CHAMBER OF THE CITY COUNCIL CITY HALL, CITY OF STEPHENVI.LLE, TEXAS The City Council of the City of Stephenville, Texas, met in Emergency Session Monday, July 30, 1979 at 4 o'clock p.m. with Mayor Donald R. Jones present and presiding. Council - members Mike Leese, W.M. Irwin, Calvin A. McGee, Charles Riggins, Raymond Anderson, and E. W. Ferguson were present. Councilmembers Larry Hammett and Linda Chew were absent. Others attending the meeting were City Administrator Marshall Shelton, Administrative Assistant Kurt Ackermann, Director of Public Works R. Y. Gann, Building Inspector Hardy Lockhart, City Secretary Joyce Pemberton, Mr. Robert Keeney, Mr. Terry Ogle, Mrs. Virginia Dorris and members of the press. Mayor Jones called the meeting to order and explained that this meeting was called un- der emergency conditions because of a "work holdup" due to the issuance of a building per- mit being issued inadvertently". ZONING BOARD RECOMMEDATIONS 1. To grant a 10 foot front yard variance as requested by Terry Ogle Mayor Jones explained that Terry 0gle had requested a 10 foot front yard variance on Lots 3, 4, & 5, Block 123, City Addition, for the purpose of moving the pro- posed apartment complex out of the flood plain of the Methodist "Branch. In their meeting of July 12, 1979, the Zoning Board had approved and recommended that the City Council approve the request as submitted by Mr. Ogle, provided that all of the proposed buildings be moved forward the same distance. Subsequently, a building permit had been issued to Mr. Ogle for this building be- fore the Council had approved the recommendations of the Zoning Board. When Mr. Ogle had been advised of this situation, he had stopped work and now needs some action by the Council. Councilman Anderson moved, seconded by Councilman Ferguson, that the City Council accept the recommendation of the Zoning Board and approve a 10 foot front yard HE variance on Lots 3, 4, & 5, Block 123, City Addition, provided that all other proposed buildings are moved forward the same distance (buildings facing onto Barton Street.) Motion carried unanimously by those members present. 2. To consider an amendment to the Zoning, Ordinance pertaining to realtors' signs - $88 Mayor Jones advised that the Zoning Board had recommended an amendment to the Zoning Ordinance to include a section pertaining to the size of realtors' signs when ad- vertising a house or property for sale within the city limits. Said amendment re- quires publication and a public hearing. Councilman Irwin moved, seconded by Councilman Leese, a public hearing to consider the above amendment to the Zoning Ordinance be set for the Regular Council meeting on September 4, 1979, at 7 o'clock p.m. in Council Chamber. Motion carried unani- mously by those members present. 3. Public hearing set to consider the following rezoning recommendations: A. To rezone from R -1 to B -2 Lot 9, Block 153, City Addition, owned by Mr. Ralph Starling; Lot 10, Block 153, City Addition, owned by Mr. John ii. Wiggins; and all of the 11.36 acres owned by Mr. Kenneth Lesley and Mr. Kenneth Lockhart. B. To rezone from B -1 to B -2, Lot 1, Block 3, Sims Addition, owned by Mr. Robert Keeney and Mr. R. L. Alexander. Councilman McGee moved, seconded by Councilman Anderson, that the City Council set August 16, 1979 at 3 o'clock p.m, in Council Chamber as time, place and date for a public hearing for the above proposed zoning changes. Motion carried unanimously by those members present. Mayor Jones advised that Mr. Robert Keeney wished to place a mobile home on his portion of Lot 1, Block 3, Sims Addition, for the purposes of a residence and business office. He needs some kind of Council authority to place the mobile home on this property while waiting the time period for the rezoning of said property. Mr. Keeney said that he had gotten a permit for a sewer tap for a mobile home (June 18th) and was told he needed to bring in the serial numbers of the mobile home on this property. When he came back with the serial numbers, he was told he could not put a mobile home on said property because it was zoned B -1 rather than B -2. Now he needs some authorization to place the mobile home on this lot so that he may proceed with getting the utilities installed prior to delivery of the mobile home. After much discussion, it was the consensus of the Mayor and Council that they could foresee no problems with the zoning change. It was just a matter of time and red tape to make it legal. Mayor Jones advised that the Council could not act specifically on the request with- out publication and a „public hearing. After more discussion, Councilman McGee asked if any of the councilmembers present had any objections to said rezoning to which they said "no ". He advised that the Zoning Ordinance requires a 3/4 majority vote of the Council to overrule objections to a zoning change. Therefore, Mr. Keeney was advised to go ahead and place his mo- bile home on said property and install utilities and the property would be rezoned to B -2 after publication and public hearing. Mayor Jones said, for the record, that this does not set a precedent because the situation is unique in that the property around it is already zoned B -2. There had been mobile homes on,said property previously and there had been some misunderstand- ing pertaining to the sewer tap being paid for a mobile home, then being told of the need for a zoning change for a mobile home. Mayor Jones announced that there would be a council. meeting to continue discussions on the proposed budget and long range plans Friday, August 3rd at Tarleton Student Center, Conference room C, at 1 o'clock p.m. There being no other business, the meeting adjourned at 4:30 n.m.
