HomeMy WebLinkAbout1971-08-03 - Regular City Council54 Stephenville, Texas August 3, 1971 The City Council met in a regular meeting on the above date with Mayor Skipper pre- siding and the following council members present: Don Metsgar, Garland Loudermilk, Doug Smithey, W. M. Irwin, Toby Stone, Raymond Anderson, and Mrs. Fred McCleskey. - Others present were: Director of Public Works Gann, Director of Parks Isham, Fire Marshall Ferguson, Chief Cornell, and City Attorney Chandler. Minutes of prevous meeting were read and approved. Mr. Kal Segrist appeared before the council stating that some years ago under the administration of Jack Arthur a policy was adopted concerning water and sewer charges for apartments. Mr. Segrist feels that he should not be charged the extra $1.00 per month for sewer. The room that is rented in Mr. Segrist home has a bath but no kitchen facilities. This was refered to Water and Sewer Committee for investigation and report. Mr. L. E. Pittman appeared before the council stating that in 1963 he paid for extension of sewer line from 6th street to 5th street and south on 5th street. Also paid for water line from Groesbeck north on 5th street. The smounts paid were: Water line -- $361.20, Sewer line -- $660.80. There are now houses being built on 5th street and being tied on water and sewer lines paid for by Mr. Pittman. Mr. Pittman requested that he be refunded a pro rata share of the cost of water and sewer lines. This was refered to Water and Sewer Committees for investigation and recommendations. Mr. Doug Smithey, owner and developer.of the property mentioned by Mr. Pittman, stated that before he purchased the property all available records were checked concerning water and sewer charges and any other indebtedness against the property and nothing, was found. '\\ Councilman Metsgar reported that Law and Order Committee has looked into the petition 11 of property owners on Kaylock street and has no recommendation. Councilman Metsgar reported the ambulance has made more runs this year than last year. Also that since ambulance has been operated by police department all calls have been collected for except 3. Councilman Smithey reported that the specifications are almost complete on the proposed fire station and should be ready to call for bids in near future. Councilwoman McCleskey reported that the state will pay $100.00 of cost to install shuffleboard at Senior Citizens Center, leaving approximately $100.00 to be paid by the city.. Director of Parks Isham reported that he and Councilwoman McCleskey visited in Austin recently and checked on the requirements to receive a grant for Park improvements. It was found that considerable expense would be necessary on existing park facilities to qualify for a grant. It was suggested that the Park Committee secure a Master Plan for Park improvements and present same for the consideration of the council. Councilman Loudermilk had nothing to report. Director of Public Works reported that the new well is complete and test pumping should commence in the morning then well will be ready to tie into the water system. Director of Public Works presented charts and graphs showing water pumped for the last ten years, and noted the peak months and days that most water was pumped. Also pointed (� out the locations of City wells and discussed the amounts of water produced from each area and discussed the water storage and distribution system, Councilman Anderson brought up for discussion the purchase of additional well site and the drilling of another well while the drilling crew is here. It was moved by Councilman Anderson, seconded by Councilman Loudermilk, to purchase additional well site and contract for drilling of a well. Motion carried. Councilman Stone had nothing to report. Director of Public Works reported that -the street department is doing paving and re- surfacing. It was moved by Councilman Irwin, seconded by Councilman Metsgar, to transfer from City Sales Tax Fund to following funds: $7,000.00 to R & B Fund 100.00 to Airport Fund 5,610.90 to City Improvement Warrants, 1967 15,741.68 to City Improvement Warrants, 1970 Motion carried. �¢ ADMINISTRATOR. ORDINANCE J` AN ORDINANCE CREATING THE OFFICE OF ADMINISTRATOR FOR THE CITY OF STEPHENVILLE, TEXAS, AND PRESCRIBING HIS POWERS AND DUTIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE,TEXAS ,k Section 1. The Governing Body of the city shall appoint an Adminis- trator for the City of Stephenville who shall be the administrative head of the municipal government.,,under the direction and supervision of the Govern - ing Body. i Section:2, RESIDENCE OF ADMINISTRATOR: The Administrator may or not be a resident of the City of Stephenville when appointed, but during the term of his office shall reside in the City of Stephenville. '4 Section 3. TERM OF OFFICE: The Administrator shall be appointed for an indefinite period and shall be subject to discharge at the will of the 'governing body of the City. Section 4. ABSENCE OR DISABILITY OF.ADMINISTRATORe During the ab- sence or disability of the Administrator, the governing body shall designate some I properly qualified person to perform the duties of said office. Section s. POWERS AND DUTIES: The powers and duties of the Adminis- trator,shall be: (a) To devote all of his working time and attention to the affairs of the„+�.ity, and be responsible to the governing body for the ef- ficient`adminis�ation of its affairs. .,see ; that all laws and ordinances are enforced. (c;) With , prior approval of the governing body of the city, to appoint and remove. ,all heads of department. He r re rsl Hate emn]ess..r. i To exercise supervision and control over all departments created by the governing body or,that may hereafter be created by said governing body of the city. (e) To attend all meetings of the governing body with the right to take part in the discussion, but having no vote; and he shall be notified of all special meetings of said governing body. " (f) To see that all terms and conditions imposed in favor of the City of Stephenville, it inhabitants in any public utility franchise are faith- fully kept and performed and ,upon knowledge of any violation thereof to "call the same -to the attention of the governing body. (g) To act as Budget,Officer, and as such to prepare and submit to the governing body, prior to the beginning of each fiscal year, a budget of proposed expenditures for the ensuing year, showing in as much detail as E practicable the estimated amounts required by months for the efficient operation of each department of the City Government and the reasons for such estimated expenditures. (h) The Administrator, in addition to the foregoing paragraph (g), shall make.and: file a budget as required by State Law. ' (i)' To make a full ,written report to the governing body as soon after the close of each month's accounts as possible, showing the operation and fi expenditures of each department for the preceding month, and a comparison of such monthly expenditures, by departments_, with the monthly allowances made for such departments in the annual budget, and to keep the governing t ,.a�5aj &iw..aaS ,a � L' ' ' °,• 2 - body fully advised at all times as to the financial condition and needs of. the c (J�, To act as purchasing agent for the City of Stephenville and to pur- chase all merchandise, material and supplies needed by the City and may es- tablish, if needed, a suitable storehouse where such supplies shall be kept and from which same shall be issued as needed; and to adopt such rules and regulations governing requisitions and transactions of business between him - self as such purchasing agent and the heads of the departments, officers and r-employees of the City as the governing body may approve. It shall be the duty of the purchasing agent to give opportunity for competition on purchases and sales, except when the nature of the purchase or sale is such that competition is impossible or impracticable. All pur- !chases in excess of $500.00 , except of real estate, or rights or easements ` therein, shall be by contract to the lowest responsible bidder and all sales tin excess of $950.00, except of real estate or rights or easements therein, shall be made to the highest bidder after public notice and the receipt of sealed bids, unless the governing body by ordinance, determines that it is impossible or impracticable to purchase or sell in such manner. All sealed bids received shall be opened in public and thereafter shall be subject to 44 public inspection. The purchasing agent may reject all bids and readver f. tise for new bids. The purchasing agent may require successful bidders to furnish security conditioned upon the faithful performance of their contract or conditioned upon the payment of the wages and compensation of all laborers employed on work for which a contract is made by the contractor, subcontrac- tor, agent or any otl?er person, or condition for both. The purchasing agent shall not let any contract for periods exceeding one year for street light - ing, public improvements, labor or supplies. In case of accident or other circumstances creating an emergency, the Administrator may, with the consent of the governing body, award contracts, and make purchases for the purpose of repairing damages caused by said accident or avoiding said public emergency; but immediately afterwards, he shall file with the Mayor a certificate showing such emergency and the necessity of such action together with an itemized account of all expendi- tures.' (k) To recommend to the governing body the salaries to be paid each appointive officer and subordinate employee of the City; and it shall be the duty of the governing body to pass ordinances or resolutions, from time to time, fixing rates of compensation. (1) To recommend to the governing body, in writing, from time to time, !for adoption, such measures as he may deem necessary or expendient. (m) To do and perform such other duties as may be prescribed by ordi- nance or resolution of the governing body of the City. Section 6, COMPENSATION AND BOND OF ADMINISTRATOR: The Administrator shall receive such compensation as the governing body shall fix from time to time by ordinance and shall furnish such surety bond as may be required by the governing body by ordinance, the premium to be paid by the City. Section 7. Motion carried unanimously. It was moved by Councilman Stone, seconded by Councilman Loudermilk, to adopt on final / reading an ordinance making a part of the City of Stephenville land adjacent to said city, which joins the present city limits of the City of Stephenville and which ordinance de- scribes said land. Motion carried unanimously. (Said ordinance being attached to and becoming a part of these minutes). It was moved by Councilman Metsgar, seconded by Councilman Loudermilk, to adopt an ordinance altering the prima facie speed limits established for vehicles under provisions of sections 167 and 169 of article XIX, R.C.S. 6071D, uniform act regulating traffic on highways upon the basis of an engineering and traffic investigation upon certain streets and highways, or y parts thereof, within the corporate limits of the City of Stephenville as set out in the ordinance and providing a penalty of a fine not to exceed $200.00 for violation of this ordinance. Motion carried unanimously. It was moved by Councilman Irwin, seconded by Councilmen Smithey, to appoint Philip Ferguson City Secretary. The Council then went into Executive Session. It was reported that the motion to appoint Philip Ferguson City Secretary carried. It was moved by Councilman Irwin, seconded by Councilwoman McCleskey to adopt an ordinance creating the office of Administrator for the City of Stephenville, Texas and prescribes his powers and duties.
