October 4, 1966
- The City Council met in a regular meetin on the above date with Mayor Arthur
presiding and the following Councilmen present: Robert Herrin , Mrs. Doyle White,
Roy Swain, Charles Riggins, Wm. Irwin, Telefus B. Cawyer, Raymond Anderson, and
Mrs. Fred McCleskey; others present were: Chief Cornell, Street Supt. Collins,
Fire Marshall Ferguson and City Attorney Chandler.
Minutes of previous meetings were read and approved.
Mr. Youngblood, representing Chamber of CommerceCommunity Development Committe,
appeared before the Council.reporting that the.Chamber Committee is planning to sell
signs to the various churches. The signs will direct persons to the churches. The
committee asked permission to place signs on city owned property and asked city crews
to install the signs.
The Council discussed this, pointing out that city crews are very busy and can -
not make any promises to install the signs. It was moved by Councilman Herrin ,
seconded by Councilman Riggins, to grant permission to install the signs, subject
to approval of Law and Order Committee. Motion carried.
Mr. Bill Davidson appeared before the Council and asked to buy a 10 foot strip
of land that lies between his property and Harbin Drive. Mr. Davidson plans to sell
his property and the purchaser needs this strip of land in order that he will have
access from that direction.
City Attorney Chandler stated that the City cannot sell this .land due to the
fact that it is a city street and is being used as a street. Mr. Chandler pointed
out that anyone purchasing property owned by Mr. Davidson would have right to use
the 10 foot strip of land to gain access to such property as it is a public street.
Councilman Herrin -; reported that recently there have been several cases of
breaking and entering. The Police Dept. is doing a good job with a limited number
of policemen.;
Councilman Irwin reported that some of the city streets are being repaired.
The retopping of Frey St. has been completed and is in real good shape.
Councilman Anderson reported that the Water Committee has not had a chance to
meet and make any final recomendations on change of water rates. There have been
suggestions made as follows; increase the minimum in the amount of 25 cents and
increase price after 109000 gallons to 35 cents per thousand.
After discussion it was moved by= Councilman`Anders.on , se_conded;;by Councilman
McCleskey that the water rates be raised from $2.50 to $2.75 minimum for 3,000
gallons, ales the rate be raised from 25 cents to 35 cents per thousand gallons
after 10,000 gallons have been used. These rates to be effective with December 15,
1966 reading. Motion carried unanimously.
Councilman Anderson also reported a need to do something about the destroying
of city meter boxes, and the filling of meter boxes with dirt. It was agreed tha
in the future when anyone damages or destroys city meter boxes or city property,
they will be required to pay for such damages.
The Mayor read a letter from Mr. Virgil Yoakum requesting to lease the City
Cemetaries. The Council discussed this proposal but no action was taken.
The Mayor asked the Cemetary Committee to make a study of the prices being
charged for grave spaces and report their recomendations back to the Council.
Councilman Cawyer reported that persons on College Farm Road who live East of
the river want city sewer service. It was explained there would be no way to put
this on sewer unless the property owners want to pay for the lines and a lift station.
Councilwoman McCleskey reported that a large number of persons are taking part
in all activities of the park and recreation program.
Councilman Riggins reported there are some complaints of trailer houses being
set up in residential sections. It was agreed to refer this to Zoning Commission
and Adjustment Board for study and report.
Councilman Riggins also reported that owners of Dawson Property would like to
complete the sale of their property to the City. The Council agreed to contact Mr.
Taylor Allmon about the money for the purchase of this property.

The Mayor reported that several complaints have been received from residents
of a water problem being created by the construction of the Chateau Apartments.
It was noted that this is private property and therefore would not be a city
problem.
It was moved by Councilman Irwin, seconded by Councilman Herrin to transfer
the necessary funds. Motion carried unanimously.
It was moved by Councilman Anderson, seconded by Councilwoman McCleskey to .
transfer each month $670.00 from Water Works Operating Fund to Water Works Im-
provements Warrants 1964 Fund. Motion carried unanimously.
It was moved by Councilman Anderson, seconded by Councilman Irwin to
transfer $1,370.00 each month from Water Works Operating fund to Water Works
Inprovements Warrants fund. Motion carried unanimously.
It was moved by Councilwoman MCCleskey, seconded by Councilman Riggins to
transfer $6,000.00 from Cemetary Fund to Savings account. Motion carried unanimously.
It was moved by Councilman Swain, seconded by Councilman Riggins to adopt
an ordinance granting permission to C. C. Pemberton to transfer and assign franchise
granted him by City Council of City of Stephenville to furnish garbage collection
and disposal service to residents of the City of Stephenville. Such transfer
and assignement to be made to Harlan Huey and granting to the said Harlan Huey
increase in rates for such service and extending term to period of ten years from
date of this ordinance. Motion carried. (ordinance attached to and becoming a
part of the minutes.)
It was agreed to advertise for bids on some junk iron and junk trucks.
The Council discussed the annual report prepared by Blanche Davis.
It was moved by Councilman Riggins, seconded by Councilman Herrin to express
thanks to Miss Davis for this and all past reports. Motion carried unanimously.
There being no other business at this tim/1" e Council stood adjourned sub-

AN ORDINANCE GRANTING PERMISSION TO C. C. PEMBERTON TO TRANSFER AND ASSIGN
FRANCHISE GRANTED HIM BY CITY COUNCIL OF CITY OF STEPHENVILLE TO FURNISH
GARBAGE COLLECTION AND DISPOSAL SERVICE TO RESIDENTS OF THE CITY OF STEPHEN -

TERM FOR PERIOD OF TEN YEARS FROM DATE OF THIS ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
Section One
C. C. Pemberton is hereby granted permission and consent to transfer
to `i3a a�z Huey franchise granted to C._C. "Pembe�n by the City Council of the
City of Stephenville to furnish garbage collection and disposal service to the
residents of the City of Stephenville and permitting the use of the streets,
alleys and public ways for the purpose of ,furnishing and p
such franchise being dated 6ac r wd -M.3, and recordedifn the lminutes ofrthee
meeting held on that date of this City Council.
Section Two
Said franchise shall remain exactly as granted to-E, C. Pemberton with
the exception of the extension of time for a period of ten years from this date
and permission to raise rates as hereinafter set out. Harlan--Huey shall take
such transfer and take the place of'C. C -. Pemberton in said franchise and will
be responsible to fully perform under the terms of said franchise and subject
to all the terms and conditions thereof.
Section Three
The rates and charges for the service of collecting and disposing of
garbage and refuse to be made by'Har1an - -..H',1--_y are fixed and determined as follows:
(a) $2.00 per month for pickup from residential premises;
(b) $2.65 per month for pickup and disposal from business
and commercial premises. This is a minimum and may
be increased by agreement if amount above average.
Above rates are,aubject_,to change by action of the City Council either upon

Section Four
The term of the franchise,„as assigned to Harla�y by e C,_.Pem3aer-
tvn shall begin on the 1st day of-- .October, - 1966, and shall extend for a period
of ten years thereafter, subject to the provisions herein set out.
Section Five
As provided in the original franchise, it cannot be assigned by
Harlan -Huey without the written consent of the City Council of the City of
Stephenville.
