January 28, 1965
The City Council met in a called meeting on the above date with Mayor Cook pre-
siding and the following councilmen present:
Hubert Darby, Mrs. Fred McCleskey, E. Lee Orbison, Charles Riggins, Roy Swain, Bill
Christian, W. H. Stem, and Mrs. Doyle White.
It was moved by Councilman Stem, seconded. by Councilman Swain to adopt the
following resolution:

Resolved., that the City Attorney Joseph A. Chandler be, and, is hereby directed.
to file suits on condemnation for pipe -line right -of -way easements, against the
following defendants relative to land. owned by them as shown below:
Nachtigall tract- Robert R. Nachtigall and wife Maxine Nachtigall & Veterans Land Board
a strip of land 20 feet wide and about 1320 feet long, running about S 25 E across
64.53 acres out of the H. C. Hudson Survey, Abstract No. 342, in Erath County, Texas
said 64.53 acres being part of the land. described. in the assignment of contract to --
Robert R. Nachtigall d.ated.March, 1963, and. of record. in Vol. 389, page 518, in the
deed. records of Erath County, Texas, said. strip crossing the South line of said
tract about 973 feet S 60 W from the S.E. Corner of the Nachtigall land, and. as
surveyed and. marked. on the ground. by Homer A. Hunter & Associates in June, 1964•
Ott Miller and wife Mary L. Miller tract
a strip of land 20 feet wide and. about 386 feet long, running about S 25 deg E across
the land of said. Ott Miller and. being a part of that certain 11.061 acres out of
the H. C. Hudson Survey, Abstract No. 342, in Erath County, Texas, which. was conveyed.
to said. Miller and wife by deed. dated. Aug 5, 1963 and of record in Vol. 391, page 370

a strip of land 20 feet wide and. about 2198 feet long running about S 25 deg E across
that certain 1411 acres out of the H. C. Hudson Survey, Abstract No. 342, in Erath
County, Texas, which was conveyed. to Hamilton Gaines by deed. dated Jan. 7, 1947 and
of record. in Vol. 300, page 15, in the Deed Records of Erath County, Texas, said
strip crossing the North line of said. 1411 acre tract about 973 feet S 60 deg W
from the N.E. Corner of said Gaines land, and as surveyed and. marked on the ground

R. C. Wise and wife Edythe E. Wise.
a strip of land. 20 feet wide and about 654 feet long running about S 25 deg E across
that certain 126.22 acres out of the H. C. Hudson Survey, Abstract No. 342, in Erath
County, Texas, which was conveyed to R. C. Wise by deed dated. Jan. 14, 1939 and of
record. in Vol. 257, page 105, in the Deed. Records of Erath County, Texas, said, strip
crossing the South line of said Wise land about 638 feet Westerly from the S. E..
Corner of said Wise land., and as surveyed. and marked on the ground.iby Homer A. Hunter

H. L. Olson and. wife Betty Lee Olson
a strip of land 20 feet wide and. about 1,118 feet long running about S 25 deg E
across that ceryain 130.4 acres out of the H. C. Hudson Survey, Abstract No. 342,
in Erath County, Texas, which. was conveyed to H. L. Olson and wife Betty Lee Olson
by deed dated. July 3, 1963, and of record. in Vol. 390, page 622, in the Deed Records
of Erath County, Texas, this tract crossing the North line of said.Olson land. about
638 feet Westerly from the N.E. Corner of said Olson land, and as surveyed. and,
marked. on the ground by Homer A. Hunter & Associates in June 1964, and. including
any land which might be occupied: and. claimed. by said Olson which. is a part of the

We, the undersigned officers of said City, hereby certify
as follows:
1.. The City Council of said City convened in
REGULAR MEETING ON THE 5TH DAY OF JANUARY, 1965,
at.the City Hall, and the roll was called of the duly,consti-
tuted officers and members of said City Council, to -wit:

thus constituting a quorum. Whereupon, among other business,
the following was transacted at said Meeting: a written

was duly introduced for the consideration of said City Council
and read in full. It was then duly moved and seconded that said
Resolution be adopted; and, after due discussion, said motion,
carrying with it the adoption of said Resolution, prevailed and
carried by the following vote:

1 2. That a true, full, and correct copy of the aforesaid
Resolution adopted at the Meeting described in the above and
j foregoing paragraph is attached to and follows this Certificate;
that said Resolution has been duly recorded in said City Council'
minutes of said Meeting, that the above and foregoing paragraph
is a true, full, and correct excerpt from said City Council's
minutes of said Meeting pertaining to the adoption of said Res -
olution; that the persons named in the above and foregoing para-
graph are the duly chosen, qualified, and acting officers and
members of said City Council as indicated therein; and that each
of the officers and members of said City Council was duly and
sufficiently notified officially and personally, in advance, of
the time, place, and purpose of the aforesaid Meeting,'and that
said Resolution would be introduced and considered for adoption
at said Meeting, and each of said officers and members consented,
in advance, to the holding of said Meeting for such purpose.
3. That the Mayor of said City has approved, and hereby
- approves, the aforesaid Resolution; that the lx,, or and the City
Secretary of said City have duly signed said Resci•:zion; and that
the Mayor and the City Secretary of said City hereby declare that
their signing of this Certificate shall constitute the signing of
the attached and following copy of said Resolution for all

RESOLUTION
APPROVING ESTIMATE NO. 2 OF TEXAS WATER
WELLS, INC. ON CONSTRUCTION OF WATERWORKS
IMPROVEMENTS.
WHEREAS, on September 1, 1964, the City Council of
the City of Stephenville, Texas, passed an Ordinance, which,
among other things,.authorized the issuance of $310,000 of
City of Stephenville Waterworks Improvements Warrants, Series
1964, for the purpose of paying for waterworks improvements to
be constructed under Contracts "A ", "B" and "C "; and
WHEREAS, Contract "B" has been partially performed
and the Contractor, Texas Water Wells, Inc., has filed a
request for payment designated "Estimate No. 2 ", as follows:
Test Hole No. 1 As specified $ 4,500.00
Test Hole No. 2 based on 450' $ 4,500.00
Deduct 50' @ $4.00 per foot 200.00
Deduct cores and formation test 821.00
Net Test Hole No. 2. 31479.00
Test Hole No. 3 based on 450' $ 4,500.00`

WHEREAS, the foregoing estimate has been approved by
Homer A. Hunter Associates, Consulting Engineers for this City,
and this City Council has fully investigated the wor'-c performed
and materials furnished and has found that the contract has
been satisfactorily performed to the extent shown in the fore-
going request; and

WHEREAS, this City Council has been furnished with
satisfactory evidence that all laborers and materialmen have
been paid down to the date of said request; and
WHEREAS, Warrants should now be delivered to said
Contractor as hereinafter provided;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE,
TEXAS:
1. That the above Estimate No. 2 is hereby approved
and the City Council of the City of Stephenville hereby finds

and declares that said contract has been satisfactorily per-
formed and materials furnished in accordance with said contract,
plans and specifications to the extent shown in said estimate
and that the City of Stephenville has received full value to

the amount there shown.
2. That, for the purpose of evidencing the City's
indebtedness to said Contractor, the City Secretary is hereby
j directed to deliver to Texas Water Wells, Inc., Warrants Numbers

25 through 31, .aggregating $7,000.
3. That the balance of $376.90 shall,be_ retained by
the City and carried forward pending the next warrant.delivery
under said contract,

An Ordinance approving certain Rate Schedules filed by
Texas Power & Light Company in the City of Stephenville-,
Texas, and providing conditions under which such Rate
Schedules may be changed, modified, amended or withdrawn:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

SECTION 1: That Texas Power & Light Company, having
filed on the 5 day of Jan. 19 65 ,
its Rate Book No. , containing a set of electric
Rate Schedules and the Service Regulations referred to
therein, with the City Secretary, the same are hereby
approved as Schedules of Rates and Service Regulations
under which said Company is authorized to collect charges
from its customers for the sale of electric power and
energy within the corporate limits of the City until such
time as said Rate Schedules and Service Regulations may
be changed, modified, amended or withdrawn with the
approval of the City Council.
SECTION 2: The filing of the Rate Schedules and
Service Regulations, and the approval of same by the City
Council, in the manner herein provided, shall constitute
notice to the consumers of electricity, within the City,
of the availability and application of such Rate Schedules
and Service Regulations.
SECTION 3: This Ordinance shall take effect and
be in full force and effect from and after the date of
its passage and approval by the Mayor.

Section One
The alley shown to run from the North line of Block 39 to the South
line thereof in Frey First Addition in the City of Stephenville as shown at
page 784 of King's 1956 Map of Stephenville and being 8 feet in width is hereby
declared to have been abandoned for alley purposes and this alley is hereby
ordered vacated and closed as an alley.
Section Two
W. E. Cook, Mayor of the City of Stephenville, Texas, is hereby
authorized and directed to execute to A. B. Hutchinson for the sum of $25.00
paid to the City of Stephenville, a quit claim deed covering the alley shown
to be 8 feet in width running from the North line of Block 39 to the South line
thereof in Frey First Addition in the City of Stephenville, which quit claim
deed shall convey the right, title and interest of the City of Stephenville to
said A. B. Hutchison:;.. and which deed shall be attested by the City Secretary of

South and shown to be 20 feet in width, is hereby declared to have been a-
bandoned for alley purposes and said alley is hereby ordered vacated and closed
as an alley.
Section Two
W. E. Cook, Mayor of the City of Stephenville, Texas, is hereby
authorized and directed to execute a quit claim deed in consideration of the
payment to said City of the sum of $25.00 to the Westerly 10 feet of such alley
where it adjoins Lot 1 -A of Block 14 and running Southerly a distance of 164
feet to L. P. Wakefield, the Westerly 10 feet of such alley as it adjoins Lott- _;C',.
running 116 feet to the North line of West Shirley Street to R. W. Hufstetler,
the Easterly 10 feet of such alley running from the South line of West Frey
Street as it adjoins Subdivision 1 of Lot 7 in Block 13 of Shapard & Collins.
Addition and running Southerly a distance of 140 feet to J. E. Moser and the
Easterly 10 feet of such alley as it adjoins Subdivision 4 of Lot 8 of Block 13
of said Addition running a distance of 140 feet to the North line of West Shirley
Street to Mrs. I. Cain; which quit claim deed shall convey the right, title and
interest of the City of Stephenville to said persons named in the portions of
said alley adjoining their said lots, and which deed shall be attested by the
City Secretary of the City of Stephenville and the seal of the City affixed

Motion for the above resolution carried. unanimously.
Councilman Swain reported that a representative of Bryant - Curington Company would
like to meet with the Council in regard. to the comprehensive planning survey.
