CHAMBER OF THE CITY COUNCIL
CITY HALL, CITY OF STEPHENVILLE, TEXAS
The City Council met in Regular Session, Tuesday, May 4, 1976 at 7:OO;p.m.,
with Mayor Donald R. Jones present and presiding. Councilmen Jim Chambers,
W. M. Irwin, Calvin McGee, Charles Riggins, Raymond Anderson, Jesse Sexton,
Larry Hammett and Councilwoman Betty Heath were present
Others attending the meeting were City Administrator Marshall Shelton,
Director of Public Works R. Y. Gann, Assistant City Attorney Randy
Chandler, Director of Utilities Danny Johnson, Director of Parks and
Recreation Ronnie Isham, Chairman of the Zoning Board Dean Cox, Taylor Almon,
Dan Rambo, Dorothy Watkins, Chief of Police Mike Watkins, Phil Bradbury,
Harry Schermer, Rev. Emil Becker, and City Secretary Joyce Pemberton, Also
a large group of interested citizens.
Reverend Emil Becker gave the invocation.
There being no additions, deletions, or corrections to the minutes of the
previous meetings on April 6th and April 26th, Mayor Jones declared the
minutes approved as written.
Mr. Taylor Almon, the City's financial advisor, came before the Council and
read an ordinance authorizing the issuance of Refunding Bonds by the Water
Development Board in the amount of $375,000 for the Certificates of Obligation
for the financing of the water supply wells.
After some discussion, Councilman Chambers made the motion to pass and adopt
the ordinance authorizing the issuance of Refunding Bonds in the amount of
$3751000 as read. (Ordinance attached to and becoming a part of these min-
utes/. Councilman Irwin made the second. Motion carried unanimously.
ORDINANCE
ORDINANCE AUTHORIZING THE ISSUANCE OF REFUNDING BONDS.
WHEREAS, heretofore on May 6, 1975, the City Council passed an ordinance
authorizing the issuance of of City of Stephenville Certificates of Obligation,
Series 1975, dated June 1, 1975, hereinafter called "Series 1975 Certificates
of Obligation "; and
WHEREAS, Series 1975 Certificates of Obligation, in the principal amount
of $100,000, being Certificates of Obligation Nos. 1 through 20, have been
issued and delivered, and the City has received full value therefor; and
WHEREAS,heretofore on March 30, 1976, the City Council of the City of
Stephenville, Texas, passed an Ordinance authorizing the issuance of City
of Stephenville Certificates of Obligation, Series 1976, dated April 10, 1976,
hereinafter called "Series 1976 Certificates of Obligation "; and
WHEREAS, Series 1976 Certificates of Obligation, in the principal
amount of $275,000, being Certificates'of Obligation Nos. 1 through 55,
have been issued and delivered, and the City has received full value
therefore; and
WHEREAS, in order to effectuate an interest savings, the City deems
it advisable to issue the refunding bonds, as hereinafter set out, to re-
fund Series 1975 Certificates of Obligation and Series 1976 Certificates of
Obligation, in the aggregate amount of $375,000, pursuant to Article 717k -3,
V.A.T.C.S.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Director of Parks & Recreation Ronnie Isham came before the Council reporting
that the specifications for the electrical work on the camper sites at the
City Park were not complete therefore, the requests for bids had not been
mailed.
Mr. Isham also reported that it cost the City approximately $800.00 for the
Tarleton- Stephenville Bicentennial Fair. The Tarleton Bicentennial Fair
committee is make their financial report at the next Council meeting. Mr.
Isham stated he thought the Fair was a success and it would be nice as an
annual event but, in his opinion, the Council should set the guidelines
and a committee from the Council oversee the fair.

Mr. Dan Rambo, one of the developers of a proposed apartment complex to
be constructed on a portion of Lots 10 and 11, Block 139, City Addition, _
came before the Council and gave a detailed report, along with plats and
drawings, of what their intentions and plans are for this project, if the
Council should grant the zoning request.
After considerable discussion between Mr. Rambo and the Council, Mayor
Jones asked Councilman Irwin to report the recommendations of his committee,
appointed to study this zoning change request.
After explaining the Committee's recommendations and why, Councilman Irwin
made the motion that the Council uphold the recommendations of the Zoning
Board to rezone a portion of Lots l0 and 11, Block 139, City Addition,
City of Stephenville, Texas, from R -1 to R -2. The north 260 to 280 feet
to remain R -1 as a buffer zone between the rear boundary lines of the
residences on Phelps Street, provided the drainage problem is resolved. This
motion also includes the Zoning Board's recommendation to rezone Blocks 140
and 145, City Addition, City of Stephenville, Texas, from R -2 to B -1 for the
purpose of a retail business. Councilman Chambers made the second.
Councilwoman Heath stated, in part, that she did not feel the zoning changes
on Lots 10 and 11, Block 139, City Addition, should be made in view of the
opposition of the surrounding residents.
Councilman Chambers explained that, in his opinion, to develop this property
for single family dwellings would be too costly and for this particular
property, the proposed zoning change would be in logical and proper sequence.
After more discussion, Councilman McGee made the motion to separate the two
zoning requests for the purpose of voting. Councilman Irwin made the second.
Motion carried unanimously.
Councilman Irwin made the motion that a portion of Blocks 140 and 145, City
Addition, City of Stephenville, Texas, being that 6.66 acres located south
of West Washington and going through to US 377, be rezoned from R -2 to B -1
for the purpose of a retail business. Councilman Anderson made the second.
Motion carried unanimously.
Councilman Irwin made the motion that the recommendations of the Zoning Board
be upheld and that a portion of Lots 10 and 11, Block 139, City Addition,
City of Stephenville, Texas, be rezoned from R -1 to R -2, with the north 260
to 280 feet of said lots to remain R -1 as a buffer zone to the rear boundary
lines of the residences on Phelps Street, provided the drainage problem is
satisfied and accepted by the Director of Public Works R. Y. Gann. Council-
man Chambers made the second. Motion carried by a vote of 6 for, 2 against,
as follows:
AYES: Councilmen Chambers, Irwin, Riggins, Anderson, Sexton and Hammett.
NAYS: Councilwoman Heath and Councilman McGee.
Mr. Terry Shell, 301 S..Lillian and Mr. R. D. Godwin, 575 Charlotte, came
before the Council voicing their opposition to the rezoning of Lots 10 and
11, Block 139, City Addition. ^�

Fire Marshall Kenneth Haley reported only one bid was received for a booster
tank for the new fire truck chassis.
W. A. Neel and Associates, Waco, Texas--- - - - - -- $7,500.00
Approximately 120 calendar days after receipt of an order and cab
and chassis.
Mr. Haley recommended accepting this bid as they would meet the specifications
100 %.
After some discussion, Councilman Sexton made the motion to accept the only
bid received which is that of W. A. Neel & Associates, Waco, Texas, in the
amount of $7,500.00 for one (i) special booster truck equipment mounted on
the City of Stephenville cab and chassis as per the enclosed specifications.
Councilman,Hammett made the second. Motion carried unanimously.
After considerable discussion, Councilman Hammett made the motion to approve
the following recommendations from the Water Department:
A. Tarleton State University - Each meter will be gilled as a residential
meter - each meter will be charged a minimum and regular rates
thereafter, effective with the September 15, 1976, billing.
B. The Stephenville Golf Course will be billed a minimum on each
meter and regular rates up to 10,000 gallons, 45� per 1,000
gallons of consumption on each meter and that their rates be f
adjusted each time there is a water rate increase. This to be
effective September 15, 1976, billing. —

C. If a customer has more than one water meter, each meter be
charged a minimum and regular rates thereafter. If the
customer has one meter cut off anytime during the year, he
will receive no bill for this meter during the time it is off.
D. The City must have a water deposit for each meter before the
water is turned on.
E. The following policies for disconnects for non - payment of water
bills:
1. An additional $5.00 delinquent charge will automatically
be charged to all accounts unpaid or not received at City
Hall by 8 :30 A. M. on the morning of cut -off day.
2. The Service Man is not authorized to accept payment of bill.
All payments must be made at City Hall.
3. When a customer calls into City Hall on Cut -Off day and
requests that his bill be put on "hold" until later in the
day, etc., he is subject to pay the $5.00 delinquent charge.
Councilman McGee made the second. Motion carried unanimously.
City Administrator Shelton reported the following two bids had been re-
ceived for roofing repairs on the City Hall, Library, and Recreation
Building:
Hamilton Roofing Company, Fort Worth, Texas ---------- $ 9,739.00
Queen Roofing Company, Mineral Wells, Texas---- - - - - -- $11,183.00
Mr. Shelton also explained that the above bidders had said they could
patch the roofs for approximately $400.00 each and also that this is not
a budgeted item, but certainly the repairs are needed.
After considerable discussion, Councilman Anderson made the motion to have
the roofs patched at this time and put the complete roofing repairs in next
year's budget. Councilman Sexton made the second. Motion carried unani-
mously.
After considerable discussion, Councilman McGee made the motion to raise
the parking meter fines to fifty cents (50f) per ticket twice a day and
make the parking on the lot behind the Senior Citizens building a "sticker
type" parking at $10.00 per month.
After more discussion, Councilman McGee withdrew his motion and Mayor Jones
asked Mr. Shelton to check into this further with the Downtown Merchants
Association and the Chamber of Commerce.
Mayor Jones explained that he had three items that needed to be taken care
of at this time and were not on the agenda (1) the appointment of an
interim Municipal Judge, (2) consideration of the Zoning Board's recommend-
ations and (3) discuss establishing a rifle range.
Councilwoman Heath made the motion that the Council consider the above non -
agenda items. Councilman Sexton made the second. Motion carried uanimously.
Mayor Jones explained that, due to illness, the present Municipal Judge,
J. P. Hedrick, is unable to carry out his duties and an interim Municipal
Judge is needed. As an administrative matter, City Administrator Shelton
has appointed Joyce Pemberton as interim Municipal Judge, subject to the
Council's approval.
Councilman Irwin made the motion to appoint Joyce Pemberton as interim
Municipal Judge. Councilman Riggins made the xecond. Motion carried
unanimously.
After some discussion, Councilman Anderson made the motion that the Council
set June 1, 1976 at 7:00 p.m. for a Public Hearing for consideration of re-
zoning of Lot 12, Block 157, City Addition, City of Stephenville, Texas,
this being the property commonly known as the Charles Neblett Property on
US -377. Councilman Sexton made the second. Motion carried unanimously.
Mr. Harry Schermeer, President of the Sportsman Club, came before the Council
requesting that the Council give some consideration to joining with the
Sportsman Club in establishing a rifle range.
After some discussion, Mayor Jones appointed City Administrator Shelton,
Chief of Police Mike Watkins and Director of Public Works R. Y. Gann as a
committee, to work with a committee from the Sportsman Club to see what
can be worked out in regard to a rifle range.
B
The Council discussed the Performance Bond on the Fire Sub - Station and It
what steps should be taken to get the building finished and ready for
use. —
There being no other business, the meeting adjourned at 10 :00 P.M.

WHEREAS, the City Council deems it advisable to issue
tificates of Obligation to be sold for cash for the purpose
paying all or a portion of the City's contractual obligations
improvements and extensions to the City's waterworks system,
wit: drill water supply wells and install deep well turbine
ps for water field, and for paying all or a portion of the
al, fiscal and engineering fees in connection with this
•roject; and
WHEREAS, the Certificates of Obligation hereinafter author -
zed and designated are to be issued and delivered pursuant to
2368x.1 V.A.T.C.S; and
WHEREAS, the City Council has heretofore, on the 2nd of
1976, passed an Ordinance authorizing and directing the
ty Secretary to give Notice of Intention to Issue Certificates

WHEREAS, said notice has been duly published in the
ville Empire Tribune, which is a newspaper of general

(hereinafter sometimes called "Certificates ") are hereby author-

Section 4. That said Certificates shall bear interest from
their date to their respective maturities, or to their dates of
redemption prior to maturity, at the rate of 7% per annum. Said
interest shall be evidenced by interest coupons which shall ap-
pertain to said Certificates, and which shall be payable in the

set forth in this Ordinance.
Section 5. That said Certificates and interest coupons
shall be issued, shall be payable, may be redeemed prior to their
scheduled maturities, shall have the characteristics, and shall
signed and executed (and said Certificates shall be sealed), all
as provided, and in the manner indicated, in the FORM OF CERTIFI-
CATE set forth in this Ordinance.
Section 6. That the form of said Certificates, including
the form of Registration Certificate of the Comptroller of Public
Accounts of the State of Texas to be printed and endorsed on each
of said Certificates, and the form of the aforesaid interest
coupons which shall appertain and be attached initially to each
of said Certificates, shall be, respectively, substantially as

Section 7. That a special "Interest and Sinking Fund" is
hereby created solely for the benefit of said Certificates, and
said Interest and Sinking Fund shall be established and maintain-
by said City at an official depository bank of said City.
Said Interest and Sinking Fund shall be kept separate and apart
from all other funds and accounts of said City and shall be used
only for paying the interest on and principal of said Certificate:
ad valorem taxes levied and collected for and on account of
said Certificates shall be deposited, as collected, to the credit

and deposited to the credit of the aforesaid Interest and Sinking

Section B. Said Certificates additionally shall be payable
from and secured by the revenues of the City's waterworks system
remaining after payment of all operation and maintenance expenses
thereof, and all debt service, reserve, and other requirements in
connection with all of the City's revenue bonds (now or hereafter
outstanding) and the City's outstanding Certificates of Obliga-
tion, Series 1975 which are payable from and secured.by a lien
on all or any part of the net revenues of the City's waterworks
system, with the aforesaid remaining revenues being hereinafter
called "Surplus Revenues ". The City shall deposit all Surplus
Revenues that remain after satisfying the prior lien on such
revenues, to the credit of the Interest and Sinking Fund created
pursuant to Section 7. Notwithstanding the requirements of
Section 7, if Surplus Revenues are actually on deposit in the
Interest and Sinking Fund in advance of the time when ad valorem
taxes are scheduled to be levied for any year, then the amount of
taxes which otherwise would have been required to be levied pur-
suant to Section 7 may be reduced to the extent and by the amount
of the Surplus Revenues then on deposit in the Interest and Sink-
ing Fund.
Section 9. That the Mayor of said City is hereby authorized
to have control of said Certificates and all necessary records
and proceedings pertaining to said Certificates pending their
delivery and their investigation, examination, and approval by
the Attorney General of the State of Texas, and their registra-
tion by the Comptroller of Public Accounts of the State of Texas.
Upon registration of said Certificates, said Comptroller of Public
Accounts (or a deputy designated in writing to act for said Comp-
troller) shall manually sign the Comptroller's Registration Cer-
tificate printed and endorsed on each of said Certificates, and
the seal of said Comptroller shall be impressed or placed in fac-
simile, on each of said Certificates.
Section 10. That the City covenants to and with the purchas
ers of the Certificates that it will make no use of the proceeds
of the Certificates at any time throughout the term of this issue
of Certificates, which if such use had been reasonably expected
on the.date of delivery of the Certificates to and payment for
the Certificates by the purchasers, would have caused the Certi-
ficates to be arbitrage bonds within the meaning of Section 103(d
of the Internal Revenue Code of 1954, as amended, or any regula-
tions or rulings pertaining thereto; and by this covenant the Ci
is obligated to comply with the requirements of the aforesaid
Section 103(d) and all applicable and pertinent Department of
the Treasury regulations relating to arbitrage bonds. The City
further covenants that the proceeds of the Certificates will not
otherwise be used directly or indirectly so as to cause all or
any part of the Certificates to be or become arbitrage bonds
within the meaning of the aforesaid Section 103(d), or any regu-
lations or rulings pertaining thereto.
Section 11. It is hereby officially found and determined
that a case of emergency or urgent public necessity exists which
requires the holding of the meeting at which this Ordinance is
passed, such emergency or urgent public necessity being that
the authorization of the proposed Certificates of Obligation is
required as soon as possible and without delay for necessary and
urgently needed public improvements; and that said meeting was
open to the public and public notice of the time, place, and
purpose of said meeting was given, all as required by Vernon's
Ann. Civ. St., Article 6252 -17.
Section 12. That said Certificates are hereby sold and
shall be delivered to Almon & Co. for cash for the par value
thereof and accrued interest to date of delivery, and such
accrued interest shall be deposited into the Interest and Sink-
ing Fund.
Section 13. That this Ordinance was read once by the City
Council and it was deemed by said City Council that upon passage
of this Ordinance it shall take effect immediately.

said Board of Equalization has finally approved the same; and
that the assessed value of taxable property in said City upon
which the annual ad valorem tax of said City actually has been
or will be levied (after deducting the amount of exemptions,
if any, of assessed values of residence homesteads of persons
sixty five years of age or older pursuant to Section 1 -b(b) of
Article VIII of the Texas Constitution), according to the

WHEREAS, heretofore on May 4 1975, the City Council passed
an Ordinance authorizing the issuance of City of.Stephenville
Certificates of Obligation, Series 1975, dated June 1, 1975,
hereinafter called "Series 1975 Certificates of Obligation "; and
WHEREAS, Series 1975 Certificates of Obligation, in the
principal amount of $100,000, being Certificates of Obligation
Nos. 1 through 20, have been issued and delivered, and the City
has received full value therefor; and
WHEREAS, heretofore on March 30, 1976, the City Council of
the City of Stephenville, Texas, passed an Ordinance authorizing
the issuance of City of Stephenville Certificates of Obligation,
Series 1976, dated April 10, 1976, hereinafter called "Series
1976 Certificates of Obligation "; and
WHEREAS, Series 1976 Certificates of Obligation, in the
principal amount of $275,000, being Certificates of Obligation

standing and unpaid; and said tax shall be assessed and
collected each such year and deposited to the credit of the
aforesaid Interest and Sinking Fund. Said ad valorem taxes
sufficient to provide for the payment of the interest on and
principal of said bonds, as such interest comes due and such
principal matures, are hereby pledged irrevocably for such
payment, within the limit prescribed by law.
Section 8. That the proper proportionate part of the
Interest and Sinking Funds originally established for the ob-
ligations being refunded, together with the proper proportionate
part of all taxes heretofore levied and now in the process of
collection for the benefit of said obligations being refunded,
are hereby appropriated, and shall be transferred immediately
to the Series 1976 Interest and Sinking Fund created herein.
Section 9. That the Mayor of said City is hereby
authorized to have control of said bonds and all necessary
records and proceedings pertaining to said bonds pending their
delivery and their investigation, examination, and approval by
the Attorney General of the State of TExas, and their regis-
tration by the Comptroller of Public Accounts of the State of
TExas. Upon registration of said bonds, said Comptroller of
Public Accounts (or a deputy designated in writing to act for
said Comptroller) shall manually sign the Comptroller's
Registration. Certificate printed and endorsed on each of said
bonds, and the seal of said Comptroller shall be impressed, or
placed in facsimile, on each of said bonds.
Section 10. That the Comptroller of Public Accounts of
the State of Texas is hereby authorized and directed to deliver
said bonds to the holder or holders of the Series 1975
Certificates of Obligation and Series 1976 Certificates of
Obligation being refunded thereby, in exchange for, and upon
surrender and cancellation of, a like amount of said obliga
tions being so refunded, provided that all current and unmatured
interest coupons are attached to each of said Series 1975 Cer-
tificates of Obligation and Series 1976 Certificates of Obliga-
tion surrendered for exchange. In addition to all other rights,
the holder of the bonds shall be subrogated to all pertinent
and necessary rights of the holder of the obligations being
refunded hereby.
Section 11., That it is hereby officially found and deter -
mined that a case of emergency or urgent public necessity
exists which requires the holding of the meeting at which this
Ordinance is passed, such emergency or urgent public necessity
being that the proceeds from the sale of said bonds are
required as soon as possible and without delay for necessary
and urgently needed public improvements; and that said meeting
was open to the public, and public notice of the time, place
and purpose of said meeting was given, all as required by
Vernon's Ann. Civ. St. Article 6252 -17.
Section 12. That it is understood that the Texas Water
Development Board will be the owner of the Bonds, and the City
hereby covenants to render a final accounting to the Texas
Water Development Board, in reference to the total cost in-
curred by the City for the improvements and extensions to the
City's Waterworks System.
Section 13. That the City shall use any surplus proceeds
from the Series 1975 Certificates of Obligation and Series
1976 Certificates of Obligation remaining after completion of
the improvements and extensions to the waterworks system for
the purchase of these Bonds owned by the Texas Water Development
Board.
Section 14. That this Ordinance was read once by the City
Council and it was deemed by the City Council that upon passage
of this Ordinance it shall take effect immediately.

We, the undersigned officers of said City, hereby certify
as follows:
1. That this certificate is executed for and on behalf of
said City with reference to the issuance of the proposed City
of Stephenville, Texas General Obligation Refunding Bonds,
Series 1976, dated June 10, 1976, in the principal amount of
$375,000.
2. That said City is duly incorporated Home Rule City,
having more than 5000 inhabitants, operating and existing under
the Constitution and laws of the State of Texas and the duly
adopted Home Rule Charter of said City, which Charter has not
been changed or amended since the passage of the ordinance
authorizing the issuance of the most recently dated, issued,
and outstanding obligations of said City, shown in Exhibit A,
which is attached to this certificate.
3. That no litigation of any nature has ever been filed
pertaining to, affecting, questioning or contesting: (a) the
ordinance which authorized said City's proposed REfunding Bonds
described in paragraph 1 of this certificate; (b) the issuance,
execution, delivery, payment, security or validity of said pro-
posed Refunding Bonds; (c) the authority of the governing body
and the officers of said City to issue, execute and delivery
said Refunding Bonds; (d) the validity of the corporate exist-
ence of said city; or (e) the current tax rolls of said City;
and that no litigation is pending pertaining to, affecting,
questioning, or contesting the current boundaries of said
City.
4. That attached to this certificate and marked Exhibit
A is a true, full and correct schedule and statement of all
presently outstanding tax indebtedness of said City.
5. That the currently effective ad valorem tax rolls of
said City are those for the year 1975, being the most recently
approved tax rolls of said City; that said City has caused the
taxable property in said City to be assessed as required by
law; that the Board of Equalization of said City has equalized
and approved the valuation of taxable property in said City
for said year; that the tax assessor of said City has duly
verified the aforesaid tax rolls, and said Board of Equaliza-
tion has finally approved the same; and that the assessed value
of taxable property in said City, upon which the annual ad
valorem tax of said City actually has been.or will be levied
(after deducting the amount of exemptions, if any, of assessed
values of residence homesteads of persons sixty five years of
age or older pursuant to Section 1 -b(b) of Article VIII of the
Texas Constituion), according to the aforesaid tax rolls for
said year, as delivered to the city secretary of said City,
and finally approved and recorded by the governing body of said
City, is $18,916,990.
. 6. That none of the City of Stephenville Certificates of
Obligation, Series 1975, dated June 1, 1975 or City of Stephen-
ville Certificates of Obligation, Series 1976, dated April 10,
1976, being refunded by the aforesaid proposed City of
Stephenville, Texas General Obligation Refunding Bonds, Series
1976, has ever been held in, or purchased for the account of,
the Interest and Sinking Funds created and maintained for the
benefit of such obligations being so refunded and nothing in
said Interest and Sinking Funds are available and can be used
for the retirement of any such obligations.
