CITY COUNCIL CHAMBERS
CITY HALL, CITY OF STEPHENVILLE, TEXAS
The City Council met in Regular Session Tuesday, October 7, 1975 at 7:00 P.M.
with Mayor Donald.R. Jones presiding and Councilmen Jim Chambers, W. M. Irwin,
Charles Riggins, Raymond Anderson , Jesse Sexton, Larry Hammett and Neal Guthrie
were present.
Others attending the meeting were City Administrator Marshall Shelton,
Assistant City Attorney Randy - Chandler, Administrative Aide Kurt Ackermann,
City Secretary Joyce Pemberton, Director of Public Works R. Y. Gann, Chief'
of Police Mike Watkins, Fire Marshall E. W. Ferguson, Director of Parks &
Recreation Ronnie Isham, Fireman Kenneth Haley and Foreman of Water Dept. J.D.
Chapman. Also attending were Mr. Taylor Almon and George Feagan of Dallas and
the attached list.
Councilman Chambers moved seconded by Councilman Sexton, to approve the
minutes of the meetings of September 2nd, September 21st and October 6th as
written. Motion carried unanimously.
The recommendations of the Zoning Board to rezone Lots 2, 3, 8 and 9, Block
56, College View Addition, City of Stephenville, Texas, (Chamberlin "66 ". Station
and Terry's Grocery on W. Frey) from R -2 to B -1 was tabled until a later meeting.
Mr. George Feagan, representing Hunter & Associates, came before the Council
and discussed the various ways of bringing water from the three test holes on the
Glen Rose Highway into the city.
Mr. Taylor Almon, Investment Banker of Dallas, came before the Council and
discussed the various ways of financing the water well field proposal. After
quite a bit of discussion, it was the consensus of the Mayor and Council to delay
further discussion until the end of the meeting.
Mr. J. W. Beck, local manager of Lone Star Gas Co., came before the Council
with a request for a rate increase. After quite a bit of discussion n, Mayor Jones
appointed Councilmen Riggins, Sexton and Hammett as a committee with Councilman
Riggins as chairman, to work with Mr. Beck and report back to the Council at a
future meeting.
Mayor Jones read the two bids received for a fire truck chassis to,replace
the 1951 model as follows:
Herrin Motor Co., Stephenville ,Texas ------- -- $6,799.36
Bruner Chev. Co., Stephenville, Texas-- - - - - -- 6,870.00
Councilman Guthrie moved, seconded by Councilman Hammett, to accept the low bid
of Herrin Motor Co. for a 1976 model chassis as per specifications at the price
of $6,799.36. Motion carried unanimously. The amount of $7,000.00 had been
budgeted for this chassis.
Mayor J nes read Depository Bids from both Farmers First National Bank and
Stephenville Bank & Trust Co. After some discussion, Councilman Irwin moved,
seconded by Councilman Sexton, to accept the bid of Stephenville Bank & Trust Co.
as depository for the next fiscal year. Motion carried unanimously.
Councilmen Riggins and Chambers left the meeting before the bids were opened.
The Council asked Mr. Shelton to set up the CD's to mature October 1st of each year.
After some discussion, Councilman Sexton moved, seconded by Councilman Riggins,
to approve Mr. Raymond Lindley's request for a permit for a mobile home park north
of the Western Motel on the Dublin Highway as it was already zoned for this type
of permit. Motion carried unanimously.
Mayor Jones read the only bid received for the electric wiring for the re-
creation hall.
City Electric Co., Stephenville, Texas - - - - -- $2,165.00
After some discussion, Councilman Guthrie moved, seconded by Councilman Hammett, to
accept the bid of City Electric in the amount of $2,165.80 for electric wiring of
recreation hall. Motion carried unanimously. The amount of $2,500.00 had been
budgeted for this item.
After some discussion, Councilman Chambers moved, seconded by Councilman Irwin,
to invite bids on a front -end loader for the Recreation Dept. and set the date for
the November 4th meeting. Motion carried unanimously.

DUPUY SURVEY, THE H. C. HUDSON SURVEY AND THE JOHN BLAIR SURVEY, DESCRIBED
IN SEVEN (7) PARCELS, WHICH LAND JOINS THE PRESENT CITY LIMITS OF THE CITY
OF STEPHENVILLE AND WHICH ORDINANCE FULLY DESCRIBES SAID LAND.

is hereby received into the City Limits of the City of Stephenville and
made a part of the City of Stephenville and the City Limits of the City
of Stephenville are hereby extended in accordance with the lines and the
description of the parcels of land hereinabove described.
The above and foregoing ordinance was introduced at the meeting of
the City Council of the City of Stephenville held on the 1st day of July,
1975 by Councilman McCoy. At such time it was moved by Councilman McCoy
and seconded by Councilman Irwin, and the same being put to a vote, such
motion carried to the effect that this ordinance be published for one (1)
issue in the Stephenville Empire- Tribune, a newspaper published in the City
of Stephenville, Erath County, Texas, and that by such publication notice
be given in accordance with Section 5 o Article 1 of the City Charter of
the City of Stephenville, Texas, and in accordance with Section 6 of Article
970a of the Revised Civil Statutes of Texas that this ordinance will be
finally acted upon in not less than thirty (30) days after such publication
and that all interested persons shall be heard at public hearing to be held
not more than twenty (20) days.nor less than ten (10) days prior to the
institution of the proceedings to effect such annexation, this public hear-
ing to be held on the 29th day of July, 1975 at 3:00 o'clock, p.m. in the
City Council Meeting Room in the City Hall of the City of Stephenville,
Texas; and any citizen of Stephenville or of the territory to be annexed
and all interested persons, shall have the right to so contest such annexa-
tion and shall have the right to so contest same by filing with the City
of Stephenville a written petition setting out their reasons for such
contest and any such person shall be given an opportunity to be heard.
before said ordinance in the form hereinabove set out or in a form to be
amended by this Council shall be acted upon.
Notice as above provided was duly published as provided and on July
29, 1975 at 3:00 p.m. public hearing was had by the City Council at the
City Council Meeting Room, and all those present were given full oppor-
tunity to be heard in opposition to the annexation of land as above set
out and all those desiring to contest the annexation were given full oppor-
tunity to so contest same. All those present desiring to speak on the
matter of such annexation were permitted to do so. After all had been so
heard, the meeting was adjourned.
Thereafter, on August 18, 1975, the City Council met at 3:00 p,�m. in
the City Council Meeting Room in the City Hall with all members of the
Council and the Mayor being present, motion was made by Councilman Irwin
and seconded by Councilman Riggins that this ordinance be again introduced
for the purpose of instituting the proceedings for annexation as herein -
above set out. Motion being put to a vote, it carried with six Councilmen
voting for the motion and Councilman Sexton voting against it. The Mayor
declared the proceedings for annexation to be instituted, subject to future
action of the Council in accordance with law.
On the 7th day of October, 1975, the Council met in regular session
at the City Council Meeting Room in the City Hall. A quorum being present
motion was made by Councilman Irwin and seconded by Councilman Chambers that
this ordinance be finallypassed as above set out. The motion being put to
a vote, it carried with six Councilmen voting for the passage of the
ordinance and Councilman Sexton voting against. This ordinance shall go
into effect immediately and the above described land is hereby declared
to be annexed and same is a part of the City of Stephenville as of this date
of passage.

After some discussion, Councilman Chambers moved, seconded by Councilman
Irwin, to invite bids for the construction of restroom facilities in the city
park which is a budgeted item. Motion carried unanimously.
Councilman Chambers moved, seconded by Councilman Irwin, to appoint Mr. Olen
Fenner as Election Judge for the Special Election on November 4th, with Mr. C. N.
Merrill as alternate. Motion carried unanimously.
Councilman Irwin moved, seconded by Councilman Chambers, to adopt the ;
Annexation Ordinance.
Councilman Sexton asked for some discussion on this motion. Councilman
Sexton and Mr. Marty Wrinkle voiced their objection to this ordinance.
After some discussion, Councilman Irwin called for question on the above
motion and the motion carried by the following vote:
AYES: Councilmen Chambers, Irwin, Riggins, Anderson, Hammett and Guthrie.
NAYS: Councilman Sexton
Mayor Jones explained that bids were received from Herrin Motor Co., Bruner
Chev. Co. and Harbin Buick for two police cars. As all three bids varied from
the specifications, Mayor Jones appointed Councilmen Sexton, chairman, Hammett
and Riggins as a committee to make recommendations back on the basis of these
bids or whether or not we want compliance with specifications we had. The amount
of $10,000. has been budgeted for these two cars.
Councilman Irwin moved, seconded by Councilman Riggins, that we submit on the
November 4th Special Election a referendum of an opinion poll only regarding one -
way streets.
After considerable discussion, question was called on the above motion.
Motion did not carry by the following vote:
AYES: Councilmen Anderson, Irwin and Riggins.
NAYS: Councilmen Chambers, Sexton, Guthrie and Hammett.
It was the consensus of the Mayor and Council that a study should be made
regarding the necessity for one -way streets. The Council asked Mr. Shelton to
contact someone qualified to make a study, based on the by -pass loops and truck
routes etc, the traffic safety and the traffic flow,along with the consideration
of the businesses being hurt financially, and give us a recommendation as to
whether or not we need one -way streets. This to be done post -haste and when
they have the information together and ready to- report, a special meeting will
be called.
After considerable discussion, Councilman Irwin moved, seconded by Councilman
Riggins, to authorize Almon & Co. to enter into negotations for a loan of $1,5009000
from Texas Water Development Board regarding the city water system. Motion carried
by the following vote:
AYES: Councilmen Irwin, Riggins, Anderson, Sexton, Hammett and Guthrie.
ABSTAINED: Councilman Chambers.
There being no other business, the meeting adjourned at 10:35 p.m.
