HomeMy WebLinkAbout1967-12-05 - Regular City CouncilStephenville, Texas December 5, 1967 The City Council met in a regular meeting on the above date with Mayor Arthur presiding and the following council members present: Mrs. Doyle Whitey Garlan Loudermilk, Charles Riggin's, W. M. Irwin, telefus Cawyer, Raymond Anderson, and Mrs. Fred McCloskey. Others present were: Director of Public Works Gann, Chief Cornell, Fire Marshall Ferguson, and City Attorney Chandler. Minutes of previous meetings were read and approved. Councilman Irwin reported that the paving of Lennox, Dodge and Pearl streets is Al being done and will be complete in a few days if the weather stays good. Also the streets in the Kingland Addition have been resurfaced. Councilman Irwin also reported that Street Superintendent Harvey Collins will retire the first of January. There is a needoto hire fastreet superintendent. It was recommended that the city hire C. C. Hard'ey Collins to work part time by the hour. Also that Mr. Collins be paid $2.50 per hour. Director of Public Works Gann stated that he will recommend C. C. Booth for the iob of Street Superintendent. It was moved by Councilman Irwin and seconded by Councilman Riggins to hire C. C. Booth for Street Superintendent at a salary of $500.00 per month beginning January 1, 1968. Motion carried unanimously. It was moved by Councilman Cawyer and seconded by Councilman McCloskey that the following resolution by adopted: Resolution of Commemoration, Harvey Collins It was called to the attention of the City Council that Harvey Collins, Superintendent of City Streets Department, was retiring after more than twenty years of service ()F� to the City as street maintenance, foreman and a` Superintendant of City Street Department. Thereupon the following resolution as introduced and upon vote unanimously carried: Resolved, that this City Council express to H�irvey Collins on behalf of the City of Stephenville, this Council and all prior City Councils during,.zthe tenure of his service, grateful and sincere appreciation for his ability and consistent -- application of his work and that the streets of Stephenville have reflected and will for years to come reflect his substantial contribution to the progress and welfare of the City and its citizens: Be it further resolved, that this resolution be spread upon the Minutes of the City Council and a certified copy thereof delivered by the City Secretary to Harvey Collins. Councilman Anderson reported that th.e Water Department is in good shape and has very few problems at this time. councilman Loudermilk stated that the vote by the citizens to adopt the 1% clay sales tax shows the confidence of the citizens in the City Council. Councilwoman McCleskey reported that all activites of the recreation department have had large attendance. A lso reported a need to build a place for the tractor and equipment at the City Park. This is not a bugeted item, but maybe able to take some of the budget money of arts and crafts for this purpose. Mayor stated that we should be able to salvage enough material from the Higginbotham Lumber Yard building for this purpose. Also a need to decide on a location for such building was brought up. Councilman Riggins atated that the work on the square is almost complete and lots of compliments are being received and , of course, a lot less complaints. The Council discussed the problem of watering of shrubs on the square and the sweeping of the places that cannot be swept by the street sweeping machine. The Council asked City Secretary to try to handle the problems of watering shrubs and sweeping the necessary places on the square; Chief of Police reported that some problems in the moving of traffic have been created by the new traffic lights and allowing of left turns at some intersections. -- It is believed if the lights on Washington Street are set to change at the same time and. no left turns allowed at some intersections, the traffic would move better. The Council authorized Chief of Police to place above recommendations into effect. Chief of Police also gave a report on the number of accidents, amount of property damage, and number of arrests made this year as compared to last year. This report shows approximately same number of accidents that property damage is a lot less than last year. There have been an increase in the number of arrests this year. Mr . Don Almon appeared before the'Council and presented ordinances as follows: Approving estimate Number 4 of City Electric Co, for Courthouse square improvements in the amount of $5,558.31, and authorizing issuance of wa0rants Number 161 through 165 in the amount of $1000.00 each plus certificate for $558.31, also approving estimate Number 4 of Williams and Young for Courthouse Square improvements in the amount of $11,850.53 and authorizing issuance of wanrants Number 166 through 176in the amount of $1000.00 each plus certificate for 850.53. It was moved by Councilwoman McCleskey and seconded by Councilman Arderson to ad-opt orrd inances approving above esti- fates. The :notion carried unanimously. (Said ordinances being attached to and becoming a part of these minutes). Mayor appointed Councilwoman White, and McCleskey, and Councilman Riggins as a committee to canvass the result of the City election. This committee reported the elections returns in order. It was moved by Council Riggins and seconded by Councilwoman McCleskey to adopt a r resolution and order canvassing returns and declaring results of special election held in the City of Stpehenville, Texas'on the 5th day of December, 1967, on the question of adoption of a 1% local sales and use tax within the City. Motion carried. (Said resolution being attached to and becoming a part of these minutes.) City Secretary reported that in the part.the City has paid Erath County for - feeding of prisioners at the rate of '3.00 per day. There has been a bill of considerable size presented by the County for feeding prisioners; Which has not been paid as it ig beleived the charge is too high. The County has now agreed to reduce this to V1.75 per day, and the figure appears to be reasonable. The Council discussed the equalization beard for the coming year and it was agreed to hire E. A. ulanchard and C. E. Skiles, these persons to make a recommendation to the Council for the other Board member. The Council asked that the Coard and Tax Collecter do the necesaary work to raise the evaluations of property that is too low. The Board to use all the time needed to throughly complete this work. That a true, full and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and fore- going paragraph is attached to and follows this Certificate; that said Ordinance has been duly recorded in said City,Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said City Council's minutes of said Meeting pertaining to the passage of said Ordi- nance; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said City. Hunter Associates, Consulting Engineers for this City, and this City Council has fully investigated the work performed and materials furnished and has found that the contract has been satisfactorily performed to the extent shown in the foregoing request; and WHEREAS, this City Council has been furnished with satisfactory evidence that all laborers and materialmen have been paid down to the date of said request; and WHEREAS, Warrants should now be delivered to said Contractor as hereinafter provided; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: 1. WHEREAS, there was held in the City of Stephenville, Texas, on the 5th day of December, 1967, an election at which there were submitted to the duly qualified resident electors of said City, for their action thereupon, the following propositions: FOR adoption of a one percent (1 /) local sales and use tax within the city. AGAINST adoption of a one percent (1 /) local sales and use tax within the city. and WHEREAS, there were cast at said election 1,223 votes, of which number there were cast: FOR adoption of a one percent (1 %) local sales and use tax within the city. 894 votes AGAINST adoption of a one percent (1 %) local sales and use tax within the city. 329 votes Majority FOR adoption of a one percent (1 %) local sales and use tax within the city. 565 votes as shown in the official election returns heretofore lawfully submitted to the City Council of the City of Stephenville, Texas, and filed with the City Secretary of said City; and WHEREAS, only duly qualified resident electors of said city voted at said election, and said election was called and held in strict conformity with the laws of the State of Texas: now therefore BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: Section 1. That the election described in the preamble to this resolution and order was duly called and notice thereof given in accordance with law; that said election was held in the manner required by law; that only duly qualified resident electors of the City of Stephenville, Texas, voted at said election; that due returns of said election have been made by the proper officers; that said election resulted favorably to the proposition: FOR ADOPTION OF A ONE PERCENT (1 %) LOCAL SALES AND USE TAX WITHIN THE CITY: and that a majority of the qualified voters of said City of Stephenville, Texas, voting at said election, have iaoted in favor of approving and adopting a One Percent (1%) Local Sales and Use Tax within said City. That the City Secretary is hereby authorized and directed to transmit to the Comptroller of Public Accounts of the State of Texas, in Austin, Texas, by United States Registered Mail, or by United States Certified Mail, a certified copy of this Resolution and Order Canvassing the Returns of Special Election, under the official seal of the City of Stephenville, Texas, -u 10 showing approval of said Local Sales and Use Tax by the qualified voters of said City, together with a map of said,City, clearly showing the boundaries thereof as of the date of said election.
