REGULAR SESSION - TUESDAY
AUGUST 3, 1976 - 7:00 P.M.
CHAMBER OF THE CITY COUNCIL
CITY HALL, CITY OF STEPHENVILLE, TEXAS
The City Council met in Regular Session Tuesday, August 3, 1976 at 7 o'clock p.m.
with Mayor Donald R. Jones present and presiding. Councilmen Jim Chambers, W.M.
Irwin, Calvin McGee, Charles Riggins, Larry Hammett, and Councilwoman Betty Heath
present. Councilman Raymond Anderson was absent.
Others attending the meeting were City Administrator Marshall Shelton, Director
of Public Works R.Y. Gann, City Attorney Joseph Chandler, Fire Marshall Kenneth
Haley, J. D. Chapman, City Secretary Joyce Pemberton, Dr. O.A. Grant, Marie
Clayton and members of the Garden Club and the Bicentennial Committee.
Reverend Henry Cox gave the invocation.
Being there were no additions, deletions or corrections, Mayor Jones declared
the minutes of previous meetings approved as written.
Mayor Jones advised the Council that he would like to set the date of August 31,
1976 at 7 o'clock p.m. for the Public Hearing for the formal approval of the 1976-
1977 budget.
City Administrator Shelton reviewed the budget in general and Mayor Jones authorized
him to go on with the preparation of the formal budget and get copies to the Council
before the meeting on August 31st.
Dr. 0. A. Grant came before the Council in behalf of the Bicentennial Committee
and the Garden Clubs to present a proposal to preserve the Bosque River a a park
area. Some of the recommendations proposed were a Nature Trail, a Hike & Bike Trail,
a museum for plants being threatened by extinction and some others.
Dr. Grant stated that he realized this would have to be considered a long range
plant, but as it was of major interest tothe Bicentennial Committee and the
various garden clubs and was strongly recommended in the Comprehensive Plan of
the City, they did urge the Council to undertake this project now.
After much discussion, it was the consensus of the Mayor and Council to submit
this proposal to the Planning Commission to examine what the potential is; what
the feasibility is, the acquisition costs would be; the maintenance costs; what
the scope of the project would be; and to develop proposals and report to the Council.
After City Administrator Shelton advised the Council what had brought about the
contract between the City of Dublin and the City of Stephenville for Dublin's use
of the Stephenville Sanitary Landfill, Councilman Irwin made the motion to authorize
Mayor Jones to enter into a contract with the City of Dublin for their use of the
Stephenville Sanitary Landfill. Councilwoman Heath made the second. Motion carried
unanimously.
Mr. Truett Bramlett came before the Council requesting something be done about
persons dumping their trash on the roads on Wednesday afternoons when the landfill
is closed.
After some discussion, it was the Council's feeling to make a concerted effort to
publicize the hours the landfill is open and hours it is closed and amount of the
fines for dumping trash on the roads.
Councilwoman Heath reported to the Council on her committee's meeting with
Warner Cable TV regarding a rate increase. She stated that the Committee felt
that the increase of fifty cents (50C) per primary connection was reasonable, but
did recommend this request be tabled until the cable company made the rate of re-
turn on common equity figures available:. Councilman Chambers asked that a
Balance Sheet listing the assets and liabilities be made available. Mayor
Jones tabled this request until said information is available.
The following bids had been received for 10 beds complete for the new fire
sub - station:

After some discussion, Councilwoman Heath made the motion to accept the low bid
of Wood Furniture Co., Stephenville, Texas, in the amount of $1,267.00 for ten
(10) beds complete. Councilman Hammett made the second. Motion carried unanimously.
The Council asked that all bids for the remainder of the furniture for the new
station be submitted at one time so the Council will have an overall picture of
the cost.
City Administrator Shelton told the Council that it was in the coming budget to
put the new fire sub station in operation in October, 1976.

The following bids had been received for a Flow Meter for the Wastewater.
Treatment Plant

After some discussion, Councilman Chambers made the motion to accept the
low bid in the amount of $1,729.00 submitted by B.I.F.,Dallas, Texas, for
a Flow Meter for the wastewater treatment plant. Councilman Hammett made
the second. Motion carried as follows:
AYES: Councilmen Chambers, McGee, Riggins, Hammett, and Council-
woman Heath.
NAYS: Councilman Irwin.
Mr. Shelton reported that the EPA had informed the City of Stephenville that
by July, 1980, the sewer treatment plant would have to be up to standard and
that this Flow Meter was a budgeted item.
Councilman McGee made the motion to reappoint Dr. Leon M. Altaras as City
Health Officer, subject to his acceptance, for the coming year. Councilman
Irwin made the second. Motion carried unanimously.
Mayor Jones told the Council he had received a letter

City Attorney Chandler advised the Council that the only legal justification
for granting this request is that it is a part of the City recreation program
and to further the City's recreation facilities.
City Administrator Shelton explained that this project is not a budgeted item
but he thought he could find the money some way if the Council thought it was
needed. It could be budgeted if we could pay after October 1st.
After considerable discussion, Mayor Jones appointed a committee of Councilmen
Chambers, Riggins and Irwin, with himself as ex officion, along with our legal
counsel, to meet with representatives from Tarleton to determine if we can
legally participate in this project and also determine if it is financially
feasible.
Mayor Jones opened the floor for Public Hearing to consider rezoning from R -2
to B -1, Lots 2,3,8 and 9, College View Addition, and the issuance of a non
conforming permit for two gasoline pumps; to consider the rezoning from R -1 to
INDUSTRIAL 31.13 acres of Lot 1, Block 149, City Addition, out of the L. E.
Pittman 51 and 20 acre tracts and 13.38 acres of Lot 2, Block 149, City Addition
out of the Dwi�ht..Lee Pittman 14.029 acre tracts, City of Stephenville, Texas:
Being there were no comments from the public, Mayor Jones closed the Public
Hearing for the consideration of rezoning the above mentioned property.
After some discussion, Councilman Riggins made the motion to accept the -
recommendations of the City Zoning Board to rezone from R -2 to B -1, Lots
2,3,8 and 9, Block 56, College View Addition, City of Stephenville, Texas, and
to issue a non conforming permit for two (2) gasoline pumps to be installed.
Councilman Chambers made the second. Motion carried unanimously.
Councilman Irwin made the motion to accept the recommendations of the City
Zoning Board to rezone from R -1 to INDUSTRIAL, 31.13 acres of Lot 1, Block
149, City Addition, out of the L.E. Pittman 51 and 20 acre tracts and 13.38
acres of Lot 2, Block 149, City Addition, out of the Dwight Lee Pittman
14.029 acre tract, City of Stephenville, Texas. Councilman Hammett made the
second. Motion carried unanimously.
Mayor Jones explained to the Council that the annual terms of the City Building
Board, Electrical Board and Plumbing Board had expired and he recommended the
following appointments, subject to their acceptance.

Councilwoman Heath moved to accept the above recommendations of Mayor Jones as
members of the City Electrical Board. Councilman Chambers made the second.

The City of Stephenville and the City of Dublin do hereby
contract and agree for the use of the City of Stephenville Land Fill
by the City of Dublin for solid waste disposal on the terms and con-
ditions hereinafter set out:

This contract shall become effective on August 1, 1976 or
as soon thereafter as same may be executed by the parties hereto and
shall extend to August 1, 1977.

Packer truck price will be eighty cents ($.80) per cubic
;yard and rated capacity of each packer unit will always be assumed
to be fully loaded for the making of this charge. All other vehicles
will pay according to posted prices at land fill on individual basis.
3.
Rules for use of the land fill will be the same as those
now in ;effect and which rules are attached hereto and signed by the
Mayor of each city for the purpose of identification.
4.
Litter shall be controlled by the City of Dublin between
the land fill and the City of Dublin.
5.
Billing by the City of Stephenville to the City of Dublin
will be on a monthly basis according to tickets issued for each trip
to the land fill and payment will be made upon the submission of the
bills.

All dumping will be in the place designated by the land
fill attendant.
7.
Hours that the land fill will be open may change from time
to time as designated by the Stephenville City Council. The present
hours have been observed for two years and are as follows:
Monday 9:00 a.m. to 6:00 p.m.
Tuesday 9:00 a.m, to 6:00 p.m.
Wednesday: 9:OO a.m. to 12:00 noon
Thursday : 9:00 a`:m. to 6:00 p.m.
Friday 9:00 a.m. to 6:00 p.m.
Saturday : 9:00 a.m. to 1:00 p.m.

This contract is executed in pursuance of resolution by the
City Council of the City of Stephenville passed at meeting of the
3rd day of August , 1976 and recorded in the Minutes of said
meeting appearing in Volume _K_ at Page 50A of such minutes. This
contract is executed in pursuance of resolution of the City Council
of the City of Dublin, Texas, passed on the 13m day of July
1976 and recorded in Volume at Page 79 of said minutes.

RULES FOR USE OF STEPHENVILLE LANDFILL
1. All vehicles must be covered. Brush must be tied down, everything
else must be covered.
2. No burning will be permitted.
3. An attendant shall be on duty during designated hours to direct
public deposit unloading of refuse and unloading shall be confined
to as small an area as possible.
4. Control of windblown material as follows: approximately 6 feet
poultry and rabbit nettings around entire landfill and 4 feet
around immediate area.
5. Any windblown material shall be policed constantly to maintain a
clean and sanitary site.
6. No loitering, pilfering or hunting for souvenirs by the public
shall be permitted.
7. Provision shall be made for all - weather access from the entrance
of the site to the unloading area or wet weather access shall be
provided to an alternate treatment area.
8. All solid waste deposited each day shall be covered with earthen
material and then compacted to prevent insect and rodent problems
and blowing waste materials. Six (6) feet of cover daily is
required. Dirt previously mixed with garbage or trash shall not
be used for cover.
9. A final cover of compacted material shall be placed over each
ditch not later than one week after completion with two feet of
earthen material.
10. The gate attendant shall have authority to direct vehicles to the
correct location and obtain license numbers of those vehicles
violating state regulations by not having screens or allowing
trash to blow from vehicle in transit.
11. A deputy Sheriff duly deputized will patrol the area from the
City to the landfill with full authority to issue tickets to any
person that allows paper and trash to blow from their vehicles.

12. The gate to the landfill will be open on designated hours to be
published in the local paper. Anyone found dumping in any area
except the landfill will be ticketed.

Dear Mayor Jones:
We are transmitting herewith five (5) copies of the new Municipal
Maintenance Ordinance and Agreement with the City of Stephenville.
This agreement is in accordance with the letter dated May 20, 1976,
from Mr. Marshall Shelton. We understand that the State Department
of Highways and Public Transportation will be allowed to use the City
of Stephenville landfill at no cost to the State.
After you have reviewed the attached Municipal Maintenance Ordinance
and Agreement, and if you concur, please execute four (4) copies and
return to this office for our certification and retain one (1) copy
for your files. One copy will be returned to you for your permanent
file after certification by the proper authorities.

AN ORDINANCE PROVIDING FOR THE MAINTENANCE OF CERTAIN STATE
HIGHWAYS AND/OR PORTIONS OF STATE HIGHWAYS IN THE CITY OF
Stephenville , COUNTY OF Erath ,
TEXAS, HEREBY REFERRED TO AS MUNICIPAL MAINTENANCE PROJECT AND
AUTHORIZING THE MAYOR OF THE CITY OR OTHER AUTHORIZED CITY OFFICIAL
TO EXECUTE AND AFFIX THE CORPORATE SEAL AND ATTEST SAME. A CERTAIN
AGREEMENT BETWEEN THE CITY AND THE STATE OF TEXAS, PROVIDING FOR
THE MAINTENANCE AND USE OF THE SAID MAINTENANCE PROJECT: AND DE-
CLARING AN EMERGENCY AND PROVIDING THAT THIS ORDINANCE SHOULD BE
EFFECTIVE FROM AND AFTER ITS PASSAGE.
WHEREAS, the Public convenience, safety and necessity of the
City, and the people of the City require that State Highway routes within the
City be adequately maintained; and
WHEREAS, the City has requested that the State of Texas, enter
upon and contribute financially to the maintenance of said project; and
WHEREAS, the State of Texas has made it known to the City
that it will, with its own forces and equipment and at its sole cost and expense,
enter upon and maintain said project, conditioned upon the provisions concerning
liabilities and responsibilities for maintenance, control, supervision, and
regulation which are set out in the form attached hereto, made a part hereof, and
marked "MUNICIPAL MAINTENANCE AGREEMENT "; and
WHEREAS, said project consists of those State Highways and /or
portions thereof which are described and included in the form attached hereto and
marked-"MUNICIPAL MAINTENANCE AGREEMENT."
NOW, THEREFORE, BE IT ORDAINED by the City Council of
Stephenville, Texas
SECTION 1. That the public convenience, safety and necessity of the City
and the people of the City require said project be adequately maintained.
SECTION 2. That the State of Texas be and is hereby authorized to enter
upon and maintain said maintenance project.
SECTION 3. That the Mayor, or proper City official, of the City, be and
is hereby authorized to execute for and on behalf of the City an agreement with
the State of Texas, in accordance with and for the purpose of carrying out the
terms and provisions of this order, in the form attached hereto, made a part hereto,
and marked "MUNICIPAL MAINTENANCE AGREEMENT." The City Secretary is hereby directed
to attest the agreement and to affix the proper seal of the City thereto.
SECTION 4. The Mayor of the City, having requested in writing that this ordinance
take effect forthwith and there being in fact an emergency and imperative necessity
that the work herein provided for be begun and carried out promptly and with expedition
and that the agreement aforesaid shall be immediately made, executed and delivered
to the end that such work herein provided for may be begun and carried out promptly
and with expedition. The reading of the ordinance on three several days is hereby
dispensed with and the same shall be in full force and effect from and after its
passage.

MUNICIPAL MAINTENANCE AGREEMENT

THIS AGREEMENT made this 3rt1 day of August 19��,
by and between the State of Texas, hereinafter referred to as the "State ",
party of the first part, and the City of Stephenville Erath

County, Texas (population 9277 1960 Federal Census) acting by
and through its duly authorized officers, hereinafter called the "City ",
party of the second part.
W I T N E S S E T H
WHEREAS, the City has requested the State to assist in the mainten-
ance of State Highway routes within such city; and
WHEREAS, the State Highway Engineer, acting for and in behalf of the
State Highway Commission, has made it known to the City that the State will
assist the City in the maintenance, control, supervision, and regulation of
State Highway routes within such city, conditioned that the City will enter
into agreements with the State for the purpose of determining the responsi-
bilities of the parties thereto:
A G R E E M E N T
NOW, THEREFORE, in consideration of the premises and of the mutual
convenants and agreements of the parties hereto to be by them respectively
kept and performed, it is agreed as follows:

1. This agreement is intended to cover and provide for State
participation in the maintenance of the following classifi-
cation of State Highway routes within the City:
A. Non - Controlled Access routes or portions thereof which
are described and /or graphically shown as "State Main-
tained" routes in Exhibit "A ", which is attached hereto
and made a part hereof.
B. All State Highway routes or portions thereof which have
been designated by the Texas Highway Commission as Con-
trolled Access Highways and which are described and /or
graphically shown in Exhibit "B ", which is attached
hereto and made a part hereof.
2. The City shall retain full responsibility for the mainten-
ance of those State Highway routes and portions thereof
which are listed and /or graphically shown in Exhibit "A"
and Exhibit "B" as "City Maintained" routes, except that
the State is hereby authorized by the City to erect and
maintain normal route markers and directional and desti-
nation signs thereon for direction of highway traffic.
3. In the event that the present system of State Highway
routes within the City is changed by cancellation, modified
routing, new routes, or change in the City's corporate
limits, the State shall terminate maintenance and this
agreement shall become null and void on that portion of
the routes which are no longer routes of a State Highway;
and the full effect and all conditions of this agreement
shall apply to the changed routes or new routes of the
State Highways within the City and shall be classified as
"State Maintained under paragraph 1 above, unless the
execution of a new agreement on the changed portion of
the routes is requested by either the City or the State.
GENERAL CONDITIONS
1. The City hereby agrees and does hereby authorize the State to
maintain the State Highway routes covered by this agreement in
the manner set out herein.

2. This agreement shall supplement any existing agreements between
the State and the City for the maintenance or construction and
maintenance of the highways covered herein and this agreement
shall supersede such existing agreements only in respect to
points of conflict.
3. Traffic regulations including speed limits, will be established
and fixed by agreement with the State after traffic and engi-
neering surveys have been conducted.
4. It is mutually agreed that, subject to approval by the State,
any street lighting system may be installed by the City provided
the City shall pay all cost of installation, maintenance and
operation except in those installation specifically covered by
separate agreements between the City and State.
5. It is understood and agreed that this agreement is for the
purpose of defining the authority and responsibility of both
parties for maintenance of highway routes through the City and
shall in no way be considered to cover any present or past obli-
gation either real or anticipated concerning such State Highway
routes through the City.
6. The City shall prohibit the movement of loads over State main-
tained streets which exceed the legal limits for either weight,
length, height or width, as prescribed in Vernon's Penal Code
827a for public highways outside coporate limits of cities,
except those having proper permits from the State for such
movements. The City shall also, by ordinance and enforcement,
prescribe and enforce lower weight limits when mutually agreed
by the City and the State that such restrictions are needed to
avoid damage to the street and /or for traffic safety.
7, The City shall prevent future encroachments within the right of
way of the highway routes and assist in removal of any present
encroachments when requested by the State except where specifi-
cally authorized by separate agreement; and prohibit the plant-
ing of trees or shrubbery or the creation or construction of
any other obstruction within the right of way without prior
agreement with the State.
8. The City agrees that traffic control devices, such as stop
and slow signs, traffic signal lights and other types of
devices for traffic control, in respect to type of device,
points of installation, and necessity will be fixed by agree-

ment with the State after traffic and engineering surveys have
been made. The City agrees that it will not install or main-
tain or permit the installation or maintenance of any type of
traffic control device which will affect or influence the
utility of the State Highway routes without having obtained in
writing the prior approval of the State. Traffic control de-
vices installed prior to the date of this agreement are hereby
made subject to the terms of this agreement and the City agrees
to the removal of such devices which affect or influence the
utility of the State Highway routes unless their continued use
is approved in writing by the State. It is understood that
future traffic signal lights installed as a joint project by
the City and State will be the subject of a separate agreement
outlining the responsibilities for installation and maintenance.
9. The City agrees to continue its responsibility for proper con-
struction, maintenance and control of access driveway facilities
in accordance with "Regulations for Access Driveways to State
Highways" adopted by the Texas Highway Department or in accord-
ance with other standards and specifications for the design,
construction and maintenance details subject to approval by the
Texas Highway Department.
10. It is understood that the use of unused right of way and areas
beneath structures for parking, will be the responsibility of
the City as determined by a separate agreement.
NON - CONTROLLED ACCESS HIGHWAYS
State'.s Responsibilities
1. Maintain the pavement, base and its support and maintain the
shoulders on those sections where there is no curb and gutter.
2. Install and maintain normal highway markings necessary for
directing highway traffic in a safe and efficient manner, which
shall include normal route markers, directional and destination
signs, center line, lane line and no- passing barrier line
stripes, and such other pavement markings considered necessary
for direction of traffic, except crosswalks. Any other traffic
striping desired by the City may be placed and maintained by
the City subject to the approval of the State.

3. Assist the City in sweeping and otherwise cleaning the pavement,
in mowing and cleaningtof litter; and in maintenance of roadway
ditches, on those sections of State Highway routes where and to
the extent that such duties are delineated on Exhibit "A
4. Assist in snow and ice control as availability of labor and
equipment will allow.
City's Responsibilities
1. Prohibit angle parking, except upon written approval by the
State after traffic and engineering surveys have been conducted
to determine that the roadway is of sufficient width to permit
angle parking without interfering with the free movement of
traffic.
2.
-Require installations, repairs, removals or adjustments of
publicly or privately owned utilities or services to be per-
formed in accordance with 'State Highway Department specif-
cations and subject to approval of the _State.
3. Retain all functions and responsibilities for maintenance,
control, supervision, and regulation which are not specifi -
cally described as the responsibility of the State. The
assistance by the State in maintenance of roadway ditches
does not relieve the City of its responsibility for drainage
of the highway facility within its corporate limits except
where participation by the State other than above is speci-
fically covered in a separate agreement between the City and
the State.

Termination
1. It is understood and agreed between the parties hereto that all
obligation of the State created herein to maintain the State
Highway routes covered by this agreement shall terminate if and
when they are no longer routes of State Highways; and further,
that should either party fail to properly fulfill its obligations
as herein outlined, the other party may terminate this agreement
upon thirty days written notice.
Said State assumption of maintenance shall be effective the date of
execution of this agreement by the Highway Department.

Councilwoman Heath made the motion to appoint Theresa Mulloy to the North Texas
Council of Governments' Board on Drug Abuse when they have an opening. Councilman

Mayor Jones reviewed the Maintenance Agreement with the Texas Highway Department
and explained what was involved and whey we.were changing our maintenance agree-
ment with them.
After some discussion, Coucilman Riggins made the motion to adopt the Maintenance
Agreement with Texas Highway Department as presented. Councilman McGee made the
second. Motion carried unanimously.
City Administrator Shelton read the bids received for a new dump truck for the
Street Department. They are as follows:

Director of Public Works Gann requested more time to consider the above bids in
order to determine if the old bed the city now has will fit the new chassis and
how much cost will be involved to get the old bed installed on the new chassis.
After some discussion, Mayor Jones deferred action on this item until the meeting
of August 31, 1976.
Councilwoman Heath suggested discontinuing the invocations and just asking for
the prayers of everyone for this Council and all governing bodies. After some
discussion, it was the consensus of the Council to continue the invocations.
