SPECIAL SESSION - FRIDAY

The City Council of the City of Stephenville, Texas, met in Special
Session, Friday, June 27, 1980 at 1:30 p.m. with Mayor Joe F. Cummings
present and presiding.

Mayor Cummings called the meeting to order and declared a quorum
present.
Mayor Cummings advised that Mr. Tom Pugh had requested permission to
address the Council pertaining to a building permit for Lot 10, Block F,
West Gate Addition.
Mr. Tom Pugh came before the Council to discuss the issuance of a
building permit for the above mentioned lot. Mr. Pugh reminded the
Council of the discussion and action taken in the June 3rd council meeting.
Mr. Pugh stated that in the last meeting the Council had approved his re-
quest for a building permit for Lot 10, Block F, West Gate Addition, subject
to the condition that he pave, curb and gutter the entire width of the
street in front of said lot. He later found out that he would have to
install the paving, curbing and gutter before the permit would be issued.
He advised that he now has the paving, curbing and gutter installed and
it has been inspected and approved by the building inspector.
Now, Mr. Pugh advised, that he has been refused a building permit
the second time.because an administrative decision has been made that he
will have to move some dirt in the city's right of way at the end of the
street he has just had paved. He explained that when he had finished the
paving he had found that the drainage stopped where his paving ended. If
something was not done the water would pond there and ruin the paving. He
had hired a dozer to take the dirt excavated for the paving and build a
holding area and cut a small channel for drainage to a ditch. Also, he
had agreed to smooth this out when the building was completed and he did
the final yard work. However, he had been advised that he would have to
remove the dirt from the public right of way before he could have said
building permit. Mr. Pugh stated that he did not feel he should be required
to do excavation on a public right of way and build the street. It was
not part of his proposal to the Council and it was not part of the agreement
the Council voted on in the June 3rd meeting.
Mr. Pugh said he realized this was not an agenda item for this
meeting, but the Council had already voted on his proposal and he
would like a building permit.
Councilman Irwin commented that this was an administrative matter
and should be discussed in an executive session.
Mayor Cummings advised Mr. Pugh that the Council would discuss
this in executive session and advise him:+as soon as possible.
Mayor Cummings called an executive session under ARTICLE 6252 -17,
VERNON'S TEXAS CIVIL STATUTES, SECTION 2 (g).
The Mayor and City Council reconvened in Open Session at 2:35 p.m.
There being no action to be taken and no other business to come
before the Council, the meeting adjourned at 2:40 p.m.
