CITY HALL, CITY OF STEPHENVILLE, TEXAS
The City Council of the City of Stephenville, Texas, met in Special Session, Tuesday,
March 28, 1978, at 3:00 p.m. with Mayor Donald R. Jones present and presiding. Council -
members Calvin McGee, Raymond Anderson, Larry Hammett, and Betty Heath were present.
Councilmembers W. M. Irwin, Charles Higgins, and Ermer Ferguson were absent.
Others attending the meeting were City Administrator Marshall Shelton, Director of
Public Works R. Y. Gann, and City Secretary Joyce Pemberton.
Mayor Jones called the meeting to order in open session and then announced the
Council would go into Executive Session under Article 6557 -17 V.T.C.S., Section 3 -la,
to wit: "Where the attorney's advice is sought by the governmental body on pending or
contemplated litigation."
Mayor Jones reconvened the meeting in open session.
Mayor Jones explained that the Council had discussed the matter of Mrs. Richard
Gentzel Carpenter's request in regard to a non - conforming permit to operate a 2 chair
barber shop at 121 Park Drive, Greenview Addition, Stephenville, Texas, and the possi-
bility of litigation arising out of that. -
Mayor Jones advised the Council that the Zoning Board, on two occasions, had considered
Mrs. Carpenter's application for a non - conforming permit and had refused to act because
of the fact that there are plat restrictions for the Greenview Addition which apparently
prohibit the operation of a business. In addition to plat restrictions, it is zoned
R -1 and the Zoning Board refused to act on the basis that there are plat restrictions
on said property.
Mayor Jones said that as a result of discussion in the executive session, it was
his understanding that the Council is not interested in considering a non - conforming
permit until Mrs. Carpenter has complied with the Zoning Ordinance requirements for the
granting of a non - conforming permit and has additionally obtained a waiver from those
persons having lots in the Greenview Addition from the plat restrictions before any
action can be taken. Mayor Jones also stated it was his understanding that Mrs. Carpenter
is presently operating a barber shop at 121 Park Dr., Greenview - Addition.
The Council discussed the fact that no permits of any kind had been issued for any
of the work, such as building permit, plumbing permit or electrical permit nor had any
of the work been inspected by the City Inspector as provided in the city ordinances.
After discussion, Councilman McGee made the motion that the City Attorney write
Mrs. Carpenter a letter giving until the 1st day of April, 1978, to cease and desist
the operation of said barber shop located at 121 Park Drive, Greenview Addition, City
of Stephenville, Texas, until all the necessary legal actions have been taken to meet
the requirements of submitting to a non - conforming permit and further that Mrs. Carpenter
disclose the names of those persons that did the work at said location and that all
plumbing and electrical work be uncovered for inspection by the City Inspector. That
there be no operation of barber shop from and after= the -1st day of April, 1978, and if
there is operation of said barber shop after the let day of April, 1978, that misdemeanor
charges will be filed according to city ordinances, subject to a fine up to $100.00 per
day. Also the city to follow up on the filing of misdemeanor charges against those
persons who did the work without proper permits. Councilman Hammett made the second.
Motion carried unanimously.
There being no other business to come before the Council, Mayor Jones adjourned
the meeting at 4:10 p, m.
