HomeMy WebLinkAbout1970-08-04 - Regular City CouncilAugust 4, 1970 25 Stephenville, Texas The City Council met on the above date in regular session with the following members present: Toby Stone, W. M. Irwin, Don Metsgar, Doug Smithey, Mrs. Fred McCleskey, Garland Loudermilk, and Mayor John Skipper presiding. Minutes of the previous meetings were read. Councilman Stone interjected a request for an addition to the minutes concerning his case as read with the following: 1. A letter was introduced by Toby Stone and signed by the building inspector that the reason this permit was denied for the building in question was "No accessory building shall be constructed upon a lot until the construction of the main use building has been actually commenced. No accessory building shall be used unless the main use building on the lot is also being used." 2. Section 5, page 12, use 6 and 8 of the zoning ordinance was brought to the attention of the council and zoning board by Toby Stone. 3. It was brought to the attention of the council that the zoning borard gave no reason in their report to the city council for recommending this building permit be denied. 4. Omit 5. Even though the permit was denied by the building inspector for the above reason, Col McCullough stated that they gave this reason very little consideration and their main reason for recommending that the city council uphold the building inspector in his refusal to issue this permit was because of the complaint of a neighbor. J. D. McCullough, chairman of the zoning board was present and passed approval on the addition. The minutes were then approved by the Mayor. Mr. Glen Carruth appeared before the council and presented a set of plans for a 128 unit apartment house complex to be located on FM988, Lingleville Highway, between the new loop and the proposed Bluebonnet street. Mr. Carruth requested a resolution in effect by the council to continue with preparation of this construction. Mayor Skipper appointed a committee of Councilmen Irwin, Metsgar, and Smithey to study these plans. Mr. A. A. Schrimsher appeared before the council and presented a petition by residents living on north Graham requesting a reconsideration of making both sides of Graham street illegal to parking. Mr. Schrimsher cited the need for parking space on at least one side of north Graham for residents. A resident on North Graham, Mrs. King, 6tated that trucks needed to be re- routed and the street needed to be patrolled by the city police more often at &fight. Councilman Metsgar stated his committee had orginally made parking illegal on Graham to releave congestion of traffic around the post office and hospital. This matter was referred to the original committee. Councilman Smithey reported that two realtors appraised that portion of land known as Culp street at $300. and $500. respectively. Councilman Irwin pointed out that Mr. Howard Ross had made a bid on this property at an earlier date. Councilman Irwin made a motion seconded by Councilman Stone that the city accept the bid of Mr. Ross for $100. and sell Culp street to him. Motion carried. Councilman Metsgar stated that city policemen and firemen should be allowed holidays as other employees. Mayor Skipper pointed out that this would require me extra finances for more help. This was referred to the finance committee for study. Councilman Smithey reported that he had attended the Library board meeting and the library had had some air conditioning problems this past month. It was reported that the historical museum needed a guard light near the museum at night. TP 8 L had agreed to install such a light. City ambulance and fire department truck runs were frequent and operation is good. It was also reported by Councilman Smithey that a fire substation was needed. Apropriations for this project had been set aside at a previous date. Extra equipment at the present fire station could be utilized in the new substation. It was also pointed out that such a building manned with four additional firemen would meet with insurance requirements for the city, however the expense of manning the station would need consideration by the finance committee. J Councilman Smithey made a motion seconded by Councilman Stone that a fire substation be built at the specific site on Frey and Harbin. The vote was 3 d for and 3 against. Mayor Skipper postponed his deciding vote until the next meeting. Councilwoman McCleskey reported a large number had participated in activities at both the city park and the senior citizen center. Park Director Isham reported that the Region 7 Softball Tournament drew a large number to the park. Director Isham also reported on a trash hauliung problem that the park dept. had been confronted with for some time. 0 This was referred to the sanitation committee for study. Councilman Loudermilk presented a request by Tarleton State College to close a portion of Turner street in order to extend the TSC drill field and it would keep this area mowed. Councilman Loudermilk made a motion seconded by Councilman Smithey that this portion of Turner .street be closed. Motion carried. Councilman Stone and Director of Public Works Gann reported.that street paving and resurfacing is still in operation, some 32,000 feet completed. Councilman Irwin reported that the Finance committee was still making its study awaiting budget proposals. Councilman Irwin then read a proposed junk car ordinance for the city. Councilman Irwin made a motion seconded by Councilman Metsgar that the city council adopt the ordinance concerning inoperative junk vehicles on private property. Motion carried. Councilman Irwin made a motion seconded by Councilwoman McCleskey that the ordinance for inoperative junk vehicles on city streets also be adopted. Motion carried. Said ordinances being attached to and becoming a part of these minutes. Councilman Loudermilk brought the council up to date on the airport improvement project relating that the contract between the city and the state was on a 50 -50 basis under specifications drawn up by Hunter Associates. Councilman Stone and Irwin were appointed to investigate whether or not the city should go on contract or forced account for the completion of the project. This committee would invest- igate the possibility of getting cheaper contract bids for construction on part of the city airport. The city has been handling the construction on approaches to the hangars and other areas and has amassed some '.$5,000. in construction. The engineering fees have amassed $4,500. and a state matchment of the funds is necessary. The state is scheduled for a $15,000. reimbursement to the city. Councilman Metsgar commented on a need to consolidate the insurance on city property to one controlling agency. Mayor Skipper appointed Eouncilmen Metsgar, Loudermilk, and Irwin to study this matter. Councilman Loudermilk made a motion seconded by Councilman Stone that the city not sell the city property located near the Bosque River as requested by the individual at the previous meeting. Motion carried. Councilman Stone stated that he had met with the Plumbing Board and discussed the - using of tupe of PVC plastic sewer pipe. Stone said the board had no objections to the use of this pipe in force lines, and he felt the PVC class 160 should be adopted in use with force lines. Mayor Skipper and other members of the council felt a survey of other cities using this type of pipe would be necessary and the recommendations by the city engineering firm, Hunter Associates would also be necessary before any final action be taken. It was reported that the notice for the change in time from 7 P.M. to 1:30 P.M. Friday, August 7, 1970 for the Housing Authority meeting has been publicized in the local paper and radio. Mayor Skipper reported that there were ninety nine pieces of property owned by the city and he requested that the council begin considering the best use for some of this property. City Secretary Cates reported a need for the following transfer of funds out of the City Sales Tex Fund: $15,000. to the General Fund 500. to the City Library 5,600. to the City Street Improvement Warrants, 1969. Councilwoman McCleskey made a motion seconded by Councilman Irwin that these transfer of funds be made. Motion carried. Mr. Taylor Almon of Almon & Co. appeared before the council to finalize action on payment of warrants as follows: Whereas, on May 29, 1969, the city council of the City of Stephenville, Texas passed an ordinance authorizing the issuance of City of Stephenville Water System Improvement Warrants, Series 1969, in the amount of $400,000., for the purpose of paying for improvements to the city's water system, and to pay part or all of the engineers fees and inspection and testing fees, and authorizing the execution of contracts designated A, B, C, and D. Councilman Irwin made a motion seconded by Councilman Metsgar that the city so pay the engineer's fees of Hunter Associates in the amount of $8,350.73. Motion carried. Councilman Irwin made a motion seconded by Councilwoman McCleskey that the city pay for services under contract B to the Water Tank Service Co., Inc. the amount of $24,250. Motion carried. Councilman Irwin made a motion seconded by Councilman Loudermilk that indebtedness to the fiscal agent, Almon & Co. be paid for in the amount of $6,015. Motion carried. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: This Article may be cited as "Junked Motor Vehicle Regulations." Section One Definitions. For the purposes of this Article, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense shall include the future; words used in the plural number include the singular numbers; and words used in the singular number include the plural number. The word 'shall' is always mandatory and not merely directory; (1) "Junked Motor Vehicle'- Any motor vehicle, as defined in this ordinance which does not have lawfully affixed thereto both an unexpired license plate or plates and a valid motor vehicle safety inspection certificate, and the condition of which is one or more of the following: (a) Wrecked (b) Dismantled (c) Partially dismantled (d) Inoperative (e) Abandoned (f) Discarded Exceptions: The provisions hereto shall not apply to: A. Any motor vehicle in operable condition specifically adapted or constructed for racing or operation on privately owned drag strips or raceways; B. Any motor vehicle retained by the owner for antique collection purposes, rather than for salvage or for transportation; nor C. Any motor vehicle stored as the property of a member of the armed forces of the United States who is on active duty assignment. (2) 'Person' - Any individual, firm, partnership, association, corporation, company or organization of any kind. Section Two Junked Motor Vehicles - Declared a Public Nuisance. The presence of any junked motor vehicle on any private lot, tract or parcel of land, or portion thereof, occupied or unoccupied, improved or un- improved, within the City of Stephenville, shall be deemed a public nuisance; and it shall be unlawful for any person to cause or maintain such a public nuisance by wrecking, dismantling, partially dismantling, rendering inoper- able, abandoning or discarding any motor vehicle on the real property of another or to suffer, permit or allow any junked motor vehicle to be parked, left or maintained on his own real property, provided that this ordinance shall not apply with regard to: 474 (a) Any junked motor vehicle in an enclosed building; (b) Any junked motor vehicle on the premises of a business enterprise operated in a lawful manner, when necessary to the operation of -I such business enterprise; or (c) Any junked motor vehicle in an appropriate storage place or depository maintained at a location officially designated and in a manner approved by the City of Stephenville. Section Three Notice to Owner or Occupant to Abate Public Nuisance or Occupied Premises Whenever any such public nuisance exists on occupied premises, theChief of Police or his duly authorized agent shall order the owner of the premises, if in possession thereof, or the occupant of the premises whereon such pub- lic nuisance exists, to abate or remove the same. Such order shall: (a) Be in writing; (b) Specify the public nuisance and its location; (c( Specify the corrective measures required; (d) Provide for compliance within ten (10) days from service thereof. r r Such order shall be served upon the owner of the premises or the occup- ant by serving him personally or by sending said order by certified mail, return receipt requested, to the address of the premises. If the owner or occupant of the premises fails or refuses to comply with the order of the Chief of Police or his duly authorized agent within the ten (10) days period after service thereof, as provided herein, the Chief of Police or his duly authorized agent shall take possession of such junked motor vehicle and re- move it from the premises. The Chief of lziice or his duly authorized agent shall thereafter dispose of said junked motor vehicle in such manner as the City Council may provide. However, if the owner or occupant of said premises so desires,he may, within said ten (10) day period after service of notice to abate the nuisance, request the Clerk of the Corporation Court of the City of Stephenville, either in person or in writing and without the requirement of bond, that a date and a time be set when he may appear before the Judge of the Corporation Court for a trial to determine whether or not he is in violation of this Article; and said trial shall be set as provided in,secton Five hereof. Section Four Notice to Owner to Abate Public Nuisance on Unoccupied Premises Whenever any such public nuisance exists on unoccupied premises within the City in violation of this ordinance, and the owner thereof can be found, —( the Chief of Police or his duly authorized agent shall order the owner of the premises whereon such public nuisance exists, to abate or remove same. Such c- order shall: (a) Be in writing; (b) Specify the public nuisance and its location; (c) Specify the corrective measures required; and (d) Provide for compliance within ten (10) days from service thereof. The order shall be served upon the owner of the premises by serving him person- ally or by sending said order by certified mail, return receipt requested, to his address as shown on the current tax rolls of the City of Stephenville, Texas. If the owner of the premises fails or refuses to comply with the order of the Chief of Police or his duly authorized agent, within the ten (10) day period after service thereof, as provided herein, the Chief of Police or his duly authorized agent shall take possession of such junked motor vehicle and remove it from the premises. The Chief of Police or his duly authorized agent F' I shall thereafter dispose of said junked motor vehicle in such manner as the City Council may provide. However, if the owner of sad premises so desires, he may within said ten (10) day period after service of notice to abate the nuisance, request the Clerk of the Corporation Court of the City of Stephenville, either in person or in writing and without the requirement of bond, that a date and a time be set when he may appear before the Judge of the Corporation Court for a trial to determine whether or not he is in violation of this Article.; and said trial shall be set as provided herein. Section Five Preliminaries to Trial in Corporation Court Upon receiving a request for trial, made pursuant to above, the Clerk of the Corporation Court shall set a date and a time for such trial on the Court Docket. The Clerk of the Corporation Court shall notify the City Attorney of the date and time of such hearing. The City Attorney shall cause to be pre- pared, filed, and served on the defendant, a written complaint charging that the owner or occupant of the premises, as the case may be, has violated this Article. After service, such complaint shall be on file with the Clerk of the Corporation Court not less than ten (10) days prior to the date of trial. } Section Six { Trial in Corporation Court The Judge of the Corporation Court shall hear any case brought before said Court, as set out herein, and shall determine whether or not the de- fendant is, in fact, in violation of this Article. Upon a finding that said defendant is in violation of this Article, said defendant shall be deemed guilty of a misdemeanor and ®Ubject to a fine in accordance with the penalty provision hereinafter set forth. The Judge of said Court shall further order such defendant to remove and abate said nuisance within ten (10) days, the same being a reasonable time. If the defendant shall fail and refuse, within said ten (10) days, to abate or remove the nuisance, the Judge of the Corpor- ation Court may issue an order directingthe Chief of Police to have the same removed and the Chief of Police or his duly authorized agent shall take poss- ession of said junked motor vehicle and remove it from the premises. The Chief of Police or his duly authorized agent shall thereafter dispose of said junked motor vehicle in such manner as the City Council may provide. Section Seven Removal with permission of Owner or Occupant If, within ten (10) days after receipt of notice from the Chief of Police, or his duly authorized agent, to abate the nuisance, as herein provided, the owner or accupant of the premises shall give his written permission to the Chief of Police, or his duly authorized agent for removal of the junked motor vehicle from the premises, the giving of such permission shall be considred compliance with theprovisions of this Article. Section Eight Removal from Unoccupied Premises by Order of Corporation Court If there is a junked motor vehicle, as herein defined, on premises that are unoccupied, andreither the owner of the premises nor the owner of said vehicle can be found and notified to remove same, then, upon a showing of such facts to the Judge of the Corporation Court, the Court may issue an order directing the Chief of Police to have the same removed, and the Chief of Police or his duly authorized agent shall take possession of said junked motor vehicle and remove it from the premises. The Chief of Police or his duly authorized agent shall thereafter dispose of said junked motor vehicle in such manner as the City Council may provide. I � I If� 497 4919 Section Nine Evidence of Abandonment If a junked motor vehicle, as defined in this Article, has been situated on the private property of another without such person's permission, for a period of sixty (60) days or longer, this fact shall be prima facie evidence that the owner of said vehicle has abandoned the same. Section Ten Penalty Any person violating any of the provisions of this Article shall be guilty of a misdemeanor, and upon conviction shall be subject to a fine of not more than $200.00. Each transaction in violation of any of the provis- ions thereof shall be deemed a separate offense. Section Eleven It is hereby declared to be the intention of the City Council that the Sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judg- ment or decree of any court of competent jurisdiction, such unconstitution- ality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. Section Twelve The fact that there are presently no adequate provisions regulating public nuisances created by junked motor vehicles on private property, mak- ing the regulation thereof necessary in the public interest, creates an urgency and an emergency in the immediate preservation of the public health, safety, comfort and general welfare, and requires that this ordin- ance shall take effect immediately from and after its passage, and it is accordingly so ordained. Section Two Vehicles or trailers found to be situated so as to violate any part of this ordinance shall be towed into the City pound and such shall not.be allowed to be re- claimed except upon proof of ownership and payment of the towing fee and cost of storage.
