CHAMBER OF THE CITY COUNCIL CITY HALL, CITY OF STEPHENVILLE, TEXAS The City Council of the City of Stephenville, Texas met in Special Session Wednesday, May 17, 1978 at 4:30 p.m, with Mayor Donald R. Jones present and presiding. Councilmembers Mike Leese, Calvin McGee, Charles Riggins, Raymond Anderson, Ermer Ferguson and Linda Chew were present. Councilmen W. M. Irwin and Larry Hammett were absent. Others attending the meeting were City Administrator Marshall Shelton, Assistant City At- torney Randy Chandler, Administrative Assistant Kurt Ackerman, Chief of Police Mike Watkins, Tax Assessor Robert Groves, Administrative Assistant Verna Hancock, Acting City Secretary Trecia Perales. Mayor Jones called the meeting to order and called attention directly to the items on the agenda. ITEM I: ADOPTION OF THE ANNEXATION ORDINANCE Councilman Mike Leese made the motion that the City Council pass and approve the annexation ordinance as read. Councilman Charles Riggins made the second. Motion carried. ORDINANCE AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT THERETO AND BEING 11.38 ACRES OF THE JARRETT MENEFEE SURVEY WHICH IS DESCRIBED BELOW AND WHICH JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND S DESCRIBES SAID LAND, WHICH ORDINANCE FULLY BE IT ORDAINED BY,THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: ITEM II: AWARD BIDS ON POLICE CARS The following two bids were presented to the Council by Chief of Police Mike Watkins: 1. Bruner Chevrolet Co ------- 2 1978 Chev. Impalas------ - - - - -- $12,780.00 2. Pollan -Blue Ford Co-- - - - - -2 1978 Ford Ltd --------------------- $13,038.76 After some discussion, Councilman Riggins moved that the City Council accept the recom- mendation of Chief Watkins and award the bid for two 1978 Ford LTDs police cars to Pollan - Blue Ford Co., Stephenville, Texas. Councilman McGee made the second. Motion carried un- animously. Delivery of said cars to be sometime in August. ITEM III: APPOINTMENT OF THE EQUALIZATION BOARD Mayor Jones submitted the following three names for the Councils approval for appointment to the Board of Equalization: Mrs. Lillian Crow, Dr. Jeromy Curtoys and Mr. Paul Cunyus. After some discussion, Councilman McGee moved that Mrs. Lillian Crow, Dr. Jeromy Curtoys and Mr. Paul Cunyus. Mayor Jones also advised that in the June regular council meeting, the Council would discuss raising the assessment ratio to 50% or 100 %. ITEM IV: CONSIDER PURCHASE OF RIGHT -OF -WAY ON LONG ST. Mayor Jones advised the Council that a base offer of $975.00 was made to Mrs. Shirley Whitely for the purchase of right -of -way on Long Street by the railroad for the extension of Long Street. Mrs. Whitely refused this offer. Councilman Anderson suggested that the bid be raised to $1500.00. It was the consensus of the Council that Mr. Shelton should make either a verbal or written offer of $1500.00 to Mrs. Whitely. MISCELLANEOUS DISCUSSION NEW BUSINESS Mayor Jones advised the Council that Mr. Harold Fox would like to purchase a portion of Carey St- (501 X 1040 for the amount of $975.00. No action could be taken as this was not an agenda item. -- K— Councilman McGee suggested that a "cut -off procedure" will need to be set up with a hearing before cutting off water for non - payment of water bills. Such as letting the customer know in vl writing when the hearing is set. No action could be taken as this was not an agenda item. Im OLD BUSINESS Mayor Jones advised the Council that Mrs. Herrington of the Texas Antiquity Commissinn in Austin is coming to talk to the Council concerning the brick streets. Mayor Jones set Wednesday, May 24th as the date for a Special Session of the City Council in the Council Chambers. There being no other business to come before the Council, Mayor Jones - Adjourned the meeting at 5:20 p.m. ATTEST: SECRETARY MAYOR 166A AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT THERETO AND BEING 11.38 ACRES OF THE JARRETT MENEFEE SURVEY WHICH IS DESCRIBED BELOW AND WHICH JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE FULLY DESCRIBES SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: That certain land adjacent to the City of Stephenville and adjoining same and specifically described as follows: 11.38 acre tract of land, being part of the Jarrett Menefee Survey, Abstract No. 520, Erath County, Texas, and described as follows: BEGINNING at a point in the south line of the Jarrett Menefee Survey and the north line of the John Blair Survey, A -32, for the SWC of this tract, from which the NWC of the John Blair Survey bears S 590 50' W, 2464.6 feet; THENCE N 59° 50' E, along the south line of the Jarrett Menefee Survey, 1521.2 feet to the SEC of this tract; THENCE in a northwesterly direction, being along a curve to the right, radius = 598.81 feet, long chord = N 56° 44' 57" W, 275.49 feet, along a curve distance of 277.98 feet to a corner of this tract; THENCE S 460 33' W, 140.0 feet to a corner of this tract; THENCE N 430 27' E, 115.86 feet to a corner of this tract; THENCE S 46° 33' W, 60.00 feet to a corner of this tract; THENCE S 430 54' 35" W, 141.09 feet to a corner of this tract; THENCE N 43° 27' W, 240.0 feet to a corner of this tract; THENCE S 46° 33' W, 135.0 feet to ,a corner of this tract; THENCE N 43° 27' W, 66.52 feet to a corner of this tract; THENCE S 46° 33' W, 135.92 feet to a corner of this tract; THENCE S 120 17' W, 62.83 feet to a corner of this tract; THENCE N 770 43' W, 33.61 feet to an iron rod set at the SEC of a tract owned by Paul Howell for a corner of this tract; THENCE along the south line of the Paul Howell tract as follows: S 500 10' W, 119.0 feet; S 330 22' W, 130.5 feet; S 090 36' W, 32.6 feet; S 170 40' W, 67.9 feet and S 140 31' W, 475.5 feet to the place of beginning and containing 11.38 acres of land in area; is hereby received into the City Limits of the City of Stephenville and made a part of the City of Stephenville and the City Limits of the City of Stephenville are hereby extended in accordance with the lines and the description of the parcels of land herein - above described. The above and foregoing ordinance was introduced at the meeting of the City Council of the City of Stephenville held on the '4th day of April, 1978 by Councilman McGEE At such time it was moved by Councilman ANDERSON and seconded by Councilman Riggins , and the same being put to a vote, such motion carried to the effect that this ordinance be published for one (1) issue in the Stephenville Empire - Tribune, a newspaper published in the City of Stephenville, Erath County, Texas, and that by such publication notice be given in accordance with Section 5 of Article 1 of the City Charter of the City of Stephenville, Texas, and in accordance with Section 6 of Article 970a of the Revised Civil Statutes of Texas that this ordinance will be finally acted upon in not less than thirty (30) days after such publication and that all interested persons shall be heard at public hearing to be held not more than twenty (20) days nor less than ten (10) days after this'publicatibn hearing to be held on the 2nd day of May , 1978 at 7.00 o'clock, __p.m. in the City Council Meeting Room in the City Hall of the City of Stephenville, Texas; and any citizen of Stephenville or of the territory to be annexed and all interested persons, shall have the right to so contest such annexation and shall have the right to so contest same by filing with the City of Stephenville a written petition setting out their reasons for such contest and any such person shall be given an opportunity to be heard before said ordinance in the form hereinabove set out or in a form to be amended by this Council shall be acted upon. I. Notice as above provided was duly published as provided and on May 2, 1978 at 7:00 p.m. public hearing was had by the City Council at the City Council meeting room, and all those present were given full oppor- tunity to be heard in opposition to the annexation of land as above set out and all those desiring to contest the annexation were given full opportunity to so contest same. All those present desiring to speak on the matter of such annexation were permitted to do so. No further action was taken on such ordinance at this time, but the Mayor did announce that another meeting would be held after a period of ten days from the date of this meeting and not to exceed twenty days from the date of this meeting at which meeting final action will be taken by the Council on this ordinance. On the 17th day of May, 1978, the Council met at the City Council meeting room of the City Hall. A quorum being present, motion was made by Councilman Mike Leese and seconded by Councilman Charles Riggins that this ordinance be finally passed as above set out. The motion being put to a vote, it carried unanimously. This ordinance shall go into effect immediately and the above described land is hereby declared to be annexed and same is a part of the City of Stephenville as of this date of passage.
