The City Council met in a called meeting on the above date with Mayor Arthur pre-
siding and the following council members present: Robert Herrin, Don Metsgar,
Garland Loudermilk, Chas. Riggins, W. M. Irwin, Jack Curtis and Raymond Anderson.
Mayor explained the purpose of the meeting is to consider bids on water works im-
provements. The following bids received Contract A:

CITY OF STEPHENVILLE
Each of the undersigned City Officials of the City
of Stephenville, Texas, hereby acknowledges and certifies
that he was duly and sufficiently notified in advance that a
Special Meeting of the City Council of said City would be
held on the 10th day of April;1969,for the purpose of consider-
ing and adopting a resolution directing the publication of
notice to bidders, and that he consented to the holding of
said meeting for such purpose.

2. The City Council has ascertained and hereby
finds that the general prevailing rate of per diem wages in
the City of Stephenville and in Erath County, for work similar
to that to be performed under the contracts to be awarded
pursuant to said notice is as set out in the foregoing
prescribed form of notice.
3. Said notice shall be published in the "Stephen-
ville Empire Tribune ", a newspaper of general circulation
published within the City of Stephenville, on the same day of
each of two consecutive weeks, the first publication being
at least fourteen days prior to the date set for received
bids as shown in the form of notice above described.

Resolution be adopted; and, after due discussion, said motion,
carrying with it the adoption of said Resolution, prevailed and
carried by the following vote:

2. That a true, full and correct copy of the aforesaid
Resolution adopted at the Meeting described in the above and fore
going paragraph is attached to and follows this Certificate; that
said Resolution has been duly recorded in said City Council's min
utes of said Meeting; that the above and foregoing paragraph is a
true, full and correct excerpt from said City Council's minutes o
said Meeting pertaining to the adoption of said Resolution; that
the persons named in the above and foregoing paragraph are the
duly chosen, qualified and acting officers and members of said
City Council as indicated therein; and that each of the officers
and members of said City Council was duly and sufficiently noti-
fied officially and personally, in advance, of the time, place an
purpose of the aforesaid Meeting, and that said Resolution would
be introduced and considered for adoption at said Meeting, and
each of said officers and members consented, in advance, to the

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE, TEXAS:
1. That the Mayor of the City of Stephenville,
Texas, is hereby authorized and directed to issue a notice
to bidders in substantially the following form:

of Stephenville, Texas, will be received at the office of Mr. Rex
Cates, Director of Finance, until 3:00p.m.o'clock, on May 13th, 1969,
for furnishing and installing water system improvements as follows:

bidders must submit with their bids a Chasiers or Certified Check payabl
to or endorsed, without recourse, to the City of Stephenville, Texas,
or a Proposal Bond in the same amount, from a reliable Surety Company,
as a guarantee that Bidder will enter into a contract and execute bond
and guarantee forms provided within five (5) days after notice of award
of contract to him. Bids without check or proposal bond will not be
considered.
In accordance with Chapter 93, Acts of the 56th Legislature, which be
came effective April 27, 1959, the successful Bidder will be required to
furnish not only a performance bond in the amount of the contract, but
also a payment bond in the amount of the contract, for the protection of
all claimants supplying labor and materials as defined in said law. The
bonds must be executed by an approved Surety Company holding a permit
from the State of Texas to act as Surety and acceptable according to the
latest list of companies holding certificates of authority from the
Secretary of the Treasury of the United States, or other Surety or Sureti s
acceptable to the Owner.
All unit prices must be stated in both script and figures. The Owner
reserves the right to reject any or all bids and to waive formalities.
In case of ambiguity or lack of clearness in stating the price in the
_ bids, the owner reserves the right to consider the most advantageous
- construction thereof, or to reject the bid. Unreasonable or unbalanced
unit prices will be considered sufficient cause for rejection of any
bid or bids.

Bidders are expected to inspect the site of the work and to inform
themselves regarding local conditions and conditions under which
the work is to be done.
Not less than the prevailing rate of per diem wages for work of
similar character in the City of Stephenville, and County of Erath,
'and not less than the general prevailing rate of per, diem wages
for legal holidays, Saturdays, Sundays and overtime work shall be
paid to all laborers, workmen and mechanics employed in said City and
County on the above project.
The City Council of the City of Stephenville has ascertained and here
specifies such general prevailing rate of per diem wages in said City

the office of Hunter Associates, Inc., Consulting Engineers, 5630 Yale
Boulevard, Dallas, Texas 75206, upon deposit of $25.00 as a guarantee
of the safe return of the plans and specifications.
Deposit will be returned provided:
(1) The Bidder return the plans and specifications within
72 hours after the bid date:

(2) The Non - Bidder return the plans and specifications in
good condition.72 hours prior to bid date;
OR
(3) If the above is not complied with, the entire $25.00
deposit will be forfeited and no refund made. .

Suppliers may obtain Specifications and Plans at the address stated
above upon deposit of Fifteen ($15.00) dollars which sum is non -
refundable.
It is the intention of the City Council to issue the time warrants
of the City of Stephenville for payment of a part or all of the con -
tract to be made pursuant to this notice, and to pay part or all of
the Engineer's fees and inspection and testing fees. The maximum
amount of time warrant indebtedness to be incurred for said purpose
shall be $ 415,000.00 , the maximum rate of interest such time warrants
are to bear is Q/ _ per annum, and the maximum maturity date
thereof shall be Ju89. The City has obtained a commitment from
an investment company for the purchase of said warrants from the Con -
tractor, so that said warrants shall be delivered to the Contractor on
approved estimates and the Contractor will immediately deliver siad
warrants ,to said investment company and receive in cash the par value
therefor.

NOTICE OF INTENTION TO
ISSUE REFUNDING B0NDS
NOTICE is hereby given that on.the 7th day
of January, 1969, the City Council of the City of
Stephenville, Texas, will pass an ordinance author-
_ izing the issuance of Refunding Bonds in the amount
of $224,000, bearing interest at a rate not to
exceed 5 -1/4% per annum,.maturing serially in such
installments and during such years as may be deter-
mined by the City Council, the maximum maturity or
final maturity to be not later than 1989, for the
purpose of taking up, cancelling, refunding and in
lieu of a like amount of interest bearing time warrants
described as follows:
City of Stephenville Street Improvement
Warrants, Series 1967, dated July 1, 1967,
numbered 1 through 224, in the aggregate
amount of $224,000, bearing interest at the
rate of 5 -1/4% per annum and maturing
serially on July 1 in each of the years
1981 through 1984.
This notice is given in accordance with the
provisions of Chapter 163, Acts of the Regular Session
of the Forty - Second Legislature, as amended.

3. That the warrants of the City of Stephenville,
Texas, to be called "City of Stephenville Water System
Improvement Warrants, Series 1969," be issued under and
by virtue of the Constitution and laws of the State of
Texas in the amount of $400,000, for the purpose of paying
for improvements to the City's Water System, and to pay
part or all of the Engineer's fees and inspection and
testing fees.
4. That said Warrants shall be numbered 1
through 400, shall be in the denomination of $1,000 each,
shall be dated June 1, 1969, and shall become due and

United States of America, upon presentation and surrender of

countersigned by the City Secretary, and the seal of the City
shall be impressed upon each of them. The facsimile signatures
of the Mayor and City Secretary may be lithographed or printed
on the coupons atached to said Warrants, and said printed or

10. Said warrants, in the authorized amount of
$400,000, shall be printed, and with the printed or lithographer
coupons attached, shall be executed by the Mayor.and counter-
signed by the City Secretary. The warrants thus executed shall
be placed in the custody of the City Secretary and shall be
delivered in installments, as and when and in the amount
necessary from time to time, to the contractors and persons
furnishing labor, services, materials, equipment and land,
and the engineers on said project, or to assignees of such
contractors, persons or engineers. Under no circumstances
shall any of said warrants be delivered by the City except
for the purposes for which they are authorized. A finding by
the City Council that a specific item of indebtedness was in-
curred for a purpose for which said warrants are authorized
shall be conclusive when contained in an ordinance passed by
the City Council.
11. After claims and estimates shall have been
approved by the City Council for any purpose for which said
warrants are authorized the Mayor and City Secretary shall issue
and deliver to each claimant an amount of warrants not exceeding
the amount of the claim, and, for any amount not covered by such
delivery of warrants, a certificate in substantially the
following form:

12. As and when said certificates shall have been
accumulated from time to time in amounts not less than $1,000,
and when requested by the holder of said certificates, the City
Council will pass an ordinance describing said certificates and
authorizing the delivery of said warrants in an amount not
exceeding the amount of the accumulated certificates, specifying
by numbers the warrants to be delivered in exchange for said
.certificates. Credit balances may be carried in favor of said
bank for succeeding installment deliveries. On the occasion
of the final installment delivery the City shall make cash
adjustment with said bank out of funds available therefor.
13. On the occasion of each exchange of warrants for
certificates, both the City and the bank shall execute receipts,
each in favor of the other, to show the surrender to the City
and the receipt therefor of said certificates and the delivery
by the City and receipt therefor of said warrants.
14. That a special fund to be designated "City of St
enville Water System Improvement Warrants,.Series 1969 Fund" is
hereby created and the proceeds from all taxes collected for
on account of this series of warrants shall be credited to said
fund for the purpose of paying the interest as it accrues and t
provide a sinking fund for the purpose of paying each install-
ment of principal as it becomes due, and said fund shall be use
for no other purpose. For each year while any of said warrants
or interest thereon are unpaid, there shall be computed and
ascertained, at the time other taxes are levied, the rate of
tax based on the latest approved rolls of said City as will be
requisite and sufficient to make, raise and produce in each of
said years a fund to pay the interest as it accrues and to pay
the principal as it matures, or to provide at least 2% of the
principal as a sinking fund, whichever is greater, full
allowances being made for delinquencies and costs of collection
A tax at the rate as hereinabove determined is ordered to be
levied and is hereby levied against all of the taxable property
in said City for the current year and for each year hereafter
while said warrants or any of them are outstanding and unpaid,
the said tax each year shall be assessed and collected and
placed in the fund hereby created and the Treasurer shall honor
warrants against said fund for the purpose of paying the interest
on and principal of said warrants and for no other purpose.
15. The assignees of said claims and the holders of
said warrants are hereby subrogated to all rights which the
persons to whom the original warrants were issued had against
the City of Stephenville.
16. The Mayor and City Secretary are hereby ordered
to do any and all things necessary to accomplish the transfer of
said moneys to the interest and sinking fund of this issue in
ample time to pay such items of principal and interest.
17. That Change Order Number 1 for Contract "B" and
Change Order Number 1 for Contract "C" in the forms and amounts
attached hereto and made a part hereof, are hereby approved and
shall be executed and become a part of Contracts "B" and "C"
awarded hereunder.

It was moved by Councilman Irwin, seconded by Councilman Loudermilk that the bids
be referred to engineers for study and recommendation. Motion carried unanimously.
Mayor reported that notice has been received from Harrell Funeral Home of discon-
tinuing emergency ambulance service in Stephenville and there is a meeting set up
with the County Commissioner Court in effort to work out this problem.
Mayor presented proposed plans for 2 small dams on the Bosque that would back water
up and possibly be used for recreation purposes. These plans are for 1 dam near
Loop 195 and one near the East Washington Street bridge.
