Chandler. Stephenville, Texas April 5, 1960. meeting on the above date with Ma yor Evans present: Virgil. Dickerson, Chas. iggins, qurray, Scott D. Reed and J. P. Hedrick. Gann, St. Supt. Collins, Chief Cornell and Minutes of previous meetings were read and approved. It was moved by Alderman Reed, seconded by Alderman Dickerson, to adopt an ordinance amending an ordinance passed on February 11, 1960, authorizing issuance of $175,000.00 of City of Stephenville Waterworks Improvement Warrants, series 1960, amended as follows. A ny amounts in excess of the $175,000.00 of Warrants,herein authorized, will be paid in cash. Motion carried (said ordinance being attached to and be- coming a part of these minutes). Mr. Arris Anderson appeared before the Council asking the City to make some repairs and improvements on the baseball field at the City Park. The,Council agreed to do the necessary work at the ball field. Mr. Bryan Hale came before the Council to discuss his plan for developing a portion of land near the old City Rock Crusher site, also to discuss the need for sewer line on the west bide of N. Lydia Avenue, and asked the City to try and im- prove the traffic situation on the Square. The Council discussed the sale of the land near the old Rock Crusher, to Mr. Hale, and it was agreed not to sell this land at this-time. Mr. A L. Moorhead appeared before the Council to ask if the City was planning to close N. Charlotte Avenue. The Council assured,Mr. Moorhead this street would not be closed. Alderman Reed reported that most all phases of the Water Improvement Program are ready to be started. He also discussed the possibility of not using one of the City wells located on W. Long St. any longer. It was agreed to ask Texas Power & Light to discontinue electric service to this well. Alderman Graves reported there had been several complaints about the odor from the Sewer Plant but this is now under control. He also reported that his committee had decided to wait on placing the pipe in the drainage ditch between Clinton Street and the Railroad. Discussed at this time was the proposed Plumbing Ordinance. The Council agreed not to take any action until a later meeting. Im of Stephenville a sum equal to two per cent (2°%) of its gross revenue received from the sale of electrical energy by said Company from its residential and commercial business conducted within the corporate limits of said City and for the preceding twelve months ending December 31st, in full payment for the priv- ilege of using and occup;�Ing the streets, highways, easements, alleys, parks, and other public places in the City of Stephenville whether as rental, super - Vision and inspection charges, or otherwise, for twelve months preceding the date on which payment is due to be made. This payment shall be in lieu of any other tax or increased rate of tax or other imposition, assessment, or charges, except ad valorem taxes. Section 6, The Grantee shall file its written a cceptance of this franchise within sixty (60) days after its passage and approval. Section 7. This franchise is not exclusive, and nothing herein contained shall be construed so as to prevent the City from granting other like or similar rights and privileges to any.other person, firm or corporation. Section 8. When this franchise ordinance shall have become effective, all previous ordinances of the City of Stephenville, Texas, franting a franchise to Texas Power & Light Company for electric light, heat and power purposes, shall be automatically cancelled and annulled, and the same, together with any ex- isting street rental agreement between the City and Grantee, shall be of no further force and effect. Alderman Graves reported that his Committee recommended the City sell to Bryan Hale a portion of land in the Clifton Heights Addition. It was moved by Alderman Graves, seconded by A lderman Brandon, to sell a portion of land north of Clifton Street to Bryan Hale for $600.00. Motion carried. Discussed at this time was the granting of rights to operate a small train concession at the City Park. It was generally agreed that the City receive .20� of each dollar taken from this concession. It was moved by Alderman Riggins, sec- onded by Alderman Murray, to grant Mr. Blair the right to operate a small train concession at the City Park for a period of one year. Motion carried. It was moved by A lderman Brandon, seconded by Alderman Reed, to buy 100 feet of concrete pipe to -place in the open ditch between Clinton Street and the Railroad. Motion carried. Alderman Murray reported that lights need to be installed at the City Air- port, that there are enough lights and underground cable on hand to do this. It was agreed this possibly could be installed by the City workmen. Alderman Murray reported that there is a need for something to be done about the flow of water from the Airstrip through the orchard. It was agreed.. that the City Street Department would handle this drainage problem. Alderman Murray, Chairman of the Airport Committee, reported that he could lease the 7.65 acres east of the centerline of a line running parallel to and 250 feet easterly of the centerline of -the present airport runwa y containing 7.65 acres and a tract of 14.33 acres lying westerly of a line running parallel to the centerline of the present airport runway and 250 feet westerly of such centerline being out of that certain 30 acres of land originally conveyed to Tom E. Denman and wife by deed recorded in volume 317, at Page 9, of the Deed Records of Erath County, Texas, for the sum of $400.00 annua lly, renewable each year at yhe option of the City and also at the option of Tom E. Denman, with the City having the right to refuse to renew such lease at the end of any term thereof. The matter was discussed by the Council and there being no ob- jections to the leasing of said land and the Council appearing to be unanimously in favor of making such lease, the Mayor authorized Dean Murray to proceed to negotiate such lease with Tom E. Denman. Alderman Higgins reported the Department of Public Welfare is consolidating the Dublin office with the Stephenville office and had asked the City to help pay rent for additional office space. It was moved by Alderman Riggins, seconded by A lderman Dickerson, to pay this additional rental for the Department of Public Welfare. Motion. carried. City Attorney Chandler read in full a proposed ordinance whereby the City would enter into--contract with the County for the purpose of fighting rural fires. It was moved by Alderman Reed, seconded by Alderman Graves, to adopt an ordinance a uthorizing the Mayor of the City of Stephenville to enter into contract with Erath County, acting through its 8ommissioners Court, to furnish fire fighting equipment consisting of one fire truck,and attached equipment, outside the City Limits of the City of Stephenville, Texas, providing for compensation to be paid, 0 The Council discussed the proposed plat for subdividing Lot 7, Block 45, gollege View Addition. The Council did not accept this proposal, at this time, since the streets are only 30 feet wide. Alderman Murray expressed appreciation for the cooperation of the Council during his term of office. He also made a report of expenses in connection with construction of the new runway at the Airport. Read and discussed was an ordinance creating a Joint Airport Zoning Board. This board to be made up of 5 members, 2 members to be appointed by the City Council, 2 members to be appointed by County Commissioners Court, and the 5th member to be elected by the appointed members of the board. It was moved by Alderman ftitt -ay;- -seconded by A lderman Dickerson, to adopt this ordinance creat- ing a Joint A irport Zoning Board to be known as the Stephenville Joint Airport Zoning Board and investing such joint board with the powers such boards are au- thorized to exercise under the provisions of Chapter 391 of the Acts of the regular session of the 50th Legislature, 1947. Motion carried. Alderman Murray reported that the advertisement for bids for constructing a hangar building did not set out any specifications, therefore the contractors could not bid on this. It was suggested that Mr. Riewe of Homer A. Hunter Associates, be contacted and find the cost of writing specifications on this building. Alderman Hedrick reported there are several business places asking for load- ing zones 8nd suggested that some charge be made for all loading zones. It was suggested the Law & Order Committee work out some plan on this and report back to the Council. Alderman Hedrick would also like for the Council to study plans for construc- ting a City Jail. Alderman Riggins reported that 6 months of the current budget year had passed and that most all the City Funds are in good shape, and by being conservative with spending the City should not have any financial difficulty this year. Alderman Brandon stated he appreciated all the cooperation of the Council dur- ing his term of office. It was moved by A lderman Dickerson, seconded by Alderman Brandon, to pass an ordinance finding and declaring Sloan Street; lying between the north line of Block 3 and the south line of Block 2, Park Place Addition in the City of Stephenville, to have been abandoned as a street and ordering same vacated and closed. Motion carried ( said ordinance being attached to and becoming a part of these minutes). It was moved by Alderman Brandon, seconded by Alderman Reed, to adopt the following resolution: RESOLUTION Resolved, that the Mayor, J. Louis Evans, is hereby authorized to execute for and on behalf of the City of Stephenville, a General Warranty Deed conveying to Gulf States Telephone Company the North one -half of Lot 6, in Block 12, of the Shappard & Collins Addition in the City of Stephenville, Erath County,.Texas, as said lot and block are shown on KingTs Revised Map of the City of Stephenville, Texas, for the consideration of $800.00 paid in cash by said Telephone Company to the City of Stephenville and which deed shall be attested by the City Secretary. Motion carried. It was moved by Alderman Reed, seconded by Alderman Dickerson, to adopt the following resolutions RESOLUTION Resolved, that the Mayor, J. Louis Evans, is hereby authorized to execute for and on behalf of the City of Stephenville a General Warranty Deed conveying to Step- henville Industrial Foundation, a non - profit organization, with the same restrictions and upon the same covenants and conditions as are set out in that certain deed to said Stephenville Industrial Foundation recorded in Volume 3601 page 30, of the Deed Records of Erath County, Texas, that certain land in said county described as follows: Being out of and a part of that certain 2 acres of land conveyed to said Step- henville Industrial Foundation by the City of Stephenville by deed recorded in Volume 360, page 30, of the Deed Records of Erath County, Texas, and specifically described as follows: Beginning at the S. W. C. of that tract of land described in said deed recorded in Volume 360, at page 30, of the Deed Recrods of Erath County, Texas, for the N. W. C. of this; Thence S. 30 deg. 37 min. E. 25 ft. to S. W. C. of this; Thence N. 60 deg. E. 216 ft. to West boundary of Harbin Drive for S. E. C. of -thisa Thence with West line of Harbin Drive 25 ft. to N. E. C. of this; Thence S. 60 deg. West 216 ft. to the place of beginning; and in consideration of Ten Dollars ($10.00) and other good and valuable consid- eration by Stephenville Industrial Foundation to the City of Stephenville and which deed shall be attested by the City Secretary. Motion carried. It was moved by Alderman Dickerson, seconded by Alderman Brandon, to transfer $2000.00 from the Water Works Operating Fund to the R & B Fund. Motion carried. It was moved by A lderman Graves, seconded by Alderman Dickerson, to notify Triangle Cheese Company that whey could no longer be dumped into the sewer line since it damages the function of the sewer plant. Motion carried.. Mayor Evans appointed Aldermen Murray and Dickerson as a committee to canvas the results of the City Election. This committee reported the election returns in order and the candidates received the following votes: J. Louis Evans---------------- - - - - -- 311 votes, Mayor. I. D. Reynolds---------------- - - - - -- 316 votes, Alderman Ward # 1. Walter Brandon---------------- - - - - -- 107 votes, Alderman Ward # 2. B. G. Lawrence---------------- - - -- -- 215 votes, Alderman Ward # 2. Raymond Anderson-------------- - - - - -- 314 votes, Alderman Ward # 3. Scott D. Reed----------------- - - - - -- 312 votes, Alderman Ward # 4. It was moved by Alderman Graves, seconded by Alderman Reed, that the report of the Committee be accepted and the payroll for holding the election be approved. Motion carried. The candidates receiving the highest number of votes being J. Louis Evans, Mayor; Alderman I. D. Reynolds Ward # 1; B. G. Lawrence Alderman Ward # 2; Raymond Anderson Alderman Ward # 3; and Scott D. Reed Alderman Ward # 4. These candidates were declared . elected, a motion put to a vote carrying unanimously. (Said election returns being attached to and becoming a part of these minutes). It was moved by Alderman Dickerson, seconded by Alderman Reed, to accept the proposed plat for subdividing Lot 7, Block 45, College View Addition. Motion carried. It was moved by A lderman Reed, seconded by Alderman Brandon, that bills and accounts be allowed and ordered paid. Motion carried. Cages, City Secretary, and with the following absent: Ratliff constituting a quorum of the City Council, at which time the following proceedings were had: Alderman Reed introduced an ordinance and made a motion that it be passed. The motion was seconded by Alderman Dickerson The motion carrying with it the passage of the ordinance prevailed by the following vote: AYES: Aldermen Reed, Dickerson, Murray, Hedrick, Brandon, Riggins, Graves, 'and Mayor Evans. NOES: None. The ordinance is as follows: AN ORDINANCE AMENDING AN ORDINANCE PASSED ON FEBRUARY 11, 1960, AUTHORIZING THE ISSUANCE OF $175,000.00 OF CITY OF STEPHENVILLE WATERWORKS, IMPROVEMENT WARRANTS, SERIES 1960, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: That the ordinance passed on February 11, 1960, authorizing the issuance of $175,000.00 of Waterworks Improvement Warrants, is hereby amended by adding thereto a new Section, to be designated, Section 13, which is as follows: "Section 13. In case of vacancy in the office of county judge, or the absence, failure or inability of that officer to act, the election returns shall be delivered to the county clerk of the county who shall safely keep the same in his office, and he, or the county judge, shall deliver the same to the Commissioners' Court on the day appointed by law to open and compare the polls. ARTICLE 8.32: BALLOTS AND COPY OF REPORT OF RETURNS DELIVERED TO COUNTY CLERK; ANNOUNCEMENT. Immediately after counting votes by the managers of the election, the presiding officer shall place all the ballots voted, together with one (1) poll tax list and one (1) tally list, into a wooden or metallic box, and shall securely fasten the box with nails, screws, or locks, the key or keys shall be delivered to the sheriff, as provided by law, and he shall immediately, in no case later than thirty -six (36) hours after the closing of the polls deliver said box to the county clerk of his county whose duty it shall be to keep the same securely. And it shall be unlawful for the county clerk or anyone else to burn or otherwise destroy these ballots and records, or permit it to be done, except where provided by law. Anyone violating the provisions of this Section upon conviction shall be fined not to exceed One Thousand Dollars ($1,000). Also, the presiding judge shall deliver a copy of the report of the returns to said county clerk, together with the ballot box, and the clerk shall immediately announce the returns of the election in the precinct reporting, and shall post said returns on a bulletin board within his office. In event of any contest growing out of election within six (6) months thereafter, the county clerk shall deliver said ballot box to any competent officer having process therefor, for any tribunal or authority authorized by law to demand such ballot box; provided that all questions arising at any election box shall be settled and determined by the presiding officer and judges, any law to the contrary notwithstanding. If no contest arise out of the election within six (6) months after the day of such election, said clerk shall destroy the con- tents of said ballot box by burning the same. ARTICLE 8.33: TO RETAIN POLL AND TALLY LISTS. The presiding officer shall retain in his custody one return sheet, one poll list and one tally list of the election, and shall keep the same for six (6) months after election, subject to the inspection of anyone interested in such election.
