February 6, 1968
The City Council met in a regular meeting on the above date with Mayor Arthur
presiding and the following Councilmembers present: Robert Herrin, Mrs. Doyle
White, Garlan Loudermilk, Charles Riggins, W. M. Irwin, Telefus Cawyer, Raymond
Anderson, and Mrs. Fred McCleskey.
Others present were: Director of Public Works Gann, Fire Marshall Fergerson, Chief
Cornell and City Attorney Chandler.
Minutes of previous meeting were read and approved.
Mr. Jim Ragan appeared before the Council asking the City to pay for damages to his
car in the amount of $35.00. Mr. Ragan stated that while driving on Hyman street
a sewer manhole cove7p came off, struck his car underneath and sprung the front door
and fender.
City Attorney Chandler stated that the City is not liable for damages in such
cases, as this is something that could not be helped by the city.
There being no action by the Council it was considered that the claim of Mr. Ragan
was denied.
Councilman Herrin reported that the signal lights have been installed at the inter-
section of Loop 195 and Highway 281. Also work has started on installing signals
at the intersection of Highways 377 and 281.
Councilman Irwin reported that considerable work has been done on streets in the
Belmont Addition. The street department is now patching holes caused by the recent
heavy rain.
Councilman Anderson asked if anything is going to be done about the paving on the
squard. It was reported that the engineers were here this week and the paving will
be redone as soon as the weather is suitable.
Councilman Anderson reported that a large number of plastic bags and containers have
gotten into the facilities at the sewer plant. This has caused the failure of the
pump and is a very serious matter.
It was moved by Councilman Cawyer and seconded by Councilwoman White that the City
Attorney prepare an ordinance prohibiting the placing of anything in the City sewer
that is insoluble. The Motion carried unanimously.
Councilman Cawyer reported that some persons have expressed a desire to buy the
trash hauling business from Harlan Huey, and have asked the City to change the
franchise.to include some additional things.
The Council was agreeable to the transfer of the franchise but only if the wording
will remain the samecas present franchise.
Councilman Loudermilk reported that the auditor is in the process of doing the audit
for -one year. There is an urgent need to bring all city audits up to date.
Councilwoman McCleskey reported that all activities of the recreation program have
large attendance. Also the old barn has been torn down at the Park and plans are
being made to make a parkin7, lot on the site.
Councilman Herrin reported that dogs without proper City license are being picked up
and Council members will possibly be getting calls.

AN ORDINANCEis AMENDING SUBSECTION (10) OF SECTION 1, OF ARTICLE 1 IN
CHAPTER 2 OF THAT CERTAIN ORDINANCE OF THE CITY OF STEPHENVILLE KNOWN AS THE
"PLUMBING CODE" OF THE CITY AND PROVIDING THAT THIS ORDINANCE SHALL BE
EFFECTIVE IMMEDIATELY AFTER PUBLICATION AS PROVIDED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
Section One
Subsection (10) of Section 1 of Article 1 in Chapter 2 of the
Plumbing Code of the City of Stephenville, Texas, being the ordinance re-
corded in Volume H at Pages 50A- etseq. of the minutes of the City Council of
Stephenville, Texas, is hereby amended to read as follows:
(10) That portion of the house drain underground and
extending to the property line to be service weight
cast iron soil pipe coated with asphaltum:- or coal
tar pitch. No. 1 Vitrified clay tile may be used
from a point thirty -six inches (36 ") (3feet) outside
of foundation or structure to the tap provided by the
City; joints in the tile to be of hot pour, jiffy
joint, approved compound or a half- and -half mixture
of mortarsand and portland cement.
Section Two
That portion of the Plumbing Code hereby amended is changed as above
set out and from.the effective date of this ordinance saidsubsection as herein -
above set out shall be in lieu of and take the place of said Subsection 10 as
same now appears in the Plumbing Code of the City of Stephenville in Section 1
of Article 1 in Chapter 2 thereof.
Section Three
This ordinance shall become effective after publication as required
by the City Charter of Stephenville, Texas.

Councilwoman White reported that plans are not yet, complete for a new fire station ,
but should be ready in the near future.
It was moved by Councilman Riggins and seconded by Councilwoman White to adopt the
following resolution:
RESOLUTION:
Whereas, certain real property owned by the United States of America consisting of
what was formerly the Post Office Building in the City of Stephenville and being
the building and the grounds on which it is located and described as lots 1 and 2
of Block 22 in the City of Stephenville, Texas, as shown on Kingts 1956 map of
Stephenville, located in County of Erath, State of Texas, has been declared surplus
and is subject to disposal by the Secretary of Health, Education and Welfare; and
Whereas, the City of Stephenville, a Municipal Corporation, is in need of said
Property and can utilize said for a public library building; and
Whereas, it is the desire of the City Council of the City of Stephenville, the governing
authority of the City of Stephenville, to submit an application to the United States
Government for acquisition of the property under the provisions of Section 203
(K) (1) of the Federal Property and Administrative Services Act of 1949(53 Sta.
as amended, and regulations and procedures promulgated thereunder; 377)
Now, Therefore, Be It Resolved by the City Council of the City of Stephenville,
Texas, that Jack Arthur, Mayor of the City of Stephenville , or his successor in
Proper official of said City of
function, be and he is hereby designated as the pro
Stephenville, by whom negotiations for such acquisitions are to be prosecuted; he is
hereby duly authorized to do any and all things necessary and proper to procure
acq_usition of, and to accept the prop arty approved for transfer by the Department
of Health, Education, and Welfare; an ed he is hereby appointed to submit annual
utilization reports on the property as required by the Department of Health, Education
dnd Welfare for the City of Stephenville.
Be It Further Resolved that the City of Stephenville is ready, willing and able,
and is hereby authorized to pay all external administrative expenses incident to
the transfer of said property; to assume the expenses of commencing and operating
the peoposed program of use; and assume immediate care and maintenance thereof.
Be it Further Resolved that three certified copies of this Resolution be furnished
to the Regional Representative, Division of Surplus Property Utilization Department
of Health Education and Welfare as evidence of the official action of the City
Council of the City of Stephenville, Texas, a municipal corporation, in authorizing
the application for,and acquisition of said property.
Motion for above Resolution carried unanimously.
The Mayor reported that Dr. J. C. Terrell, owner of property in front of City Hall,
has offered to remove the house and lease the lot for a public narking lot.
It was moved by Councilman Herrin and seconded by Councilman Irwin to furnish the
labor to )9ave the lot in front of the City Hall: provided Church of Christ will
furnish maTerial to pa- >e the lot. Also the property owners -.ive a 15 year lease
on the lot for public parking, and that the lease be subect to
The motion carried unanimously. j Council approval.
A letter from B. F. Stafford was presented; this 14as a request that the City assist
in improving a street in the Kingland Addition.
It was pointed out that the City has a new policy on building streets, it was asked
that Mr. Stafford be notified of the Policy change.
A letter from Mr. Hugh Wolfe requesting that the restrictions on the golf course be
changed. This was referred to the committee for study and recommendation.
It was moved by Councilman Anderson and seconded by Councilwoman McCleskey that
the annual City election by called to be '_held on Anril 2, 1968, in accordance with.
Election Ordinance on Page 86 -Q, Minute Book F, and the State Statute Procedure
for use of the secret rn lot. The Election being called for the purpose of electing
a Mayor and 1 Councilman for each place Numbers 2, 4, 6, 8 to serve a 2 year term
Of office. The motion carried unanimously.
It was moved by Councilman Irwin and seconded by Councilman Cawyer that Homer Stephen
be appointed Election Judge, Mr. Stephen to select his assistants. The motion
carried unanimously.
The Council asked that Councilman Riggins, City Attorneys
negotiate with the Industrial Foundation for right of w land 0on$ the cNorth yLoop.
It was moved by Councilman Riggins and seconded by Councilwoman McCleskey to adopt
the following Resolution:,

RESOLUTION:
RESOLVED, TT?AT the Mayor of the City of Stephenville, Jack Arthur, be, and
is hereby, authorized to execute on behalf of the City of Stephenville Quit
Claim Deeds to land condemned for highway right of way purposes and in which
judgment was taken for the fee simple title to said land so condemned in the
name of the State of Texas and the City of Stephenville and being as follows:

and said deeds will be Quit Claim in form and will describe said land as same is
described in the deeds and judgments conveying title from the owners to the City
of Stephenville and the State of Texas.
The motion carried unanimously.
There being no other business at this time, the Council stood adjourned subject to
the Mayor's call.
