The City Council met in called meeting on this date with Mayor Evans presiding and the following councilmen present: Virgil Dickerson, I. D. Reynolds, Wm. 0. Croft, Mark Geeslin, Raymond. Anderson, Albert Graves, W. H. Stem and Harlan Huey. Councilman.Anderson, Chairman of the Committee, passed to each member a copy of the proposed permit to Erath County Electric Cooperative Association, asking each member of the Council to read this permit and make up his own mind how to vote on it. It was moved by Councilman Dickerson, seconded by Councilman Graves, to adopt the following ordinance: This motion put to a vote and carried by a vote of 5 for, 3 against. ORDINANCE PERMIT TO ERATH COUNTY ELECTRIC COOPERATIVE ASSOCIATION AN ORDINANCE GRANTING TO ERATH COUNTY ELECTRIC COOPERATIVE ASSOCIATION, A CORPORATION, ITS SUCCESSORS AND ASSIGNS, FOR A PERIOD OF THIRTY YEARS FROM APRIL 17th, 1962, THE RIGHT TO SELL, DISTRIBUTE AND TRANSMIT ELECTRIC ENERGY IN THOSE ANNEXED AREAS WITHIN THE CITY LIMITS OF THE CITY OF STEPHENVILLE, ERATH COUNTY, TEXAS, HERETOFORE SERVED BY SAID ERATH COUNTY ELECTRIC dOOPERATIVE ASSOCIATION, AND IN ALL THOSE AREAS WHICH MAY BE ANNEXED IN THE FUTURE BY THE SAID CITY OF STEPHENVILLE IN WHICH 91ID ERATH COUNTY ELECTRIC COOPERATIVE ASSOCIATION IS THEN SERVING THE INHABITANTS OR A PART THEREOF, TO THE EXTENT PERMITTED BY STATE LAW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section 1. The word "Grantee" herein shall denote Erath County Electric Cooperative Association, a corporation, with its headquarters at Stephenville, Erath County, Texas, its successors and assigns; and the word "Grantor" herein shall denote "The City of Stephenville, Erath County, Texas." Section 2. That the City of Stephenville does hereby grant unto the said Gbantee, its successors and assigns, the right to sell, distribute and transmit electric energy, to the extent permitted by law, in those areas now located within the corporate limits of said City of Stephenville which have been recently annexed and in which areas Grantee, at the time of the annexation, was serving the inhabitants, '02 or some of the inhabitants, with electric energy and in all those areas that may be annexed and included within the corporate limits of the City of Stephenville in the future in which Gtoantee at the time of the annexation shall be furnishing electric energy to the inhabitants or some of the inhabitants of such area, to the extent permitted by State Law., Section 3. Grantee shall be liable for all damages or�othes -,in?uries.toi)per- sons knd;propetty that-may be= .caused by -its neglfitenoe and shall hold the City of Stephenville harmless from all expense or liability for any account or neglect of Grantee hereunder. Section 4. Grantee shall repair at its own expense any damage that may be done by it to the streets, alleys, avenues, sidewalks, bridges and public places in said areas hereinabove mentioned within the City of Stephenville, Texas, so as to restore the same to their former state or condition. Section 5. The provisions of this permit are severaV and if any section, pro- vision or part thereof be declared invalid, then it is.he-reby declared the intent of the parties that the remaining parts of this permit would be passed, notwith- standing such invalid part or parts, and the invalidity of any particular section, provision or part, shall.not invalidate this permit. Section 6. The Erath County Rural Electrification Association will not build any additional lines in the City Limits now or in the future. Section 7. This permit shall be in force and effect from and after its pas- sage and no acceptance hereof by Grantee shall be necessary and this permit shall exist for a period of thirty (30) years from April 17th, 1962. The committee on the building permit for Harlowe Oil Company reported they recommend a permit be granted after all lawsuits are dropped. It was moved by Councilman Dickerson, seconded by Councilman Graves, to issue Harlowe Oil Company, a building permit after all lawsuits against the City are dropped. City Secretary to notify Harlowe Oil Company of this action. Motion carried. Mayor Evans reported there is a need to make a study of the Gasoline Ordinance. This ordinance is being violated, and it seems it should be enforced or repealed. The Mayor appointed Councilmen Croft, Huey and Graves as a committee to study this ordinance and report back to the Council.,. It was moved by Councilam Reynolds, seconded by Councilman Dickerson, to ad- vertise for bids on the proposed new police building, the plans to include three changes as recommended by the Building Committee, bids to be opened on May 8, 1962, at 3:00 o'clock P. M. Motion carried. It was moved by Councilman Anderson, seconded by Councilman Croft, to dedicate the City Airport as Clark Field in honor of the late Henry Clark. Motion carried.
