The City Council met in regular meeting on the above date with Mayor Evans presiding and the following Councilmen present: Virgil Dickerson, I. D. Reynolds, Raymond Anderson, W. H. Stem, Mark Geeslin, Albert Graves, And Harlan Huey. Others present: St. Supt. Collins, Chief Cornell, Wayne Rodman and City Atty. Chandler. Minutes of previous meetings were read and approved. A group, with Mr. E. M. Anderson as spokesman, appeared before the Council 1 asking that the City pay installation of the Christmas Lights each year. It was F moved by Councilman Dickerson, seconded by Councilman Graves, that in the future the City will pay for installing the Christmas Lights, that the Chamber of Commerce will furnish the bulbs and upkeep of the lights. Motion carried. Councilman Dickerson reported the employee of the Street Department,who handles the asphalt,ruins several suits of clothes each year and ask the City to furnish clothing for handling asphalt. It was agreed for the Street Committee to handle this. It was reported that several complaints have been made regarding itinerant ped- dlers in the vicinity of the Auction Barn. It was agreed to make a close check to see if these peddlers are in violation of City Ordinance. Councilman Stem reported his committee has studied sick leave policies from six other cities and have some recommendations. After discussion, it was moved by Councilman Graves, seconded by Councilman Dickerson, to adopt the following: SICK LEAVE POLICY That each permanent, full -time City Employee shall be allowed sick leave with full pay, computed upon the basis of one full working day allowed for each full month employed in a calendar year, with an extra day added for each four months, }.. at total of fifteen days per year. Sick leave may be accumulated to a total of ninety days. The administration of sick leave policy shall be the responsibility of each department head. Each department head is required to verify sick leave absence of an employee of his department after one day by requiring a doctor's certificate from such employee. It shall be the duty of City Secretary to keep all sick leave records. The above policy is not to be misconstrued with vacation time. Anyone caught taking unfair advantage of sick leave will be subject to dismissal immediately. Motion carried. 411 AN ORDINANCE REQUIRING ALL ITINERANT PERSONS OFFERING FOR SALE ANY TYPE OF INSURANCE OR INSURANCE CONTRACT IN THE CITY OF STEPHENVILLE TO OBTAIN A LICENSE BEFORE TAKING ANY ACTION WITHIN THE CITY OF STEPHENVILLE TO SELL OR OFFER FOR SALE ANY SUCH INSURANCE ;PROVIDING FOR A BOND, REQUIRING A LICENSE FEE,< PROVIDING A PENALTY FOR VIOLATION AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One No itinerant person shall offer for sale to any other person or contact any other person for the purpose of offering for sale any type of insurance contract without first obtaining from the City of Stephenville the license herein provided. Section Two The license required herein shall be obtained from the Chief of Police of the City of Stephenville.Anycr.jtiuerant� wishing to sell any type of insurance or solicit to sell of any type of insurance or who wishes to contact people for the purpose of making an appointment to sell any type of insurance will make application with the Chief of Police of the City of Stephenville and pay to the Chief of Police of the City of Stephenville at the time of making this application a fee of $25.00. The Chief of Police will investigate the reputation, reliability and dependability of the person making the applica- tion and take such time as is necessary for this purpose. If upon such in- vestigation it is determined that the applicant is a person of good reputation, reliability and dependability the Chief of Police shall issue the license applied for which license shall be for a term of one year from and after its issuance. Section Three The license herein provided shall be in the following language: "City of Stephenville (Date) "These presents evidence that has been granted a license by the ility of Stephen-' ville for a period of one (1) year from the above date to sell within the City of Stephenville insurance, make appointments for the purpose of discussing such sales and to make contacts with persons in connection with the sales so madd. This license is revocable by the Chief of Police of the City of Stephenville for good cause shown. "City of Stephenville By Chief of o ice Section Four The license herein provided for shall in all things be personal to the person named therein and no license shall cover more than one person and no license shall be assignable. License shall be for a period of one year and may be cancelled by the Chief of Police for good cause shown And his decision thereon shall be final. It shall be the duty of each holder of a license as set out above to have in his possession at all times said license. Section Five Any person violating the provisions of this ordinance, upon con- viction thereof shall be fined in any sum not exceeding $200.009 and each day in which a violation takes place shall be-considered as a separate offense. Section Six This ordinance shall in no way affect or repeal any part of any other ordinance of the City of Stephenville now in effect. M Section Seven In the event any section, subsection, sentence, clause or phrase of this ordinance shall be declared or adjudged invalid or unconstitutional, such adjudication shall in no means affect any other section, subsection,, clause or phrase of this ordinancevand all the rest thereof shall be in full force and effect. Section Eight The fact that there is no ordinance of the City of Stephenville at the present time regulating those soliciting the sale of contracts of in- surance who are itinerants, and the further fact that persons representing, themselves to be salesmen of insurance and to have licenses therefor from the State of Texas have gone to the private homes and dwellinghouses of citizens of Stephenville and have been insistent in their demeanor and efforts to sell insurance to various citizens of Stephenville and to make appointments for the purpose of discussing the sales Of insurance and such action has constituted harassment and is obnoxious to those of the citizens of Stephen - ville who are being subjected thereto, creates an emergency and imperative public itecessity- that this ordinance go into effect immediately from and - Passage. Louis Evans, Mayor of the City of Stephenville, is hereby authorized to make and execute lease with H. S. Osborne and 0. Byrd, lessee and owner of Block 110 in the City of Stephenville on that portion of West Mason Street hereivabove declared vacated for street purposes on the follow - ing terms and conditions: 1. Said area mentioned will be covered, levelled, filled, graveled and oiled and in all respects made suitable for customer parking with such use heretofore made of said area as a drainage channel not to be disturbed and to continue; 2. City of Stephenville will complete this work at an early date and get same ready for use by the said H. S. Osborne; the term of this lease will begin immediately upon payment of the consideration set out below and It will extend until December 31, 1975; H. S. Osborne will pay to the City of Stephenville for the lease of said portion of said street the sum of $1,000.00, said amount to be Paid upon delivery of said lease from the City of Stephenville to and with the said H. S. Osborne; 4• The City of Stephenville will be responsible for maintenance of said area for a period of 3 years after the completion of the construction and the beginning of the use thereof by H. S. Osborne for customer parking; all maintenance thereafter during the term of this lease shall be by H. S. Osborne; 5• City of Stephenville, through its officers, employees and agenta, shall have the right to go upon said area at any time for inspection PurPoses, for maintenance and repair purposes and may make any test in said area considered by its agents, employees or officers to be necessary, it being understood that this is required and will be done by the City in con- nection with the maintenance of drainage channel at through said area and that there may be interruptions in the use of same for customer parking when h it is necessary for the City to make any repairs, tests or inspections. PASSED AND APPROVED this the of 1963• yor 9 125 It was moved by Councilman Dickerson, seconded by Councilman Reynolds, to adopt the following: VACATION AND VACATION PAY POLICY That each permanent, full -time City Employee will accrue vacation time as follows: One day per month not to exceed fourteen calendar days per year. If an em- ployee resigns, he will be paid a pro -rata part of his vacation time. Should an employee be discharged, that employee would receive no vacation pay. It shall be the duty of each department head to report vacation time to the City Secretary. It shall be the duty of City Secretary to keep records of vacation time. Starting time will be as of employee's (date of employment) anniversary date. Motion carried. Councilman Huey presented a letter from Roy Miller's doctor who recommended that Miller not be allowed to drive a fire truck, but if the City had some other job it would be alright for him to work. It was moved by Councilman Dickerson, seconded by Councilman Huey, that the City pay Roy Miller for 30 more days and terminate him. Also if at any time Miller is able to go back to work he would be placed back on his job. Motion carried. It was moved by Councilman Reynolds, seconded by Councilman Dickerson, to pay Tommy Mitchell for his accumulated vacation time. Motion carried. It was moved by Councilman Graves, seconded by Councilman Dickerson, to trans- fer $5500.00 from the Water Works Operating Fund to the R & B Fund. Motion carried.
