The City Council of the City of Stephenville, Texas, met in regular
session, Tuesday, July 16, 1974, at .7:00 A.M., with Mayor Donald R.
Jones present and presiding. Councilmen Roy McCoy, Neal.Guthrie, Jim
Chambers, Raymond Anderson, W. M. (Bill) Irwin, and Larry Hammett were
present.
Absent were Councilmen Charles Riggins and Jesse Sexton.
Others attending were City Administrator Marshall L. Shelton,
Director of Public Works R. Y. Gann, City Secretary Joyce Pemberton,
City Attorney Joseph Chandler, City Inspector Gene Lookingbill, Mr. E.L.
Stephens, Chairman of the Electrical Board, and Dr. Robert Walker.
Mayor Jones asked Mr. E. L. Stephens to brief the Council on the
recommended amendment to the Electrical Code.
Mr. Stephen's explained that the National Electric Code will allow
nonmetalic shiethed cable in a multi- family dwelling of a wood frame con-
struction, not to exceed two storys in height. It was the consensus of
the Electrical Board to recommend to the City Council to amend the city's
Electrical Code accordingly.
Councilman Irwin moved to adopt the Electrical Code amendment as
recommended by the Electrical Board. Councilman McCoy made the second.
Motion carried unanimously.
ELECTRICAL CODE AMENDMENT
#1 Section 1, Article 36 -- PLACES OF PUBLIC /AS'SEMBLY
After the words "Multi- Family Dwelling" add: of more than
two story construction, or of masonry wall`:construction.
#2 Add the following.to clarify code interpretation: 1 -36A
Nonmetalic shiethed cable may be used as branch circuit con-
ductors in multi - family dwellings of wood frame construction, and`
not exceeding two (2), stories in height. There shall be a fused
main disconnect device installed at each meter and a panel for each
individual apartment in the building, installed in the apartment
which it serves. In the event that a branch circuit is installed
in an apartment other than the one it serves, this circuit or cir-
cuits shall be installed in conduit.
Mayor Jones asked Dr. Robert Walker representing the Historical
Society to explain to the Council a building project they are requesting.
Dr. Walker explained that the Board of the Stephenville Historical
House Museum had voted to construct an H- shaped barn building of two
modules of about 392 sq. feet each, plus a connecting breezeway of ap-
proximately 441 sq. feet, to yield a building of 1,225 sq. feet of rough
sawn cedar boards battened with red cedar shingles, to resemble a barn
of the 1870's, to be constructed behind and slightly to the west of the
stone building now used for the museum to produce additional storage
space and meeting rooms. The interiors to be finished in stages as
money allows. °
After discussion, Councilman Irwin moved that the Historical
Society be permitted to construct the above described building on city
property. Councilman Chambers made the second. Motion carried unanimously.
The Council discussed the sale of city property located close to the
airport to the Industrial Foundation. It was the consensus of the Council
not to sell this property.
Councilman Irwin reported for the Airport Committee that he had asked
Mr. Phillip Hale to give an estimate on the cost of some repairs of the
building at the airport. Mr. Hale gave an estimate of $1,100.00 to put on
• new roof, a new ceiling in the office, repair ceiling in restroom, install
• bulletin board, paint the inside of the office, repair and paid the out-
side of the office.
After discussion, Councilman moved to have Phillip Hale proceed with
the above repairs on the basis of his estimate, this assuming he can do
the repairs for the estimated $1,100.00. Councilman Guthrie made the
second. Motion carried unanimously.
Mayor Jones presented for discussion the Senior Citizens Savings
Account.
Councilman Irwin moved to divide the money between the two clubs on
a 50150 basis.
Mayor Jones asked City Attorney Joseph Chandler for comments.
Mr. Chandler explained that when this was in the court, the Judge had
stated that the City should have the money but,had no legal basis to award
it to the City. That the source of the money was mostly from the sale of
quilts, paid for from funds that were raised there and that the people who
made the quilts were paid salaries for working there. This was the main
position of the City.
Mayor Jones raised the question of the legality of giving away City
funds.
Mr. Chandler said the courts would recognize a settlement in order
that it be paid out in accordance with the settlement. The division of
the funds would have to be an agreement between the City and the other
party. Mr. Chandler also said there were no legal problems if the court
authorized it in a judgment.
After more discussion, Councilman Guthrie seconded the motion of
Councilman Irwin to authorize the City Attorney to_ compromise the law-
suit, if he can, on a split basis.
It was also established that these funds would be given to the
Stephenville Senior Citizens Center in addition to their yearly bud-
get funds.
Mayor Jones called for a vote on the above motion. The motion
carried as follows:
AYES: Councilmen Chambers, Guthrie, Anderson, Irwin, Hammett and
McCoy.
NAYS: Mayor Donald R. Jones.

Mayor Jones reported that a rate increase has been requested by Bill
Bledsoe for the garbage service. The request is to increase the rates
on residential to $2.75 from $2.30 or as an alternative, the people furnish
their own plastic bags and curb service instead of house service.
Mayor Jones appointed a committee of Councilmen Irwin, Hammett, Guthrie
and Chambers, with Councilman Irwin as Chairman, to meet with Mr. Shelton
for study on this proposal.
