REGULAR SESSION - MONDAY
NOVEMBER 1, 1976 - 7:00 P.M.

CITY HALL, CITY OF STEPHENVILLE, TEXAS
The City Council of the City of Stephenville, Texas, met in Regular Session,
Monday, November 1, 1976, at 7:00 p.m., with Mayor Donald R. Jones present and
presiding. Councilmembers Jim Chambers, Calvin McGee, Charles Riggins, Raymond
Anderson, Ermer Ferguson, Larry Hammett and Betty Heath were present. Council-
man W.M.Irwin was absent.
Others attending the meeting were City Administrator Marshall Shelton, Dir-
ector of Public Works R.Y.Gann, City Attorney Joseph Chandler, Director of Parks
and Recreation Ronnie Isham, Accountant Betty Chew, Chief of Police Mike Watkins,
City Secretary Joyce Pemberton, J.D.Chapman, Chairman of the City Zoning Board
Dean Cox, Marsha L. Rogers and many others.
Mayor Jones called the meeting to order and City Administrator Marshall
Shelton gave the invocation.
Councilwoman Heath moved the approval of the minutes of the last regular
meeting and special meeting as written: The motion was seconded by Councilman
Chambers. Motion carried unanimously.
Mayor Jones presented Dean Cox, Chairman of the City Zoning Board.
Mr. Cox explained that the City Zoning Board and the City Inspector Hardy
Lockhart had unanimously denied the application of Marsha L. Rogers to place a
mobile home on Lot 8, Block 6, Clifton Heights Additon, because the Zoning Ord-
inance requires a mobile home to be located in a B -2 or lower classification.
Mr. Cox also explained that the City Zoning Board and the City Inspector
Hardy Lockhart had unanimously approved the application of Mr. Marvin Browder
for a zoning variance to allow construction of mini - storage and office build-
ings on Lots 8,9,10, Block D -38, Groesbeck & McClellan Additon.
After considerable discussion, Councilwoman Heath moved to grant a variance
only to allow construction in B -2 area of mini - storage and office buildings on
Lots 8,9,10, Block D -38, Groesbeck & McClellan Additon, City of Stephenville,
Texas. The motion was seconded by Councilman Chambers. Motion carried unanimously.
Miss Marsha.L. Rogers was present and explained that she wanted to put the
mobile home on Lot 6, Block 8, Clifton Heights Addition, as she owned both the lot
and the mobile home. Miss Rogers also explained there were already three mobile
homes in this area and a condemned house not far from her lot and she could see
not reason not to let this be her permanent home.
Mayor Jones reviewed the amendment in 1974 of the Zoning Ordinance, which
states that a mobile home must be located in a B -2 or lower classification.
Mayor Jones also explained that he had looked at this area earlier in the day
and there were several non - conforming uses in this area that were in existence
when the Zoning Ordinance went into effect or when the amendent was made and also
that this lot is only approximately 90 feet from INDUSTRIAL zoning and, in his
opinion, this request should be studied more closely. _
After considerable discussion, Councilwoman Heath moved to grant a variance,
without setting a precedent, to allow Marsha L. Rogers to place a mobile home on
Lot 8, Block 6, Clifton Heights Addition, City of Stephenville, Texas. The motion
was seconded by Councilman Riggins, Motion carried unanimously.
Mayor Jones stated at this time, the City Zoning Board is doing exactly what
their obligation is and that is to look at these areas on the basis of the Council's
prior statements of use in setting it up as a B -2 zoning as opposed to an R -2 and
he hopes the City Zoning Board will understand the position of the Council and the
actions they have taken on this particular request.
Mayor Jones explained to the Council that the rate ordinance for Lone Star Gas
Company passed October 7, 1976, needs a minor amendment. The last line of Section I
which reads "Next 10,000 cu.ft. @$1.561 Per Mcf Net" should be amended to read "Over
10,000 cu.ft. @$1.561 Per Mcf Net
After discussion, Councilman Anderson moved to amend the last line of Section I
of the Rate Ordinance for Lone Star Gas Company passed October 7, 1976, to read
"Over 10,000 cu.ft. @$1.561 Per Mcf Net ". Councilman McGee made the second. Motion
carried unanimously.
Councilman Chambers reporting for the Garbage Franchise Committee said the Com-
mittee would like more time before making a recommendation on the request of Mr. Bill
Bledsoe for an extension to his present Garbage Franchise.

Be it further resolved, that the above named applicant
understands that the above project schedule must be approved by
the Texas Water Quality Board and the Environmental Protection
Agency, and that once a project schedule has been approved, no
changes will be authorized without first receiving approval of
the change from the Texas Water Quality Board and the Environ-
mental Protection Agency.

,;The Council discussed the County's request for the City to furnish the
material to pave the road (from the intersection of Texas 377 to where it turns
to go to the landfill) to the Sanitary Landfill. This would cost approximately
$15,000.
It was the consensus of the Mayor and Council this is a county road and should
be maintained by the County.
!After considerable discussion, Councilman Chambers moved to advise the County
Commissioners that the City Council denied the request for assistance in paving the
road to the Sanitary Landfill. The City's money is vested for this year and the
City ,feels it should be more the County's participation than the City's. The City -
is doing its part in policing the road and keeping the area clean. Councilman
Hammett made the second. Motion carried unanimously.
City Administrator Shelton reported he had inspected Fire Station #2 as of this
date and a contractor from Garland was in the process of replacing the tile in the
truck room. Mr. Shelton said he thought the corrections and repairs, including the
carpet and tile, would be finished by Wednesday of next week. Mr. Shelton also ad-
vised the Council the Fire Dept. was needing a place to put two trucks before winter
as the pumps cannot be left out to freeze.
!'Mayor Jones said the Council would need to meet shortly after the work is finish-
ed to determine whether or not to accept the building.
Mayor Jones reviewed the Step I Grant from The Texas Water Quality Board for a
Sewer Treatment Plant. The Texas Water Quality Board is now requesting a Project
Schedule outlining the steps, items and calendar days.
After some discussion, Councilman Chambers moved adoption of Resolution agreeing
that the application ofr which Federal Grant assistance has been requested pursuant
to the Federal Water Pollution Control Act Amendments of 1972, Public Law 92 -500,
will'be constructed to completion in accordance with the laws, rules, and regulations
and with the following project scheduel. The motion was seconded by Councilwoman
Heath. The motion carried unanimously.

City Administrator Shelton reported that because of the 3% unemployment in the
city;; Stephenville was not eligible for any money from the Public Works Act passed
by Congress.
Mayor Jones presented Ronnie Isham, Director of Parks & Recreation, with a
report from his department.
'Mr. Isham stated in his report that the five year Parks Improvement Program
would be finished in June, 1977. The total cost of the program was $244,800, 50%
from;the city and 50% from Texas Parks & Wildlife Department.
Mr. Isham discussed with the Council the remaining projects he would like to
complete and the ones, due to cost, he would not be able to complete. Some of the
projects to be completed are the Hike & Bike Trails, more playground equipment in the
cityI�park, another baseball field and some landscaping.
�Mr. Isham stated he would like more support facilities such as roads and park-
ing areas in the Jaycee Park but the cost of improvements and the cost of more per -
sonnel had caused him to hold off on the Jaycee Park development.
Mr. Isham also advised the Council a new recreation building or a town meeting
place; was needed very badly. Mr. Isham said he felt the Council should be giving
this,some thought for the near future. He said maintenance costs were very high on
the old building.,
Mayor Jones commended Mr. Isham and his staff for a job well done in the Parks
and Recreation Department.
Councilman Chambers reported that in addition to the requests for ramps at the
Recreation Hall for the handicapped.he.had'.received• tin the past, he had recently
received two requests that ramps be installed at the eight corners around the square
so the handicapped can-_.-move' around in that area more easily. Councilman Chambers
asked the Council to consider this item in the near future.
There being no further business, Mayor Jones adjourned the meeting at 8:30 p.m.
