CHAMBER OF THE CITY COUNCIL CITY HALL, CITY OF STEPHENVILLE, TEXAS The City Council of the City of Stephenville, Texas, met in Regular Session, Tuesday, April 4, 1978, at 7:00 p.m.. Councilmen Calvin A. McGee, Charles Riggins, Raymond Anderson, E. W. Ferguson, and Larry Hammett were present. Mayor Donald R. Jones was absent as were Councilmembers W. M. Irwin, and Betty Heath. Others attending the meeting were City Administrator Marshall Shelton, Director of Public Works R. Y. Gann' Assistant City Attorney Randolph Chandler, Administrative Assistant Kurt Ackerman, Chief of Police Mike Watkins, Fire Marshall Kenneth Haley, Director of Parks & Recreation Ronnie Isham, Street Superintendent Clinton Hicks and City Secretary Joyce Pemberton. Also attending were Councilmembers -elect Linda .Tones Chew and Mike Leese and other interested citizens. By,-unanimous agreement, Councilman McGee chaired the meeting in the absence of Mayor Donald R. Jones. Councilman McGee called the meeting to order and the Reverend Henry Cox gave the invocation. ITEM I- CANVASSING OF THE ELECTION RETURNS Councilman McGee appointed Councilmen Riggins, Anderson, and Ferguson as a committee to canvass the returns of the City Regular Election held on April 1, 1978, and recessed the meeting until said councilmen returned. The meeting reconvened and Councilman Anderson reported that the committee had checked the returns and found them to be in order. Councilman McGee read the order Declaring Results of the City Officer's Election (said order attached to and becoming a part of these minutes) and that Donald R. Jones was duly elected Mayor of the City of Stephenville with 850 votes and Larry Hammett with 786 votes, Mike Leese with 479 votes, Calvin A. McGee with 793 votes, W. M. Irwin with 778 votes, and Linda Jones Chew with 563 votes were duly elected to the City Council subject to the taking of their oaths. Councilman Riggins moved that said Resolution be passed, adopted, and approved as read. Councilman Ferguson made the second. The motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett NOES: None ABSENT: Mayor Donald R. Jones, Councilmembers Irwin and Heath. The City Secretary gave the Oath of Office to Councilmembers Calvin A. McGee, Larry Hammett, Mike Leese, and Linda Jones Chew. Mike Leese and Linda Chew took their respective council seats but without the right to,vote until Friday, the 5th day after the election. ITEM II -GRANT PROPOSAL FOR HOUSING ASSISTANCE PAYMENTS PROGRAM Mr. Jim Williams of the Housing Division, Texas Department of community Affairs, came before the Council and presented the proposed grant program concerning the Housing Assistance Payments Program. Mr. Williams explained that this program is for families, elderly individuals, handicapped, and disabled persons who make less than 80% of the median income in their area of the State. Median income standards are set on an indi- vidual county basis according to the number of persons in each family and base income. After a lengthy discussion, it was the consensus of the Council that, due to the absence of the Mayor and Councilman Irwin and to give the new members time for them to be able to vote, this item be tabled until a called meeting to be held on April 7th. ITEM III - APPROVAL OF MINUTES Councilman Hammett moved that the minutes of the March 7th and March 28th council meetings be approved as written. Councilman Ferguson made the second. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. ITEM IV- APPROVAL OF JULY 4th FIREWORKS DISPLAY City Administrator Marshall Shelton explained that Mrs. Susie Coan had requested approval of a fireworks display for the July 4th celebration in the city park. _ x_-55 Mr. Shelton advised that the city ordinances required that the Fire Marshall be aware of said firewords display and approval of the City Council. Fire Marshall Kenneth Haley said that he had discussed this with Mrs. Coan and he could foresee no problems. Councilman Anderson moved that the City Council approve the firewords display for the July 4th celebration in the City Park as requested by Mrs. Coan. Councilman Riggins made the second. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. ITEM V- DISCUSSION OF KIWANIS SPONSORED CARNIVAL IN CITY PARK/ Councilman McGee advised the Council that the Kiwanis Club had requested permission to bring a carnival to the city park July 31st through August 5th to raise funds for their club projects. City Administrator Shelton said Mr. Gordon Green, Secretary of the Kiwanis Club, had approached him on this and explained that it would not block the entire park. It would be held on the Graham Street side of the park. Mr. Shelton said'Mr. Green had checked out the carnival thoroughly and said it was a good, clean carnival. Mr. Shelton also said he did not see anything wrong with it and did not think the Director of Parks & Recreation objected to the carnival either. When asked for his comments regarding the carnival, Mr. Isham said he had turned the Jaycees down about two months ago for the same thing. Mr. Isham said the reason he had turned them down was because he did not feel that the carnival people were what he wanted in the city park. He also said that for the past 5 to 10 yeqrs he had always refused to have carnivals and circuses in the city park and this was what he had told the representative of the Kiwanis Club. Councilman Riggins commented that he thought everyone should be given the same answer. Mr. Isham cited the problems encountered with the last carnival in the city park, such as the employees living in the park and draining raw sewage out in the park and some of the people being cheated at the concession stands. He said it had been his understanding at that time that there would not be any more carnivals held in the city park. After more discussion, Councilman McGee suggested that this item be tabled until next Friday afternoon, April 7th, and ask someone from the Kiwanis Club to be present to discuss exactly what they are planning to do and a decision can be made at that time. Director of Public Works R. Y. Gann advised the Council that the final plat and construction plans for Phase II of the River North Subdivision had been reviewed and were ready for acceptance by the Council. In answer to Councilman AndersonIs question, Mr. Shelton said these plans did meet the city's requirements and were ready for acceptance. Councilman Anderson moved, seconded by Councilman Riggins, to approve the final plat and construction plans of Phase II of the River North Subdivision as recommended by Mr. Gann and Mr. Shelton. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. Mr. Gann advised the Council that all the recommended changes in the Tanglewood Northeast Subdivision plats have been made and the final plat and the construction plans are ready for acceptance by the City Council. Councilman Hammett moved, seconded by Councilman Ferguson, to approve the final plat and construction plans for the Tanglewood Northeast Subdivision as recommended by Mr. Gann. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. Councilman McGee opened the floor for a Public Hearing to consider the Zoning Boards recommendations of rezoning from R -1 to B -1 Lots 13 and 14 (Lot 14 being 156 18.96 acres), Block 14, Lots 29, 30, 31, and 1. Block 16, Lots 1, 2, 3, 4, and 5, Block 17, and Lot -1, -Block 20, (Lot l.being 19.397 acres) of the River North Subdivision, Phase II. TANGLEWOOD NORTHEAST SUBDIVISION Councilman McGee advised the Council that the Zoning Board had recommended the rezoning of Lot 12, Block 1, and Lot 14, Block 3, Tanglewood Northeast Subdivision and opened the floor for discussion. Mr. Kenneth Lerner and Mr. Carl Chumney spoke to the Council voicing their objections to this rezoning in the Tanglewood Northeast Subdivision because of the increase of traffic in this area and not wanting retail businesses in this area as there will be a shopping center in the River North area which is not very far from this property. They did not think there was a need for two shopping areas so close together. Mrs. Virginia Dorris came before the Council and advised them that spot zoning or strip zoning needs to be considered very closely. She said B -1 does not allow gas pumps. The logical process is not to rezone one or two pieces of property and she asked the Council to study this very carefully. Mr. Seth Moore came before the Council explaining the long process he had been through with this plat and the zoning and requested a favorable ruling from the Council on this rezoning. After discussion, it was the consensus of the Council to table these items until Friday, April 7th, when the Mayor and more of the Council, subject to voting, would be In attendance and would have more time for study. ITEM IX -HEAR RANDY CHANDLER Councilman McGee tabled this item until Friday, April 7th. ITEM X- APPROVAL OF $5.00 INCREASE PER WATER METER DEPOSIT City Administrator Shelton explained that the reason for the suggested increase in water meter deposits was due to the losses in the payment of final water bills. Mr. Shelton said the present deposit does not cover near all of the final bills and this increase will not cover all of them but would cover the majority of them. After some discussion, Councilman Hammett moved, seconded by Councilman Riggins, that the water meter deposits be increased $5.00 on all size meters as recommended by Mr. Shelton. Said increase not to be retroactive. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. ITEM XI- REQUEST TO TAKE BIDS ON SAVAGE PROPERTY Mr. Shelton advised the Council that he had been unable to rent this property, but on Monday, the day before the council meeting, he had rented the Savage Property temporarily and there is no need for action at this time. ITEM XII- CONSIDERATION OF COMBINING THE PLANNING & ZONING COMMISSIONS Due to the absence of the Mayor, this item was tabled until Friday. ITEM XIII- APPROVAL OF UPGRADING OF POUND FEES City Administrator Shelton explained that the purpose of the increase in pound fees was to discourage owners from permitting their animals to run at large and to let the pet owners bear a greater share of the animal control expense. After some discussion, Councilman Anderson moved, seconded by Councilman Hammett, that the City Council amend Chapter 3 of the Code of Ordinances, City of Stephenville, as recommended by Mr. Shelton. Motion carried as follows: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. (Said amendment attached to and becoming a part of these minutes.) ITEM XIV- APPROVAL OF ANNEXATION ORDINANCE Councilman McGee advised the Council that there was a portion of the River North Subdivision outside the city limits. An Ordinance annexing this portion of land into the city was needed. Councilman McGee read the caption of said ordinance which had been prepared by the City Attorney. 157 ORDINANCE AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT THERETO AND BEING 11,38 ACRES OF THE JARRETT MENEFEE SURVEY WHICH IS DESCRIBED BELOW AND WHICH JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE FULLY DESCRIBES SAID LAND. Councilman McGee introduced the above ordinance. Councilman Anderson moved, seconded by Councilman Riggins, that the above captioned ordinance be published one time in the Empire Tribune newspaper and that May 2, 1978, at 7:00 p.m, be the date of Public Hearing to consider said annexation. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. ITEM XV- APPROVAL OF BUDGET REVISION City Administrator Shelton had prepared members of the Council copies of the proposed budget revisions. He explained that the overall budgets of most departments remained the same. The Street Department had purchased a new motor grader which increased their budget by $8,125.00 and the Legal Department needed to increase their budget $1,683.00. After some discussion, Councilman Hammett moved, seconded by Councilman Ferguson, that the City Council approve the proposed budget revisions as presented by Mr. Shelton. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. (Said revisions attached to and becoming a part of these minutes.) OLD BUSINESS Councilman Hammett suggested that maybe some of the persons involved with the rezoning discussed earlier in the meeting should meet with the Zoning Board before Friday so that the Council could make a decision Friday. Councilman McGee agreed that a decision needs to be reached as soon as possible as this has been hanging for a long time. Mr. Shelton advised that the Zoning Board has a meeting scheduled for next Thursday at 3:00 p.m, which would be a good time for anyone concerned to meet with them. Councilman McGee said he didnot think there was any question regarding the zoning change of the River North Property and he would entertain a motion to rezone this property. Councilman Riggins moved, seconded by Councilman Anderson, to approve the reco- mmendations of the Zoning Board to rezone from R -1 to B -1 Lots 13 and 14,. (Lot 14 being 18.96 acres) Block 14, Lots 29, 30, 31, and 1, Block 16, Lots 1, 2, 3, 4, and 5, Block 17, and Lot 1, Block 20, (Lot 1 being 19.397 acres) of the River North Subdivision. Motion carried by the following vote: AYES: Councilmen McGee, Riggins, Anderson, Ferguson, and Hammett. NOES: None ABSENT: Mayor Donald R. Jones and Councilmembers Irwin and Heath. There being no other business to come before the Council, the meeting adjourned at 8:40 p.m. COUNCIL RECONVENED Councilman McGee called the Council back into session at 8:45 p.m, with all council- members previously listed in attendance. Councilman McGee explained that Mrs. Heath who was to speak to the council regarding ambulance policy was absent but her husband Jack Heath was present and prepared to speak in her behalf. Mr. Jack Heath came before the Council regarding the city +s ambulance policy. Mr. Heath stated that he was speaking as an adjoining county ambulance operator, as DeLeon is starting an ambulance service and he is administrator of the DeLeon Hospital. Mr. Heath said the reason he was speaking to the Council at this time was that on two occasions, that he knew of, when the Stephenville Ambulance Service had been called to respond to a transfer to the Stephenville Hospital from DeLeon, on both occasions, the Nursing Home that called was told that there were no ambulances in Stephenville, That they were all dispatched out of town. On both occasions, there were two, at least, in Stephenville, Mr. Heath said it should be a matter of policy to answer ambulance calls in adjoining counties. He said there is a difference in telling a patient that you are refusing to 158 transport them and in telling them there is not an ambulance available to transport them. Councilman Hammett asked Fire Marshall Kenneth Haley if he would like to respond and to make the Council aware of the circumstances of said instances. Fire Marshall Haley came before the Council and explained that on one occasion Mr. Heath was speaking of was on March 20th. The Fire Department had received a request to transfer a patient from DeLeon to Stephenville, At the time they received the call, they had one ambulance in route to Fort Worth with Mrs. Bradley (records available) and one ambulance on a transfer locally. Mr. Haley cited several different dates when ambulance calls had been made to and from DeLeon and said they had helped DeLeon at anytime they could. Mr. Haley explained that when he had an ambulance out of town that only left five men with which to operate the fire station and the emergency ambulance. He said he did not feel he should leave Erath County and the City of Stephenville unprotected. Mr. Heath said he was not questioning that the Stephenville Ambulance had provided service, he was questioning the fact as to reasons given when not providing service. Councilman McGee, in summations said he thought the question was the wording of what the people were told rather than what the status of the ambulances was. They were told there was not an ambulance available in town. There was an ambulance available in town but not available for a run out of town, leaving the county and the City of Stephenville unprotected. There is not a written policy on this and this should be looked into. Councilman McGee asked Mr. Shelton, or his designated representative, to present a written policy for the Council to look at and approve as to the operation of the ambulance within the City of Stephenville, within Erath County, ant the policy to be used for tranfers, etc. Councilman Ri ins suggested ggested that, maybe, the administrators of the nursing homes in the adjoining counties would like to meet with the Council or committee or whoever will write the policies so they would know and understand what the policies area Also the County Commissioners as they pay one -half the cost of the ambulance service. County Commissioner Terry Ownes came before the Council with the comment that the Commissioners had been made aware of't'his complaint. He said this was the only complaint they have ever received regarding the ambulance service. All they have ever heard before has been praise. Mr. Owens said the County Commissioners felt that, regardless of the situation in adjoining counties, the county and the city was morally obligated to Stephenville and Erath County. That has to be the first moral obligation, then if the equipment is available, to help other counties. The commissioners would like to have someone sit in on the meeting to help establish a written policy. It was the consensus of the Council to work on some written guidelines for the operation of the ambulance. The meeting adjourned again at 9:10 p.m. ATTEST: Mayor 1-0h AN ORDINANCE AMENDING CHAPTER THREE OF THE CODE OF ORDINANCES OF THE CITY OF STEPHENVILLE, TEXAS, TITLED "ANIMALS AND FOWL ", AND COMPLETELY RESTATING SAID CHAPTER AND MAKING CHANGES THEREIN AS SHOWN BY THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: Chapter 3 ANIMALS AND FOWL Art. I. In General, Sec. 3- 1- - -3 -29 Art. II. Dogs ; arid:Cats - Sec:: 3- 3- - -3 -51 Div. 1. Generally, Sec. 3- 30- - -3 -44 Div. 2. Dog and Cat Kennels, Sec. 3- 45- - -3 -51 ARTICLE I. IN GENERAL Sec. 3 -1. Keeping of noisy animals prohibited. It shall be unlawful for any person to willfully or knowingly keep or harbor on his premises any animal that makes or creates loud and obnoxious noises, by whatever method created, thereby disturbing the peace of the neighborhood or disturbing any occupant of adjacent premises or any person living in the vicinity thereof. A person shall be deemed to have willfully and knowingly violated the terms of this j section if such person has been notified by his neighbors, the animal control man or any police officer of such disturbance and has refused for a period of twenty -four (24) hours to correct such disturbance and prevent its recurrence. (Ord. of 6 -5 -73, Sec. 2) Cross reference -- Animal pens which become nuisances, Sec. 10 -18. Sec. 3 -2. Tying up, using animal of another. It shall be unlawful for any person to tie up and use within the corporate limits of the city any horse, mare, gelding, mule, ox, cow or any other domestic animal which is the property of another, without the consent of the owner thereof. (Rev. Ords. 1958, Art. 228) Sec. 3 -3. Restrictions on keeping stallions, jacks, bulls. It shall be unlawful for any person to keep a stallion, jack or bull for services to mares, jennets or cows, within five hundred (500) feet of any public street or private residence of any person living within the corporate limits of the city, except the residence of the person keeping or standing such stallion, jack or bull. (Rev. Ords. 1958, Art. 138) Cross reference -- Zoning, Ch. 20. Sec. 3 -4. Running at large prohibited. It shall be unlawful for any person owning or keeping any animal to suffer or permit such animal to run at large upon the public streets, avenues, alleys, parks or other public property of the city, or to permit any animal to run at large or go upon the premises owned or in possession of any other person in the city. (Ord. of 6 -5 -73, Sec. 1) Sec. 3 -5. Impounding animals. Any animal running at large or violating any provision of this chapter or Code in the city limits shall be impounded by the animal control man or any police officer. If any animal is found upon the premises of any person other than the owner of such animal, the owner or occupant of the premises shall have the right to confine such animal until he can notify the animal control man to impound such animal, provided the same is done within a reasonable period of time. (Ord. of 6 -5 -73, Sec. 3) Sec. 3 -6. Procedure in animal bite cases. It',shall be the duty of any person owning or having charge of any warm - blooded animal which has bitten, clawed or scratched any person to have such - animal confined by a licensed veterinarian for a period of fourteen (14) days, and if for any reason such animal is not so confined by the owner, the animal control man shall impound such animal for observation. If, at the expiration of the fourteen (14) days the health of the animal is satisfactory, it may be released upon payment of all expenses incurred by such confinement. (Ord. of 6 -5- 73, Sec. 4) M Section 3 -7. Impoundment fees. (a) The following fees shall be charged for the impoundment of animals: (1) For impounding cats, per head . . . . . $ 2.00 (2) For care of cats, per day . . . . . . . . 1.00 (3) For impounding dogs, per head . . . . . . . 10.00 (4) For care of dogs, per day . . . . . . . . . 2.00 (b) The owner of any impounded animal may reclaim such animal upon payment of the above fees, and by signing an affidavit to the effect that he is the owner. (Ord. of 6 -5 -73, Sec. 5) (c) Animals running at large are prohibited by law on public streets, parks, and other public property of the city.. Owners of animals running at large and.picked up by Animal Control will be fined $10.00 per animal. The same will hold true for animals running at large upon the premises of other persons within the city. (d) Visiting hours.at Animal Shelter, City of Stephenville: 10:00 a.m. to 4:00 p.m. . . . . . . . Weekdays 9:00 a.m. to 12:00 noon . . . . . . . Saturday Closed . . . . . . . . . . . . . . Sunday Sec. 3 -8. Destruction or disposition of impounded animal. Any animal impounded under this chapter may be killed by the animal control man, the police or any designated person, or may be sold or given away, after it has been impounded for a period of five (5) days. The city . shall not be responsible or liable for any injury to or death of an impounded animal. (Ord. of 6 -5 -73, Sec. 6) Sec. 3 -9. Cruelty to animals and fowl. It shall be unlawful for any person to willfully and wantonly cruelly beat or otherwise maltreat, kill, maim, wound, poison or disfigure any domesticated animal, bird or beast of any kind; or to carry any animal, in or upon any vehicle or otherwise, in a cruel or inhuman manner; or for any person having charge or custody of any animal to fail to provide it with proper food and water; or to cruelly abandon such animal. Secs. 3- 10 --- 3 -29. Reserved. ARTICLE II. DOGS AND CATS Division 1. Generally Sec. 3 -30. Rabies vaccination; issuance of certificate and tag. All dogs within the city limits shall be immunized annually against rabies by means of an antirabies vaccine administered by a duly licensed veterinarian. Every veterinarian who vaccinates a dog which is kept in the city limits shall issue a certificate of vaccina- tion to such owner, stating the name of the owner, the address of the owner, a description of the dog, and the date of vaccination, together with a metal tag which shall be securely attached to the dog's collar and worn by the dog at all times. The shape of such tag, shall be changed each year. All dogs even though kept in enclosures or on leashes shall be duly vaccinated against rabies each year by a duly licensed veterinarian, and must show at all times a`metal tag secured to the dog's collar. Each owner of the dog shall be able to show an up -to -date certificate of vaccination, address of the owner, and a description of the dog. (Ord. of 6 -5 -73, Secs. 8, 9) Sec. 3 -31. License required; fee. No person shall keep or harbor any dog within the city without having a valid license therefor. The fee for such license shall be two dollars ($2.00) per year for each male dog; two dollars ($2.00) per year for each spayed female dog; and ten dollars ($10.00) per year for each unspayed female dog. Such fee shall be paid and the license acquired within ten (10) days after the annual immunization required by this article. Within ' fbrty -eight (48) hours after obtaining any dog from the animal shelter, the owner shall present to the police department a certificate of vaccination from a veterinarian and shall be required to obtain a current city tag. (Ord. of 6 -5 -73, Sec. 9) Sec. 3 -32. Restraining dogs. Any person within the city limits raising, owning or keeping any dog shall confine such dog to his premises by a fence, wall or other effective means of restraint, at all times, unless accompanied by a person and restrained by a leash in the hand of such person. (Ord. of 6 -5 -73, Sec. 7) Sec. 3 -33. Dangerous dogs running at large may be killed. The animal control man is hereby authorized to kill any dog found running at large which is suspected of having rabies or which cannot be captured without substantial danger to the animal control man. (Ord. of 6-5 -73, Sec. 10) Secs. 3- 34 --- 3 -44. Reserved. Division 2. Dog and Cat Kennels Sec. 3 -45, Defined. A "dog kennel" and a "cat kennel" shall mean any lot, enclosure, premises, structure or building, except a veterinary hospital, whereon or wherein four (4) or more dogs or cats over the age of six (6) months are kept or maintained for any purpose whatsoever within the city. It shall be unlawful for any person to keep, possess or maintain in the city a dog or cat kennel within one hundred (100) feet of any actual residence or habitation for human beings, or within one hundred (100) feet of any church, school or hospital, other than the residence of the keeper, possessor or owner of such dog or cat kennel, which distance shall be measured in a straight line from the nearest point of any kennel, pen, enclosure or other structure in which such dogs or cats are kept to the nearest point of such actual residence or place of human habitation, church, school or hospital. (Ord. of 7- 11 -72, Sec. 6) Sec. 3 -47. License required; fee. Any person in the city conducting, managing or maintaining a dog or cat kennel shall obtain a license to do so from the city admini- strator and shall pay a license tax as follows: (1) Where less than 15 dogs or cats are kept, per year or fraction thereof . . . . . . . . . . $ 40.00 (2) Where 15 to 25 dogs or cats, inclusive, are kept, per year or fraction thereof . . . . . 55.00 (3) Where over 25 dogs or cats are kept, per year or fraction thereof . . . . . . . . . . 150.00 (Ord. of 7- 11 -72, Sec. 2) Sec 3 -48. Tax duration; payment date. The tax for a license required by this division shall be for the calendar year or any part thereof during which a dog or cat kennel shall be maintained and shall be due and payable in advance on or before January first of each year. (Ord. of 7- 11 -72, Sec. 2) Sec. 3 -49. Inspection prerequisite to licensing. The city administrator shall make an inspection of the premises on which a proposed dog or cat kennel is to be located before a license shall be issued by him. The city administrator shall deter- mine the fitness of the proposed location from the standpoint of sanitation and humane treatment of dogs and cats to be kept there and may refuse to issue the license should he find conditions not meeting his approval. The city administrator shall keep or cause to be kept under his direction a permanent record of all dog or cat kennel licenses issued under this division, which record shall show the name and address of all persons to whom issued, the number of the license, the date of issuance, and the amount paid therefor. The city administrator may revoke the license of any dog or cat - kennel at any time for failure of the licensee to keep his premises in a sanitary condition and in such a condition as to provide humane treatment for dogs and cats kept therein, or for failure to abide by any of the provisions of this division of Code. In elections where paper ballots are used, the ballots shall be counted by one or more sets of counting officers, each set to consist of one judge or clerk who shall read the ballots, and one or more clerks who shall enter the votes on tally lists prepared for the election. As a safeguard in the accuracy of the tallying, the votes shall be entered on three original tally lists, and during the progress of the counting the lists sliall be compared and errors and discrepancies shall be corrected, and at the close of the counting the tally clerks shall certify offi- cially to the correctness of the lists. Art. 111b (Vernon's Art. 8.29b). Copies of returns, poll lists, and tally lists; distribution: (a) In precincts using paper ballots. In all general, special and primary elections, the number of copies of the returns, poll list, and tally list required for each precinct in which paper ballots are used shall be as follows: four copies of the returns, four copies of the poll list, and three copies of the tally list. These records shall be distributed as follows: (1) One copy of the returns, poll list, and tally list shall be delivered to the presiding officer of the authority which canvasses the returns (the county judge in elections held by the county; the mayor in city elections; the presiding officer of the governing board in elections held by other political subdivisions; and the chairman of the county executive committee in county primary elections) and shall be preserved by the canvassing authority for sixty days from the day of the election. (2) One copy of the returns, poll list, and tally list shall be delivered to the proper officer (the county clerk in elections held by the county and in county primary elections; the city secretary or clerk in municipal elections; and the presiding officer of the governing board in elections held by other political subdivisions), to be kept by him in his office open to inspection by the public for sixty days from the day of the election. (3) One copy of the returns, poll list, and tally list shall be placed in the ballot box containing the voted ballots. (4) The presiding judge shall retain in his custody one copy of the returns and one copy of the poll list of the election, and shall keep the same for sixty days after the day of the election, sub- ject to the inspection of anyone interested in such election.
