CHAMBER OF THE CITY COUNCIL CITY HALL, CITY OF STEPHENVILLE, TEXAS The City Council met in Special Session Friday, August 20, 1976 at 3 o'clock p.m. with Mayor'Donald R. Jones present and presiding. Councilmen Larry Hammett, Charles Riggins, W. M. Irwin, Jim Chambers, and Councilwoman Heath were present. Councilmen Calvin McGee and Raymond Anderson were absent. Others attending the meeting were City Administrator Marshall Shelton, Director of Public Works R.Y.Gann, Chief of Police Mike Watkins, Special Investigator Dale Pair, George Black, and City Secretary Joyce Pemberton. Mayor Jones explained that the purpose of this meeting was to canvass the election returns of the Special Election held on August 14th for the purpose of electing a councilman to fill the vacancy left when Jesse Sexton moved out of town. Mayor Jones appointed Councilmen Hammett, Riggins, and Councilwoman Heath and Councilman Chambers as chairman, as a committee to canvass the returns of the Special Election. Councilman Chambers reported for his committee the following results of the canvass of the returns: Candidates for Councilman, Place 5, received the follwing votes: Donald R. Taylor------------ - - - - -- 65 Ermer W. Ferguson---------- - - - - -- -190 W. J. (Bill) Shannon------- - - - - -- -133 Douglas Don Paulino--------- - - - - -- 12 Jonathan Slaten ------------------- 62 and that their canvass of the election returns reflect that Ermer W. Ferguson is the winner of the Special Election for the City Council, Place 5. Councilwoman Heath made the motion to accept the canvass of the election returns and declare Mr. Ermer W. Ferguson as the new member of the Council. Councilman Riggins made the second. Motion carried unanimously. Director of Public Works R.Y.Gann came before the Council to recommend that the low bid of Herrin Motor Ccompany, Stephenville, Texas, be accepted for a new dump truck for the Street Department at a cost of $7,000.00, without a bid. The bed to be installed by Motor Truck Equipment Company of Fort Worth, Texas, at a cost of $325.00. After some discussion, Councilman Chambers made the motion to accept the above recommendations by Mr. Gann for the purchase of a dump truck. Councilman Hammett made the second. Motion carried unanimously. Mr. George Black came before the Council to discuss the use of an $85,000 grant from the State Department of Highways and Transportation. This grant was re- ceived approximately one year ago to be used for the extension of Belknap St. when the one -way streets were in use. Now that the city does not have the one - way streets, the money may be allocated to some other project. The Council discussed several projects, such as the extension of Harbin Dr. to the South Loop, the extension of West Long St. and a bridge and the extension of East Long Street and some others. After a lengthy discussion, Councilman Riggins made the motion to allocate the $85,000 grant to the East Long Street Project with any money left over to go to the extension of West Long Street. Councilwoman Heath made the second. Motion carried by the following vote: AYES: Councilmen Chambers, Riggins, Hammett, Councilwoman Heath and Mayor Jones. NAYS: Councilman Irwin. The Council discussed the new fire sub station as to the number of men to be in each station and whether or not the new station will be the main station or not. Councilman Chambers stated that he would hate to see the new station put into full operation if it was going to cost the City more money. Councilwoman Heath reported that the windows in the new fire station were not installed correctly and that Mr. Fred B. Parker, Jr. had said the only way they could be fixed was to take them our and install them again. She also stated there were several other things wrong in the new station and she sug- gested the City witholding the 10% final payment. Councilwoman Heath stated that the workmanship as a whole was very bad. In elections where paper ballots are used, the ballots shall be counted by one or more sets of counting officers, each set to consist of one judge or clerk who shall read the ballots, and one or more clerks who shall enter the votes on tally lists prepared for the election. As a safeguard in the accuracy of the tallying, the votes shall be entered on three original tally lists, and during the progress of the counting the lists skull be compared and errors and discrepancies shall be corrected, and at the close of the counting the tally clerks shall certify offi- cially to the correctness of the lists. Art. 111b (Vernon's Art. 8.29b). Copies of returns, poll lists, and tally lists; distribution: (a) In precincts using paper ballots. In all general, special and primary elections, the number of copies of the returns, poll list, and tally list required for each precinct in which paper ballots are used shall be as follows: four copies of the returns, four copies of the poll list, and three copies of the tally list. These records shall be distributed as follows: (1) One copy of the returns, poll list, and tally list shall be delivered to the presiding officer of the authority which canvasses the returns (the county judge in elections held by the county; the mayor in city elections; the presiding officer of the governing board in elections held by other political subdivisions; and the chairman of the county executive committee in county primary elections) and shall be preserved by the canvassing authority for sixty days from the day of the election. (2) One copy of the returns, poll list, and tally list shall be delivered to the proper officer (the county clerk in elections held by the county and in county primary elections; the city secretary or clerk in municipal elections; and the presiding officer of the governing board in elections held by other political subdivisions), to be kept by him in his office open to inspection by the public for sixty days from the day of the election. (3) One copy of the returns, poll list, and tally list shall be placed in the ballot box containing the voted ballots. (4) The presiding judge shall retain in his custody one copy of the returns and one copy of the poll list of the election, and shall keep the same for sixty days after the day of the election, sub- ject to the inspection of anyone interested in such election.
