CHAMBER OF THE CITY COUNCIL CITY HALL, CITY OF STEPHENVILLE, TEXAS i The City Council of the City of Stephenville, Texas, met in Special Session, Thursday, June 16, 1977, at 3:00 p.m., with Mayor Donald R. Jones present and pre- siding. Councilmembers Jim Chambers, Calvin McGee, Charles Riggins,.Raymond Anderson, Ermer Ferguson and Betty Heath were present. Councilman W. M. Irwin and Larry Hammett were absent. Others attending the meeting were City Administrator Marshall Shelton, City Attorney Joseph Chandler, Director of Public Works R. Y. Gann, City Secretary Joyce Pemberton, Mr. Conrad Callicoatte, Mr. & Mrs. Seth Moore, Mr. David Montgomery, Mr. James Young, Mr. A. W. "Doc" Boyd, Mr. Joe Derrick, Mr. Kenneth Currier and Mr. Don Coan. Mayor Jones called the meeting to order. The discussion of the acquisition of the billing machine was omitted because the bids had not been received. Mayor Jones advised the Council that in reply to a letter from Mr. Bradbury and Mr. Rambo, contractors on the Linda Lane Apartment Complex, Mr. Gann had written a letter stating that in reviewing the plans for the Stephenville West Apartments that the plans, generally, were in compliance with the standards of the city and were to be considered approved. However, the following three items needed some attention before the issuance of a building permit: 1. Water tap be separate from fire hydrant.lead. 2. A pro rata cost be paid back to Doug Smithey for connecting to 6" sewer line in Linda Lane. 3. Consider building drainage tunnel one foot (1') larger. Mr. Gann also requested a letter stating that these items would be done. Mr. Don Coan came before the Council on behalf of Mr. Bradbury and Mr. Rambo and assured the Council that there was no problem on these items. They would do items one and two and would certainly consider the third item. I After considerable discussion with Mr. Gann as to whether or not the larger drainage tunnel should be a requirement rather than a suggestion, Councilman Anderson made the motion that the City require the drainage tunnel to be one foot (1') larger than shown on the plans. Councilman Riggins made the second. Motion carried unanimously. Mayor Jones asked Mr. Coan to relay the message to Mr. Bradbury and Mr. Rambo that the City would like a letter stating that the above listed items will be done. Mr. Coan replied that they would probably bring the letter when they applied for the building permit. Mr. Shelton asked Mr. Coan to remind Mr. Bradbury and Mr. Rambo that they had agreed to pay one half of the cost for the expert witness testimony in the zoning suit and this needs to be taken care of. Mayor Jones advised the Council that the main purpose of this meeting was to dis- cuss the subdivison standards with developers. The Council, Mr. Seth Moore and Mr. James Young discussed specifications and paving of streets in the Tanglewood Second area and the McAllister Second Addition, the sub- mission by the developer and the acceptance by the city of a subdivision, the enforcement of the Subdivision Ordinance, the submission of the "As Built" plans of the developer n and the maintenance bond of the contractor, the responsibility of supervision and inspectors of the improvements in a subdivision. After a lengthy discussion, Mayor Jones advised the Council that, in his opinion, the specific question now is, if the City had enforced the subdivision ordinance and Mr. Boyd had recommended the City's acceptance of the streets in the Tanglewood Second area back in July, 1976, where would the City stand at this point in time regarding the repair of said streets. After more discussion, Mr. Moore made the following recommendations: 1. If the contractors are going to be inspected, provide an inspector and keep on the job and when the contractor has completed the nob and the final in- spection has been made and accepted, in his opinion, this should be the accept- ance by the Council,of that particular phase of the subdivision. This should remove the liability from the contractor at this time. 2. `Mr. Gann should put in writing the accepted procedures and specifications he intends to follow and inspect and let the Council approve. Have a set standard. 3. Something needs to be decided as to who is responsible for the streets after MUM FANIM city d of the all the paving is done and the concrete trucks and dirt trucks tear them up Jones commented that he agreed basically with Mr. Moore. Councilwoman Heath suggested that the city devise a "Standard Operating Pro- cedure "'with regard to every type of inspections the city does. This procedure would outline what to do, when to do it and it would be documented and kept on file soithat in the future someone could look back in the files and know what had been done and when. Mrs. Heath suggested that a committee be appointed, composed of councilmembers, the city engineering department, city inspectors and whoever would care to' participate from the developers to work this "Standard Operating Procedure" out so that it will be fair to all concerned. It4';was the general consensus of the Mayor and Council that the subdivision ordinance should be followed. Whether it is right or if it needs amending but, until it is amended, it should be followed as written. Mayor Jones advised that, after he has had time to give this some thought, he will appoint a committee to review the subdivision ordinance. Indiscussion of utility easements City Attorney Chandler advised that, legally, the city has no obligation or control as to the upkeep of any utility easement. It is the homeowner's responsibility to take care of his portion of the easement. After much more discussion, it was the consensus of the Mayor and Council that the City will accept the streets and maintenance thereof of all the streets in the Tanglewood area with the exception of Dale Avenue, north of Overhill, in the Tangle- wood Second, third filing, and the Tanglewood West Addition. a Mayor Jones read a Resoltuion from the City of Stephenville accepting the grant offer from the Federal Aviation Administration for improvements to Clark Field. i Councilwoman Heath made the motion that the Resolution be passed and adopted as read. Councilman McGee made the second. Motion carried unanimously. a RESOLUTION WHEREAS, an application for Federal Assistance dated June 7, 1977, has been sub- mitted to the Department of Transportation, Federal Aviation Administration (FAA) requesting federal participation in the cost of certain improvements at Clark Field. ' WHEREAS, the FAA has issued a Grant Offer which, if duly accepted, provides a commitment of $49,300 in federal funds for development specified therein; and WHEREAS, it is determined to be in the interest of the City of Stephenville to accept this Grant Offer; I NOW, THEREFORE, BE IT RESOLVED that the City of Stephenville does hereby accept the provisions of said Grant Offer, a copy of which is attached hereto and incorporated herein for all purposes and, to evidence this acceptance, the Mayor is hereby authorized and directed to execute the Grant Offer on behalf of the City of,Stephenville, Texas. i PASSED, ADOPTED, AND EFFECTIVE THIS 16th day of June, 1977. Mr.lShelton asked for clarification from the Council as to whether or not to continuethe issuance of building permits on Brenda St. in the Tanglewood West Addition or not. After discussion of the drainage problems in this area with Mr. Moore, Mayor Jones stated that, as Mr. Moore had already received prior approval for four building permits on Brenda Street, he felt this decision should stand, but no other building permits should be issued in the Tanglewood West Addition until the drainage problems have been solved and Mr. Moore had complied with the subdivision ordinance as has been discussed in this meeting. Mayor Jones also pointed out that the same situation will exist in the River North Subdivision, along the Lingleville Highway, and his position will be not to issue buildingpermits until the conditions of the subdivision ordinance have been complied with. Mayor Jones advised the Council that he had received a request from the hospital administrator to implement a 15 minute parking limit on Belknap Street, from the corner of Tarleton to the hospital parking lot. This being across the street from the hospital Mayor Jones advised this item will be on next month's agenda and for the Council to give it some thought. Mayor Jones read a letter from Mr. Jack Kirby, Brownwood, Texas, requesting per- mission from the Council for his son who is attending Tarleton University to keep his mobile home on the parking lot of the West Side Church of Christ until this semester is finished. Mayor Jones suggested that he be told to move July• the mobile home by the middle of 103 .here being no other business, the meeting adjourned at 5:35 p.m. i i Mayor 3 i 3 7
