CITY COUNCIL CHAMBERS SEPTEMBER 3, 1974 CITY OF STEPHENVILLE, TEXAS The City Council met in regular session September 3, 1974, at 7:00 P.M. in the City Council Chambers at City Hall, Stephenville, Texas, with Mayor Donald R. Jones presiding and Councilmen Jim Chambers, Roy McCoy, Charles Riggins, Raymond Anderson, Jesse Sexton, Larry Hammett and Neal Guthrie present. Absent: W. M. (Bill) Irwin. Others present were: City Administrator Marshall L. Shelton, Dir. of Public Works R. Y Gann, City Attorney Joseph Chandler, "Fire Marshall E. W. Ferguson, Attorney Randy Chandler and City Secretary Joyce Pemberton. Councilman Jesse Sexton moved, seconded by Councilman Chambers, to approve the minutes of the August 6th and August 20th meetings as written. Motion carried unanimously. After discussion, Councilman Chambers moved, seconded by Councilman Hammett, to accept the bid of Stephenville State Bank and Trust Co. to act as City Depository for the City of Stephenville, Texas for the period of one (1) year, beginning October 1, 1974. Motion carriedby a vote as fol- lows: AYES: Councilmen Chambers, McCoy, Anderson, Hammett and Guthrie. NAYS: None, ABSTAINED: Councilman Riggins. The Council discussed the purchase of the Paul Kasch property of 30 acres for a.sum of $48,000.00 for the purpose of additional park facilities. It was the consensus of the Mayor and Council not to purchase this pro- perty as the money was needed other places more. The Council discussed the expense of an audit of the garbage fran- chise as Mr. Bill Bledsoe had requested a rate increase for the the garbage pickup. In order for the Council to determine if a rate in- crease is needed, they thought it necessary to have an audit or a look at his books. After much more discussion, it was the consensus of the Council and Mayor to check with Mr. Bledsoe for authorization for the Council to look at his books he presented to the auditors to see if the information is available to give a true picture of what the situation is without an audit and discuss the rate increase at a later date. After some discussion, Councilman Riggins, moved, seconded by Council- man Chambers, to adopt the budget for 1974 -75 fiscal year as set forth in the language of ordinances provided on pages 7 and 8 of the budget. Motion carried unanimously. 153 ORDINANCE LEVYING ADVALOREM TAXES ON BOTH REAL AND PERSONAL PROPERTY IN THE CITY OF STEPHENVILLE FOR THE YEAR 1974; PROVIDING FOR OCCUPATION TAXES ON EVERY PERSON, FIRM OR CORPORATION PURSUING ANY OCCUPATION, PROFESSION OR BUSINESS IN THE CITY OF STEPHENVILLE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: THAT THE DIRECT AND ADVALOREM MUNICIPAL TAXES BE, AND THE SAME ARE HERE- BY LEVIED FOR THE CALENDAR YEAR, 1974, UPON THE $100.00 VALUATION OF ALL PROPERTY, BOTH REAL AND PERSONAL, IN.THE.CITY.OP STEPHENVILLE, SUB- JECT TO TAXATION FOR THE SAID YEAR UNDER "THE CONSTITUTION OF STEPHENVILLE ADOPTED ON THE 4th DAY OF APRIL, 1961, FOR THE PURPOSE AND AT THE RATE HEREINAFTER SPECIFIED: ORDINANCE APPROVING THE BUDGET SUBMITTED BY THE CITY ADMINISTRATMR OF THE CITY OF STEPHENVILLE FOR THE FISCAL YEAR OCTOBERI, 1974 TO SEPTEMBER 30, 1975. Mayor Jones, at this time, opened the floor for discussion of the Council of Governments. After considerable discussion, Councilman Chambers moved, seconded by Councilman Sexton, to notify Central Texas Council of Governments that we are withdrawing our Resolution requesting that we be transferred to their regional unit and that we file an application for membership in North Central Texas Council of Governments. Motion carried unanimously. RESOLUTION WHEREAS, the area embraced within the physical boundaries of the Counties of Collin, Dallas, Denton, Ellis, Erath, Hood, Hunt, Johneon, Kaufman, Navarro, Palo Pinto, Parker, Rockwall, Somvervell, Tarrant, and Wise are all Counties located in the north central region of the State of Texas which have"joint and mutual environmental, economic, social, or other problems, which do or may require joint and mutual surveys, studies, plans, and related actions in order to insure the orderly growth and development of the region; and WHEREAS, the above named Counties, as well as incorporated muni- cipalities and special - purpose districts located in the above named Counties, comprise the North Central Texas Council of Governments with the participating membership of the Council composed of an elective public official from each participating local governmental unit who is designated by the respective governing body, according to the By- laws and said organization has been authorized by the original agree- ment between the respective governmental units for its creation, as well as enabling legislation in support of the Council of Governments movement; and WHEREAS, it is the opinion of the goberning body of The City of Stephenville that it will be to its benefit and to the benefit of its citizens as a whole to become a participating member of said organi- zation; NOW THEREFORE BE IT RESOLVED THE THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: SECTION 1. That the aforementioned local government may become a participating member of the North Central Texas Council of Governments, created for the purposes set out above, and the City Secretary, Joyce Pemberton, be, and is hereby authorized to apply for membership in the North Central Council of Governments by sub- mission of this Resolution and the payment of the an- nual dues established in accordance with the Bylaws of said organization. 1 m SECTION 2. That this Resolution shall take effect from and after its passage. PASSED ON THIS THE 3rd DAY OF SEPTEMBER, 1974 AT A MEETING OF THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS. Councilman Hammett moved, seconded by Councilman Chambers, to ap- point City Administrator Shelton as the voting representative in the North Central Texas Council of Governments General Assembly for 1974 -75. Motion carried unanimously. Mayor Jones explained that a one year personnel grant has been approved. This grant is in the amount of $8,300.00 which is 100% funded. Afyer considerable discussion, Councilman Sexton moved, seconded by Councilman Riggins, to authorize Mayor Jones to accept the personnel grant to start October 1, 1974. Motion carried unanimously. Councilman Guthrie moved, seconded by Councilman McCoy, to adopt- the ordinance providing for the sale of an 8 foot alley between Graham and Belknap Streets to Mr. V. C. Voss and Mr. Louis Wofford. Motion carried unanimously. ORDINANCE ORDINANCE DECLARING THAT CERTAIN ALLEY EIGHT FEET IN WIDTH RUNNING FROM THE WEST LINE OF NORTH GRAHAM AVENUE TO THE EAST LINE OF NORTH BELKNAP AVENUE AND BEING SITUATED SOUTH OF LOTS 2 -B AND 2 -A AND NORTH OF LOTS 3 -B AND 3 -A IN BLOCK 5.OF FREY FIRST ADDITION IN THE CITY OF STEPHENVILLE, ERATH COUNTY, TEXAS, AS SHOWN BY KING'S 1956 MAY OF STEPHENVILLE AT PAGE 806 THEREOF, TO HAVE BEEN ABANDONED AS AN ALLEY, ORDERING THE SAME VACATED AND CLOSED, FINDING THE VALUE OF SAID LAND AND AUTHORIZING THE CONVEYANCE OF THE NORTHERLY FOUR FEET OF THE EASTERLY NINETY -FIVE FEET AND ALL OF THE WESTERLY ONE HUNDRED EIGHT FEET OF SAID ALLEY TO V. C. VOSS AND ORDERING THE CONVEYANCE OF THE SOUTHERLY FOUR FEET OF THE EASTERLY NINETY -FIVE FEET TO LOUIS WOFFORD WPON THE PAYMENT _ OF THE AMOUNTS FOUND TO BE THE VALUE OF SAID TRACTS OF LAND. BE IT ORDAINED BY THE CITY OF STEPHENVILLE: Mayor Jones asked City Administrator Shelton to explain and comment on the alternative methods of financing the sewer trunk line. Each Councilman had been given a list of alternative methods of financing with the advantages and disadvantages of each method listed, with Mr. Shelton's recommendation being to borrow $175,000 for a period of three years with interest rate not to exceed 7 %. After considerable discussion, Councilman Anderson moved, seconded by Councilman Sexton, to finance the sewer outfall line with a bank loan for a period of three years as recommended by Mr. Shelton. Motion carried unanimously. The Council discussed the increase in cost of feeding the prisoners. No action was taken. Councilman Guthrie expressed a desire for the Council to look at all of the city facilities.and properties. Mayor Jones asked Mr. Shelton to set this up for a Saturday morning in the near future Councilman Hammett said he thought all the city employees connected with the recent manhunt were to be commended for a job well done. Mayor Jones said he concurred with Councilman Hammett in that the city employees had done an excellent job and were to be commended. Mayor Jones reported that he had received a letter from the Star - Telegram expressing their appreciation for the help and consideration shown their reporters during the coverage of the recent manhunt. There being no other business Councilman McCoy moved the adjourn. 8 :30 P.M. VOSS AND ORDERING THE CONVEYANCE OF THE SOUTHERLY FOUR FEET OF THE EASTERLY NINETY -FIVE FEET TO LOUIS WOFFORD UPON THE PAYMENT OF THE AMOUNTS FOUND TO BE THE VALUE OF SAID TRACTS OF LAND: BE IT ORDAINED BY THE CITY OF STEPHENVILLE: Section One That certain alley eight feet in width running through Block 5 of Frey First Addition along the south lines of Lots 2-B and 2 -A and along the north lines of Lot 3 -B and Lot 3 -A and which runs from the east line of North Graham Avenue to the west line of North Belknap Avenue, is hereby declared to have been abandoned for street purposes and said alley is hereby ordered vacated and closed as an alley. Section Two The northerly 4 feet of the easterly 95 feet and all of the westerly 108 feet of said alley is hereby found by the City Council of Stephenville, Texas, to be of a value of $37.50. Said amount having been offered by V. C. Voss for that portion of said alley, it is hereby ordered and decreed that Don Jones, Mayor of the City of Stephenville, execute a Special Warranty Deed to the said V. C. Voss conveying to him said portion of said alley and such deed shall be delivered to the said V. C. Voss upon the payment by him to the City of Stephenville of said sum of $37.50. Section Three That portion of said alley hereinabove mentioned which is the south 4 feet of the easterly 95 feet is hereby found by the City Council of Stephenville, Texas, to be of a value of $12,50. Said amount having been offered by Louis Wofford for that portion of said alley, it is hereby ordered and directed that Don Jones, Mayor of the City of Stephenville, execute a Special Warranty Deed to the said Louis Wofford conveying to him the above described land and such deed shall be deli- vered to the said Louis Wofford upon the payment by him to the City of Stephenville of said sum of $12.50.
