December 7, 1965.
The City Council met in a regular meeting on the above date with Mayor Arthur
presiding and the following councilmen present: Robert Herrin, Mrs. Doyle White,
Roy Swain, Chas. Riggins, Bill Christian, Telefus B. Cawyer and Mrs. Fred McCleskey.
Others present were Dir. of Pub. Works Gann, Chief Cornell and City Attorney
Chandler.
Minutes of previous meetings were read and approved.
Mr. Dan Malone appeared before the Council stating that he and Mr. Klose will
give Lots IA, 2A and 3A, Block 3, Shappard & Vaddbak Addition to the City of Step -
henville, for Park purposes with certain conditions. It was moved by Councilman
Christian, seconded by Councilman Cawyer, to adopt the following resolution:
RESOLUTION
Resolved, that deed from Rolland M. Klose conveying to the City of Otephen-
Ville be accepted and that the lots conveyed, being Lots 1A, 2A and 3A, of Block
3, Shappard & Paddock Addition, City of Stephenville, not be used for concessions
and that it remain a Park Area,s.and should it cease to be used for Park purpose
or Drive or Street purpose that it revert to Grantor, his heirs or assigns.
Motion carried unanimously.
It was moved by Councilman Higgins, seconded by Councilwoman McCleskey, to
adopt the following resolution:
RESOLUTION
Resolved, that Jack Arthur, Mayor, be, and he is hereby authorized to execute
deed to Wayne Barham in exchange for land to be conveyed to the City of Stephenville
by Edd Brooks, Trustee, and being Lots 1, 2, 3, 3A, 4B, 5 and 6, of Block 1; a nd
Lots 1B, 2B and 3B, of Block 3, Shappard & Paddock Addition, Stephenville, Texas,
as shown on King's 1956 Map of Stephenville at page�0 and being the same land
conveyed by L. W. Bell and wife, to Edd Brooks, Trustee, by deed dated April 9,
3e 1965, and recorded in Volume 401 at page 58, Deed Records of Erath County, Texas.
It being understood that Wayne Barham is paying to the said Edd Brooks cash consider-
ation for the lands to be conveyed by said Brooks to the City of Stephenville, and
which deed shall provide that no lien is being retained by the City of Stephenville
and no lien is being retained by the said Edd Brooks, as Trustee, to secure any
warranty of title made by either grantor on the land being conveyed; the land being
conveyed from the City of Stephenville to the said Wayne Barham by general Warranty
Deed, being as follows:
Motion for above resolution carried unanimously (said resolution in full being
attached to and becoming a part of these minutes).
Mesdames Hickie, Martin, Rogers and Archer appeared before the Council to ask
that the Council clearly define the area to be used by the Study Club for a museum
on the Kight property. It was moved by Councilman Swain, seconded by Councilman
Herrin, to adopt the following .resolution:
RESOLUTION
Resolved, that Stephenville Study Club be authorized to take charge of rock
J( house on land conveyed to the City by Edd Brooks, Trustee, and that adequate space
be made available to said club for the operation of the rock house as a museum.
Motion for the above resolution carried unanimously.
Councilman Christian reported that there are two homes out of the City Limits
which are being served with City water and the lines need to be lowered to make way
for the new highway. After discussion, it was agreed that the City would not lower
the lines since they are private lines out of the City Limits.
Mr. Ermer W. Ferguson reported that the property owners on the south side of
the Square have been contacted and offered to give the vancant land in back of their
buildings for use as an alley. This property has some utility lines which will need
to be lowered. It was moved by Councilwoman White, seconded by Councilman Cawyer, to
accept deeds from the property owners for the above mentioned land, same to be used
as an alley. Motion carried.
Councilwoman McCleskey reported the Park Committee is not yet ready to make
recommendations on charges for use of chairs which are property of the Park Depart-
ment.

The Council discussed the possibility of granting Farmers Milling right to
use the City Easement in front of their property for installing platform scales.
The City Attorney pointed out the necessary action involved in granting this re-
quest. It was agreed to inform Farmers Milling Company that the request has been
denied and to explain to them the reasons.
The Mayor reported that B. F. Stafford has offered to give the City two tracts
of land for park purposes.
The Mayor also reported that Harlan Huey would like to buy the City owned land
at entrance of Greenview Addition. It was pointed out that Mr. Huey would have to
give up the lease on this property before it could be offered for sale. Then the
only way it could be sold would be advertised for bids, also any title the City
could give on this land might not be satisfactory.
It was reported the Santa Fe Railroad has promised to correct the drainage
problem at Methodist Branch. The Council asked Dir. of Public �Iorks to supervise
this project.
RESOLVED: That Jack Arthur, Mayor, be, and he is hereby, authorized
to execute deed to Wayne Barham in exchange for land to be conveyed to the
City of Stephenville by Edd Brooks, trustee, and being Lots 1, 2, 3 -A, 4 -B,
5 and 6 of Block 1 and Lots 1 -B, 2 -B and 3 -B of Block 3, Shapard & Paddock
Addition, Stephenville, Texas, as shown on King's 1956 Map of Stephenville at
page 850 and being the same land conveyed by L. W. Bell and wife to Edd Brooks,
Trustee, by deed dated April 9, 1965, and recorded in Vol. 401 at page 58, Deed
Records of Erath County, Texas, it being understood that Wayne Barham is paying
to the said Edd Brooks cash consideration for the lands to be conveyed by said
Brooks to the City of Stephenville, and which deed shall provide that no lien is
being retained by the City of Stephenville and no lien is being retained by the
said Edd Brooks as Trustee to secure any warranty of title made by either grantor
on the land being conveyed; the land being conveyed from the City of Stephenville
to the said Wayne Barham by general warranty deed, being as follows:
FIRST TRACT: 3,875 acres out of the John Blair Survey, Abst. 32,
being part of a 52 -acre tract conveyed to the City of Stephenville,
Texas, May,7, 1902, recorded in Vol. 73 at page 615, Deed Records
of Erath County, Texas, and described as follows:
BEGINNING at a point in the South line of said 52 -acre tract,
in the West line of Cleveland Avenue, from which pointthe S.W.
corner of a certain 8.96 -acre tract described in Warranty Deed
dated April 29, 1965, from Villa Fontana, Inc., to the City
of Stephenville, Texas, recorded in Vol. 401, page 16, said
records, bears N. 60 -00 E. 50.0 ft. for the S.E. Corner of this
tract;
THENCE N. 30 -00 W. with the East line of Cleveland Avenue 884.9
ft. to the point of intersection of said East line of Cleveland
Avenue and the South right of way of Highway 8, from which point
the N.W. Corner of said 8.96 acre tract bears S. 77 -44 E. 67.6
ft. for the N.E. Corner of this tract;
THENCE N. 77 -44 W. with the South right of way of said Highway 8
60 ft. from its centerline 236.5 ft. to a point in said South
- right of way for the N.W. Corner of this tract;
THENCE S. 30 -00 E. across said 52 -acre tract 1044.0 ft, to 'a
point in the South line of said 52 -acre tract for the S.W.1:
Corner of this tract;
THENCE N. 60 -00 E. with the South line of said 52 -acre tract
175.0 ft. to the place of beginning, containing 3.875 acres;
SECOND TRACT: 8.96 acres of land out of a 52 -acre tract conveyed
to the City of Stephenville May 7, 1902, Vol. 73, page 615, by
J. H. Cage, out of the John Blair Survey, Abst. 32, said land
being formerly known as the Old City Dump Ground, and located
in the Northwest part of Stephenville, Erath County, Texas, a-
long F. M. Highway 8 between Garfield and Cleveland Avenue and
BEGINM NG in the S.B.L. of said 52 -acre tract where it intersects
with the W.B.L. of Garfield Avenue, an iron pin by the side of
a fence corner post N. 30 -00 W. 25 £t. from the N.E. Corner of
Lot 1, Block L, of the Chamberlin Addition for S.E.C. of this;
THENCE N. 30 -00 W. 85.2 ft. along the W.B.L. of Garfield Avenue
to its intersection with the S.B.L. of F. M. Highway 8, known as
the Lingleville road, to an iron pin for N.E.C. of this;
THENCE along the South right of way line of F.M. Highway 8 and
60 ft. from its centerline in a Westerly direction along a curve
to the right whose radius is 1015.4 ft. and whose central angle
is 21 -04 373.3 ft. to a hexagon- shaped ash stake;
THENCE continuing along the South right of way line of F.M.
Highway 8 and 60 ft. from its centerline N. 87 -44 W. 792.8 ft.
to its intersection with the E.B.L. of Cleveland Avenue,an iron
pin, for the N.W.C. of this;
THENCE S. 30 -00 E. 839.5 ft. along E.B.L. of Cleveland Avenue
to a channel iron stake on S.B.L. of said 52 -acre tract, and
being the S.W.C. of this;
THENCE N. 60 -00 E. 886.0 Ft. to the place of beginning;

Being the same land conveyed by the City of Stephenville
to Villa Fontana, Inc., by deed dated April 3, 1963, and
recorded in Vol. 389, page 546, of the Deed Records of Erath
County, Texas.
Said deed shall be attested by the City Secretary and delivered to Wayne
Barham upon the delivery to the City of general warranty deed from Edd
Brooks, Trustee, conveying that property hereinabove mentioned.

The City Secretary reported the V. F. W. wants to buy the land in front of their
building. The Council ask the Secretary to notify V. F. W. that the land would have
to be advertised for bids and would probably be very high.
The Council received one bid for Depository of City Funds, this being the bid
of The Stephenville State Bank. The Mayor and Chas. Higgins excused themselves
and asked that Councilman Swain preside while this bid was being considered. It was
moved by Councilman Herrin, seconded by Councilman Christian, to accept the bid of
The Stephenville State Bank as Depository for City Funds for the ensuing year.
Motion carried unanimously.
It was moved by Councilman Swain, seconded by Councilman Herrin, that an or-
dinance be published in the Stephenville Daily Empire making a part of the City of
Stephenville land adjacent to said City and out of the J. B. Dupuy Survey, Abstract
196, and being 13.609 acres of land which adjoins the present city limits of the
City of Stephenville, and which ordinance describes said land by metes and bounds;
that such publication notice be given in accordance with Section 5 of Article 1, of
the City Charter of Stephenville, Texas, this ordinance will be finally acted upon
at a meeting of Phis council to be hold at least 30 days after such publication;
and any citizen of '>tephenville, or of the territory to be annexed, and which is
hereinabove described shall have the right to contest such annexation by filing with
the City a written petition setting out their reasons for such contest and such
citizens shall be given the opportunity to be heard before said ordinance in the
form hereinabove set out,or in any form to be amended by this Council,shall be
acted upon. Motion carried unanimously.
