The City Council met in a regular meeting on the above date with Mayor Arthur
peesiding and the following council members present: Robert Herrin, Mres Doyle
White, Garland Loudermilk, W. M. Irwin, Charles Riggins, Telefus Cawyer, Raymond
Anderson, and Mrs. Fred McCleskey.
Others present were Director of Public Works Gann, and Fire Marshall Ferguson.
Minutes of previous meetings were read and approved.
Councilman Herrin reported that the Highway Department has given approval to
installing of flashing lights at the intersections of Highway 281 and 377, also at
Highway 281 and Loop 195. The cost of these lights has not been determined.
Councilman Irwin reported that the street committee has checked on the paving of 0ak
Street between McCart and Paddock streets and find that this must have curb and
gutter also. The property owners have been contacted and some will not,pay for curb.
The street committee has also considered the possibility of a new street east of
Graham and find that such street would be very expensive. Also have considered the
improvement of Belknap street and find this will create some additional problems.
Mayor discussed the problem of unpaved streets and the need to get these streets
fixed. It was 4xplained that the City cannot pave, curb and gutter and take a
lein on each individual parcel of property unless the property owners are agreeable.
Mayor asked council members to think about this problem and offer any suggestions.
The council asked City Secretary to check with the City of Lubbock and find how they
handle assessment on property owners for paving, curb and gutter.
The council had no objections to allowing the Highway Department to abandon Harbin
Drive as a farm road if such request is made.
Councilman Anderson reported that the well in the new well field is back in service.
There are two of the old wells out of service at this time. The pumps are worn out
and will be repaired or replaced as soon as possible.
Councilman Anderson presented the following recomendations on the sale of lots in
the East and West End Cemeteries."

Local residents from $50.00 to $100.00 per lot.
Outside City Limits from $75.00 to $150.00 per lot.
Also that $50.00 from each local resident lot sale and $100.00 from each oui
limits lot sale be placed in a savings account with the City Depository, an(
both sums have increased to $500.00 and for each $500.00 thereafter, city tc
in deposit certificate drawing as much interest that is possible to obtain,
recommend that only the interest from such deposit certificate be used to a:
maintaining both comemkea cemeteries.
It was moved by Councilman Anderson, seconded by Councilwoman McClekkey tha-
recommendations be accepted and placed into effect immediately. Also a loci
be defined as persons within the city limits. Motion carried unanimously.
Councilman Loudermilk brought up for discussion the use of radar by the pol.
department and the giving of tickets for overspeed. Mr. Loudermilk feels V
will be discouraged from coming to the city if we are too strict on enforcei
speed laws, and urged the council to refrain from anything that would disco
people from coming to the city.
Chief of Police reported that 134 warning tickets have been issued using th
machine. Chief also reported the need to do something about the increasing
of traffic accidents.
E The council discussed this and agreed to table this until the Chairman of L
Order Committee is present. Mayor asked all council members to be thinking
the amount of fine for overspeeding.
Councilwoman McCleskey reported that a full program is in operation at the
I large numbers of reunions are being held now. Also asked that streets in t
be oiled in effort to stop the excessive dust.
Councilwoman White reported that the fire department does not have radio co
at the station now. The equipment has been disconnected from the police ra
was discovered that the unit at the fire station was causing failure fm of
radio.
It was agreed that the fire committee , Mr. Ferguson and Cates would work o
problem of radio equipment in the fire deparMent.
It was reported that the Study Club has asked the city to connect water and
to the building on East Washington. The council asked Mr. Gann to take car
these connections. The Council adjourned until 7 o'clock P. M.

The council reconvened with Mayor Arthur presiding and all members present.
It was moved by Councilwoman McCleskey, seconded by Councilman Cawyer to advertise
for bids for gasoline, kerosene and diesel for the coming year. Motion carried un-
animously. The following bids received for tractor and mower:

1. The City Council of said City convened in
SPECIAL MEETING ON THE 23RD DAY OF JUNE, 1967,
at the City Hall, and the roll was called of the duly consti-
tuted officers and members of the said City Council, to -wit:

Council and read in full. It was then duly moved and seconded
that said Ordinance be passed; and, after due discussion, said
motion, carrying with it the passage of said Ordinance, prevailed

2. That a true, full and correct copy of the aforesaid
Ordinance passed at the meeting described in the above and

is a true, full and correct excerpt from said City Council's
minutes of said meeting pertaining to the passage of said Ordi-

ACCEPTING BIDS FOR THE CONSTRUCTION OF
STREET IMPROVEMENTS, AWARDING CONTRACTS
PURSUANT THERETO, AND AUTHORIZING THE
ISSUANCE OF CITY OF STEPHENVILLE STREET
IMPROVEMENT WARRANTS, SERIES 1967

CITY OF STEPHENVILLE
WHEREAS, the City Council of the City of Stephenville,
Texas, has heretofore determined that it is to the best interest
of the City to furnish and install street improvements; and
WHEREAS, the City Council has heretofore on the 15th
day of May, 1967 adopted a resolution authorizing and directing
the Mayor to give Notice to Bidders for the purpose indicated
herein, which notice is in words and figures as follows, to -wit:

NOTICE TO BIDDERS
Sealed proposals addressed to the Mayor and Councilmen of the City
of Stephenville, Texas, will be received at the office of Mr. Rex
Cates, City Secretary., until seven o'clock on June 6th
1967 for furnishing and installing street improvements as follows:
CONTRACT "A"
Courthouse Square and Appurtenances $2,000.00 Bid Bond
CONTRACT "B"
Traffic Signal System and underground
Electrical Conduits $4,500.00 Bid Bond
CONTRACT "C"
Parking Meters $ 500.00 Bid Bond
Bidders must submit with their bids a Cashiers or Certified Check
payable to or endorsed, without recourse, to the City of Stephenville,
Texas, or a Proposal Bond in the same amount, from a reliable Surety
Company, as a guarantee that Bidder will enter into a contract and
execute bond and guarantee forms provided within five (5) days after
notice of award of contract to him. Bids without check or proposal
bond will not be considered.
In accordance with Chapter 93, Acts of the 56th Legislature, which
became effective April 27, 1959, the successful Bidder will be re-
quired to furnish not only a performance bond in the amount of the
contract, but also a payment bond in the amount of the contract,
for the protection of all claimants supplying labor and materials
as defined in said law. The bonds must be executed by an approved
Surety Company holding a permit from the State of Texas to act as
Surety and acceptable according to the latest list of companies
holding certificates of authority from the Secretary of the Treasury
of the United States, or other Surety or Sureties acceptable to the
Owner.
All unit prices must be stated in both script and figures. The
Owner reserves the right to reject any or all bids and to waive forma-
lities. In case of ambiguity or lack of clearness in stating the price
in the bids, the Owner reserves the right to consider the most ad-
vantageous construction thereof, or to reject the bid. Unreasonable .
or unbalanced unit prices will be considered sufficient cause for
rejection or any bid or bids.

Instructions to Bidders, Proposal Forms, Specifications, Plans and
Contract Documents may be examined at the office of Mr. Rex Cates,
City Secretary, City Hall, Stephenville, Texas, and may be obtained
at the office of Homer A. Hunter Associates, Consulting Engineers,
5630 Yale Boulevard, Dallas, Texas 75206, upon deposit of $25.00 as a
guarantee of the safe return of the plans and specifications.
Deposit will be returned provided:
(1) The Bidder return the plans and specifications within
72 hours after the bid date;
OR
(2) The Non - Bidder return the plans and specifications in
good condition 72 hours prior to bid date;
OR If the above is not complied with, the entire $25.00
deposit will be forfeited and no refund made.
Suppliers may obtain Specifications and Plans at the address stated
above upon deposit of Fifteen ($15.00) Dollars which sum is non-
refundable.
It is the intention of the City Council to issue the time warrants
of the City of Stephenville for payment of a part or all of the
Contracts to be made pursuant to this notice, and to pay part or all
of the Engineer's fees and inspection and testing fees,
to pay for-the purchase of land and right of way for street
purposes and the cost of acquiring same, to pay for street
improvement work to be done by the City, and to pay for
legal and financial advisory services in connection with the
issuance of said warrants. The maximum amount of time
warrant indebtedness to be incurred for said purposes shall
be $240,000, the maximum rate of interest such time warrants
.are to bear is 5z7 per annum, and maturing not more than
twenty years after their date. The City has obtained
a commitment from an investment company for the purchase of
said warrants from the Contractor, so that said warrants
shall be delivered to the Contractor on approved estimates
and the Contractor will immediately deliver said warrants
to said investment company and receive in cash the par
value therefore

WHEREAS, said notice has been duly published in the
"Stephenville Daily Empire ", a newspaper published in the City
of Stephenville, Texas in its issues of May 17, 1967 and May 24,
1967; and
WHEREAS, no petition for a referendum election has
been filed with the City Council as permitted under the pro-
visions of Chapter 163, Acts of the Regular Session of the
Forty- Second Legislature, known as the "Bond and Warrant Law
of 1931 "; and
WHEREAS, on June 6,.1967,`the':day set in-said notice,
the City Council of said City opened and read the bids filed
pursuant to said notice; and
WHEREAS, after opening said bids, the City Council of
said City found that the following were the successful bidders:
CONTRACT "A" - William & Young Construction Company,
Stephenville, Texas;
CONTRACT "B" - City Electric Company,
Stephenville, Texas;
CONTRACT "C" - Duncan Parking Meter Corporation,
Elk Grove, Illinois;
and that the above bidders filed the lowest and best bids and
are the lowest responsible bidders;
BE IT ORDAINED BY'THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE:
1. That the following bids be and are hereby accepted
by the City of Stephenville, Texas:

commence and complete the construction of certain improvements described as follows:

of the Agreement and at his (or their) own proper cost and expense to furnish all the materials,
supplies, machinery, equipment, tools, superintendence, labor, insurance, and other accessories
and services necessary to complete the said construction, in accordance with the conditions and
prices stated in the Proposal attached hereto, and in accordance with the Notice to Contractors, .
General and Special Conditions of Agreement, Plans and other drawings and printed or written
explanatory matter thereof, and the Specifications and addenda therefor, as prepared by
herein entitled the ENGINEER, each of which has been identified by the CONTRACTOR and
the ENGINEER, together• with the CONTRAC'TOR'S written Proposal, the General Conditions
of the Agreement, and the Performance and Payment Bonds hereto attached; all of which are made
a part hereof and collectively evidence and constitute the entire contract.

3. That Contract "A" be awarded to William & Young
Construction Company subject to negotiation of a Change Order
for change of parking adjacent to the Courthouse and .the store
sides of Belknap Street and College Avenue.
4. That Contract "C" be awarded to Duncan Parking
Meter Corporation subject to a Change Order for number of meters
to be installed by reason of proposed change of parking.
5. That the warrants of the City of Stephenville,
Texas, to be called "City of Stephenville Street Improvement
Warrants, Series 1967 ", be issued under and by virtue of the
Constitution and laws of the State of Texas in the amount of
$240,000, for the purpose of paying part or all of.the Engineer's
fees and inspection and testing fees, paying for the purchase of
land and right of way for street purposes and the cost of ac-
quiring same, paying for street improvement work to be done by
the City, and paying for legal and financial advisory services
in connection with the issuance of said warrants.
6. That said Warrants shall be numbered 1 through
240, shall be of the denomination of $1,000 each, shall be dated
July 1, 1967, and shall become due and payable serially on July 1 j
of each of the years as follows:

7. Said Warrants shall bear interest from their date
at the rate of 5 -1/4% per annum, evidenced by coupons payable
July 1, 1968, and semi - annually thereafter on each January 1

8. That the principal of and interest on said
Warrants shall be payable at the Farmers -First National Bank,
Stephenville, Texas, in lawful money of the United States of
America, upon presentation and surrender of warrant or proper
interest coupon, without exchange or collection charges to the
owner or holder thereof.
9. Said Warrants shall be signed by the Mayor and
countersigned by the City Secretary, and the seal of the City
shall be impressed upon each of them. The facsimile signatures
of the Mayor and City Secretary may lithographed or printed
on the coupons attached to said Warrants, and said printed or
lithographed signatures shall have the same effect as if they
had been executed manually by said officers.
10. That the form of Warrants shall be substantially

The City of Stephenville, in the County of Erath,
State of Texas, acknowledges itself indebted to, and promises to
pay to the bearer hereof on the 1st day of July, 198_, the sum ofl
ONE THOUSAND DOLLARS
in lawful money of the United States of America, with interest
thereon from the date hereof at the rate of 5 -1/4% per annum,
evidenced by coupons payable July 1, 1968, and semi - annually
thereafter on January l and July l of each year, and the City
Treasurer is hereby authorized, ordered and directed to pay to
bearer said principal sum together with interest thereon
evidenced by coupons hereto attached, both principal and interest
payable at the Farmers -First National Bank, Stephenville, Texas,
without exchange or collection charges to the owner or holder
hereof. The full faith and credit of the City of Stephenville,
Texas, and all of the taxable property in said City are hereby
irrevocably pledged for the prompt payment of the principal of
this warrant at maturity and the interest thereon as: it accrues.
This warrant is one of a series of 240 warrants of
like tenor and effect, except as to number and maturity, num-

$1,000 each,..aggregating $240,000, issued for the purpose of
paying part or all of the,Engineer's fees,and inspection and
testing fees,paying for the purchase of land and right of way
street purposes and the cost of acquiring same, paying for
street improvement work to be done by the City, and paying for
legal and financial advisory services in connection with the
issuance of said warrants, under and by virtue of the Constitu-
tion and laws of the State of Texas, and pursuant to an ordinance
passed by the City Council of the City of Stephenville, Texas,
duly recorded in the minutes of said City Council.
The date of this warrant in conformity with the
ordinance above mentioned is the 1st day of July, 1967.
AND IT IS HEREBY CERTIFIED AND RECITED that the issu-
ance of this warrant and the series of which it is a part is
duly authorized by law and that all acts, conditions and things
required to be done precedent to and in the issuance of this
series of warrants and of this warrant have been properly done
and performed and have happened in regular and due time, form
and manner as required by law, and that the City of Stephenville
has received full value for this warrant; that due provision has
been made for levying and collecting annually by taxation an
amount sufficient to pay the interest on these warrants as it
falls due and to provide a sinking fund for the,final redemption
of said warrants at maturity; that the issue of warrants of
which this is one, together with all indebtedness of said City,
is within every debt and other limit prescribed by the Con-
stitution and laws of the State of Texas.

lawful money of the United States of America, without exchange
or collection charges to the bearer, upon presentation and
surrender of this interest coupon, at the Farmers -First National
Bank, Stephenville, Texas, said amount being interest due that
day on the warrant, bearing the number hereinafter designated,
of that issue of City of Stephenville Street Improvement Warrants

12. Said warrants, in the authorized amount of
$240,000, shall be printed, and with the printed or lithographed
coupons attached, shall be executed by the Mayor and counter-
signed by the City Secretary. The warrants thus executed shall
be placed in the custody of the City Secretary and shall be
delivered in installments, as and when and in the amount
necessary from time to time, to the contractors and persons
furnishing labor, services, materials, equipment and land,
and the engineers on said project, or to assignees of such
contractors, persons or engineers. Under no circumstances
shall any of said warrants be delivered by the City except
for the purposes for which they are authorized. A finding by
the City Council that a specific item of indebtedness was in-
curred for a purpose for which said warrants are authorized
shall be conclusive when contained in an ordinance passed by
the City Council.
13. After claims and estimates shall have been
approved by the City Council for any purpose for which said
warrants are authorized the Mayor and City Secretary shall issue
and deliver to each claimant an amount of warrants not exceeding
the amount of the claim, and, for any amount not covered by such
delivery of warrants, a certificate in substantially the

14. As and when said certificates shall have been
accumulated from time to time in amounts not less than $1,000,
and when requested by the holder of said certificates, the City
Council will pass an ordinance describing said certificates and
authorizing the delivery of said warrants in an amount not
exceeding the amount of the accumulated certificates, specifying
by numbers the warrants to be delivered in exchange for said
certificates. Credit balances may be carried in favor of said
bank for succeeding installment deliveries. On the occasion
of the final installment delivery the City shall make cash
adjustment with said bank out of funds available therefor.
15. On the occasion of each exchange of warrants for
certificates, both the City and the bank shall execute receipts,
each in favor of the other, to show the surrender to the City
and the receipt therefor of said certificates and the delivery
by the City and receipt therefor of said warrants.
16. That a special fund to be designated "City of
Stephenville Street Improvement Warrants, Series 1967 Fund" is
hereby created and the proceeds from all taxes collected for and
on account of this series of warrants shall be credited to said
fund for the purpose of paying the interest as it accrues and to
provide a sinking fund for the purpose of paying each install-
ment of principal as it becomes due, and said fund shall be used
for no other purpose. For each year while any of said warrants
or interest thereon are unpaid, there shall be computed and
ascertained, at the time other taxes are levied, the rate of
tax based on the latest approved rolls of said City as will be
requisite and sufficient to make, raise and produce in each of
said years a fund to pay the interest as it accrues and to pay
the principal as it matures, or to provide at least 2% of the
principal as a sinking fund, whichever is greater, full
allowances being made for delinquencies and costs of collection.
A tax at the rate as hereinabove determined is ordered to be
levied and is hereby levied against all of the taxable property
in said City for the current year and for each year hereafter
while said warrants or any of them are outstanding and unpaid,
the said tax each year shall be assessed and collected and
placed in the fund hereby created and the Treasurer shall honor
warrants against said fund for the purpose of paying the interest
on and principal of said warrants and for no other purpose.
17. The assignees of said claims and the holders of
said warrants are hereby subrogated to all rights which the
persons to whom the original warrants were issued had against
the City of Stephenville.
18. The Mayor and City Secretary are hereby ordered
to do any and all things necessary to accomplish the transfer of
said moneys to the interest and sinking fund of this issue in
ample time to pay such items of principal and interest.
Councilman Irwin reported that a member of the Garden Club had called stating all
35 members of this club are opposed to parallel parking on the square.
The council again discussed the issuing of tickets for speeding when using the radar
equipment.
It was moved by Councilman Herrin, seconded by Councilman Riggins, that the minimum
fine be $10.00, and an additional $1.00 per mile per hour be added to the fine over
40 miles per hour. The above rates of fines to apply to tickets given while using
radar equipment only. Motion carried by a vote of 7 for and 1 against,
Councilman Herrin reported yhat the cost of blinker lights for highway intersections
will be $225.55 per light plus cost of installation.
It was moved by Councilman Herrin, seconded by Councilwoman McCleskey that the city
buy and install the bouncing ball tupe of blinker lights at the intersections of
highway 281 and 377, also at highway 281 and Loop 195. Motion carried unanimously.
