HomeMy WebLinkAbout1975-07-01 - Regular City Council'_ REGULAR SESSION - TUESDAY JULY 1, 1975 CHAMBER OF THE CITY COUNCIL CITY HALL, CITY OF STEPHENVILLE, TEXAS The City Council, City of Stephenville, Texas, met in Regular Session Tuesday, July 1, 1975 at 7 :00 p.m. with Mayor Donald R. Jones present and presiding. Councilmen Jim Chambers, W. M. Irwin, Roy McCoy, Charles Riggins, Raymond Anderson, Jesse Sexton, Larry Hammett, and Neal Guthrie were present. Others attending the meeting were City Administrator Marshall Shelton, City Attorney Joseph Chandler, Director of Public Works R. Y. Gann, Chief of Police Mike Watkins, Fire Marshall E. W. Ferguson, and City Secretary Joyce Pemberton. Also attending were Fred B. Parker, Jr., Byron Singleton, Kenneth Currier, Billy Chew, Phillip Hale, Thurman Cashon and Richard Gaines. Councilman Irwin moved to approve the minutes of June ltt, June 10th and June 23rd as written. Councilman Chambers made the second. Motion carried unanimously. Councilman Irwin reported that his committee recommended no action be taken at this time on the rate increase request of Texas Power and Light . He also.said his committee would like more information before making a recommendation. There were no objections to delaying action on this request until the committee has more time to investigate and get more information. Mayor Jones opened the bids received for the new fire station and asked Fred B. Parker, Jr. and Fire Marshall Ferguson to examine them to see that all of them meet the specifications, then the Council look at and discuss them later in the meeting. After considerable discussion, Councilman Chambers moved not to adopt the Heating and Air Conditioning Code as presented. Councilman Sexton made the second. Motion carried unanimously. It was the consensusu of the Council that a more simplified code is needed. After discussion, Councilman Irwin moved to adopt the Speed Zone Ord- inance on Highways 377 & 281 and recommendations of Chief of Police Mike Watkins. Councilman McCoy made the second. Motion carried unanimously. ORDINANCE AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 167 AND 169 OF ARTICLE XIX, R.C.S. 6701d, UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON THE BASIS OF AN EN- GINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF STEPHENVILLE AS SET OUT IN THE ORDINANCE: AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR VIOLATION OF THIS ORDINANCE. Bids received on the new fire station are as follows: KENNETH CURRIER, Stephenville, Texas------------------ - - - - -$ 94,300.00 F. 0. CUNNINGHAM & RICHARD L. ROBERTS ---------------------- 198,763.83 M & L CONSTRUCTION CO, Burleson, Texas ------------------ - -- 129,985.00 K. A. SPARKS, Hamilton, Texas ------------------------------ 131,000.00 PHILLIP HALE, Stephenville, - Texas -------------------------- 109,800.00. After considerable discussion, it was the consensus of the Mayor and Council to consider and think about these bids and have another meeting in a few days to discuss the bids at some length. Director of Utilities Danny Johnson came before the Council reporting that he had received bids on an air compressor for the water meter repair shop ranging from $1,050.00 to $1,600.00. Mr. Johnson explained that this was a budgeted item and he recommended the Ingersoll Rand Compressor. After some discussion, Councilman Irwin moved to accept the recom- mendation of Mr. Johnson and to purchase the Ingersoll Rand Air Compressor at a cost of $1,295.00. Councilman Hammett made the second. Motion carried unanimously. �a SPEED ZONE ORDINANCE AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 167 AND 169 OF ARTICLE XIX, R.C.S. 6701d, UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON-CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF STEPHENVILLE AS SET OUT IN THE ORDINANCE: AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR VIOLATION OF THIS ORDINANCE. WHEREAS, Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed there- in set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part pf a street or highway, with the City taking into considera- tion the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said govern body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, now therefore, BE IT ORDAINED by the City. Council of the City of Stephenville Texas: Section 1. Upon the basis of an. engineering and traffic investigation heretofore made as authorized by the provisions of Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: -2- Control.250 -3 & 4 US -281 Erath County a) From Station 2238 +11.5 (North City Limits of Stephenville) southerly 0.414 mile to Station 2260+00.0 at 55 miles per hour. b) From Station 2260+00.0 southerly 1.644 miles to Station 72 +30.3 (South City Limits of Stephenville) at 45 miles per hour. Section 2. Any. person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any,sum riot more than two hundred ($200) dollars. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and'upon conviction thereof shall be fined in any sum not more than two hundred ($200) dollars, PASSED AND APPROVED THIS _DAY OF 19�� ATTEST: APPROVED: ;"tSecretary yor After considerable discussion, Councilman Chambers moved to increase the amount of water and sewer taps as follows: 5/8" X 3/4" meter and tap-- - - - - -- -from $ 55.00 to $ 80.00 . 3/4" meter and 1" tap------ - - - - -- -from 62.00 to 105.00 1" meter and 1" tap-------- - - - - -- -from 90.00 to 125.00 1%" meter and 1%" tap------ - - - - -- -from .235.00 to 310.00 2" meter and 2" tap-------- - - - - -- -from 345.00 to 440.00 4" sewer tap--------------- - - - - -- -from 30.00 to 40.00 Councilman Riggins made the second. Councilman Irwin asked that the above motion be amended to allow the City Administrator to review these costs and prices periodically. Councilman Riggins seconded the amendment. After more discussion, Councilman McCoy atated that he thought the above prices were fair and were needed and should be reviewed by the Council as the prices fluctuate and called for question on the above motion. Motion carried unanimously. After considerable discussion, Councilman Sexton moved to increase the reconnect fees from $2.00 to $5.00. Councilman Chambers made the second. Motion carried unanimously. This fee being for the reconnection of water after it has been turned off for non - payment and insufficient checks in payment of water bills. Director of Public Works R. Y. Gann reported that the first test hole has been drilled and the bottom strata of the trinity sands test pumped in the proposed water well field. Mr. Gann reported that the well looks pretty good at this time. After considerable discussion, Councilman McCoy moved to have "No Parking" on the north side of Frey from Belknap St. to Dale Ave. Councilman Anderson made the second. Councilman Chambers asked for more discussion as he did not think, it necessary to have the nor parking all the way to Dale Ave. After more discussion, question was called. The motion did not carry by a vote of 4 for,.; 5 against, with Mayor Jones voting against to break the tie. Councilman Guthrie moved to put "No Parking" signs on the north side of Frey St. from Belknap St. to Garfield St. Councilman Chambers made the second. Motion carried. Chief of Police Mike Watkins presented the following recommendations: No parking on Graham St. from Tarleton to Frey St. - -No Parking on one side of Belknap St. from Frey St. to Tarleton -- Close two exits and entrances on the square, for the time being, until the whole square Can be cut. These recommendations were discussed but no action taken as they were not on the agenda. Mayor Jones opened the meeting for a Public Hearing on the rezoning of the Pat Hudgens Property on the South Loop -- this being Lot 6, Block 35, Southside Addition. There being no objections to the rezoning, Mayor Jones closed the Public Hearing. Councilman Irwin moved to rezone Lot 6, Block 35, Southside Addition, City of Stephenville, Texas, from Residence I to Business II. Councilman Riggins made the second. Motion carried unanimously. After some discussion, Councilman McCoy introduced the ordinance ex- tending the city limits of the City of Stephenville, Texas. Councilman McCoy moved to publish notice, setting a Public Hearing on said ordinance for Tuesday, July 29,1975 at 3:00 p.m. Councilman Irwin made thesecond. Motion carried unanimously. Click, General Contractor for the construction of the tennis courts, has been notified to do some repair work on the tennis courts and has not. He recommends that the city do the work and sue Mr. Click for the cost. The estimated cost is approximately $2,000.00. After some discussion, Councilman Chambers moved to repair the tennis courts as needed, after the costs are determined, turn over to the City Attorney to file suit against the individual to reclaim the costs of fixing the courts. Councilman Irwin made the second. Motion carried unanimously. Councilman Hammett asked for the Council's feelings on installing trailer spaces at the city park. After some discussion, it was the consensus of the Mayor and Council that the money for these spaces be incorporated into the new budget of the Parks & Recreation Department. Mayor Jones said he would appoing the Budget Committees in a week or so. Councilman Anderson asked Danny Johnson about the low water pressure at his home. Mr. Johnson said that other than a stuck or dead meter that he knew of no reason for the low water pressure, but he would check it out the next day.
