ER OF THE CITY COUNCIL HALL, CITY OF STEPHENVILLE, TEXAS The Gity Council met in Special Session, Thursday, October 7, 1976 at 3:00 p.m. with Mayor Donald R. Jones present and presiding. Councilmembers Jim Chambers, W. M. Irwin, Charles Riggins, Raymond Anderson, Ermer Ferguson, Larry Hammett and Betty Heath were present. Councilman Calvin McGee was absent. Others attending the meeting were City Administrator Marshall Shelton, Director of Public Works R.Y.Gann, City Secretary Joyce Pemberton, Attorney Don Bird and Jonathan Pray. Mayor Jones explained the purpose of this meeting was to consider a rate ordinance for Lone Star Gas Company. Mr. Jonathan Pray came before the Counci protesting an increase in gas rates and re- questing the Council not to grant a rate increase to Lone Star Gas. Mayor Jones ex- plained to Mr. Pray the past actions of the Council and the Railroad Commission and explained the City's position as of this date. Mr. Don Bird, rate attorney employed by the City of Stephenville, came before the Council presenting his findings on the gas rates requested by Lone Star Gas Company. Mr. Bird explained that, after his discussions and negotiations with Lone Star Gas and after he had received their rate figures, he had prepared a rate ordinance (each member of the Council received a copy) for the Council to consider. Mr. Bird said this ordinance represented a compromise between the $52,000 the City had offered and the $66,000 Lone Star Gas had requested, as net income. This approx- imately a 10% reduction in net revenues. Mr. Bird also pointed out this rate ordinance is lower than the ordinance which is now in effect and which is the interim rate set by the Railroad Commission and, in his opinion, is lower thant the Railroad Commission would set if the City should decide to appeal to the Railroad Commission on October 13th and he highly recommends the Council pass and adopt this rate ordinance as pre- sented. After a lengthy discussion, Councilman Irwin moved to pass and adopt the Lone Star Gas Company rate ordinance as presented. Councilman Chambers made the second. Motion carried unanimously. Whenever as a result of any order of the Texas Railroad Commission or other governmental agency with requisite jurisdiction, or a court of competent jurisdiction, the rate aid by to consumers in the City of Stephenvi�llee increases orudecseaseo from distribution bas Of $1.0399 per PX7, each step of each of the rate schedules prescribed herein shall be adjusted upward or downward as the case may be, by the difference between the higher or lower rate and $1.0399 per MCF. Such new resulting base rate shall be computed to the nearest tenth of one cent per MT. Any such adjustment shall be applied to the bills of consumers effective the next dete billing following the billing period during which the adjustment was SECTION 3. The rate set forth in Section 1 may be charged, modified, or altered by action of the City Council of the City of Stephenville or by any other manner as provided by law. SECTION 4. Except as may be herein provided, this ordinance shall be cumulative R all previously enacted and exist ordinances of the City of Stephenville not in conflict herewith; and all ordinances or parts of ordinances which are in conflict with the provisions of this ordinance are hereby repealed as to those parts in conflict only.
