presiding and the following councilmen present: Virgil Dickerson, I. D. Reynolds,
Wm. 0. Croft, Burl Lawrence, Albert Graves, Raymond Anderson, Scott D. Reed and
W. H. Stem.
Others present were Water Supt. Gann, St. Supt. Collins, Chief Cornell and
City Atty. Chandler.
Minutes of previous meeting were read and approved.
It was moved by Councilman Dickerson, seconded by Council Reed, to hire T. M.
English for City Judge. Motion carried.
It was moved by Councilman Graves, that J. Louis Evans, Mayor, be authorized
on behalf of the City, to sign Texas Highway Department Forms D- 15 -24, Joint Use
Permit on City of Stephenville Sanitary Sewer Department sewer lines crossing Loop
195 at Highway Centerline Stationing No. 112 +89 and 112 +96 on Project R. W. 79 -5-
11. The motion was seconded by Councilman Dickerson and upon the question being
called the vote stood:
Ayes: Councilmen Dickerson, Reynolds, Croft, Lawrence, Graves, Anderson,
Reed and Stem.
Noes:. None.
The Mayor declared the motion to have carried.
It is therefore ordered, adjudged and decreed that J. Louis Evans, Mayor, be
authorized on behalf of the City , to sign an agreement with Texas Highway Department
Form D- 15 -24, Joint Use Permit, on City of Stephenville Sanitary Sewer Department
sewer lines crossing Loop 195 at Highway Centerline Stationing No. 112 +89 and 112 +96
on Project R. W. 79 -5 -11.
It was moved by Councilman Reynolds, seconded by Councilman Croft, that J. Louis
Evans, Mayor, be authorized on behalf of the City, to sign a contract with Stanley
Brown, architect, for services in connection with remodeling of the building north
of the City Hall. Motion carried.

It was moved by Councilman. Reynolds, seconded by Councilman Dickerson, that
J. Louis Evans, Mayor, be authorized on behalf of the City, to sign a contract
with Texas Power & Light Company for a term of 10 years, beginning January 1, 1962,
providing for a supply of electric power to be used by the City for municipal light. -
ing. Motion carried. (Said contract being attached to and becoming a part: of these
minutes).
It was moved by Councilman Reynolds, seconded by Councilman Dickerson, to adopt
an ordinance making City Secretary Ex Officio Clerk of the Corporation Court of the
City of Stephenville and authorizing such clerk to appoint a deputy having the same
power that the clerk has and declaring an emergency. Motion carried.
It was moved by Councilman Graves, seconded by Councilman Dickerson, to transfer
$5000.00 from the Water Works Operating Fund to the R & B Fund. Motion carried.
The City Secretary presented the Mayor and each Councilman a copy of a list of
insurance policies on City owned property. The Council agreed to study this list and
discuss same at a later meeting.
Messrs. Olmstead and McCarty appeared before the Council and stated they plan
to open a Pool Hall in the City. These men asked permission of the Council to open
this business. After discussion, the Council suggested these men contact the Sheriff,
County Attorney and Texas Ranger in connection with opening this business.
Councilman Reed reported the residence at the Water Plant needs repairs, especi-
ally the edge of the roof, screens, and something done to keep water from under the
house. It was agreed for the Water Department to handle this matter.
Mayor Evans reported that Members of the Soil Conservation, along with some of
the Council Members, met today and discussed the possibility of future surface water
supply and flood control on the Bosque River.
Councilman Graves reported Mr. Moorhead had asked about getting sewer sdXvice to
his lots. Mr. Moorhead was told he could get sewer anytime he is willing to pay the
cost of such lines.
Councilman Stem reported that Hayden Pittman contacted him and wants to settle
the pending damage suit out of court. Mr. Pittman asked $9000.00 damages. The City
has made an offer of $800.00 and will not offer any more at this time.
Councilman Reynolds asked the Council to consider a special rate for use of
the parking meters for persons wLZ& work in the Courthouse. The Council asked City
Attorney Chandler about this and he explained some of the past experiences along
this line, also stated, in his opinion, to gbant special parking permits would de-
feat the purpose of the meters. Mr. Chandler asked the Council to seriously con -
sider this before 110&king parking space to anyone. No action taken.
Councilman Anderson reported that T. P. Tackett had contacted him in regard to
delinquent personal property taxes. Mr. Tackett feels his tax is too high on the
factory and equipment. The Council discussed this and took no action or ma4e any
adjustment to the above mentioned taxes.
The Council discussed the annexation of property along the South By= Pass.`
Councilrk6h3DIUkerson, Graves and Anderson were appointed as a committee to check
into this and report their recommendations to the Council.
There being no other business at this time, the Council stood adjourned subject
to the Mayorts_ call.

AN ORDINANCE MAKING CITY SECRETARY E% OFFICIO CLERK OF THE CORPORATION
- COURT OF THE CITY OF STEPHENVILLE AND AUTHORIZING SUCH CLERK TO APPOINT A
DEPUTY HAVING THE SAME POWER THAT THE CLERK HAS AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Section One
The City Secretary of the City of Stephenville shall be Ex Officio
Clerk of the Corporation Court of the City of Stephenville and the person
who occupies the office of City Secretary shall likewise occupy the office of
Clerk of the Corporation Court of the City of Stephenville.
Section Two
The Clerk shall keep minutes of the proceedings of said Court,
issue process out of such Court, and generally perform all the duties of the
Clerk of a court as prescribed by law for a county clerk insofar as the same
may be applicable.
Section Three
The City Secretary as Clerk of the Corporation Court is authorized
to appoint a deputy clerk of such court who shall have the same power and
duties as the City Secretary has as such Clerk of the Corporation Court of
the City of Stephenville.
Section Four
The fact that there is no provision of the law in the City Charter
or the City Ordinances of Stephenville providing for a Clerk of the Corporation
Court or for a Deputy Clerk of the Corporation Court of the City of Stephen-
ville creates an emergency and an imperative public necessity that this
ordinance go into effect immediately from and after its passage and all rules
of law and other provisions, if any, to the contrary are hereby suspended.

PETITION TO THE CITY COUNCIL OF THE CITY OF STEPHENVILLE
TO THE CITY COUNCIL OF STEPHENVILLE, TEXAS:
We, James E. Query, Jr., Mrs. Estelle Query, R. C. Bills and
Mrs. Lucille Bills, being a majority of the inhabitants of the territory
described below and being qualified voters of the State of Texas do hereby
petition and request the City Council of Stephenville, Texas, annex the land
described below:
All of that certain 11.7 acres of land, more or less, a part
of the M. R. Williams Survey, Abstract No. 804, in Erath
County, Texas, described by metes and bounds as follows:
BEGINNING at the S.W. Corner of that certain 43.25 acre
tract conveyed by H. S. Foster to Boles Home by deed
dated December 29, 1960, and of record in Vol. 378, page
209 in the Deed Records of Erath County, Texas, for the
( S.W. Corner of this, in the East line of Highway No. 108,
at an internal corner of the City Limit line of the City
of Stephenville as it existed on December 5, 1961, and at
the N.W. Corner of the Dr. R. H. Walker Lot No. 10, in
Block No. 147, of said City;
THENCE with the East line of said Highway N. 30 -47 W.
at about 320 feet pass an external corner of said City
Limit line, in all 434 feet. to an angle in said right
of way line, and N. 33 -10 W. 427 feet with the East line
of said Highway to the N.W. Corner of this;
THENCE N. 60 E. 592 feet to the N.E. Corner of this;
THENCE S. 32 deg. E. 860 feet to the South line of said
43.25 acre tract;
THENCE with the South line of said 43.25 acre tract S.
58 -52 W. about 164 feet and S. 60-WG428.feet to the place
of beginning.
This tract hereafter to be known as Lot No. Eleven (11)9 in Block
No. 147, of the City of Stephenville in Erath County, Texas, for
tax purposes.
Said land above described adjoins the City of Stephenville, Texas, and the
City of Stephenville by annexing said land will be extending its City Limits
at a northerly direction along the East line of State Highway No. 108 the
distance as shown in the above description.
It is requested that this petition and the accompanying affidavit
be filed and that at the appropriate time this Council by ordinance take the
necessary action to annex the land hereinabove described to the City of
St henville.

THE NORTH CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE BE-
SCRIBES SAID LAND BY METES AND BOUNDS AND DECLARES AN EMERGENCY
BE IT.ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
That certain area of land adjacent to the City of Stephenville and
specifically described as follows:
All of that certain 11.7 acres of land, more or less, a

is hereby received into the City Limits of Stephenville and made a part of
the City of Stephenville and the City Limit lines of the City of Stephenville
are hereby extended in accordance with the lines of the tract of land here -
inabove described. Plat of said area of 11.7 acres is attached hereto.
The fact that a petition was signed and filed with the City Council
of the City of Stephenville executed by a majority of the inhabitants of
said area all of whom were qualified voters of the State of Texas and sworn
to by one of thosesigning same whose affidavit is attached to such petition,
and that such petition has been on file with this City Council for a period
of more than 20 days, all as prescribed by the Charter of the City of Stephen-
ville, Texas, creates a demand and need that said land be annexed and it
being to the best interest of the City of Stephenville that same be annexed
immediately and,that the existence of said conditions creates an emergency
and an imperative public necessity requiring that this ordinance become effec-
tive immediately and any rule of law or procedure to the contrary is hereby
suspended and this ordinance hereby finally adopted and passed this day
of January, 1962.
