The City Council met in Special Session Tuesday, June 10, 1975 at 3 :00 PM
with Mayor Donald R. Jones present and presiding. Councilmen W. M. Irwin, Roy
McCoy, Charles Riggins, Raymond Anderson, Jesse Sexton, and Neal Guthrie were
present. Councilmen James Chambers and Larry Hammett were absent.
Others attending the meeting were City Administrator Marshall Shelton,
Building Inspector Gene Lookingbill, and Administrative Aide Kurt Ackermana.
Also attending the meeting were Byron Singleton and Gerald Cook.
Byron Singleton of TP &L spoke before the Council to request a rate in-
crease for TP &L of an average of 11% effective October 1, 1975.
Mr. Singleton also requested that the Council allow TP &L to change the
starting point on their fuel adjustment clause from 20� to 70¢ base rate. Mr.
Singleton stated that the cost of fuel is currently above the 70� figure but
after some lignite plants and the nuclear plant are put into operation and the
price of fuel will level off at around 70� in the next few years. He also
requested that the Council allow TP &L to modify the fuel clause from a three
month average recovery to a one month recovery.
After considerable discussion, Councilman Irwin moved, seconded by Council-
man Riggins, that the Council refer the TP &L rate increase request to Hunter &
Associates for study and advisement regarding what action the Council should take.
Motion carried unanimously.
Councilman Irwin requested that the Mayor appoint a committee of the Council
to work with Hunter & Associates on the request. Mayor Jones stated that he would
do so.
Chairman of the Fire Truck Committee Jesse Sexton stated that his committee
recommended to the Council that the bid from the Fire Apparatus Company of Wichita
Falls be accepted for the purchase of two 1,000 gallon pumper trucks at a cost of
$83,500.00. Councilman Sexton also stated that the bid could be reduced by $600.00
if the City took delivery at Wichita Falls, Texas.
Councilman Sexton moved, seconded by Councilman Anderson, that the Council
accept the bid from the Fire Apparatus Co. of Wichita Falls for the purchase of
two 1,000 gallon pumper trucks at a total cost of $83,500.00. Motion carried
with Councilman Irwin voting against stating that he was in favor of the purchase
of only one truck at this time.
Gerald Cook of the Stephenville Chamber of Commerce came before the Council
to request that the Chamber of Commerce would like to take as many Councilmen as
possible to Dallas to talk to an attorney there in order to gain some insight on
financing industrial prospects under Internal Revenue Ruling 63 -20.
Mr. Cook explained that Ruling 63 -20 was synonomous with a tax bond and that
the reason for coming to the City was that under this type of industrial financing
a non - profit corporation would have to be formed which would issue the bonds. Mr.
Cook went on to say that these bonds would sell for two points below the prime
rate. The bonds would be used to finance the acquisition of property and construct-
ion of a plant. The bonds would then be paid for through a lease with the company
being financed The property would be owned by the City at the time the bonds
are retired. Until that time the property would be under the ownership of the
non - profit corporation formed by consent of the City. At no time would the name
of the City appear on the bonds or in the name of the non - profit organization.
After considerable discussion, Mayor Jones indicated to Mr. Cook that he would
contact him as to a °date for making the trip to Dallas regarding Rule 63 -20.
City Administrator Marshall Shelton stated that he would like to know the
feelings of the Council regarding a water rate increase to 45� per 1,000 gallons
for over 10,000 gallons used. He went on to say that since the new computer
would be coming in the Council would need to decide whether or not to allow the
increase so that the change could be programmed. The additional revenues from
the rate increase would also be helpful in amortizing the cost of the test wells
now going in.
Mayor Jones stated that he felt since additional revenues would be needed
in the future this would be a good way to raise them.
No action taken.
Mayor Jones stated that he had been informed by the Texas Highway Department
that they are wanting to lower the speed limits on highways 281 and 377 from 55mph
to 40 mph. This change would affect those stretches of highway within the city
limits but would not affect the by -pass. The Highway Department also indicated
that the changes would require a Speed Zone Ordinance.
The Council decided to take the request under consideration. No action taken.
There being no other business, the meeting adjourned at 4 :30 P.M.

ORDINANCE BY THE CITY OF STEPHENVILLE, TEXAS, ESTABLISHING TRUCK,ROUTES
THROUGH THE CITY; THE DESIGNATION OF CERTAIN STREETS AS ESTABLISHED TRUCK
ROUTES; PROVIDING FOR ERECTION OF TRUCK ROUTE SIGNS; IMPOSING PENALTIES AND
CONTAINING A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
Section One
The following definitions shall apply in the interpretations and
enforcement of this ordinance:
(1) COMMERCIAL VEHICLE: Every vehicle which is self - propelled and
designated, maintained, or used primarily for the transportation of property
and has a gross vehicular weight of seven thousand five hundred (7500) pounds
or more, and every trailer with a gross vehicular weight of seven thousand
five hundred (7500) pounds or more.
(2) LOCAL COMMERCIAL VEHICLE: Any commercial vehicle whose origin
and /or destination is within, and any locally operated commercial vehicle.
(3) THROUGH COMMERCIAL VEHICLE: Any commercial vehicle whose origin.
and destination is other than the city.
(4) TRUCK ROUTE: A street, road or highway designated by the City
Council upon which it shall be lawful for all through commercial vehicles
and local commercial vehicles to travel.
Section Two
General restriction on operation of commercial vehicles; truck routes:
(1) THROUGH COMMERCIAL VEHICLES. It shall be unlawful for any person
to operate a through commercial vehicle upon any street, boulevard, alley,
or avenue within the limits of the City of Stephenville, Texas, except that
such commercial vehicle may travel or be operated upon any street, boulevard,
or avenue designated as a U. S. or State Highway or as a truck route.
(2) LOCAL COMMERCIAL VEHICLES. It shall be unlawful for any person
to operate any local commercial vehicle upon any street, boulevard, alley, or
avenue within the limits of the City of Stephenville, Texas, except on a
designated U. S. or State Highway or a designated truck route. A local
commercial vehicle may leave any designated truck route and travel on any
street, boulevard, alley, or avenue within the City of Stephenville for the
purpose of delivering or picking up goods, wares, materials and /or merchan-
dise, or returning to its established place of business or home. When a
local commercial vehicle enters a street, boulevard, alley, or avenue as
herein permitted, such vehicle shall enter such street, boulevard, alley, or
avenue at the intersection nearest the point of pick up or delivery or its
established place of business or home and return to the truck route by the
nearest route. Where more than one pick up or delivery is required, addi-
tional pick up or delivery may be made, then the vehicle shall not be required
to return to the truck route after each individual pick up or delivery, but
shall return to the truck route upon the completion of all pick ups or
deliveries.
(3) TRUCK ROUTES ESTABLISHED. Every U. S. and State Highway within
the limits of the City of Stephenville is hereby designated, as a truck
route under the terms of this section, and the following streets, roads and
highways are hereby designated truck routes by name as follows:
(a) U. S. Highway 377 (South Loop) from City Limits to City Limits.
(b) U. S. Highway 377 (Business Route) from East City Limits to U. S.
Highway 281.
(c) Farm to Market Highway 8 from City Limits to City Limits.
(d) U. S. Highway 281 from City Limits to City Limits.
(e) State Highway 108 from South City Limits to Junction with U. S.
Highway 377�(South Loop).
(f) State Highway 108.from North City Limits to Farm to Market
Highway 8.
(4) MARKING OF TRUCK ROUTES. The traffic engineer shall mark the
truck routes established herein by the erection of suitable signs.
Section Three
Any person, firm, or corporation violating any provisions of this
ordinance or failing to observe any provision hereof shall be deemed guilty
of a misdemeanor and upon conviction shall be fined in any sum not less
than $5.00 and not more than $100.00; and if such violation be continuing,
each day or part of a day violation shall be a separate offense.
Section Four
Each and every provision, paragraph, sentence and clause of this
ordinance has been separately considered and passed by the City Council, and
each provision, and if any provision hereof should be ineffective, invalid,
or unconstitutional for any cause, it shall not impair, or affect the re-
maining portion nor any other; part thereof, but the valid portion shall be
enforced just as if it had been passed alone.
