tarleton State University,
and the City of Stephenville, along with the Optimist Club, Wright's Ice, Lone Star Ag
Credit, F&M Bank, HEB, Stephenville Historical Museum Board, and A+ Porta Kans are all
partnering together to inspire and educate the Hook Elementary 4th grade students in a
one-of-a-kind experience along the beautiful Bosque River Trail. The Tarleton College of
Liberal and Fine Arts, College of Education, College of Agricultural and Environmental
'—' Sciences, and the College of Science and Technology will bring students to lead this event
and provide an amazing experience. Stations will be located along the Bosque River Trail
and will highlight the environment, the arts, sustainable practices, nature, history, music,
the museum, and physical health emphasis. One of the core values of for Stephenville ISD
is relationships. Building relationships across the community of Stephenville, along with
all of the other organizations, shows our Stephenville ISD 4th graders what it means to be
part of this great city. We would like to make a special recognition of two 4th grade
students: Caleb Jones from Mrs. Kimbrough's class and Libby Post from Mrs. Moore's class
who designed the shirts for this year's amazing event. Thanks to all of the 4th grade
students who submitted pictures for the t-shirt contest.
2. Citizens'General Discussion
Jeane Edwards, 838 N. Paddock, addressed the council regarding the city's sex offender
ordinance. Mayor Svien referred the matter to the Public Health and Safety Committee
for review.
V. Planning and Zoning Commission

1. PUBLIC HEARING
Case No.:AS2019-002
Abandonment of a 12-foot Alley Located in Block 15 of the City Addition of the City of
Stephenville, Erath,Texas,located between Virginia Street and Floral Street.
The Planning and Zoning commission made a unanimous, favorable
recommendation to close the alleyway.
Mayor Svien opened the public hearing at 5:42 p.m.

2. Consider Approval of Ordinance No. 2019-0-37 Abandoning a 12-foot Alley Located in
Block 15 of the City Addition of the City of Stephenville
MOTION by Mark McClinton, second by Carla Trussell, to approve Ordinance No. 2019-0-
37 Abandoning a 12-foot Alley Located in Block 15 of the City Addition of the City of
Stephenville.
MOTION CARRIED by unanimous vote.
3. PUBLIC HEARING
Case No.:SV2019-004
Elk Ridge Baptist Church is Requesting a Waiver from the City of Stephenville
Subdivision Ordinance Section 155.6.11.A - Sidewalks at 1515 South Alexander Road,
being Lot 1, Block 1, of the Elk Ridge Baptist Church Addition to the City of Stephenville,
Erath County,Texas.
Mayor Svien opened the public hearing at 5:45 p.m.
Those speaking in favor of the waiver:
Daniel McCabe, 1045 Antelope Trail, Pastor of Elk Ridge Baptist Church, stated that the
church was asking for the waiver based on the fact that there are no other sidewalks
between the South Loop and the city limits. He also stated that there was little, if any,
pedestrian traffic along Alexander Road, and that encouraging pedestrian traffic along the

highway could be dangerous.
Andy Hansen, 1000 E. Lingleville Road, owns the land to the west and south of the church.
He stated that he felt the site plan that was developed adheres to the spirit of the
ordinance in that sidewalks, curb,and gutter are included within the interior of the plan.
No one came forward to speak in opposition to the waiver.
Concerns were raised with the number of waivers requested regarding sidewalks and the
complexity of some requests. Mayor Svien asked that the Planning and Development
Committee review the sidewalk requirement in the city's subdivision ordinance.
4. Consider Approval of a Waiver from the City of Stephenville Subdivision Ordinance
Section 155.6.11.A - Sidewalks at 1515 South Alexander Road, being Lot 1, Block 1, of
the Elk Ridge Baptist Church Addition to the City of Stephenville, Erath County,Texas.
MOTION by Brandon Huckabee, second by Brady Pendleton,to approve a waiver from the
City of Stephenville Subdivision Ordinance Section 155.6.11.A - Sidewalks at 1515 South
Alexander Road.
MOTION CARRIED by the following votes:

City of Stephenville, Erath County,Texas.
The Planning and Zoning Committee made a unanimous, favorable recommendation to
approve the waiver.
Mayor Svien opened the public hearing at 5:54 p.m.
Those speaking in favor of the waiver:
Daniel McCabe stated that the stormwater drainage plan has been reviewed by the city
and TxDOT and that drainage from the property is being properly handled without
additional curb and gutter that would be located in TxDOT's right-of-way.
Andy Hansen stated that TxDOT is currently addressing curb and gutter on state highways
in other areas and he believes it may be a matter of being patient and letting TxDOT
address the issue as part of their future plans.
No one came forward to speak against the waiver.

MOTION by Carla Trussell, second by Nick Robinson, to approve a Hotel Occupancy Tax
Fund application from the Cross Timbers Fine Arts Council in the amount of$40,500.
MOTION CARRIED by unanimous vote.
3. Consider Approval of Hotel Occupancy Tax Fund Application from the Stephenville
Historical Museum
Carla Trussell abstained from the vote as she is on the Museum's board of directors.
MOTION by Brady Pendleton, second by Nick Robinson, to approve a Hotel Occupancy
Tax Fund application from the Stephenville Historical Museum in the amount of$82,677.
MOTION CARRIED by the following votes:

2. Consider Approval of Telecommunications Accounts Audit Agreement
MOTION by Mark McClinton, second by Carla Trussell, to approve an agreement with
SpyGlass Group, LLC.
MOTION CARRIED by unanimous vote.
X. MONTHLY BUDGET REPORT
Monica Harris, Director of Finance, gave the following report:
In reviewing the financial statements ending August 31, 2019, the financial indicators are
as or better than expected.
Property Tax-We received $10K in property taxes in the month of August, resulting in a $261K or
4.50% increase over funds collected through August last year. Erath County usually collects
approximately 99.85% of the property taxes through August. The $6.06 million collected is
-- 100.38%of the$6.04 million budgeted.
Sales Tax - We received $700K in sales tax in August, resulting in $159K over the target budget
through August. We received $352K or 6.28% more than the funds received through August last
year. There was a large correction in August due to audit collections, which explains the lower
receipts in May,June,and July.
HOT Funds-We received $459K in Hotel Occupancy Tax revenue through August, a $95K increase
over the $364K in Hotel Occupancy Tax revenue received last year. We spent $424K in Hotel
Occupancy Tax funds through August as compared to $344K last year. This increase is
expenditures for Moolafest and Tourism wages.
Revenue (Budgetary comparison) - The target budget for operating revenue is $24 million. We
received $25 million in revenue through August, resulting in $962K over budget. This is a result of
property taxes, sales and other taxes, building permits,and interest income.
Expenditures (Budgetary comparison) - The target budget for operating expenditures is $19
million.We expended $17.1 million through July, resulting in $1.9 million under budget.
Revenue (Prior year comparison) - Operating revenue received last year was $23.4 million as
compared to the current year's $25 million, resulting in a $1.56 million increase due to property
taxes,sales and other taxes, building permits,service charges, and investment income.
Expenditures (Prior year comparison) - Operating expenditures last year were $16.4 million as
compared to the current year's $17.1 million, resulting in a $745K increase. Additional
expenditures included wages,the special election,outside
professional fees, maintenance, Child Safety grants,wages, advertising, and Moolafest in the HOT
Fund, and wages and economic development programs in the SEDA Fund.
New Programs-The SCBA bottles and ground monitor nozzles for the Fire Department have been
purchased.The Utility master plans are still in progress.

Xl. Stephenville Type B Economic Development Authority Update
Jeff Sandford, Executive Director, updated the council on facade grants, New Market Tax Credits,
industry recruitment, and plans for Christmas lights downtown in conjunction with the Tourism
and Visitors Bureau.

XIV. Comments by Council Members
Mark McClinton reminded everyone to visit the downtown Farmer's Market on Saturday. He also
thanked them for the great chuck wagon breakfast to help kick off the rodeo. He also wanted to
remind everyone that Sundown on the Square and Bygone Days on the Bosque are coming up this
month.
Carla Trussell wanted to remind everyone of the many events happening in October: Dinner in the
Stacks, October 5; Sundown on the Square, October 12; Bygone Days on the Bosque and Michael
Martin Murphy Concert, October 19; Tarleton Homecoming, October 19; Fright Fest Film Festival,
October 25; Spirits of Erath West End Cemetery Walk, November 3.
Brady Pendleton shared the announcement that Tarleton has become a Division I school, and with
that comes tremendous growth and positive change for Stephenville and the surrounding area.
He encouraged the community to step up and be involved in the coming changes.
Ricky Thurman announced that Habitat for Humanity's fundraiser would be taking place on Friday.
He encouraged residents to be active and attend meetings, as well as consider serving on a
citizen's board or commission.
Gerald Cook announced that the Stephenville Education Foundation Color Run would be taking
place on Saturday. He also reiterated what council member Pendleton had stated regarding the
City Of Stephenville

growth and change that comes with Tarleton going to Division I.
Brandon Huckabee reminded everyone that the electronics recycling would be on Saturday, as
well as the Lutheran German Supper. He also stated that he is excited for the growth and changes
coming to Stephenville.
Doug Svien thanked the council for their time and dedication.
