CHAMBER OF THE CITY COUNCIL CITY OF STEPHENVILLE, TEXAS The City Council met in Special Session Tuesday, April 15, 1975 at 3:00 P.M. with Mayor Donald R. Jones present and presiding. Councilmen Jim Chambers, Roy McCoy, Charles Riggins, Jesse Sexton, Larry Hammett and Neal Guthrie were present. Councilmen W. M. Irwin and Raymond Anderson.were absent. Others attending the meeting were City Administrator Shelton, City Inspector-.Lookingbill, City Secretary Joyce Pemberton`, J. W. Beck and Mack Spurlock. Mayor Jones explained that at a previous meeting Lone Star Gas Co. had presented an ordinance granting a gas cost adjustment. After some discussion, Councilman Chambers moved, seconded by Councilman Riggins, to adopt the ordinance amending and supplement - ing the present Rate Ordinance No. 685 as presented. Motion carried unanimously. Councilman Sexton moved, seconded by Councilman Guthrie, to pass on final reading the ordinance to annex 95.27 acres of land which in- cludes a portion of the Tanglewood Second Addition and the land owned by the Stephenville Independent School District. Motion carried unanimously. ORDINANCE AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND AD- JACENT TO SAID CITY AND WHICH INCLUDES PORTIONS OF TANGLEWOOD SECOND ADDITION AND LAND OWNED BY THE STEPHENVILLE INDEPENDENT SCHOOL DISTRICT, ALL OF WHICH JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE DESCRIBES SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: Councilman Guthrie reported that the committee appointed to check into the "No Parking" regulations on W. Jones Street, had met with Chief Watkins and it was their recommendation to change the "No Parking" signs to "No Parking During School Hours ". This would be from 8:00 A.M. to 4 :00 P.M.. Mayor Jones said that Warner Cable TV of Stephenville has re- quested that the Council consider a rate increase of $1.50 on primary connections and $1.00 on additional outlets, effective April 1, 1975. Mayor Jones explained that he would give this some thought and would probably appoint a committee to study this and give their re- commendations to the Council. Councilman Guthrie said he would like to commend City Inspector Lookingbill for the manner in which he handled the meeting with the heating and air conditioning people the previous night. He said he thought Mr. Lookingbill did an excellent job. ORDINANCE AN ORDINANCE AMENDING TAINED IN BOOK J PAGE 110A GENERAL SERVICE RATE TO BE RESIDENTIAL AND COMMERCIAL STEPHENVILLE, ERATH COUNTY IN WHICH SUCH RATES MAY BE FOR EFFECTIVE DATE OF THIS AND SUPPLEMENTING ORDINANCE NO 685 CON - IN EFFECT FIXING AND DETERMINING THE CHARGED FOR SALES OF NATURAL GAS TO CONSUMERS WITHIN THE CITY LIMITS OF TEXAS, AND PROVIDING FOR THE MANNER AMENDED AND SUPPLEMENTED; PROVIDING AMENDMENT; AND DECLARING AN EMERGENCY. There being no other business, Councilman Chambers moved the meeting adjourn. Councilman McCoy made the second. Motion carried unanimously. Meeting adjourned at 3:30 P.M. M or ATTEST: 'Cit Secretary no 4G7 AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT TO SAID CITY AND WHICH INCLUDES PORTIONS OF TANGLEWOOD SECOND ADDITION AND LAND OWNED BY THE STEPHENVILLE INDEPENDENT SCHOOL DISTRICT, ALL OF WHICH JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE DESCRIBES SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: That certain land adjacent to the City of Stephenville and specifi- cally described as follows: All that certain 95.27 acre tract of land, being part of the Wm. Motley Survey, Abstract No. 515 and part of the John Blair Survey, Abstract No. 32, situated in Erath County, Texas, and described as follows: BEGINNING at an iron rod found in place at the NWC of Hillcrest Addition, an addition to the City of Stephenville, Erath County, Texas, with a plat of said Addition being of record in Volume 435, Page 151, Deed Records of Erath County, Texas, being in the present city limits of the City of Stephenville and in the southeast right of way line of Farm Road No. 988, for the NEC of this tract, being also the NEC of Tanglewood Second Addition, Third Filing, with a plat and Dedication of said Addition being of record in Volume 1, Page 114 of the Subdivision Records of Erath County, Texas; THENCE S 390 58' W along the south right of way line of Farm Road No. 988, at 781.5 feet pass the NWC of Tanglewood Second Addition, Third Filing and the NEC of a 1.17 acre tract of land dedicated as an extention of North Dale Avenue, with said Dedication recorded in Volume 524, Page 534 of the Deed Records of Erath County, Texas, continuing at 840 feet cross the west line of the John Blair Survey and the east line of the Wm. Motley Survey, continuing in all 866.6 feet to the NWC of said extention of North Dale Avenue for a corner of this tract; THENCE S 290 59' 30" E along the west line of North Dale Avenue, 620.3 feet to its intersection with the north line of Overhill Drive, dedication thereof recorded in Volume 524, Page 534 of the Deed Records of Erath County, Texas, for an internal corner of this tract, THENCE S 600 00' 30" W along t1m north line of Overhill Drive, at 344.4 feet cross the east line of a 4.00 acre tract of land con- veyed by Seth Moore et ux to George Barron by deed dated April 17, 1974 and recorded in Volume 517, Page 291, Deed Records of Erath County, Texas, continuing at 717.9 feet cross the west line of - said 4.00 acre tract and the east line of a 5.00 acre tract of land conveyed by Stephenville Land, Inc. to the Oakdale Methodist Church by deed dated June 1, 1973 and recorded in Volume 496, Page 160 of said Deed Records, continuing in all 1700.9 feet to a point in the curved southeast right of way line of Farm Road No. 988 for a corner of this tract; THENCE along the curved southeast right of way of Farm Road No. 988 as follows: S 400 37' W 120.74 feet to the SWC of said 5.00 acre tract and in the original north line of a 50.00 acre tract of land conveyed by Lemuel A. Brock et ux, to the Stephenville Independent School District by deed dated January 9, 1967 and recorded in Volume 412, Page 322, Deed Records of Erath County, Texas, S 41° 55' W 128.79 feet to the intersection of the south line of Overhill Drive and the southeast line of said Highway, and S 420 44' W 68.27 feet to an iron rod set in the west line of said 50.00 acre tract for the NWC of this tract; THENCE S 300 00' E 923.85 feet to an iron rod set at,the westerly SWC of said 50 acre tract, for the westerly SWC of this tract; THENCE N 590 57' 30" E 848.8 feet to an iron rod at an internal corner of said 50 acre tract, for an internal corner of this tract; THENCE S 310 06' E at 132.4 feet pass the southerly SWC of said 50 acre tract, being the NWC of a 20.00 acre tract of land conveyed by Lemuel A. Brock et ux, to the Stephenville Independent School District by deed dated February 16, 1966 and recorded in Volume 405, Page 189 of the Deed Records of Erath County, Texas, continuing in all 862.8 feet to the SWC of said 20 acre tract, for the southerly SWC of this tract; THENCE N 600 00' E 1187.0 feet to a railroad spike set in the intersection of the centerlines of west Frey Street and Dale Avenue, being the SEC of said 20 acre tract and in the present west line of the City Limits of Stephenville, for the southerly SEC of this tract; THENCE N 300 00' W along Dale Avenue, parallel to and 30 feet westerly at right angles from the east right of way of Dale Avenue, 1239.0 feet to the NWC of Tanglewood Addition, with Plat and Dedi- cation of same being of record in Volume 425,.Page 89 of the Deed Records of Erath County, Texas, being a corner of the City Limits, for an internal corner of this tract; THENCE N 600 00' E along the north line of Wisteria Drive, 153.6 feet to the SWC of Tanglewood Second Addition, with a Plat and Dedications of same being of record in Volume 453, Page 524 of the Deed Records of Erath County, Texas, being an internal corner of said City Limits for an internal corner of this tract;, - -i THENCE along the west and north lines of Tanglewood Second Addition and with the present City Limits as follows: N 300 00' W 100.0 feet, N 60° 00' E 307.0 feet, N 300 00' W 92.0 feet and N 600 00' E 311.4 feet to the NEC of said Addition, being in the west line of the West Oaks Addition to the City of Stephenville, with a plat of said Addition being of record in Volume 406, Page 294 of the Deed Records of Erath County, Texas; THENCE N 300 12' W along the west line of said West Oaks Addition and the east line of Tanglewood Second Addition, with a plat and dedication of said addition being of record in Volume 496, Page 313 of the Deed Records of Erath County, Texas, 454.0 feet to an iron rod set at its NEC, being in the north line of Overhill Drive and at the SEC of Tanglewood Second Addition, Third Filing, and in a line of the present City Limits, for a corner of this tract; THENCE N 300 15' 30" W along the east line of said'.Third Filing, at 155 feet pass the NWC of West Oaks Addition and the SWC of Hillcrest Addition, continuing in all 917.3 feet to the place of beginning and containing 95.27 acres of land in area; are hereby extended in accordance with the lines of the tract of land hereinabove described. The above and foregoing ordinance was introduced at the meeting of the City Council of the City of Stephenville held on the 4th day of March, 1975 by Councilman Chambers At such time it was moved by Councilman Chambers and seconded by Councilman Irwin , and the same being put to a vote, such motion carried to the effect that this ordinance be published for one issue in the Stephenville Empire- Tribune and that by such publication notice be given in accordance with Section 5 of Article 1 of the City Charter of the City of Stephenville, Texas, and in accordance with Section 6 of Article 970a of the Revised Civil Statutes of Texas, that this ordi- nance will be finally acted upon not less than thirty (30) days after such publication and that all interested persons shall be heard at a public hearing to be held not more than twenty (20) days nor less than ten (10) days prior to the institution of the proceedings to effect such annexation; and any citizen of Stephenville or of the territory to be annexed and all interested persons, shall have the right to contest such annexation and shall have the right to so contest same by filing with the City a written petition setting out their reasons for such contest and such person shall be given an opportunity to be heard before said ordinance in the form hereinabove set out or in a form to be amended by this Council shall be acted upon. This proposed ordinance was duly published in the Stephenville Empire - Tribune in the issue of March 6, 1975, and notice was thereby given that this ordinance would be acted upon at least thirty (30) days after such publication. Public hearing was set on such ordinance for March 18, 1975 and such hearing was duly held so that any citizen of Stephenville or the terri- tory to be annexed and any interested person might appear to contest such annexation. No person appeared to contest such annexation. The City Council of Stephenville met on the 15th day of April, 1975, and a quorum being present, the City Secretary was called upon to advise the council whether any written petitions or contests of the proposed annexation had been filed with her for presentation to the City Council. The City Secretary advised that no written petitions or contests of any kind had been filed and that no person had made any inquiry of her concerning the annexation. Thereupon, it was moved by Councilman Sexton and seconded by Councilman Guthrie that this ordinance be finally passed as hereinabove set out. Said motion being put to a vote, it carried unanimously.
