Stephenville, Texas
August 6, 1963.
The City Council met in a regular meeting on the above date with Mayor Evans
presiding and the following councilmen present: I. D. Reynolds, Hubert Darby, Mark
Geeslin, E. Lee Orbison, Raymond Anderson, Roy Swain Jr., Harlan Huey and W. H. Stem.:'
Others present were Dir.•of Public Works Gann, St. Supt. Collins, Chief Cornell
and City Atty. Chandler.
Minutes of previous meetings were read and approved.
Mr. B. L. Singleton, Manager of Texas Power & Light Co., appeared before the
Council presenting slides showing the continued rise in the cost of taxes, salaries
and line building materials. Also slides showing the changes of the cost of elec-
tricity for several years. The company plans to decrease the residential and com-
mercial rates although taxes, salaries and materials have gone up., The decreas=e
will amount to approximately 22°.. Mr. Singleton presented ordinances for rate re-
duction which are for the Council's consideration.
Mrs. Fred McCleskey and Mr. Bill Riddick appeared before the Council stating
the Recreation Board has cut the proposed budget to $17,618.00 and ask that the
Council approve.this proposed budget.
Mr. T. C. Poston came before the Council stating he is ready to lease, or sell,
Lot 2, Block 18, City Addition. This lot now being used for a public parking lot. Mr.
Poston would like for the City to make some kind of offer in the near future.
The budget for the coming year was discussed in detail at this time. It was
moved by Councilman Reynolds, seconded by Councilman Orbison, that the proper notice
be run in the local newspaper and the new budget be acted upon at the next regular
meeting of the Council. Motion carried.
NOTICE
The annual budget of the City of Stephenville, Texas, has been prepared and
filed with the City Secretary for approval by the City Council: This is to notify
that the City Council will meet on the 3rd day of September, 1963, at the City Hall
in the City of Stephenville, Texas, at 7:00 o'clock P. M., to hear any and all pro-
tests why such budget shall not be accepted and approved.
Councilman Geeslin stated that several citizens had asked when the gas company
was going to work on installing more lines. The Councii agreed to keep a close check
on this so the project will be completed before winter.
Councilman Stem reported a meeting had been held with a representative of W. rrr
Guyton Associates and a proposal for an underground water survey had been presented
by the above firm. The estimated cost not to exceed $4250.00.
It was moved by Councilman Swain, seconded by Councilman Geeslin, to employ
W. 19. Guyton Associates to make the underground water survey. Motion carried.
Councilman Orbison presented the Council with a list of some of the persons who
owe the City delinquent tax and asked that something be done about them. After dis-
cussion, it was agreed to wait and see if the suits being filed by the County will clear
some of the delinquent tax.
Councilman Orbison reported a large percent of the fires are started from burning
of trash. The Fire Committee would like for an ordinance to be passed preventing burn-
ing of trash in the City. It was agreed to look into this and discuss it more at a
later meeting.
It was moved by Councilman Darby, seconded by Councilman Swain, that North Carey
Avenue not be closed. Motion carried.
Councilman Huey asked if the Sanitation Department plans to cover more of Metho-
dist Branch this budget year. It was agreed that work would start soon on this project.
Councilman Huey reported the Twentieth Century Club has decided not to allow the
marker near Piggly - Wiggly Store to be moved.
Councilman Huey also reported the Park Committee has contacted the officials of
the Rodeo Arena to see if they are interested in tearing down the auction barn at the
Park and rebuilding it at the arena. The Park Committee would like to recommend that
this barn be given to the Rodeo Arena if they would agree to rebuild it. It was agreed
to look into this further before any action taken.
It was moved by Councilman Reynolds, seconded by Councilman Huey, to ask City At-
torney Chandler to prepare an ordinance against the poisoning of animals. Motion carried.
It was moved by Councilman Huey, seconded by Councilman Swain, to adopt an ordinance
approving certain rate schedules filed by Texas Power & Light Company in the City of
Stephenville, Texas, and providing conditions under which such rate schedules may be
changed, modified, amended or withdrawn. Motion carried. (Said ordinance being attached
to and becoming a part of these minutes).

AN ORDINANCE DECLARING PERSONS, FIRMS, ASSOCIATIONS OF PERSONS OR CORPORATIONS
OWNING OR- OPERATING A BILLIARD TABLE WITHIN THE INCORPORATED LIMITS OF .
STEPHENVILLE SUBJECT TO BAN, PROHIBITION, REGULATION, SUPERVISION, CONTROL
ANY LICENSE BY TH9 CITY OF STEPIE NVILLE OTHER THAN RELIGIOUS, CHARITABLE OR
EDUCATIONAL ORGANIZATIONS ; REQUIRING A LICENSE IN CONNECTION WITH OPERATION
OF BILLIARD TABLES, PROVIDING A PENALTY FOR VIOLATION AND DECLARING AN
EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Section One
Every person, firm, association of persons or 'corporation owning or
operating a billiard table within the incorporated limits of the City of
Stephenville except religious, charitable or educational organizations are
hereby declared subject to ban, prohibition, regulation, supervision, control
and license by the City of Stephenville in pursuance of Article 19.019 Section
(10) of the Revised Civil Statutes of Texas.
Section Two
No person, firm, association of persons or corporation shall own and
operate a billiard table within the incorporated limits of the City of Ste -
phenville without first obtaining a license therefor from the City Secretary
of the City of Stephenville. The City Secretary will investigate the reputation,
reliability and dependability of the person, firm, association of persons or
corporation making such application. If upon such investigation it is determined
that the applicant is of good reputation, reliability and dependability, the
City Secretary shall issue the license applied for which license shall be for
• term of one year from and after its issuance. The City Council may impose
• fee for the issuance of such license.
Section Three
License herein provided shall be in the following language:

revocable by the City Council of the City of Stephenville

Section Four
License herein provided for shall be i1 all things personal and appli.
cable only to the person, firm, association of persons or corporation,- 10 whom
or to which issued and no license shall be assignable by the licensee. The
license shall:.-be for a'- period of one year and maybe canceled by the City Council
for good cause shown and the decision of the Council shall be final. It shall be
the duty of each holder of a "license as above 'set out to have same displayed at
all times at the place where billiard table or billiard tables may be in operation.
Section Five
Any person violating the provisions of this ordinance, upon conviction
thereof shall be fined in any sum not exceeding $200.00 and each day in which a
violation takes place shall be considered as a separate offense.
Section Six
In the event any section, subsection, sentence, clause or phrase of
this ordinance shall be declared or adjudged invalid or unconstitutional, such
adjudication shall in no means affect any other section, subsection or clause
or phrase of this ordinance and all the remainder thereof shall be in full force
and effect.

Section Seven
A billiard table is defined as it is in Article 19.010 Section 10,
of the Revised Civil Statutes of Texas as 'follows: "A billiard table is
defined as any table surrounded by a ledge or cushion with or without pockets
upon which balls are impelled by a stick or cue."
Section Eight
Because there is no ordinance of the City of Stephenville regulating
billiard tables and because the 58Th Legislature of the State of Texas enacted
Section 10 of Article 19.01 of the Revised Civil Statutes of Texas providing
for the taxation by the State of billiard tables, repealing the then existing
laws prohibiting the operation of billiard tables and conferring upon cities
and towns the authority to levy tax and license owners.and operators of
billiard tables and to ban, prohibit, regulate, supervise and control any per-
soup firm, association of persons or corporations owning or operating a billiard
table within the limits of such City or Town creates a necessity that this
ordinance go into effect immediately from and after its passage.

It was moved by Councilman Geeslin, seconded by Councilman Reynolds, to ad-
opt an ordinance Imposing an additional charge on Texas Power & Light Company in
an amount equaling 2% of its gross revenues from sale of electricity from indus-
trial, governmental and municipal business in this City. Motion carried. (Said
ordinance being attached to and becoming a part of these minutes).
It was moved by Councilman Anderson, seconded by Councilman Geeslin, to accept
from Jack Farrar a deed for the extension of North Rowland Avenue. Motion carried.
It was moved by Councilman Geeslin, seconded by Councilman Orbison, to transfer
the necessary funds. Motion carried.
It was moved by Councilman Orbison, seconded by Councilman Geeslin, to adopt
and ordinance declaring persons, firms, associations of persons or corporations
owning or operating a Billiard Table within the incorporated limits of Stephenville,
subject to ban, prohibition, regulation, supervision, control and license by the
City of Stephenville other than religious, charitable or educational organizations,
requiring a license in connection with operation of billiard tables, providing a
penalty for violation and declaring an emergency. Motion carried. (Said ordinance
being attached to and becoming a part of these minutes).
It was moved by Councilman Orbison, seconded by Councilman Anderson, to approve
the 1962 Delinquent Tax Roll. Motion carried.
