July 21, 1964•
The City Council met in regular meeting on the above date with Mayor Cook pre-
siding and the following councilmen present: Hubert Darby, Mrs_, Fred McCleskey, E.
Lee Orbison, Chas. Higgins, Roy Swain, Bill Christian, W. H. Stem and Mrs. Doyle White.
J. D. McCullough, Chairman of Zoning Commission & Adjustment Board, appeared be-
fore the Council stating that Mr. Oscar Hammitt has applied for building permit to
construct a Drive -In Cafe on Lot 4, Block 129, City Addition. The building inspector
denied such permit on the grounds that the property was zoned Residence 2. There was
an appeal filed requesting that zoning be changed to Business 1. The Board has met
and found considerable opposition to changing the zoning. Based upon this opposition
the Board voted to recommend that the Council not change the zoning at this time.
The Board has also considered an appeal filed by Harlowe Oil Company on Lots 2 -3-
8-9, Block 56, College View Addition. After contacting property owners the Board found
no opposition to a grocery store in the area, and recommended to the Council that a
non - conforming permit be granted to Harlowe Oil Company for the grocery store.
It was moved by Councilman Riggins, seconded by Councilwoman McCleskey, to accept
the recommendations of the Zoning Commission & Adjustment Board. Motion carried.
Mayor Cook reported a company is interested in locating a large poultry process-
ing plant in this area. The plant would employ a maximum of 130 persons. The Indus-
trial Foundation has the necessary land in the southwest part of the City. The plant
would require a large amount of water and the owners want to know what the water,
taxes, sewage, and. utility connections will cost.
It was moved by Councilman Christian, seconded by Councilman Stem, to offer this
industry the followings
.20� per thousand gallons of water.
Water and sewer lines at no cost.. -
$5000.00 valuation for tax. purposes for a 10 year period.
The motion carried unanimously.

Alderman Higgins introduced a resolution and
moved that it be adopted. The motion was sc- corded by Alderman
Mrs. Fred McCleskey The motion carrying with it the adoption of
the resolution prevailed by the following vote:

BE IT RESOLVED ]�Y THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE. TEXAS:
i. That the Mayor of the City of Stephenville, Texas,
is hereby authorized and directed to issue a notice to bidders
in substantially the following form:
ADVERTISEMENT FOR BIDS
Sealed proposals addressed to the Mayor and Councilmen of the
City of Stephenville, Texas, will be received at the office of

ri. :x Cates, City Secretary, until 5x:00 P. QM, o!clock,
on July 28 1964 for furnishing and installing water
system improvements as follows:
CONTRACT "A" - WELL FIELD SUPPLY:LTNE $ 8,000.00 Bid Bond
CONTRACT "B" - TEST HOLES AND L.TATER
SUPPLY WELLS $ 3,000.00 Bid Bond
CONTRACT "C" - WELL PUMPS $ 1,000.00 Bid Bond
Bidders must submit with their bids a Cashiers or Certified Check
payable to or endorsed, without recourse, to the City of Stephenville;
Texas, or a Proposal Bond in the same amuunt, from a reliable Surety
Company, as a guarantee that Bidder will enter into a contract and
execute bond and guarantee forms provided within five (5) days after
notice of award of contract to him. Bids without check or proposal
bond will not be considered.
In accordance with Chapter 93, ..cts of :e 56th Legislature, which
became effective April 27, 1959, the s-�ccessful Bidder will be re-
quired to furnish not only a performance bond in the amount of the
contract, but also a payment bona in the amour.t of the - contract,
for the protection of all claimants supplying labor and materials
as defined in said law. The bonds must be executed by an approved
Surety Company holding a permit from the State of Texas to act as
Surety and acceptable according to the latest list of companies
holding certificates of authority from the Secretary of the Treasury
of the United States, or. other Surety or Sureties acceptable to the.
Owner.
All unit prices 'must be stated in both script and figures. The
Owner reserves the right to reject any or all bids and to waive
formalities. In case of ambiguity or lack of clearness in stat-
ing th-e price in the bids, the Osier reserves the right to con -
sider the most advantageous construction thereof, 'or to reject
the bid. Unreasonable or unbalanced v. it prices will be considered
sufficient cause for rejectioa of any -3i'a or bids.
Bidders arc expected to inspect the site of the work and to in-
form themselves regarding local conditions and conditions under
which the work is to be done.
Not less than the prevailing rate of per diem wages for work of
similar character in the City of Stephenville, and County of
Erath, and not less than the general prevailing rate of per diem
wages £or legal holidays, S"ourdrys, Sund yo, and ' ovorti -mo work
shall be paid to all laborers, workmen and mechanics employed
in said City and County on the above project.
The City Council of the City of Stephenville. has ascertained
and here specifies such general prevailing rate of per diem
wages in said City and County to be as follows:

Stephenville or. payment of apart or all
of the contract to be made pursuant to this notice, and to pay
part or all of the Engineer's fees and inspection and testing
fees. The maximum amount of time warrant indebtedness to be
incurred for said purposes shall be $ 310,000 , the maximum
rate of interest such time warrants are to bear is 4,75%
per annum, and the maximum maturity date thereof shall be
1982 The City has obtained a commitment from an invest-
ment company for the purchase of said warrants from the Contrac-
tor, so that said warrants shall be delivered to the Contractor
on approved estimates and the Contractor will immediately del-
iver said warrants 'to said investment company and receive in
cash the par value therefor,

2. The City Council has ascertained and hereby finds
that the general prevailing rate of per diem wages in the City
of Stephenville and in Erath County, for work similar to that
to be performed under the contract to be awarded pursuant to
said notice is as out in the foregoing prescribed form of
notice.
3. Said notice shall be published in the 1°Stephenville
Empires ", a newspaper of general circulation published
within the City of Stephenville, on the same day of each of two
consecutive weeks, the first publication being at least fourteen
(14) full days prior to the date set for receiving bids as shown
in the form of notice above prescribed.

Councilman Chas. Riggins introduced a resolution
and moved its adoption. The motion carrying with it the
adoption of the resolution prevailed by the following vote:

The resolution as adopted is as follows:
RESOLUTION
APPOINTING DIRECTOR TO THE BOARD OF DIRECTORS
OF UPPER LEON RIVER MUNICIPAL WATER DISTRICT.
WHEREAS, Upper Leon River Municipal Water District
was established by Chapter 405, Acts of the 57th Legislature
of the State of Texas, Regular Session (Vernon's Ann. Civ. St.
8280 -257); and
WHEREAS, pursuant to the Act creating the District
each City contained in the District is entitled to two
Directors on said Board;
WHEREAS, each Director serves for a term of two
years with his term expiring on May 31 of his second year
in office; and
WHEREAS, the said Act requires this body to appoint
a Director each year to replace the Director whose term
expires.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE, TEXAS
1. L. B. Howard is hereby appointed Director
of the Board of Directors of Upper Leon River Municipal Water
District for the term ending May 31, 1966.
2. It is hereby found that said person thus
appointed Director resides in and owns taxable property in
the City of Stephenville and that he is not a member of the
governing body of said City or an employee of said City.
3. The Director hereby appointed shall subscribe
to the Constitutional Oath of office and shall give bond for
the faithful performance of his duties in the amount of
$5,000.00.

Councilman Stem reported that most of the citizens are cooperating by watering
late in the evening and early in the morning. There is still a need to conserve water
in every possible way.
Councilmen Riggins, Darby, Swain, McCleskey, White and Christian had nothing to
report.
Councilman Orbison asked all committee chairmen to get their budget requests in
to the Director of Finance as soon as possible.
The City Secretary asked that the Council consider hiring someone to secure the
necessary pipeline easements. It was moved by Councilman Swain, seconded by Council-
man Stem, to hire J. D. McCullough to contact property owners to secure pipeline ease-
ments. Motion carried.
Upon motion and second the Council stood adjourned.
