October 3, 1967
The City Council met in a regular meeting with Mayor Pro Tem Herrin presiding and
the following members present: Mrs. Doyle White, Garland Loudermilk, Charles Riggins,
W. M. Irwin, Telefus Cawyer, Raymond Anderson, and Mrs. Fred McCloskey.
Others present were Director of Public Works Gann, Chief of Police Cornell, Fire
Marshall Ferguson and City Attorney Chandler.
Mrs. Dorothy Pittman appeared before the council and asked questions aboilf the zoning
ordinance. What does zoning mean? What protection does zoning offer for home owrws?
Mr. Mark Geeslin appeared before the Council and stated that he is in favor of
rezoning a part of Block 34 South Side. In Mr. Geeslin opinion the proposed
development would be an asset to the City and neighborhood.
Messrs. W. C. Ammons and Morris Couch stated they are in favor of the rezoning.
Mr. E. A. Blanchard, member of the Zoning Commission and Adjustment Board,
explained briefly the zoning ordinance and the purposes of zoning. It was then
moved by Councilman Irwin, seconded by Councilman Riggins that the zoning of
part of Block 34 South Side Addition fronting on loop 195 to a depth of 350
feet along South Lillian and South Second Street be rezoned to Business 2, 7111
the remaining part of Block 34 to remain zoned Residence 1, for construction
as per letter and plot plan. Should Construction not begin within one year,
the property to revert to Residence 1. Motion carried unanimously.
Mrs. Effie Walker appeared before the Council and asked that the charges for
water and sewer at the apartment house be reduced. The Council took no action.
Mr. Dan Allmon appeared before the Council and presented ordinances as follows:
Approving estimate Number 1 of Williams and Young for Counthouse Square
improvements in the amount of $13,245.25, and authorizing issuance of Warrants
Number 11 through 83 in amount of $1,000.00 each plus certificate for $245.25.
Also approving estimate Number 1 of City Electric Company for Courthouse Square
improvements in the amount of $5,057.53, and authorizing issuance of Warrants
Number 84 through 88 in the amount of $1.000.00 each plus certificate for $57,33.

Also approving payment for engineering services for Courthouse Square improve -
ments in the amount of $13,931.36 and authorizing issuance of Warrants Number 89
through 101 in the amount of $1,000.50 each , plus certificate for $931.36. Also
approving estimate Number 2 of Williams and Young in the amount of $9,422.47 and
authorizing issuance of Warrants Number 102 through 110 plus certificate for
$422.47. Also approving estimate Number two of City Electric Company in the
amount of $22,735.73 and authorizing issuance of Warranty Number 111 through 132
in the amount if $7,000 each plus certificate for $735.73.
It was moved by Councilman Riggins and seconded by Councilman Irwin to adopt
ordinances approving estimates Number l of Williams and Young, City Electric
Company, and Homer A. Hunter Engineers. Motion carried ununimously.(said
ordinances being attacked to and becoming -a part of there minutes.)
It was moved by Councilman Loudermilk and seconded by Councilwoman McClesky
to adopy ordinances approving estimates Number 2 of Williams and Young, and,
City Electric Company. Motion carried unamimously. (Said ordinances being
attached to and,becoming a part of there minutes.)
Councilman Loudermilk reported that a meeting was held with Harlan Huey to
discuss the garbage service. Mr. Huey feels that garbage service should be,
made compulsory of all persons in the City. He also assured the Committee that
top wages are paid garbage workmen and the personeil are the best that he can
hire.
City Attorney Chandler suggested that the Council check with Texas League of
Municipalities and other cities on the legal angle of compulsory garbage service,
and ways this is being handled in other cities.
Councilman Irwin reported that the College Farm Road has been repaired, Bingham
Street resurfaced, and most streets have been graded since the resent rain.
Also that the source of securing coliche is no longer available. Asked for any
suggestion for securing coliche for future use.
Director.;bf Public Works reported that one of the City Wells is located near
Albritton residence and these persons are claiming the heavy pumping. of the
City well caused their well to fail with result that $60.00 was spent to
lower their pump. They asked the City to pay this bill. No action was taken.
Mr. Gann also reported that the Water Department employees turned the water
off at 216 Devine Street to repair a leak in the meter box. The Water Department
employees stated that the property owners were notified that the water would
be off for repairs. However the owner of a beauty shop at this address claims
no one notified her of the water being turned off. As a result the beauty shop
owner is asking the City to pay $10.00 for loss during the period the water was
off. The Council asked City Secretary to write a letter to the beauty shop owner.
Councilwoman McCleskey reported that all activities of the Park and Recreation
Department have had good attendance.
It was moved by Councilwoman McCleskey and seconded by Councilwoman White
that the Council reaffirm their previous opinion on use of the sale barn at
the City Park. Motion carried unamimously.
The following bid received for two new cars for the Police Department:

Difference -------- $4090.00
It was moved by Councilman Irwin and seconded by Councilman Riggins to accept
the bid of Jones Chevrolet Company. Motion carried unamimously.
It was reported that the blinker lights for the highway intersections have been
purchased and should be here in about two weeks.
It was reported that W. B. Hale has made a request to buy some
Heights Addition. Mayor a q Y property in Clifton
Hei
9 y appointed Councilman Anderson and Cawyer as a committee
to check on this.
The Council was presented the annual report of the Water Department and requested
it be of record that Mrs. Joyce Pemberton be commended for preparing this find report.
A bid was received from Stephenville - State: Bank for keeping of City funds. It
was moved by Councilman Irwin and seconded by Councilman Anderson to accept the
bid of Stephenville State Bank as depository of City funds for the ensueing year.
The motion carried unamimously.
There being no other business at this time, the Council stood adjourned subject
to the - Mayor's call.

APPROVING ESTIMATE NO, 2. OF WILLIAMS
& YOUNG CONSTRUCTION CO, FOR COURTHOUSE
SQUARE IMPROVEMENTS
WHEREAS, on June 23, 1967, the City Council of
the City of Stephenville, Texas, passed an Ordinance, which,
among other things, authorized the issuance of $240,000 of
City of Stephenville Street Improvement Warrants, Series 1967,
for the purpose of paying part or all of the Engineer's fees
and inspection and testing fees, paying for the purchase of
land and right of way for street purposes and the cost of ac-
quiring same, paying.for street improvement work to be done by
the City, and paying for legal and financial advisory services
in connection with the issuance of said warrants, and Contracts
"A'!, "B" and "C "; and
WHEREAS, Contract "A" has been partially performed

WHEREAS, the foregoing estimate has been approved
by Homer A, Hunter Associates, Consulting Engineers for this
City, and this City Council has fully investigated the work
performed and materials furnished and has found that the
contract has been satisfactorily performed to the extent
shown in the foregoing request; and
WHEREAS, this City Council has been furnished with
satisfactory evidence that all.laborers and materialmen have
been paid down to the date of said request; and
WHEREAS, Warrants should now be delivered to said
Contractor as hereinafter provided;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE,
TEXAS:
1. That the above Estimate No. 2 is hereby approved
and the City Council of the City of Stephenville hereby finds
and declares that said contract has been satisfactorily per-
formed and materials furnished in accordance with said contract,
plans and specifications to the extent shown in said estimate
and that the City of Stephenville has received full value to
the amount there shown.
2. That for the purpose of evidencing the City's
indebtedness to said Contractor, the City Secretary is hereby
directed to deliver to Williams & Young Construction Co., War-
rants Numbers 102 through 110, plus a certificate as authorized
by Section 13 of the ordinance passed on June.23, 1967, in the

3. The item of indebtedness above listed is incurred
for a purpose for which said Warrants are authorized, to -wit:

WHEREAS, on June 23, 1967, the City Council of

City of Stephenville Street Improvement Warrants, Series 1967,

City, and this City Council has fully investigated the work

WHEREAS, on June 23, 1967, the City Council of the
City of Stephenville, Texas passed an Ordinance which, among
other things, authorized the issuance of $240,000 of City of
Stephenville Street Improvement Warrants, Series 1967, for
the purpose of paying part or all of the Engineer's fees
and inspection and testing fees, paying for the purchase of
land and right of way for street purposes and the cost of ac-
quiring same, paying for street improvement work to be done by
the City, and paying for legal and financial advisory services
in connection with the issuance of said warrants, and Contracts

WHEREAS, said Warrants are numbered from 1 through
