CITY COUNCIL CHAMBERS
CITY OF STEPHENVILLE, TEXAS
The City Council met in a called session, Friday, October 11, 1974 at
3:00 P.M. in the City Council Chambers at City Hall, Stephenville, Texas
with Mayor Donald R. Jones presiding and the following members present:
Jim Chambers, Charles Riggins, Raymond Anderson, Jesse Sexton, Larry
Hammett and Neal Guthrie.
Absent were Councilmen W. M. Irwin and Roy McCoy.
Others attending the meeting were: City Administrator Marshall Shelton,
Chief of Police Mike Watkins, City Inspector Gene Lookingbill, Director of
- Personnel Kurt Ackerman, City Secretary Joyce Pemberton, M. C. Brandon, Jr.
W. N. Brown and Mr. McClure.
Mr. M. C. Brandon, Jr., representing the Building Committee of the First
Baptist Church, came before the Council requesting permission to use, purchase,
close or otherwise use one block of Barton Avenue between Green and Mason Streets
so that the First Baptist Church may erect a new structure adjacent to the present
structure.
After discussion, it was the consensus of the Mayor and Council to submit
this to the City Attorney to check to see if there are any legal problems, if
not the Mayor will-appoint a committee to meet with the Building Board of the
church to-consider all the ramifications and go from there.
Mr. McClure, representing the Farm Bureau, came before the Council re-
questing a "Letter of Intent" from the City so that the National Guard could
declare, as surplus, the 22 acres of property on the corner of Highways 281
and'367 and turn this property over to the Farm Bureau to construct a new
building on it.
Mayor Jones said he would consult with the City Attorney as to the legal
aspects and what the City can do legally.
Mayor Jones suggested recommending,to the Zoning Board that they amend the
Zoning Ordinance to include the mini warehouse type buildings or to classify
these buildings in one of the zoning areas. Also draw up a form for a Special
Use Permit rather than a Non Conforming Permit with a resolution to be attached

-- specifying the use and restrictions and the penalties if violated.

After discussion, Councilman Sexton, seconded by Councilman Guthrie, moved
to accept the recommendation of the Zoning Board to issue a Special Use Permit
With the restriction to conform with the Fire Prevention Code, to Mr. L. T.
Solomon, Dallas, Texas, for the.purpose of contructing a mini warehouse on pro-
perty located directly behind the One Stop Shopping Center, 1660 Lingleville Rd.
Motion carried unanimously.
After considerable discussion, Councilman Anderson moved, seconded by
Councilman Hammett,.to accept the recommendation of the committee to make the
two blocks of Paddock Street by the Central Ward School, one way going south
with three lanes of traffic, painting crosswalks and putting up appropiate
signs. Motion carried unanimously.
After considerable discussion, Councilman Anderson moved, seconded by
Councilman Sexton, to accept the recommendation of the committee on the
traffic control around Chamberlin School this would include painting cross-
walks, change parking area in front of the building to loading and unload-
ing lanes from east to west, the west end of area is still parking area, the
south side of.Frey St. in front of the school building to be classified "No
Parking '. Motion carried unanimously.
After discussion, Councilman Chambers moved, seconded by Councilman
Hammett, to accept the recommendation of the Committee that the City not
participate in the purchase of the Christmas decorations for the Square.
That the City continue assisting the Downtown Merchants with the installation
removal and paying of the electrical bill as in the past. Motion carried'
unanimously.
Mayor Jones suggested getting colored plastic covers for the beam lights
that shine on the Courthouse dome during the holiday season.
Mayor Jones reported that he had received a letter from Lt. Roy Johnson
Commander of the National Guard here, requesting a $50.00 per month donation
from the City, in view of the fact that they are willing to and have done
quite a bit of work for the City. No action was taken.
Chief Watkins brought up for discussion that Mrs. James Traeek had
requested that the Square be blocked off for rally on October 14th.
After considerable discussion, it was the consensus of the.Mayor.and
Council that the rally should be held in the City Park.
City Administrator Marshall Shelton polled the Council and their vote
was to pass an ordinance vacating and closing the south 250 feet of North
Bates Avenue.

THE SAME VACATED AND CLOSED, FINDING THE VALUE OF SAID LAND AND AUTHORIZING
THE CONVEYANCE OF THAT PART OF SAID.LANp TO FRED PETERSON AND VERNA E. .
PETERSON UPON THE PAYMENT OF THE AMOUNT FOUND TO BE THE VALUE OF SAID TRACT OF
LAND:

STEPHENVILLE AT PAGE 845 THEREOF, TO HAVE BEEN ABANDONED AS A STREET,

BEGINNING at an iron pin set at the intersection of the south line
of E. Elm Street with the east line of North Bates Avenue, being
at the NWC of Lot 1 -C, Block 92, City of Stephenville, Texas, for
the NEC of this tract;
THENCE S 60 000' W 60.0 feet to an iron pin set at the intersection
of the south line of E. Elm Street with the west line of North
Bates Avenue, being the NEC of Lot 10, Block 8, Cage Addition to
the City of Stephenville, Texas, for the NWC of this tract;
THENCE S 30 000' E along east line of Block 8,,Cage Addition,
250.0 feet to an iron pin set in the north line of Block 92,
City of Stephenville, at the SWC of North Bates Avenue, for the
SWC of this tract;
THENCE N 60 000' E 60.0 feet to an iron pin set at interior corner
of said Block 92, for the SEC of North Bates Avenue, for the SEC
of this tract;
THENCE N 30 000' W along a west line of said Block 92, City of
Stephenville, Texas 250.0 feet to the place of beginning, con-

line of E. Elm Street with the East line of North Bates Avenue,
being the NWC of Lot 1 -C, Block 92, City of Stephenville,
Texas, for the NEC of this tract;
THENCE S 30 000' E along the west line of said Block 92, City of
Stephenville, Texas, 250.0 feet to an iron pin set at the SEC
of North Bates Avenue, for the SEC of this tract;
THENCE S 60 000' W 60.0 feet to an iron pin set in the north
line of said Block 92, at the SWC of North Bates Avenue, for the
SWC of this tract;
THENCE N 30 000' W along the east line of Block 8, Cage Addition,
37.7 feet to-an -iron pin set on easterly side of a wire fence,,
for a corner of this tract;
THENCE along the easterly side of a wire fence and chain link
fence, as follows: N 20 °36' W 42.9 feet; N 28 022' W 70.0 feet,
and N 26 003' W 100.2 feet to an iron pin set in south line of E.
Elm Street, from which point the NEC of Lot 10, Block 8, Cage
Addition bears S 60 °00' W 15.9 feet, for the NWC of this tract;
THENCE N 60 000' E along south line of E. Elm Street, 44.1 feet
to the place of beginning, containing 0.299 acres;
is hereby found by the City Council of Stephenville, Texas, to be of
$ 115.80 Said amount having been offered by Fred Peterson and
Verna E. Peterson for that portion of said street, it is hereby ordered
and decreed that Don Jones, Mayor of the City of `S'tephenville, execute
a Special Warranty Deed to the said Fred Peterson and Verna E. Peterson
conveying to them said portion of said street and such deed shall be
delivered to the said Fred Peterson and Verna E. Peterson upon the
payment by them to the City of Stephenville of said sum of $ 115.80

ORDINANCE DECLARING A PORTION OF WEST TURNER STREET RUNNING WESTERLY FROM
ITS INTERSECTION WITH ST. PETER AVENUE A DISTANCE OF 100 FEET IN THE CITY
OF STEPHENVILLE IN ERATH COUNTY, TEXAS, TO HAVE BEEN ABANDONED AS A STREET,
ORDERING SAME VACATED AND CLOSED, FINDING THE VALUE OF SAID LAND, AND
AUTHORIZING THE CONVEYANCE OF SAME TO DAN MALONE UPON THE PAYMENT OF THE
AMOUNT FOUND TO BE THE VALUE OF THIS LAND.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Section One
That portion of West Turner Street described as follows:
0.092 acres of land situated in the Groesbeeck & McClelland
Addition to the City of Stephenville, Texas, being a portion
of W. Turner Street, according to King's 1956 Revised Map of
said City attached to Adoption recorded in Volume 381, Page
105, Deed Records of Erath County, Texas, made for the City
of Stephenville, Texas, and described as follows:
BEGINNING at the SEC of Blk. B -30, Groesbeeck & McClelland
Addition, for the NEC of this tract;
THENCE S 30 -00 E 40.0 feet to the NEC of Blk. A -30, said
Addition, for the SEC of this tract;
THENCE S 60 -00 W 100.0 feet to the NWC of Lot 13, Blk. A -30,
said Addition, for the SWC of this tract;
THENCE N 30 -00 W 40.0 feet to the SWC of Lot 16, Blk. B -30,
said Addition, for the NWC of this tract;
THENCE N 60 -00 E 100.0 feet to the place of beginning;
is hereby declared to have been abandoned for street purposes and said
portion of West Turner Street above described is hereby ordered vacated
and closed as a street.
Section Two
That portion of West Turner Street hereinabove described is hereby
found by the City Council of Stephenville, Texas, to be of a value of
$50.00. Said amount having been offered by Dan Malone for that portion
of West Turner Street above described, it is hereby ordered and directed
that Don Jones, Mayor of the City of Stephenville, execute a special
warranty deed to the said Dan Malone conveying to him the above des-
cribed land and such deed shall be delivered to the said Dan Malone upon
the payment by him to the City of Stephenville of said sum of $50.00.

AMENDMENT TO FRANCHISE TO BILLY R. BLEDSOE
FOR GARBAGE COLLECTION AND DISPOSAL
AN ORDINANCE AMENDING THAT FRANCHISE GRANTING TO BILLY R. BLEDSOE TO
FURNISH GARBAGE COLLECTION AND DISPOSAL SERVICE TO THE RESIDENTS OF THE
CITY OF STEPHENVILLE WHICH ORDINANCE HEREBY AMENDED IS DATED APRIL 3,
1973.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
Section One
In pursuance of Section 12 of said prior ordinance granting franchise
to Billy R. Bledsoe for garbage collection and disposal in the City of
Stephenville dated April 1, 1973, the said Billy R. Bledsoe has submitted
to the City Council of the City of Stephenville a request for an adjust-
ment in the established charges for garbage and refuse collection and said
ordinance is hereby amended.as herein below set out.
Section Two
The established rate being charged by the contractor with the approval
of the City Council of the City of Stephenville for collection of garbage
in residential areas in the City of Stephenville and which is $2.30 per
month is hereby increased to the sum of $2.75 per month for each residence.
This charge shall go into effect beginning October 15, 1974 and such in-
crease shall appear on the first billing for the period of time ending
November 15, 1974 which is the billing to be shown on the December, 1974
statements.
Section Three
That part of Section 11 of said garbage franchise collection and
disposal ordinance dated April 3, 1973 which reads as follows:
"On or before the 1st day of each month, the City shall pay to
the Contractor ninety two and one half (922) percent of the
gross receipts from garbage collection charges on accounts
actually serviced by the Contractor for the preceding month."
is hereby changed to read:
"On or before the lst day of each month, the City shall pay to
the Contractor ninety one (91) percent of the gross receipts
from garbage collection charges on accounts actually serviced
by the Contractor for the preceding month."
Section Four
Said original franchise to Billy R. Bledsoe dated April 3, 1973
except for the above changes shall remain in full effect.
