The City Council of the City of Stephenville, Texas met in Regular
Session, Tuesday, April 3, 1979 at 7 o'clock p.m. with Mayor Donald R.
Jones present and presiding. Councilmembers Mike Leese, W. M. Irwin,
Charles Riggins, Raymond Anderson, E. W. Ferguson, Larry Hammett, and
Linda Chew were present. Councilman Calvin A. McGee was absent.
Others attending the meeting were City Administrator Marshall Shelton,
Administrative Assistant Kurt Ackermann, Director of Public Works R. Y.
Gann, Chiefof Police Mike Watkins, Fire Marshall Kenneth Haley, Director
of Parks & Recreation Ronnie Isham, Director of Utilities Danny Johnson,
Tax Assessor Robert Groves, City Secretary Joyce Pemberton, Accountant
Charlene Young, Mr. Cleve Cole, Mr. Charles Gambel, members of the press
and many others.
Mayor Jones called the meeting to order and asked the councilmembers
to read their copies of the minutes of the meetings of March 6th and
March 2.7th, 1979.
ITEM I: APPROVAL OF THE MINUTE'S.
Councilman Irwin moved, seconded by Councilman Riggins, that the
minutes of the meetings of March 6, 1979 and March 27, 1979 be approved
as written. Motion carried unanimously by those members present.
ITEM II: SALE OF ALLEY BETWEEN MINN'IE AND PECAN STREETS.
Mayor Jones explained that Mrs. Dorothy Watkins, in behalf of a
client, had made a request to purchase an 8' x 104' alley off Race St.
between Minnie and Pecan Streets.
City Administrator Shelton advised that this property is not used
as an alley now, has no utility lines in it, and there are no objections
from any of the residents in the area.
Mayor Jones advised that the Council needs to make a finding of
abandonment for public use and set a value on it if the Council decides
to sell. He also stated that in cases where its an alley abandonment
of this size, no utilities are involved and an adjacent property owner
is the purchaser, the city does not have to publish for bidders.
Councilman Irwin moved, seconded by Councilman Leese, that the city
sell the 8' x 104' strip of alley to property owner of Lot 2A, Block 9,
Frey First Addition, for the price of $50.00 so that they may take it
over, keep it clean and count it as part of their home. Motion carried
unanimously by those members present.
ITEM III: ADOPTION OF INDUSTRIAL WASTE ORDINANCE.
City Administrator Marshall Shelton advised that the city is re-
quired to have a written INDUSTRIAL WASTE ORDINANCE in order to complete
Step II of the grant for the new sewer treatment plant.
After discussion and after Director of Utilities Danny Johnson had
examined the sample ordinance furnished by Mr. Conrad Callicoatte, Council-
man Riggins moved,, seconded by Councilman Irwin, that the City Council
approve the adoption_ of an Industrial Waste Ordinance as presented.
Motion carried unanimously by those member present.
ORDINANCE
ORDINANCE REGULATING INDUSTRIAL WASTE DISCHARGE INTO THE SEWER SYSTEM AND
SEWER MAINS OF THE CITY OF STEPHENVILLE; DEFINING THE TERMS USED IN THE
ORDINANCE, FIXING STANDARDS FOR INDUSTRIAL WASTE PROHIBITED ANV INDUSTRIAL
WASTE PERMITTED; AND PROVIDING PENALTIES FOR VIOLATION.
ITEM IV: BID AWARDED FOR PURCHASE OF 2,000 FEET OF DUCTILE IRON PIPE.
Administrative Assistand Kurt Ackermann presented the following bids
for the purchase of 2,000 feet of ductile iron pipe to be used for replace-
ment lines for the water department:

Mr. Ackermann did advise that there is sufficient money in the
budget for said pipe.
After discussion, Councilman Anderson moved, seconded by Council-
man Hammett, to accept the low bid of $8,140.00 submitted by McWane
Cast Iron Co. for the purchase of 2,000 feet of 6" ductile iron pipe
for the Water Department. Motion carried unanimously by those members
present.
ITEM V: APPROVAL OF PRELIMINARY PLAT OF NORTH DALE SUBDIVISION.
Mayor Jones explained that Mr. Kenneth Currier has submitted the
preliminary plat of the North Dale Subdivision for approval. Said sub-
division is to be 58 lots on an extension of North Dale Avenue across
FM 988 to and including 4 lots owned by Eddie Caudle in the Green Acres
Subdivision and 3 lots,in Tanglewood West Addition owned by Seth Moore, Jr.
A large part of said subdivision is out of the city limits.
City Administrator Shelton handed the Councilmembers copies of the
preliminary plat of the proposed subdivision. Mr. Shelton explained
that Mr. Currier is proposing to develop approximately 30 lots as Phase
I at this time.
Mayor Jones advised that as part of this property is out of the
city limits at this time, it is a three -step process to annex it into
the city limits. Mr. Currier is planning to present a petition to annex
that part not presently in the city limits and a request for rezoning
from R -1 to R -2 of the entire subdivision.
The Council discussed each of the following recommendations of
the Planning Commission:
1. That the preliminary plat of the North Dale Subdivision be
accepted as presented with the following exceptions:
a. That the proposed extension of North Dale Avenue remain
an 80' dedicated street (as shown on plat) but Mr.
Currier be allowed to drop back to a 60 ft. street for
paving at this time (same width as Dale Avenue by the
high school.)
b. That Mr. Currier will put the east side of the curb on the
property line so that should the street need to be widened
in the future only one curb would need to be torn out.
C. That the 4 lots owned by Eddie Caudle (at the top of the
plat) are to be redrawn on the final plat so that Lot 4
(the corner lot) will allow for the 60 ft. extension of
North Dale Avenue on the set back line.
d. That the zoning be changed to R -2 as the Commission feels
there is a very definite need for property for duplexes.
Mayor Jones read the requirements for annexation by petition from
The City Charter and set the May 1st regular council meeting as the date
for action on the annexation and the Public Hearing for the rezoning also.
After discussion, Councilman Hammett moved, seconded by Council-
woman Chew, that the City Council accept the recommendations of the
Planning Commission and approve the preliminary plat of the North
Dale Subdivision, subject to said recommendations and subject to the
annexation ordinance. Motion carried unanimously by those members
present.
LANDFILL GATE RATES INCREASED TO CITY OF DUBLIN AT
City Administrator Marshall Shelton explained that the cost of
operation of the landfill had precipitated the 20% increase in the
landfill gate rates to the City of Dublin and Tarleton State University.
He said he felt the increase was needed due to the cost of the new
dozer. Mr. Shelton said he had talked to the City of Dublin regarding
the increase but did not know that he had talked with all concerned at
Tarleton. He advised that the City of Dublin and Tarleton State Uni-
versity were the only ones that used their own packer trucks.
Councilman Irwin asked what proportion of the use of the landfill
does Dublin and Tarleton have in relation to The Norton Company? Or is
the city penalizing Dublin and Tarleton to save someone else?

INDUSTRIAL WASTE ORDINANCE
AN ORDINANCE REGULATING INDUSTRIAL WASTE DISCHARGE INTO THE
SEWER SYSTEM AND SEWER MAINS OF THE CITY OF STEPHENVILLE; DEFINING
TERMS USED IN THE ORDINANCE; FIXING STANDARDS FOR INDUSTRIAL WASTE
PROHIBITED AND INDUSTRIAL WASTE PERMITTED; AND PROVIDING PENALTIES
FOR VIOLATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE,
TEXAS:
That an industrial waste discharge ordinance is hereby passed
and adopted by the City of Stephenville, the terms and provisions
of which are as follows:
SECTION ONE
Definitions
The following terms, as used in this ordinance, shall mean the following:
1. City: The City of Stephenville, Texas, or any authorized person
acting in its behalf.
2. Person: Any person, natural or artificial, including any individ-
ual, firm, company, municipal or private corporation, association,
governmental agency or other entity, and agents, servants or em-
ployees.
3. Approving Authority: The City Council or its duly authorized
deputy, agent or representative.
4. Sewage: A combination of the water- carried wastes from residences,
business buildings, institutions and industrial establishments,
together with such ground, surface and storm waters as may be pre-
sent.
5. Domestic sewage: Water -borne wastes normally discharging into the
sanitary conveniences of dwellings (including apartment houses and
hotels), office buildings, factories and institutions, free storm
and surface waters and industrial wastes.
6. Normal domestic sewage: Normal sewage for the city in which the
average concentration of suspended materials and five (5) day BOD
are established at two hundred and twenty five (225) parts per
million each, by weight, on the basis of the normal daily con -
tributions of seventeen hundredths (0.17) pound per capita, per
one hundred (100) gallons.
7. Garbage: Solid wastes and residue from the preparation, cooking
and dispensing of food, and from the handling, storage and sale
of food products and produce.
8. Properly shredded garbage: The wastes resulting from the preparation,
cooking and dispensing of food that have been shredded to such a
degree that all particles will be carried freely under the flow
conditions normally prevailing in public sewers, with no particle
greater than one -half inch in any deimemsion.
9. Sewer: A pipe or conduit for carrying sanitary sewage.
10. Public Sewer: A sewer in which all owners of abutting properties
have equal rights and interest, and is controlled by public authority.
11. Sanitary Sewer: A sewer that conveys sewage or industrial wastes,
or a combination of both, and into which storm, surface and ground
waters or unpolluted industrial waste -s are not intentionally admitted.
12. Storm sewer or storm drain: A sewer which carries storm and surface
waters and drainage, but excludes sewage and polluted industrial wastes.
13. Sewerage works: All facilities for collecting, pumping, treating, and
disposing of sewage and industrial wastes, and would include sewage,
as well as the sewage treatment facilities.
14. Sewerage: The system of sewers and appurtenances for the collection,
transportation and pumping of sewage and industrial wastes.
15. Sewage treatment plant: Any city -owned facilities, devices and struc-
tures used for receiving and treating sewage from the city sanitary
sewer system.

(1) A five (5) day twenty (20) degrees centigrade biochemical oxygen
demand (BOD) greater than two hundred and twenty -five (225) parts
per million, and /or
(2) Suspended solids containing greater than two hundred (200) parts
per million.
(b) Pretreatment: Where required, in the opinion of the approving authority,
to modify or eliminate wastes that are harmful to the structures, pro-
cesses or operation of the sewage disposal works, the person shall pro-
vide, at his expense, such preliminary treatment or processing facilities
as may be determined necessary to render his wastes acceptable for ad-
mission to the public sewers.
(c) Grease, Oil and Sand Interceptors: Grease, oil and sand interceptors
shall be provided for the proper handling of liquid wastes containing
grease in excessive amounts, or any flammable wastes, sand and other
harmful ingredients; except that such interceptors shall not be re-
quired for private living quarters or dwellings. All interceptors shall
be of a type and capacity approved by the approving authority and shall
be located so as to be readily and easily accessible for cleaning and
inspection. Grease and oil interceptors shall be constructed of imper-
vious materials capable of withstanding abrupt and extreme changes in
temperature. They shall be of substantial construction, water tight and
equipped with easily removable covers which, when bolted in place, shall
be gastight and water tight. Where installed, all grease, oil and sand
interceptors shall be maintained by the owner, at his expense, in con -
tinuously efficient operation at all times.
SECTION THREE
Prohibited Discharges
(a) No person shall discharge, or cause to be discharged, any storm water,
groundwater, roof runoff, subsurface drainage, down spouts, yard drains,
yard fountain and ponds or lawn sprays into any sanitary sewer. Storm
water and all other unpolluted drainage shall be discharged to such
sewers as are specifically designated as storm sewers, or to a natural
outlet approved by the approving authority. Unpolluted processed water
may be discharged upon prior written approval of the approving authority
to a storm sewer or natural outlet, or into the sanitary sewer system
by an indirect connection whereby such discharge is cooled, if required,
and flows into the sanitary sewer at a rate not in excess of three (3)
gallons per minute; provided the waste does not contain materials or
substances in suspension or solution in violation of the limits prescribed
by this ordinance.

(b) No person shall discharge or cause to be discharged, either directly or
indirectly, any of the following described substances, materials, water
or wastes:
(1) Any liquid having a temperature higher than one hundred fifty (150)
degrees Fahrenheit (65 degrees centigrade).
(2) Any water or waste containing wax, grease, oil, plastic or other sub-
stance that will solidify or become discernibly viscous at temperatures
between thirty -two (32) degrees to one hundred fifty (150) degrees
Fahrenheit.
(3) Any solids, liquids or gases which by themselves or by interaction
with other substances may cause fire or explosion hazards, or in any
other way be injurious to persons, property, or the operator of the
sewage disposal works.
(4) Any solids, slurries or viscous substances of such character as to
be capable of causing obstruction to the flow in sewers, or other
interference with the proper operation of the sewerage works, such
as ashes, cinders, sand, mud, straw, shavings, metal, glass, rags,
feathers, tar, plastics, wood, whole blood, paunch manure, hair and
fleshings, entrails, lime slurry, lime residues, slops, chemical
residues, or bulk solids.
(5) Any garbage that has not been properly comminuted or shredded. If
properly comminuted or shredded, it may be accepted under provisions
established in Section One.

(2) Any radioactive wastes greater than the allowable releases as
specified by current United States Bureau of Standards handbooks
dealing with the handling and release of radioactivity.
(3) Cyanides or cyanogen compounds capable of liberating hydrocyanic
gas on acidification in excess of five - tenths (0.5) part per
million by weight as CN in the wastes from any outlet into the
public sewers.
(4) Materials which exert or cause:
a. Unusual concentrations of solids or composition; as for example,
in total suspended soldis of inert nature (such as fuller's
earth) and /or in total dissolved solids (such as sodium chloride
or sodium sulfate),
b. Excessive discoloration,
C. Unusual biochemical oxygen demand or an immediate oxygen demand.
d. High hydrogen sulfide content, or
e. Unusual flow and concentration which shall be pretreated to a
concentration acceptable to the city, if such wastes can;
1. Cause damage to collection facilities;
2. Impair the processes;
3. Incur treatment cost exceeding those of normal sewage; or
4. Render the water unfit for stream disposal or industrial use.
f. Where discharge of wastes to the sanitary sewer are not properly
pretreated or otherwise corrected the approving authority may:
1. Reject the wastes or terminate the service of water and /or
sanitary sewer;
2. Require control of the quantities and rates of discharge of
the wastes; or
3. Require payment of surcharges for excessive cost for treat-
ment, provided the wastes are amenable to treatment by normal
sewage plant facilities operated by the city.
SECTION FOUR
Control of Admissable Wastes.
(a) Permit: Within thirty (30) days after passage of this ordinance, any
person desiring to deposit or discharge any industrial waste mixture
into the sewers or sewerage works of the city, or any sewer connected
therewith, or who is now so doing, shall make application to the aprov-
ing authority for a permit therefor upon application forms to be ob-
tained from the approving authority.
(b) Control chambers: Within six (6) months from the date of passage of
this ordinance, any person discharging or desiring to discharge an
industrial waste mixture into the sewers or sewerage works of the
city, or any sewer connected therewith, shall provide and maintain in
a suitable, accessible position on his premises, or such premises
occupied by him, an inspection chamber or manhole near the outlet of
each sewer, drain, pipe, channel, or conncection which communicates
with any sewer or sewerage works of the city or any sewer connected
therewith. Each such manhole or inspection chamber shall be of such
design and construction which will prevent infiltration by ground and
surface waters or introduction of slugs of solids by installation of
screens with maximum openings of one inch, but of such sufficient fine-
ness to prevent the entrance of objectionable slugs of solids to the
sanitary sewer system, and shall be so maintained by persons discharg-
ing wastes so that any authorized representative or employee of the
city may readily and safely measure the volume and obtain samples of
the flow at all times. Plans for the construction of control manholes
or inspection chambers, including such flow- machine devices as may or
may not be required, shall be approved by the approving authority
prior to the beginning of construction.
(c) Measurement of flow: The water consumption during the previous month,
as determined from the meter records of the water department, shall be
the valid basis for computing the sewage flow, unless actual sewage
flow is measured by a recording meter of a type approved by the aprov-
ing authority. The owner shall install and maintain such device in a
proper condition to accurately measure such flow. Upon failure to do
so, the water consumption shall be the basis for charges.

SECTION NINE
Powers and Authority of Enforcing Agents:
The approving authority shall be permitted to gain access to such
properties as may be necessary for the purpose of inspection, observation,
measurement, sampling and testing, in accordance with provisions of these
regulations. Any person found to be violating any provisions of this
ordinance shall be served by the city with written notice stating the
nature of the violation and providing a reasonable time limit for the
satisfactory correction thereof. Any person who shall continue any
violation beyond the limit shall be guilty of violation of the service
contract and shall be summarily disconnected form the sanitary sewer or
water service. Such disconnection and reconnection shall be at the total
expense of the customer.
Where acids and chemicals damaging to sewer lines or treatment pro-
cesses are released to the sewer causing rapid deterioration of such
structures or interfering with proper treatment of sewage, the approving
authority is authorized to immediately terminate services by such measures
as are necessary to protect the facilities.
SECTION TEN
Penalty and Liability for Damage:
(a) If any person shall violate any of the provisions of this ordinance,
he shall be guilty of a misdemeanor and, upon conviction in the
municipal court, shall be punished by a fine as provided in Section
Nine for each offense. Each day of each such violation shall be
deemed a separate offense.
(b) Any person violating any of the provisions of this ordinance shall
become liable to the city for any expense, loss or damage occasioned
by the city by reason of such violation.
SECTION ELEVEN
This ordinance shall go into effect immediately from and after its
passage and the publication of the caption and title thereof as provided
by the city charter, and it is so ordained.

said Dublin would pay $6,374.00 per year @ 80q per cu.yd. and ,8,640.00
per year @ $1.00 per cu.yd. - - - - Tarleton would go from $969.00
per year @ 80(, per cu.yd. to $1,440.00 per year @ $1.00 per cu.yd.
Councilman Irwin said he would like to leave this in discussion.
The usage of the landfill should be equalized. The taxpayers should
not have to subsidize an industry for use of the landfill and, before
the Council approves an increase in the gate rate, this should be taken
into consideration.
Mr. Shelton.advised that the city receives 15% or $37,000 per year
of what Mr. Bledsoe collects and 20
$ 000 per year in gate fees which
totals $57,000 per year and that is about -what is spent. The $57,000
- includes the amoritization of the old bulldozer. Of course, the new
dozer was twice as costly.
After more discussion, Councilman Irwin moved, seconded by Council-
man Hammett, to approve the increase of the landfill gate rates from 80G
per cu.yd. to $1.00 per cu.yd. to the City of Dublin and Tarleton State
University. Motion carried unanimously by those members present.
Councilman Irwin asked that Mr. Shelton check on the usage and
charges regarding the landfill and check on the percentage paid to the
city by Mr. Bledsoe and is the 15% binding by contract.
Mayor Jones advised the Council of the problem of disposing of
the asbestos fibers from Genaut Industries, Inc. He said there were
some aspects of it that the Council needs to consider.
There was a Resolution passed on November 14, 1978, resolving that
the City of Stephenville sill designate a section of the city landfill
area for the deposit of these drums of dust and solvents from Genaut
Industries, Inc.
Mr. Shelton advised the Council that, after working with the State
Health Department and Genaut Industries, Inc. for a considerable period
of time, the city had received approval, under certain conditions, but
Genaut has not actually come to the city and made arrangements for the
disposal of the asbestos fibers. The State Health Department does not
dictate that we actually do it. The city still has to negotiate the
- cost, etc, with Genaut Industries, Inc. They are not actually using
the landfill for the asbestos dust and fibers at this time. They just
have permission from the State Health Department. There is no way the
city can take care of that for the same charge as other garbage. There
is a lot of figuring to be done before it will be ready to be brought
to the Council for consideration.
Councilman Riggins said he didn't think the city would want to
bury the asbestos fibers and dust in the landfill at all because some
day the city will want to sell this property and that will make it
much harder to sell.
Mr. Shelton said the city does not have to take the asbestos fibers
from Genaut. They just have the approval of the State Health Department
and it will be something for the Council to consider. Genaut has been
storing this in drums on their own property for the past year.
Mayor Jones asked Mr. Shelton that there was no question of Genaut's
not using the city's landfill at this time and it would have to have
the approval of the Council before Genaut Industries, Inc. could dispose
of their drums of asbestos fibers and dust and Mr. Shelton agreed.

Mayor Jones advised the Council that a date needs to be set for
canvassing the election returns of the City Officers Election held
on the 7th day of April, 1979.
With the consent of the Council, Mayor Jones set Monday, April 9,
1979 at 4 o'clock p.m. as the date to canvass the April 7th election
returns and designate the winners of the election and to give the Oath
of Office to those elected.
EXECUTIVE SESSION
There being no old or new business for discussion, Mayor Jones
called an Executive Session at 8:15 p.m. as provided under the Open
Meetings Act - Article 6252 -17, Vernon's Civil Statutes, Section 1 (e)
"in which the governing body seeks the city attorney's advice with
respect to pending litigation ".
At 9:15 p.m., the Mayor reconvened the council meeting in Open
Session.
Mayor Jones advised that, in the Executive Session, the Council had
discussed matters related to pending litigation and there is some action
that needs to be taken at this time. It has been suggested that in re-
gard to a lawsuit filed by John Lester Brannon against the City of Stephen-
ville and police officer Ronnie Meyers that the city proceed with the
filing of an answer in defense of the lawsuit and that the city authorize
the city attorney to join such additional counsel as he might desire to
do so for practice in the federal courts in Fort Worth, Texas.
There being no further discussion, Councilman Irwin moved, seconded
by Councilman Hammett, that the city file an answer to the lawsuit filed 1,
by John Lester Brannon against the City of Stephenville and Officer Ronnie
Meyers and authorize City Attorney Joseph Chandler to employ a competent
attorney to join him in defending the suit. Motion carried unanimously
by those members present. Councilman McGee was absent.
