The City Council met in a called session on the above date with the following i
members present: Doug Smithey, Toby Stone, Mrs. Fred McCleskey, Garaland
Loudermilk, W. M. Irwin, Don Metsgar, and Mayor Skipper presiding. Members
of the Zoning Board were also present.
Mayor Skipper stated that the purpose of the meeting was to invite the members
of the Zoning Board to appear before the council and answer some questions con-
cerning the building permit refusal to Mr. Toby Stone.
J. D. McCullough, Chairman of the Zoning Board, stated that after Mr. Stone
appealed to the Board when the permit was denied by the Building Inspector, .
the Board upheld the denial based on the following interpretation of the
zoning ordinances:
1. The secondary building cannot be built before the primary structure is
completed and,
2. An adjacent property owner objected due to sanitation problems that might
occur.
The Zoning Board presented its recommendations to the city council which stated
that due to the above mentioned reasons Mr. Stone was in violation.
Mr. McCullough said that it was suggested by the Board that if the building in
question was moved to a better location that a non- conforming permit could be
issued.
The city council that reviewed this matter accepted this interpretation and
held Mr. Stone in violation of the zoning ordinance.
Mr. Stone stated his rebuttal that the building was incidental to farm operation
and therefore permissible as written under the zoning ordinance.
After a lengthy discussion on the matter Councilman Smithey made a motion seconded
by Councilman Metsgar that a building permit be issued to Mr. Stone and the law-
suit be dismissed.
The motion did not carry with a vote of 2 for and 3 against.
Mr. Stone then requested that the building inspector be allowed to issue a
permit for a 3 bedroom brick dwelling on this particular tract of land.
Councilman Irwin made a motion seconded by Councilman Loudermilk that a permit
be issued for the dwelling subject to the City Attorney's approval. Motion carried.
There being no further business to consider the council stood adjourned subject
to the Mayor's call.
